concern enough to appoint investigators in the case. >> alisyn: after the story had come out. several stories have come out. but the one in particular was on may 29 in the "new york times" where it talked about the kill list and it paints a scenario inside the situation room. so somebody in there obviously talked to the "new york times" because it talks about president obama's expressions in there, some things he said. do you think these leaks are coming from the white house? >> well, somebody was in the room. it depends on what the definition of is is. because the white house can be just a small group that works there, but then you have political appointees that might come over from the department of defense, who was in the room along with them. so if they have offended the president by leaking, i hope that they follow this to wherever it goes and that person gets in a lot of trouble. but the pattern here is one of repeated leaks and it's always to make him look like a tougher commander in chief on national security. the thing is, he doesn't need to

try that hard on that. we all get it. we all buy it. we all support him. that's great. everybody else is focused on the economy. that's exactly what they don't want you to talk about. >> brian: one element you brought up last night is how odd is it that 36 administration officials that david sanger said he talked to dozens of people over the course of months are read into something as highly secretive as this. >> the article about the drone list, remember they talked about gathering once a month, 100 people on a conference call, which to me is like a webinar than something that's secretive and small. so either they're not managing it properly from the white house perspective, so maybe you'll start seeing those stories, or somebody was talking out of school or with permission, maybe not from the president himself, but from somebody. senator mccain, talk being the senator donnel lean exchange, it's my favorite. it's the best pr advice any white house gets. you don't get in trouble for something you don't say. >> steve: that's right. maybe somebody at the white house didn't say it per se, but green lighted somebody else.

you mentioned the other gaffe. this was when the president of the united states said the private sector is doing just fine. and he's taken some heat and in fact, the rnc rolled out a commercial within an hour, mitt romney let him have it within an hour. then he came back out about three, four hours later and said, it's absolutely clear the economy is not doing fine. when we had john mccain here, we reminded him of the time during the crash in 2008 when he talked about how the fundamentals of the economy were sound and he got hammered by obama, the now president's team push that out. >> on that moment when you're following politics and you're watching that 08 campaign, as soon as that happened, and i talked to some folks who worked at arlington at mccain headquarters, they knew that that moment on that day they were not going to win. >> alisyn: that's interesting. >> so when president obama in that press conference said that, my first instinct was, oh, boy. if you are hanging out with celebrities and hedge fund

authorize. >> kill list. and drone strikes. we know that three dozen advisors describe how the president deals with terrorism and includes rules, what to do on a drone strike. it also reveals that the president personally approves every person on the kill list. >> alisyn: if u.s. attorneys initiate this or special prosecutor is appointed, how long do these investigations generally take? >> this election will take until after the election. there will be no results revealed before this election. and it's split up between two u.s. attorneys. we don't know specifically what they are investigating because the issues that we just talked about are so classified. they will be looking at the espionage act. the espionage act under american law, which makes it a federal crime to transmit or receive defense information that can do harm to the united states. >> alisyn: someone could go to jail? >> somebody could go to jail. somebody should go to jail. this is absolutely wrong,

benefits of the "new york times" that their style book requires them to be precise about their sourcing as much as possible. if i could read one thing, this is about the cyber warfare attacks on iran. and the times quotes the president in a meeting with the secretary of -- the c.i.a. and the vice president saying should we shut this thing down, mr. obama asks? according to members of the president's national security team who were in the room. that's a leak. that is an unauthorized or should be an illegal leak of a national security secret, the cyber security thing was classified program. no one had admitted to it before. >> steve: it still is! >> of course. so here you have the president's national security team telling the "new york times" what the president said in meetings and what he decided in those meetings. if that isn't a crime, then why do we have secrecy laws at all? >> steve: there is a possibility that this particular reporter actually spoke to the president of the united states. >> i think it's very likely.

>> steve: oh, boy. well, eric holder has come out and said, okay, we know this is a problem, so i'm going to appoint two prosecutors to look into it. >> right. >> steve: the problem is, the prosecutors report to holder, holder reports to the president. if the president's white house is the one that's doing all the leaking, i'm sure we'll get results the day after the election. >> right. if ever. look, i think that i saw john mccain earlier repeating his call for an independent prosecutor. i think that's absolutely required here. you can not have the executive branch controlling an investigation when we have so much evidence already that it is the executive branch that's doing the leaking, that it is members of the president's national security team who are doing the leaking. so i think to ask eric holder or people who work for him to investigate this in a way that isn't even fair because no matter what they find, it won't be considered credible because of who they are and because of holder's relationship. i think the president should be the one, if he really wants the
