florida. you can see these cars having a tough time driving through flooded streets. these residents trying to salvage waste left of their belongings before they leave home and head for higher lands. it also spawned isolated tornadoes. at least one woman died. police found her dead in her home that was destroyed in the storm. residents say it wreaked havoc on their neighborhoods. >> open the door and the door ripped out of my hand. >> all of the chairs from the pool from inside the pool. >> am it could still become a hurricane but the latest path of the tropical storm making land fall in the florida panhandle. >> mary anne rafferty, thank you. we have live coverage from the city where the tornado struck. maria molina where is debbie heading next? >> she is a ril tive-- relative

weak storm system now. the heavy amount of rain with the storm system. regardless of what's on the coast this is a highly uncertain track with the storm system because of a process digging in along the east. that is expected to eventually sweep up debbie and take it up toward the north. it is not even moving at this moment stationary over the gulf of mexico. it is expected to slowly intensify over the next 24-28 hours. by wednesday 1:00 a.m. slightly off toward the northeast with the wind 55 miles per hour. we have it for a long period of time we will be seeing heavy rain along the coast of florida. even though it is taking it northward across land fall that's not the big story where the center will land. the winds aren't a huge story it's the rainfall that is a concern. we did just have a new update come out at 5:00 a.m. by the

national hurricane center that's what the winds are estimated at. we have winds out of the west that is really blowing most of this toward the state of florida away from the center of circulation. that's why it isn't rapidly intensifying. near the center of it we don't have much shower or thunderstorm activity. another big concern we have been talking about is the tornado threat. there is a tornado watch across the state of florida, campau you are -- tampa you are included in that. we have the risk. we will see more activity from some of these thunderstorms in some of these rain bands as they move on shore. no tornado warnings. we are mentioning the rain is the big story here. warnings in effect on the florida panhandle all of the way down into west central parts of florida. warnings remain in effect through the rest of the day as we continue to get more heavy

reform. i believe most americans will say we will never go back to the age where my child will be denied access to health insurance because he or she has a preexisting condition. fwhier sent members a memo not to spice the ball if that happens. they are looking at a broad plan to move forward. >> all along we said real problems this isn't the solution. if this goes away you have to start dealing with the problem. >> the main question is considering if it forces americans to purchase mandatory healthcare insurance or face a fine if they fail to do so. however the court decides or which ever way they go it could have a sweeping impact on the presidential race. also the court will decide the fate of the controversial arizona anti immigration law which allows police officers to check immigration status during traffic stops and make it a

crime for immigrants to seek work without proper documents. critics say that's racial profiling. thank you very much. the supreme court much anticipated ruling they are the big talker as expected. >> both democrats and republicans are bracing for this landmark decision. he is already taking a sharp stance on the potential ruling. if the court shoots down obama care the justices can become political. >> principal because we took a bold step something that some 7th president before president obama decides to do. something this country has been fighting to get for quite sometime. all of a sudden now that we have the elements in place to start this moving forward the court may have to step in. a lot of folks are wondering what the supreme court is really trying to do. we saw the decision to allow secret money to come into

campaigns. now they go forward swear going to over turn the law. they have a personal responsibility requirement to it that we see in other aspects of our nation and society. is this supreme court really trying to dispense justice for all of us or does it become a political body just like congress or the white house is? >> the other big talker is the arizona immigration bill ruling. >> marco rubio weighs in on arizona's law and constitutional right to have that bill. i believe they have a right for this bill. i don't believe other. what the supreme court analyzes is the constitutionality to the law. i believe arizona has constitutional right to do this. he will be on fox and friends this moirs at 7:45 eastern so make sure to stick around for that. >> 9 after the hour.

a grand jury failed to indict them on a top level terror charge but they still face other crime charges. some of the victims of bernie madoff of 65 million scheme are getting a million dollars as part of the settlement. he steered clients to madoff agreed to the deal to settle a civil lawsuit. the investors will get over 40 percent of their losses but only up to $5 million. an additional $5 million will also go to new york state to cover the costs of the settlement. cranberry lovers beware new reports say cranberry juice may be the next drink to be targeted venlt it is usually sweetened it could be banned from schools if new nutrition standards from the federal government take effect. the changes are on the heels of let's move initiative. they say cranberry juice has health benefits. those are your 5@5:30.

all eyes will be on the supreme court today. weaked learn what the justice is ruling on president obama's healthcare law. >> there could be a decision on crack down on illegal immigration. we are live with more on both of these. >> these would be the best kept secret in washington right now. healthcare law will come in week very possibly today. will the justices deal a blow to the healthcare law less than five months before election day or will they uphold it? over the weekend both sides were bracing for the decision republicans hoping for a repeal. >> all along we said real problems this isn't the solution. if this goes away you still have to start dealing with the problems. the most critical question for the court is it constitutional to force americans to purchase healthcare insurance or fine them if they

it will come in slightly a bit more 65 miles per hour verses 65 mile per hour winds right now. most of the showers and thunderstorm activity displaced on to the eastern half of the storm system. that's because we have winds pushing the thunderstorm activity toward the east. it will see a lot of rain over the weekend. you can see the center of circulation not much shower and thunderstorm activity. all of the rain to the east we have a concern as far as severe weather in the form of tornadoes. there is a severe weather watch until 2:00 p.m. conditions are favorable to have more tornadoes with some of the rain bands. it is typical or common to see this. we will see when we have tropical storms making land fall or even hurricanes. no tornado warnings in effect.

vigorous at this point. the rain has stopped but we were driving an hour ago and many of the streets over waters. we were trying to go around the corner to get a better picture of that that's when we stumbled across a collapsed house. it is some of the worst damage he has seen no one was injured told a couple had to be rescued they were trapped inside. there were several reports of tornadoes in the area. obviously residents are terrified. windows were blown out lawn furniture tossed around every where cars lifted and moved. they are waking up this morning trying to assess the damage. power still out that has been tough. roads are flooded. we have seen emergency crews to make sure everyone was okay. so far we don't know the extent of the damage.

let's ask the executive director of american law. thank you for joining us. >> thank you for having me. >> three options here. first the law is ruled constitutional and stands as is. what is the next move for the white house? >> the only way it would be repealed is by president romney and a congress. they fear that. for all of the people out there who think it is unconstitutional the court says no it's not. it will take an act of congress. people believe this is what will happen. portions of a law ruled unconstitutional. they require people to purchase insurance. the individual mandate is going too far over the article one commerce. government has never been able to force people to buy something. if you buy a stock they regulate the market. you make the decision to buy the stock. we are going to force you to buy

it. it's a two-step process. if we okay this if we allow this it will change forever. >> how did the white house respond to that? that's a blow to president obama and his administration. >> this would be falling apart. if that happens you are talking about insurance premiums going up from 5 percent to 40 percent immediately. right before the election they have to figure out they have to blame the rich and do what they are already hitting at. that's what the issue is all about. >> the third thing that could happen they could start the whole thing down the whole thing is unconstitutional. the unpopular decisions involving abortion and catholic church fighting back.
