that has nothing to do with sports. it's s.a.t. prep and violin lessons and the whole gamut. so sports is just a part of this, i think, larger societal phenomenon. >> you looked at what people are spending on sports, whether it's 101 training, whether it's going to these tournaments, whether it's college recruiting services. what do you discover? >> one thing i discovered is it's a huge industry and $5 billion a year is the figure that's commonly used. i think that's quite conservative. it doesn't capture a lot of things like, you know, travel tournaments. a lot of us have kids who played in travel tournaments and that figure doesn't catch things like the gas and the lunches at the pizza restaurants and the hotels. so it's a huge industry and not many families are spending $10,000 a year and more to keep their kids on this track that they think might be leading to something down the line like a college scholarship or even playing center field for the yankees some day.

>> what's the reality that you discovered about how many -- how many high school athletes will play college ball in any sport? >> i think if more parents understood this, the dynamic would change. i mean, just 5% of high school varsity athletes will ever play a minute or a down or an inning in college. so the odds are very much against turning your kid into a college athlete and let me justed that the percentage of kids who get athletic aid in college is even smaller than that. >> well, you know, you wrote the book "the most expensive game in town" so this is something that people should be worried about. are they wasting their money? are they sacrificing their vacations and out of a job and putting money into hotels and tournaments. i wrote a book it's how you play the game, the game does count. you see the benefits of sports of team work, comraderie and you see how people can be selling a dream. where do you find the balance? >> brian, i think there's so

thieves. new reports now show cell phone theft is on the rise big time. what can you do to protect yourself? what exactly is at stake in terms of your personal information? kevin mitnik is a former hacker and current author of this book called "ghost in the wires" and here to tell us how to keep tabs on your own cell phone and secure your identity. first off, kevin, why now are people saying i'm going to steal these things and it's lucrative? what's the money making aspect of these steps? >> for example, iphones are quite expensive. we have a bad economy now and one other reason could be, you could be targeted because of the information on your phone. your e-mail. you might be storing passwords or other confidential information especially if you're working in a business environment. >> people say i have a password, you're not going to get to my information anyway, correct? >> people keep a lot of private data on their cell phones. they keep notes and they keep passwords and they keep their e-mail and if a hacker or somebody steals your phone, there's a password recovery

software so even if you have a password on that phone, they could break that password and they get access to your data or criminals just want to, you know, just reinstall the software and take over the phone and use your phone. >> all right. so here's some basic things you say we should do to avoid theft, keep your eye on your phone, of course. >> keep your eye -- >> go ahead. >> yeah, keep your eye on your phones. if there's a software you can install on the phone to find your phone if it's stolen, but that only works if the truck is stupid enough to keep, you know, keep the same software on the phone. if they reinstall the software, it's going to wipe up on tracking software and you'll never find your phone. >> usually they're a professional. my phone was stolen and i was able to track it to the guy's house because he wasn't that bright. what they will do with your phone i find staggering. it's easy to recycle the phone. what do you mean? >> you can reinstall the software if you have, for example, itunes, you can do it

on your iphone. just rewrite the software on the phone so that way, it could be repurposed. the -- you know, and the other thing is, you know, getting access to the, you know, information on the phone which is, you know, i think more important. it's important for people to choose more complex passwords than simply a four digit code. you could actually enable your phone to use a longer password and i suggest that because there's software, one company in russia called elcom soft sells software that allows anybody to crack their password within like 20 minutes. if a crook gets access to your phone and has 20 minutes, they can get your password and get complete access to information on the device. >> go ahead. >> and people back up their phone like their blackberry, their iphone. they back up the information on their computer. if somebody gets access to your computer and steals that backup, it's very easy to recover all

don't have the fear of deportation any longer. this is a two-year deal. come forward, we're not going to throw you out. how do you feel about it? >> look, something has to be done. certainly you have a big problem with immigration. the country is doing poorly. you have actually people coming in because of the fact that there's as much to come to, frankly which is sad in itself. something has to be done with respect to immigration. as they said during the republican debates, i think most of them agreed really. you have people who have been here for 20 years and they speak the language. some of them don't even speak spanish but they speak the language. it's very, very tough, i mean, on a human basis and a lot of other basis to be throwing people out. but something has to be done. this was not the right move. this was a political move. you have to come up with a permanent solution and we have to secure our borders and if we don't secure our borders, we no longer have a country but something has to be done. >> if you're donald trump, how do you play this? >> it's a very complicated subject and you don't just play it one way but for people who have been here for years that

have, you know, been hard workers and have good jobs, are supporting a family, it's very, very tough to just say by the way, you know, 22 years, you're getting -- you have to leave. get out so, you know, a solution has to come up with. it's a very, very difficult situation. i'm one of the world's very conservative people, but on a human basis, how do you throw somebody out that's lived in this country for 20 years? >> how do you feel how mitt romney has handled it over the weekend? >> i think he's handled it good. he handled it with compassion but said i want a permanent solution. this isn't a solution. this is just politics. he wants a permanent solution to it and i think he'll come up with that. >> yeah. one other question for you before we move on. what -- so a part of the provision with this executive decision is you can apply for a work permit if you're in this country illegally. what will hundreds of thousands of work permits do to unemployment and the economy at

large? >> well, obviously, you know, the concept is that you throw everybody out and everybody else gets a job but it doesn't work that way and a lot of the jobs that these people have a lot of other people don't want. you know that and i know that. you see it all the time, whether it's picking grapes or doing something else, you have jobs that a lot of people aren't going to want. so i don't think it's as complicated as that. but we really have to come up with the solution and we also have to have a solution with compassion. we have to show some compassion. we just can't throw everybody out. >> this is going to be scary. you might agree with vice president biden on this. you've talked about the chinese airports and talked about some of their cities and compare them to ours and down on what we're doing here. here's the vice president over the weekend. >> wish you could travel around the world with me, 600,000 miles so far, just since vice president. blindfolded americans took them

to some are the airports in china and took them to any one of your cities in the middle of the night, just so they could see it, and then said which one is an american? which one is in your city in america? and which one is in china? most americans would say, well, that great one is in america. it's not. >> by the way, you have to point out you see the wall behind him? he was speaking to the conference of mayors of u.s. cities which might not have been the best audience, i don't know, to talk about this with. >> he makes a good point. that is, mr. trump, there's a lot of infrastructure in the united states of america is in decline. >> well, what he's really saying is a very sad thing. our country is going to hell. the great cities now and the great cities that are being built are being built in china and other countries. i've been saying it to you folks for three years. >> yep. >> you go around and you see what we have. you come to laguardia airport. it's like the third world place and you go to l.a.x. in los angeles or kennedy and newark, it's very, very sad and then you go to some of the airports in

airports in the united states vs. airports in china. and how the chinese are doing so well in developing new facilities. what about when it comes to golf courses? who's got better golf courses? the united states and i know you just closed on doral in the miami area or other places around the world? >> well, we really do top them in the golf world, i will tell you. we have some great courses in this country and china is just starting with, that you know, they're building a lot of different places and a lot of different courses. they're building everything. china is booming. and we're dying and china is booming. and to a large extent it's because of what they do, they've taken our jobs. they manipulate their currency so it's very, very tough for us to compete. they make it very hard for our companies to go in and work there. they take all the secrets. they take everything that they have to take. whereas they pour in here so china, what they're doing, look, if i'm from china, i love what the government is doing. but if i'm from this country, i don't like what the chinese government is doing.

prosecutor here in new york. good to have you on the show. >> nice to be here. >> so obviously, you're very familiar with this topic. mayor bloomberg wants to ban the gigantic sodas that are the size that we are. what's next? popcorn and who knows what else? obviously, the issues of legality start to pop up. what's your feeling on this? does this somehow violate the constitution? >> i can think of two different provisions in the constitution that are going to be raised. >> commerce clause. >> the commerce clause and the due process clause. i mean, due process at a minimum requires the government to behave rationally, appropriately, fairly with people. >> they said they are well rational and appropriate because of owe obesity. >> the question is whether or not this regulation will have a meaningful effect on obesity. for example, when people purchase less of a product where that product is in the smaller container. when people purchase less, fewer cigarettes if a cigarette

package has five cigarettes in it or drink less beer if the beer container is 16 ounces or -- >> i'm thinking -- i don't drink the supersize thing but if i did and i wasn't allowed to buy them anymore, i would buy a couple of medium ones and take two of them. >> that's the idea. people like to purchase item in bulk whether it's food or household items, it's cheaper. it's more convenient to store and so there is that big question, you know, it's a factual question that a judge ultimately will have to decide, whether it will work. whether purchasing smaller item will reduce the amount of consumption that people do when they purchase these large sugary sodas. >> who are we going to see lawsuits springing up from? individuals? >> it's going to be merchants. >> can i sue? >> sure, you can sue. if you consume these items. >> on what grounds? >> you can say maybe it's more costly, more time consuming and some, you know, environmental groups might sue saying it's

work. so a survey was done called usage, the acronym is understanding statin use and gaps in education. this was done to kind of get the landscape and see exactly where we are with this and the attitudes and they found out that a lot of people aren't taking their medications because they interact with one another. >> yeah. >> people are not just -- people are not just being treated for high cholesterol. they're being treated for other things as well. >> and you don't take a statin. you're able to control it through diet and exercise. >> actually, i'm one of the people that was able to control it through diet and exercise and i'm not on a statin medication but many people are but the whole premise of putting this survey together was to develop a resource they've now put on the web site called statinusage.com and gives us ideas in ways that the doctors and patients can now talk to each other and develop a more effective way of controlling high cholesterol.

>> brian: snacking. >> steve: can we talk to you about what has happened over the last -- after we adjourned here at "fox & friends," the president came out a couple hours later and announced his change in what's going on with young people under 30 who are in this country illegally. essentially what he's going to do is ignore the law of the land. >> out of the clear blue sky, all of a sudden on a friday afternoon, a little unusual that it plopped out there, the president calls for a statement in the rose garden and goes out and talks about something that he says he can do through executive order. that is in question. that is to stop the deportation of any young person who is here illegally, maybe brought by their parents between the ages of 16 and 30, give them a work permit and a couple other things. interestingly, and i loved what meghan kelly did on friday as they waited, president obama's 45 minutes late to his own statement. i don't know who was thinking or had the memory to remember that

just last year, president obama was asked by the anchor y haven't you done anything? and he said, it's a myth that i could do something on my own. i have to go through congress. and then a year later, he does exactly what he said he couldn't do before. so when you play that sound bite, maybe we'll play it again, we'll hard to swallow the administration's spin that this wasn't political. >> steve: what sound bite is she talking about? this one. >> this is to the a political move. this builds on a lot of steps. >> you could have done it last year action the year before that. the year before that. >> we've been trying to he can't get the dream act done. this bill is on a series of stage to homeland security department has already taken. >> steve: how dare you suggest it was political? >> i know. how could i possibly think a? here is one thing that i think is a little boysome for me. i think that president obama actually could have had this pass through the congress. >> is that right rubio had recently introduced something

similar and how much stronger this could have been for everybody if you believe it was the right policy it have it done through congress and in a way that if you believe it's right way to do as president obama said, then could you get it through congress and make it stick because this gives somebody a two-year reprieve. but as soon as you give somebody for two years u start worrying about two years later? so a more permanent fix would have been welcome. i think it's hard to swallow it isn't political. but if i was on the side of this, i could pocket it and move on. >> brian: if i'm the parent here illegally with my kid, my kid goes in, now you can stay here without fever deportation, you go to sign in, by the way, can you bring your parents, who are probably already paranoid about being deported. how did mitt romney handle this? he's live all weekend on his bus tour. when he goes to sit down, this story obviously came up. listen. >> i come into office and say we need to get this done.

on a long-term basis, not this stop-gap measure. what the president did, he should have worked on this years ago if he felt seriously about this, he should have taken action when he had a democrat house and senate. but he didn't. he saves these sort of things until 4 1/2 months before the general election. >> brian: he wouldn't answer specifically would he repeal it if he was to get into office or veto it. do you think he should have been more specific? >> no, not at this point. that disappoints some people because they want him to say it's unconstitutional. and it might be. but i think you have to let the scholars look at it. the other reason i wouldn't do it is because one of the big complaints during the bush administration was that president bush overstepped the boundaries of executive power. and that was a theme on front page of most papers, including the one here in new york city. over and over again. this time on whether it's national security issues or domestic, they seem not to even care. and i think if i were mitt romney, i would not fall into

this trap. i would continue to focus on jobs and the economy. >> steve: sure. while mitt romney was out and about on his burks where was the president of the united states? >> let me guess. >> steve: it wasn't a fund-raiser. >> it must have been golf. >> steve: that's right. his 100th round of golf. >> right. yeah. i wouldn't recommend it, but i don't think they care. or even if anybody does care, they don't convince him that way >> juliet: if he's with john boehner, that's one thing -- >> this is how he blows off steam or deals with stress or whatever. >> steve: your former boss was a big golfer and then he just stopped. >> he stopped because he -- one day felt like it is not fair for me as commander in chief, when i have asked young men and women to be in harm's way, that i'm out golfing. he put that aside and he picked up golf afterward as brian knows bosomy now he's very good.

but president obama doesn't have -- he doesn't get any of the criticism. we used to get criticism all the time. >> brian: david axelrod said maybe the president shouldn't be golfing. now he thinks it's great. this is going to be a huge week. we could and should find out this week about obamacare. will the mandate be looked at as constitutional? we hear it's very heated behind the scene. >> yes. so i think that the decision comes out today. i'll tell you why. they usually come out on a hon and next monday would be the last monday. i think they want to get it off of their plate. i also believe that because this is very unusual, i think, justice ginsburg sent a little warning shot i think this weekend to let people know to expect sharp disagreements in the opinion when it does come out. so there is four scenarios. either uphold it or split the baby a couple different ways, or strike the whole thing down. no matter what, there is going to be a lot of politic force the

first maybe three days and then everybody, republicans and democrats alike, better get together and figure out now what do we do? >> brian: yeah, because if they strike down the man it is date. >> anything left? if they strike down the whole thing, what's going to be there? people are just going to be pointing fingers? there is already systems in place, they're already ramping up. >> michael tan has a great thing on the five things you could do with health care. i read it yesterday. there is some really good ideas in there that would be market oriented where we would own our own insurance. like i'm an independent person, so i have my own insurance. but say you worked at a job. instead of your insurance being tied to your job, what if it was tied to you and you could take that wherever you went. that's when people worry about the most is if you lose your job. there are some ways to fix this. they could have had this done in a bipartisan fashion. they decided not to. they went too far with the mandate. and imagine the politics.

find out when did that. vote, february 2, 2006, senator obama said this, a special counsel will special the public's confidence in the investigation and prosecution and help to restore its faith in our government. shouldn't we be restoring our faith in our government? >> it's an election year and what it appears to be -- this is going to be pushed beyond the election, the president will not be interrogated before the election. question, question is the proper word. it's not about a 2012 election year. it's about serious leaks. the leaks came out of this administration. mr. david plouffe and the white house administration should be down on their wee knees begging for forgiveness of the american people saying listen, somebody screwed up. >> brian: or overheated with anger. >> but not aggressive in terms of questioning of the media to say how dare you ask this kind of question. i'm not running the investigation. the truth is, they are running the investigation.
