"fox & friends" starts right now. >> good morning, everyone. today is thursday, june 7, 2012. i'm gretchen carlson. thanks so much for spending part of your day with us. unprecedented leaks related to national security but the real story -- who congress thinks might be behind them. >> i'm suggesting somebody in the white house is orchestrating an effort to leak classified information and programs to make the president look good. >> well, that's one side of the story. now, we're going to have the president's response. >> and oops! an obama economist goes off message defending the bush tax

cuts. sound familiar? yep, it's the second time this week. what is the white house doing about the chaos inity cou-- its court? we'll tell you. >> you want to be loaded? at one sports arena, last call for alcohol depends on how much you paid for your seat or your suite. "fox & friends" starts right now. >> so the more you pay for your seat, the more you can drink? >> yes. and the ladies can drink. so if usual in the bleachers, you won't be a belcher. >> cut off in the fourth quarter so you cut off in fourth quarter so for those in suites you could be drinking until 2:00 in morning. that's part of the jay-z imprint on the new nets. >> we're going to be debating that coming up very soon. in the meantime, some headlines for you. we start with a fox news alert. overnight, u.s. defense secretary leon panetta making a surprise visit to afghanistan.

he was greeted by the u.s. commander general john allen and the u.s. ambassador to afghanistan at least for now ryan crocker. in a news conference, he spoke about the progress he sees with the war. >> complete the transition. complete the effort of giving operational capability to the afghans and continue the drawdown towards the end of 2014 and then the effort to develop any presence beyond 2014. >> secretary panetta saying the united states is losing its patience with pakistan. this comes a day after he said u.s. drone strikes will continue in that country. attorney general eric holder set to testify today for the house judiciary committee about operation fast & furious. this after increased pressure from house republicans who say holder has not been forthcoming with the information. as you may know, fast & furious was supposed to track guns from the united states back to

mexican drug cartels. instead, many of those weapons got lost and at least two of them were used in a shootout that killed u.s. border patrol agent brian terry. the justice department claiming top officials did not know the details until it was too late but house lawmakers say they have evidence proving otherwise. police and fire unions in san jose, california, now suing over the city's new pension reforms. the cost-cutting plan won overwhelming support among voters on tuesday but city workers say the measure which calls for them to pay more to keep their current retirement benefit plans amount to broken promises so in response, the city of san jose launched its own lawsuit asking a federal judge to step in with a quick decision. coming up at 8:50 a.m. eastern time, we'll talk to the mayor of san jose, chuck reed. just call her the queen of country! carrie underwood, the big winner at the cmt music awards last night in nashville. >> all right. and so the buckle goes to miss

press to apparently make the white house look good. >> two articles in particular and we've gone over them here. kill list, the president went out in a "new york times" story and a 16-page story goes into great detail about al-qaida terrorists, how he kills them and how he disseminates who dies and who doesn't and where they're shot and people in this article are quoted like tom donnelon are quoted, national security advisor talks about the whole thing and they say that three dozen current and former advisors are also on the record with this reporter talking and this really bothers people who are concerned with winning long term the war on terror, unravelling our strategies. >> so why would they do that? why would they leak this stuff? well, the accusation goes on to say that they're doing it for political purposes. that they feel like this is one thing that the president can hang his hat on as far as foreign policy and taking out usama bin laden and continuing to kill terrorists. and so instead of focusing, some say, on the economy and other things like jobs, this is one thing that they want to tout

that the president has done. but at what expense? when you have a democratic senator like dianne feinstein who is very high ranking in investigating this type of thing saying this, i'm convinced what we need to do is codify a process and that the process that exists now is totally inadequate. when you have her asking for an investigation into the leaks, you know that it's a big deal. because it's crossing over political lines. >> when you look in the last year or so, when did president obama get his highest ratings? right after the killing of usama bin laden so he's got, you know, he's got some traction there. lindsay graham was on with greta van susteren last night and took aim directly at the white house for the leaks. listen. >> i'm suggesting somebody in the white house is orchestrating an effort to leak classified information and programs to make the president look good. to think otherwise is just absurd. these three stories within 45 days of each other or less than

that, paint a portrait of an administration defining terrorism, talking about disrupting a bomb plot that would have put us all at risk and a cyber attack on iran trying to build a nuclear weapon. >> the director of national intelligence, james clapper will be thursday morning, that's today, on capitol hill trying to explain to everyone how "the new york times" knows more about our intelligence operation that maybe the senate select intelligence committee and that's the chairperson, senator dianne feinstein. meanwhile, senator john mccain and senator graham are leading the charge to find out who leaked this and the accusation is it came from the administration. here's what jay carney said yesterday. any indication that they've leaked this information for political gain is grossly irresponsible. >> mccain was one of the first person that came forward and

said something doesn't smell right. let's move on to the other big political story this morning which is the continuation of democratic surrogates coming out against president obama's plan. >> then walking them back. >> well, but it's very interesting because first, of course, we had former president bill clinton in a myriad of examples, more specifically and recently about tax cuts, whether or not they should expire come january. now you have larry summers issuing a clarification on what he said about the bush tax cuts. remember, he was one of the original economic planning guys for president obama when he first came into office. here's the original thing that larry summers said. the real risk to this economy is on the side of slowdown. certainly not on the side of overheating. that means we've got to make sure we don't take the gasoline out of the tank at the end of this year. that's got to be the top priority. >> so he -- >> yeah, people concluded that he meant by that, don't raise taxes. let the bush tax rates remain. >> so he -- somebody got to him. and he had to back track. and he said "i fully support"

this is completely different. i fully support president obama's position on tax cuts extending the high income tax cut does little for demand and poses substantial problems of fairness and fiscal prudence as well. i'll tell you what, congressman paul ryan was on with hannity last night and had a little bit to say about this spinning. >> last thing you want to do in a bad economy like this is crank up tax rates so that's where we actually agree on that. people from the left and right on economics agree don't raise taxes in this kind of an economy. the president, though is so into this class warfare, pitting americans against each other that he's willing to trash all the advice he's getting from people in his own party about what it is to do to prevent us from going into a recession. >> the phone calls and the forced back tracking began publicly with cory booker when he made the statement about being nauseated by the bain attacks and mitt romney and then you have bill clinton, the former president of the united states gets a call to walk back

what he said about the bush tax rates. he has to do it in a written statement and larry summers according to the insider books that are out, he was the most powerful advisor in the administration. >> he was absolutely. >> i love the fact that one of the advisors for president clinton or somebody else said that maybe it's his age that he's suddenly speaking out of turn. he's been out of politics for 12 years. come on! president clinton is one of the smartest politicians ever and by the way, he's only 65 years old. younger than president reagan before he even ran for office. i don't think it has anything to do with his age. that excuse isn't going to get past the smell test. >> does this smell ok to you? talking about class warfare at the new nets arena over in brooklyn, the amount of money you spend on your seat is going to determine whether or not you can buy just one more round of alcohol. for instance, the proposed alcohol guidelines. sales of beverages will end at the start of the fourth quarter.

that's standard in a lot of places. >> if you pay between $15 and $55 for a ticket. >> that's right. if you have the regular seats. or an hour before end of other events. here's what you're talking about. premium ticket holders can drink after the cutoff and that has some people going wait a minute so the people who are up there in the ritzy suites get to drink until closing time? yeah, well past closing time. >> i agree with that. you know how much they're paying for those suites? if you have $260,000, up to $550,000 a year to put into the economy and put into the suites, you can drink 24 hours a day as far as i'm concerned as long as you don't drive. >> that's the problem. people in the neighborhood are saying, wait, those are the people that don't take mass transportation, they're driving themselves. and drinking until 2:00 in the morning with jay-z hanging out, you know. >> it is transportation. >> people who can afford the fancy suites are the people who can afford the expensive parking

so 2:00 in the morning, they get in their car and they've been drinking for 12 hours, that can be a problem. >> i think you've been watching too many rapper videos. >> that's good. maybe this can happen. maybe the people in the suites can toss beers to the people in the regular seats and they can bring fishing nets to the arena. >> not a bad idea. >> the people in the regular seats can still go to the restaurants that will remain open at this new arena so it's not like they're not allowed to get drinks. they just have to go to a different place. >> they have to pay for the new arena in brooklyn and it's got to be shined up every day. >> one cocktail inside. we're about to get new jobless numbers this morning but the administration maintains they are creating jobs, especially green jobs like this. >> garbage men have green jobs. >> yes. >> does a teenage kid who works full time at a used record shop count? >> yes. >> yes, those are all green jobs. is the labor department fudging employment data for political reasons? we'll talk about that.

>> welcome back, everyone. the next time you hear a politician saying they're creating green jobs, just remember this. >> do garbage men have green jobs? >> yes. >> does the teenage kid that works full time at a used record shop count? >> yes. >> wouldn't an oil lobbyist count as having a green job if they're engaged in advocacy related to environmental issues? >> yes. >> and that admission makes the number of green jobs created look even worse when you realize that's the category. here to react, tennessee congressman guy dejarley, welcome. were you surprised by those answers? >> yes, a little bit. it seems harder and harder to categorize what exactly a green

job is. >> i'm still trying to figure it out. the kid who is working at the record shop, why is that a green job? because you're throwing away old l.p.'s? i don't know, they're recyclable? >> right, i guess. you know, if you're a plumber, it's a green job. if you move porta-potties, it's a green job. if you drive an electric bus, it's a green job so it's just a myriad of things that become very confusing and hard to count. >> so when the department of labor comes up with statistics like they did in 2010 and say there were three million green jobs created, not only do we have to wonder where those jobs came from, we have to wonder where the criteria is. do you not trust those numbers? >> i'm very leary of the numbers. the one thing that we keep looking at is the shifting unemployment numbers. is it 8.7, is it 8.1, is it 8.2? and really the american people are looking hard at these numbers. you can't look at a poll that doesn't say the number one thing on voters' minds is jobs and the

economy. so at the very least, the american people deserve the facts when it comes to the actual job numbers. job creators look at these numbers in making their investments and clearly it seems like there seems to be discrepancies on what the numbers actually are. >> and most importantly, coming up in november, voters look at the unemployment number to decide which name they tick off, either obama or romney. this green job discussion is really the tip of the iceberg. what you're really concerned about is how these numbers have come out in the last couple of months, the unemployment numbers and then they look pretty good and then they're revised later on and you're wondering why is that happening? because that really doesn't get any press when they're revised on the downward side, right? >> that's right, gretchen and really, if you want to look at employment, why don't we look at the employment rate? employment rate is at one of the lowest in the past 30 years. it's somewhere around 63% of people that are actually employed so if we look at a number of 8 or 8.2 or 8.4, what happens to those 26%, 28% in

see over the counter. david prince is the co-owner of the gun range. it's just north of dallas, texas, and joins us live from the metroplex. good morning to you, david. >> good morning to you guys. >> it's great to have you. you know, for a kid, this has got to sound great because not only do they learn how to shoot guns at your facility, but you're now opening it up for birthday parties. and you say that kids can start shooting guns at age 8. david, why age 8? >> well, first, we want to make sure that everybody knows that the children when they come in and their parents are going to be giving us 30 minute instructional by a certified n.r.a. instructors that are trained in handgun safety and shooting accuracy and they're going to have that before they even get into the range but once they get into the range, you know, the guns will be there waiting for them. they're not going to be running around shooting at pinatas. this is to be a well orchestrated, carefully -- >> no, i understand that.

>> designed program. >> i was reading some of the news accounts. i saw one mother was worried, oh, you know, you're going to have birthday parties there. i'm worried that my son won't be able to tell the difference between, you know, a video game that he's played a lot at home and, you know, holding a real .22 or a b.b. gun out there. >> well, that's why it's so important to train the children from this age. you know, throughout the decades, boy scouts of america have been letting children and every summer, there's summer camps for boy scouts and girl scouts at age 6 start with b.b. guns and .22's and we're providing families a place to bring their children and learn how to safely shoot a gun. and that's -- that's our goal. and at our range, education and instruction are our paramount mission statement. so age 8, we chose it just because our shooting tables are a certain height and we just don't -- we thought it would be safer if the kids can be able to reach over and shoot over those shooting tables. that's our biggest reason.

>> well, i took an n.r.a. class when i was a kid as well and the boy scout training and the cub scout training with b.b. guns and then .22's but i think the number one reaction for some parents might be, david, my kid is going to go to this birthday party at this place. i'm worried that horsing around, they might shoot somebody else or hurt themselves. >> that's the instructions. when they go into that range, there will be parents there but especially there will be enough range safety officers that are going to be within arm's reach of every child and they'll be shown how to always point the gun downrange and keep their finger off the trigger until ready to shoot and the guns won't be loaded until ready to shoot so the children aren't going to be running around with guns. they'll be standing in the stalls. individual stalls built for one person to be standing there shooting at a time. so -- but once begin, none of this is going to be happening until these children and parents are properly trained on handgun safety. >> it sounds like you've thought of everything.

senate side. you know, they do that at the house as well and it's a bipartisan thing. not just democrats. it's republicans as well. >> i'm wondering how do they get the ideas? is their constituents coming to them saying we have to have a safe digging day? you know, or is it the lobbyists who work for safe digging who are saying we need to honor these people? >> could be a little of both. something from column a and column b. nonetheless, they do it and it costs a lot of money. that's a lot of ink. >> the rest of the headlines for a thursday. at least 55 parents and students from kentucky were on this bus heading to washington, d.c. it flipped over, a witness snapped this picture. the accident happening just minutes into the trip. right as the bus driver was turning the curve, dozens of people taken to the hospital. thankfully, none of the injuries are life threatening. >> just a couple of hours, john pistole, the head of the t.s.a. will be on the hot seat on capitol hill. the subcommittee holding a hearing on ways to improve the agency's customer service. yeah. good. and restore the public's trust

in it as well. many lawmakers have criticized the agency for numerous security lapses, improper patdowns and, of course, just blowing taxpayer dough. >> many lawmakers and religious leaders outraged after a same-sex wedding ceremony took place in the base chapel at fort polk in louisiana. john fleming says the state does not recognize same-sex marriage or civil unions. some calling into question the legality of the ceremony. a spokesperson for the american veterans for equal rights say gay personnel should receive the same rights as military troops. roseanne barr out of work again. she says this time the liberal politicians are to blame. barr claims her new sitcom got shelved is because -- the reason is because her politics are simply too liberal. too progressive. barr says "they don't like the things i say" so it's kind of like black listing or something. but the fact is i still think

>> no, completely different. the stuff in the stadium does not have this layer but it has rubber. you've seen that rubber come up. this has a thatch layer that holds the blades up and looks like dead grass at the bottom of your lawn. >> this seems like a great idea. how pervasive is at this point? >> it's very easy to install by yourself. you can do it yourself. it's easy to maintain. you have limited maintenance. you can put just -- >> i don't know how you could do it yourself. don't you need a certain rock and soil? doesn't it have to be graded perfectly? how can do you it yourself? >> we're telling people if they're doing a small job, 200 to 300 square feet, they can do it over the weekend. >> do it over the weekend? >> exactly. >> isn't it like carpet? it's got to be flat. you don't need a back hoe? >> nope, it's much easier than that. just a sod cutter and putting down some crushed rock and then the turf on top of that. anything over 300, 400 square feet, people usually get a professional.

you're on the democratic side. it appears that the laundry list continues to grow of these surrogates who are speaking out against president obama's policies. what's going on? >> well, i don't think that president clinton is necessarily speaking out against his policies. he's saying there should be a temporary extension of the bush tax cuts and as you know, president obama said no. he wants to negotiate a long-term deal with republicans even going back to the grand bargain but i think president clinton is saying, you know what? if we just had a temporary extension, then we can get a budget deal. president obama has been trying to hardball negotiations with republicans by saying no deal. and so, you know, on one level i'll say this -- it comes across to me on -- this is not the first time, gretchen, for clinton. he also said that romney had a sterling business record. >> no, this has become daily. >> right. so i think -- my theory is he wants to be the big dog in the democratic ranks and he doesn't want anybody to mistake the president obama as the true -- >> that could be one theory or he's just speaking his mind and

what he believes to be the truth. >> yeah, and i think that's exactly what clinton is doing. this happens too frequently to be a minor disagreement and look, i think the clintons if you read the back stories, and there's been tons of pieces and if you talk to a number of democrats and juan, you know better than i do, they don't like obama. they don't like mr. and mrs. obama, they had a tough primary season and i do think he thinks he's the big dog. this goes beyond clinton. this is now larry summers and before that, it was cory booker, duvall patrick, dianne feinstein. eventually, people say this points to obama's weakness. a lot of democrats think he might lose. when people think he might lose, the dissent starts flowing. >> you're talking about david axelrod who should be back plotting a campaign strategy, they're sending him out now as a surrogate on tv. not the most gifted speaker and i'm trying to be kind but he's no president obama behind a

microphone. what does that say to you? >> i think david is the strategist and the most celebrated episode was the one in boston where he went out there to try to make evidence to try to draw attention, i should say, to romney's lack of job creation when he was governor of massachusetts. >> he's not even a politician. >> what happens was romney sent his guys, his ringsers out to the campaign headquarters to heckle axelrod so it didn't go well. but let me just say -- nobody thinks that anybody knows which way this election is going and in fact, if you look at the polls, obama -- it's not that the democrats are running away. i think when you talk about a lot of these surrogates, sometimes they have their own agenda. some have their own relationships with wall street, for example, they're not going to say anything negative about wall street because wall street is putting money in their pockets. >> they don't want the negative economic data to wash over them, too. they don't want to be associated with president obama because of his job performance. i've worked on a number of campaigns. your top political strategist is

>> all right. in regulation proposed by the federal government to protect endangered sea turtles is prompting a bitter battle. the government wants every shrimp boat fisherman to have a device on their boat that would allow sea turtles to escape if caught and maybe arrows so they know where the hole is. some fishermen say the cost could put them out of business. you were talking millions of dollars. this next fisherman who you're eventually going to meet said over the years, he's only got maybe two or three sea turtles caught in his net and peter gersia is with us right now. a fisherman who is proud to say he trolls for shrimp with skimmer trolls and traps blue crabs. how is this going to affect you? >> it's going to really, i mean, put a final nail in our coffin, i believe, because, you know, we've been exempt with the smaller rigs and, you know, rightfully so because we shut

those down, there's nothing that's going to get in the net because we actively work the nets. once you put these devices in these smaller rigs, the rigs are, you know, close to the boat. it's going to be a hazard. we're going to get them in the wheel. it's just not going to -- when you pick everything that's above and that point, we're going to be dumping it out. you'll probably lose about 60% of your catch. >> who is making up these rules? in 40 years, you've only got about two or three turtles caught up in your stuff. >> that's it. i mean, the one of them i caught was by one of the universities, they had a fiberglass pitch on his shell and they had another one that was basically in the same area. so i mean, before this one point, like about say five, six, 10 years ago, we never caught any of them, so to me, you know, either release the injured ones or the population is that big that we're seeing them now. because, you know, i'm a shrimper since the early 70's and, you know, a lot of shrimp

>> total split within the democratic party about future economic policy. january 1st, everybody's taxes go up because the bush tax cuts disappear. the president wants to keep those -- he wants to raise taxes on the wealthy. and the moderate democrats want to get rid of all tax increases come january 1st. there is a total split. this is not the first split on a particular item of policy. ed rendell, former governor of pennsylvania, steve ratner, the guy that did the g.m. bailout, cory booker, mayor of newark are all moderates within the democratic party and all have been critical of the president's stance on private enterprise. all of them have been forced to walk it back, clarify, so to speak, but the split is there. it's obvious. >> why are they walking it back? that's my question. why did cory booker walk it back? now you have larry summers -- >> angry phone calls! >> does anybody tell president clinton what to do? apparently so. he had to walk it back. here's larry summers clarifying his comments. i fully support president obama's position on tax cuts.

this flight, u.s. airways brings you here. and as you land, what did you see? >> it was just an outstanding day. it was the day of a lifetime to be honest with you. the people that run the honor flight, honor flight myrtle beach, the finest group of people i've ever had the opportunity to work with. the trip that day was unreal! >> so u.s. airways, you're on the flight, you're flying basically for free for your service to the country, world war ii, and brooks, when you land, you expected just to go about your day. but what you saw, too, can you hear brooks? >> i'm not getting anything. >> he's having trouble hearing you right now. >> all right, ed. so you know what? i'll ask you and you can ask brooks. so ed to you, you went in and you said when you started shaking the hands, you were hit by a flash mob of patriots and especially the children. what was it about the children that got to you?

>> it was so exciting. he asked what the children did. >> it's an amazing thing to be walking -- i lost all now. i hear nothing. >> ok. well, so what happened is they walked out. u.s. airways rallied the people. all the flyers there. anybody in the airport when they started asking a few people. they asked a few more so when the u.s. airways flight attendants turned around, they thought, this is going to be embarrassing. we only have our staff here. they turned around and every single flier, everybody that was there, every pedestrian that was there to greet their family had gathered around and treated these patriots like world war ii had just ended. in fact, brooks or ed as i go back to you, there was even somebody in the newspaper that say nazis quit from 1945. >> well, they could have been. i didn't see it. i heard nothing about that.

it was -- it was pretty wonderful pulling in there. they had the fire ranges giving us an honor order salute and then there's people in the airport when we got there, it was amazing. >> right. and ed, would you just ask brooks how he felt the entire time, what he felt like when he walked out through that doorway? >> how did you feel when you walked out the doorway at the airport in washington? >> if i could communicate, i would tell you. >> he's listening to you. he can hear you. >> it's part of what you just said. it's when these young children, 150 strong and hundreds of kids on the cart paths in the areas down through the memorials, they would come up to you and say we thank you for your service. and i accepted that and really, really got to me when the young ones because it was not maybe all of their idea. this goes back to the parents and grandparents and people who

have told them what happened to us, why we were in war with all of our adversaries going on. but it's a pleasure and really happy moment to go through and visit with people who have been in the wars and the wars that have come and gone and the many, many people, i understand there's somewhere around 400,000 possibly buried in arlington. and areas around it. and it's a matter of really staying at attention and giving a salute to all and that's what we would want to do and we look forward to do. we still are looking down the road and even though we got a little age on us, if we had to do it again, we'd do it right now. >> i know you would. >> these things never go away. >> brooks, i can't thank you enough. >> our lover for -- love for

you need to be an american citizen here untso the state of florida is now saying sue me. that's what they're saying to the federal government. we're doing what's constitutional and proper. the first requirement is you be a united states citizen. the d.o.j. is saying that you are impacting minority voters in the state of florida and you're doing it on purpose. but unfortunately, it's part of the mantra of the federal government, especially in election year where they say listen, if you want to comply with the law, if you want to comply with the constitution, what you're really doing is engaging in racially suspect behavior. and you're trying to disenfranchise african-american and hispanic voters and what the state of florida is saying is no, we have identified about 180,000 people who may not be registered voters properly because they're not citizens or because they're felons or because they have some mental illness or there's some other issue involved. and they said no, the federal

is basically when your assets are far below your liabilities. you only make a certain amount of money and go to the court and say listen, judge, i just can't pay these bills and i want to complete discharge of my liabilities. that's the chapter 7 we spoke about last week. >> brian: let's move to something else and that is chapter 13. could that be an option? >> yeah, it is. what happens is if you have too much disposable income every month, let's say you make $5,000 a month, your expenses are $4,500 a month. you have $500 left disposable income. you may not qualify for the 7, but you may qualify for the chapter 13. what happens is if you have a certain amount of debt, let's say you have 30 or 40,000 in unsecured debt, credit card debt or otherwise, they take that $500 and there is a way to plan this out over several years to pay back the small percentage of that debt. what i want our viewers to understand is just because you may be out of a 7, a 13 is something you should always look at. >> brian: what are we going to

be left with after we call in chapter 13, are we eventually going to have to repay all that? >> this is the good thing about 13. let's say you have this debt, unsecured credit card debt, maybe second mortgages that are going after people and they've been turned into the collection, when you pay that certain part that's been approved by the court -- that's what's important for our viewers to understand. you actually file a plan, good bankruptcy lawyer will put this all together for you. you file a plan with the court. court then will approve that plan. you usually have either 36 months or 60 months to pay that back. when that percentage of debt, brian, has been paid back, after three to five years, your debt is discharged. so it's gone. it's over. so you get the relief, different from a 7 -- but you still walk away with paying less. that's different than chapter 13. >> brian: i like the formula you spelled out.

you said if you owe $40,000, no matter credit card bills or whatever, you have $300 of disposable income, you work out a deal that pays $18,000 back of debt over 60 months that should be feasible and workable? >> absolutely. that's why ultimately what the court will do, it's sort of like a spreadsheet. you give the expenses, income, the court says you have my blessing. you pay back this over the three to five years. one quick thing, brian, the only down side to a 13, it's based on your present income. if for some reason your income changes and goes down, many times you have to go back to court and ask the court for a new blessing to pay different than what was approved originally. that's the only down side. but that's part of the teal with a chapter 13. >> brian: all right, bob. thanks so much. bob massi. >> okay. >> brian: you can e-mail bob with your questions by logging on to our web site and click on shattered dreams. how to put your life back together. president obama out with some fundraising numbers this

>> gretchen: fox business alert. the labor department releasing brand-new weekly jobless numbers. 377,000 first-time unemployment claims were filed last week. that's down from 383,000 the week before. economists were expecting exactly that number. eric bolling is here to analyze. how often are they right on the exact number? >> we don't even know if that's going to be the actual number. of two wait 'til next week 'cause last week it was 380 they revised that up to 383. look, 377, 380, last friday we got unemployment rate going up. only 62 or 67,000 jobs created. that should be creating 2 or 300,000 jobs. jobs picture isn't looking good. this isn't fantastic for jobs. look at the four week average, you're 375 or so over the last four weeks. wrong direction. >> steve: there were some numbers out yesterday, the so-called beige book. i heard in the radio drive it in, well t does show growth, but

it's very slow growth. beige book manufacturing. >> manufacturing in the u.s. is growing. it's growing at a slow pace, but if you look back 20 years, we're nowhere near where we were in manufacturing 20 years ago. we're down probable lea 500,000 jobs in america versus even ten years ago. manufacturing is going overseas and there is a reason for that. companies can do business overseas. they can hire for what they want to pay and keep their money there. we're at the highest corporate tax rate in the developed world now. we exceeded japan, which brings -- can i preempt this with, you remember this? remember this envelope? i said i can get gasoline down a dollar. >> steve: you're recycling an envelope, that's green job. >> let me tell you something, governor palin and i went on air on this network. we did a special on gasoline that was april 13, a friday. we opened the envelope and we talked about speculation in the oil markets. four days later, april 17, president obama went to the podium and said you know what

we're going to do? we're going to tackle speculation in the oil department. that was the high price for oil in the last two months was $104 a barrel. it's $85 a barrel today. get no credit for it. doesn't matter. fine, it's going down. i got an idea for jobs. i can create a million jobs in two years. full screen. here it is. take a corporate holiday. any company -- there is $2 trillion overseas sitting in overseas bank accounts right now. allow them to bring that money back. repatriate it. because if they do it now, this get charged 35% tax. corporate tax rainfall they've been charged taxes in those various tax. let them bring it back for free, but that bottom part right there, 25% of whatever they bring back has to be earmarked through the irs and used towards u.s. hiring and u.s. capital investment. you will create jobs. you will have hires. you'll also have companies putting on more workers to create the things that companies have been reluctant to buy over the last three years because

>> gretchen: this week california voters sent a strong message to the city's union. overwhelming 70% saying enough with the big bloated pensions. if police and firefighters want to keep cashing in, they have to cut back or pay more. now those city workers are firing back, claiming that's not fair. they've already filed a lawsuit and all the voters, they will have to wait to see what happens. joining me now, the mayor of san jose, california, chuck lee. good morning to you, mr. mayor. >> good morning. >> gretchen: now you are a democrat. but you are in favor of these cuts. correct? >> yes, i was. i led the effort to make sure we

can survive as a city and deliver services to our residents by getting control over these skyrocketing costs. >> gretchen: one of the reasons is you're in debt in your town. is it correct, $115 million deficit just last year? >> that was last year's gap in the general fund budget. we have millions created by our retirement system. that's a pretty big number for a city of a million people. >> gretchen: here is what you told vanity fair. our police and firefighters will earn more in retirement than they did when they were working. there's a corruption here. it's not just a financial corruption, it's a corruption of the attitude of public service. can you expound on that? >> public service shouldn't be just about the money. it ought to be about serving the public, delivering services to the public. unfortunately, many people have decided that the money is more important than anything else and that's what the unions have focused on in negotiations and that seems to be the most important thing to some people. but most of our employees are

committed to public service. but the cost of the benefits has gotten so extreme that taxpayers can't afford it. the employees can't afford it and these things are extraordinarily expensive. >> gretchen: now the voters in your city, 70% to 30%, said they thought that these pensions should be curtailed. now there is lawsuit already. the unions are now going to go to court to try and make sure they can keep those pensions where they are and now you are countering that lawsuit with what? >> this is california. nothing important happens without litigation. so we're not surprised by litigation. in fact, the city filed a declaratory relief action in federal court on election day to seek a validation of the charter changes that we're make to go insure that we're following the law. but we've planned for it. we are ready for it and i look forward to getting a court decision to help clarify the law in this area so other cities can move forward to deal with this terrible crisis that's plaguing cities across the state and the
