ex nfl player took this picture, look at this, from an airplane above queens, new york. you can see the rain looking like a giant vortex over the city. that is scary. parts of massachusetts to vermont with hail and lightning but no major injuries are reported. on the down side there were wide-spread airport delays that could create a backlog of flights throughout the day. >>heather: and the parents of homegrown terrorist anwar al-awlaki are, get this, suing the u.s. government. the aclu filing a lawsuit on behalf of the parents claiming the drop strike that killed their son and two others was unconstitutional. the justice department has fired back saying it was justified. al-awlaki you remember, was a major al qaeda figure. he was linked to the underwear bomber and the ft. hood shooter.

>> united flight towns around not once but twice because of a strong smell. shortly after taking off from honolulu passengers detected what they describe as maybe electric electrical odor and the captain decided to fly back to hawaii. when the smell disappeared they took off again on the way to los angeles but an hour into the flight, the odor returned and they were forced to go back. united telling all passengers, sorry for the inconvenience. >> three muslim men from london are charged with traveling to pakistan to getterror training. the suspects intended to carry out acts of terror and they told others how to get training. two of the men live near the olympic sites but police say they have nothing to do with the arrest coming ahead of the games. police arresting two others for having copies of an al qaeda magazine.

>> i cannot guess their motives. i would just ask for an apology. >>heather: later today we will hear more from george zimmerman and he reveals if he has any regrets. and, also, he discusses the moment he and trayvon martin came face-to-face. >>heather: very interesting interview. >> brand new fox news polls are out this morning, about the presidential election and the state of the country. >> the results show that mood in america could be very bad for president obama. and peter doocy is covering the story, live for us from washington, dc. peter, what is this telling us? >>peter: i don't want to alarm anyone but the 2012 election is not be held today so do you not is to head to the polls but if it was, here is how it would breakdown. president obama would take 45 percent of the vote. mitt romney would take 41 percent of the vote. the president's number hasn't

budged in a month but is down two months since this time last year and romney's chances are the same as last july, but higher than last month. as for the independents, president obama is winning there right now, too. he has 38 percent of their support. slightly better than last month. romney has 34 percent of their support. three points better than last month but 28 percent of the middle of the road voters are "unsure." and although the president is leading the race right now in the fox news polls as the american public kicks around the idea of who they want their next president to be, 64 percent actually think government is the problem giving current economic conditions. just 23 percent think the government is the solution and 8 percent are mixed and say "it depends." and 62 percent of voters are not satisfied the way things are going in the country today which is much higher than the 38

percent who are satisfied with things in america right now. and the information the polls are based on were taken from sunday to tuesday of this week. so they are current. they give you an idea the way folk are leaning 110 days before the election. >>heather: 110 days will go by fast. >>heather: and your mind could change before then. now, time for the first weather update. janice, we have the storms that cleared but it is still hot, hot, hot, across the country. >> ladies, winter will be here soon enough. right? >>heather: will we remember all of the daytime highs when it is like, 30 degrees out there? i don't. >> it is still hot. there is relief on the way for some of us. you can see the greens and yellows, that is a cold front sagging south, so, some areas will feel a drop in the heat.

other areas not so much. this is the heat index. that is the temperature with the humidity combined, what it feels like, it will feel like 101 in louisville, and 99 in washington, dc, and 105 in kansas city. the cold front will sag south and tomorrow, new york, 72. can you believe that? 80 in cleveland. 81 in chicago. but, again, it will just be the northern tier in the mid-atlantic that will feel the relief. so, to show you an example, average in chicago, 84 today, 92 friday, and 82. new york, average 84, today, 83, friday, 72. we will enjoy that temperature. satellite radar showing the storms exiting the northeast. we will see the potential if severe weather across the ohio river valley and parts of the northern plains. we will bring you the latest in the heat and the storms. >>heather: 72, a very good

number. now stories you can bank on this morning. signed, sealed and not delivered, the post office's money problems are growing worse as lawmakers try to figure out what to do over the age. and now lauren, we are talking about a $5.5 billion payment due august 1. >> a couple days away, and they are warning, again, they will default if nothing is done by lawmakers and that default could come sooner than we think. it is not just the $5.5 billion that is due and another $5.5 billion is due the end of september so that is what the age is facing. a glimmer of hope is the service will not be disrupted and the post am service workers still are paid. the house of representatives goes on recess in august so it will be done. >>heather: from an agency that can't pay to another agency that is told to "pay up," capital 1,

$210 million fine agreeing to pay that sum to settle charges that the call center representatives urged customers into paying for pricey add on services such as payment protection telling them those services were free when they weren't. the settlement, the first ever for the new consumer financial protection bureau, the money going back to the affected customer. but, also, the case is not isolated and we could see other banks face charges. all and over half of the revenue is from credit cards. finally, fun news, the "dark knight," rises opens up at midnight. >>heather: people are waiting in line. i will not be there but the third and final batman movie opens time from time warner and will gross about the same at this weekend's box objection, big money not studio and bigger money for the scalpers. we are seeing tickets being

drive america's wealth and excellence, and government is a parasite and lives off the excess of wealth, in the form of taxation. obama has the view at the heart of american excellence and achievement is government and not enterprise and romney ought to take the headline of the "wall street journal" and "lender versus staples." >>heather: also karl rove tells us what he thinks is behind the president's comments. >> he says this, i think in part, because he is exhausted. look, being president is a demanding job. running for president is a demanding job. and you take as much time out of the president's schedule as he has, and you have 100 fundraiser. he has had more fundraisers than his protect says -- his

rain, hail, lightning and wind, making a mess out of things as far west as ohio. you can see giant trees snapping in arlington, massachusetts, many falling on cars, homes and power lines. 100,000 people in seven states are without power this morning waiting for it to be restored. all the skies opening in new york, raining out the yankee and blue jays game. fans last night running for cover. the storm did bring a little bit of relief from the heat. fortunately, no one was hurt. we will talk with janice. >> radio calls being released not shooting of a california highway patrol officer. he stays calm and tells backup to slow down when he realizes he will be okay. >> i've been shot twice and the suspect vehicle, blue, blue, with 24" wheels and bullet holes on the driver side.

month and that outraged romney who says it shows the president is more concerned with keeping his own job than helping millions of americans who need a job now. and doug is live in washington, dc with this angle. >>doug: after a few days on defense the romney campaign is on an aggressive tact and they are going after something we have not heard about lately: the job council. the president attended another fundraiser late yesterday, and you see him returning to the white house and the romney campaign is comparing that record pace of presidential fundraisers to the number of meetings the president has had with his jobs council. >> in the last six months he has held 100 fundraisers. guess how many meetings he had with the jobs council? zero. zero not last six months. so it is very clear where his priorities are. his priority is not creating

jobs for you. it is trying to keep his own job. that is why he will lose. >> the jobs council includes two dozen business and labor leaders who are supposed to give the white house advice on job creation. their last meeting, according to the white house website, was january 17. the white house yesterday defended the president's schedule. >> no specific reason but he has a lot on his plate, but he continues to solicit and receive advice from numerous folks outside the administration about the economy. about the ideas that he can work on with congress to help the economy grow and create jobs. >> the ranched up attacks by romney could affect the growing concern among many conservatives that romney campaign was not forceful enough going after the

president's record. back to you in new york. >>heather: thank you, dow. and now, the weather, before you leave the house you want to check in on the weather. >> there could be more rain on the way, janice? >> if you are traveling across the eastern seaboard especially the big cities including new york, boston, washington, dc, call ahead. we had a lot of delays last night because of big thunderstorms that rolled our way. things are clearing out nicely. so, if you are headed to the airport you will not have problems this morning but we could have backlog and we could have potentially severe weather. we had over 300 reports of severe weather yesterday and last night. across the west, a little bit of rain in southern california and new mexico but, all in all, very quiet. this area across the upper midwest and northern plains we could see showers and thunderstorms and even stronger weather in terms of severe weather. so dakotas and bismark, and

you made in the 9-1-1 call, what made you think he was suspicious, and what made you thing he might be on drugs? >> he was suspicious because it was raining. and he was in between houses. and cutting in between houses. and he was walking very leisurely for the weather. and i didn't, it didn't look like he was a resident that was checking mail and got caught in the rain. >> was he talking to you a lot during this fight? during this, when he was beating you, because you are saying he was beating you and pounding your head not cement. was he talking to you during that time? >>guest: yes. >> he was saying what? >> cursing and telling me to shut up and finally telling me he was going to kill me. >> he said those words and he said it -- when did he first see your gun? >> after we were on the ground i

not come across as someone who went out looking to kill someone. remember these types of interviews do not always go so well for defendants. we remember sandusky gave an interview that was such an utter disaster that the prosecutor put it in at his trial. over all, from a defense perspective he did pretty well. >>heather: in that segment he was talking about the timeline of events, so, did he lay the ground work for a good self-defense argument? >>guest: i absolutely believe he did. we do not know what the prosecution has up their sleeve and we did not know if the jury will credit his version as true. but if you take his version of events, and you give that same version at trial and if a jury credited that version as true he did lay the ground work and make out what i believe would be a valid self-defense claim. >> if you were his attorney without have him testify? >>guest: i think he has to testify at trial. because a self-defense claim

depends on a state of mind of the person accused, no one else can get into george zimmerman's head so he has to testify. but based on what i saw i would feel comfortable as his lawyer putting him on the stand. >> a lot of times people are advised not to give interviews beforehand. why do you think he did this? was this a good idea? >>guest: i think he had to do it because the prosecution released the information early in the week about this witness number 9 who accused him of molestation and the family was accused of racism and you do not want only one side getting their version out to the jury. beyond that, he has to testify because no one else can say what he can say. no one else can give that perspective. >> he said in that interview he was the only one that witnessed the shooting. the actual shots fired. >>guest: right, and he gave a very vivid version, more than we have heard to day as to the specific events. his head was being pounded

federally funded solar plant closes their doors after receiving help from the government. diane macedo is here with that story for us. >>diane: good morning, so, the company is shutting the solar plant a year after opening despite receiving more than $20 million in federal tax credits and grants. the las vegas review journal says they began selling equipment online yesterday and former manager tells the "wall street journal" the plant had 700 employees has idle since may. most solar companies blamed chinese subsidies for their inability to compete there were "a lot of quality issues and stuff coming back because of function at issues." the plant was highly touted by lawmakers when it opened especially nevada senator harry reid who blames the death of the company on the c.e.o. brian robertson saying many investors pulled back after he was killed in a december plane crash and

the company announced 200 lay off as month later but a representative said the plant would ramp back up by 2012. and the company received $15.6 million under a bush administration grant and more in tax credits under obama will join a growing list of solar companies that failed despite getting taxpayer money. solyndra received $535 million in federal loan guaranteed and beacon power had $43 million loan guarantee and abound solar got $70 million loan guarantee all bankrupt. so now they join these other companies. >>heather: the time, now, is 49 minutes after the top of the hour. next, terrorists find a way around the federal "no fly," list. they are becoming pilots. we have a live report on that and a weather man's worst nightmare. and that is not the ugly part. but, first, we will check to see

representatives homeland security subcommittee is baffled. >> there are foreign nationals in the united states training to fly just like atta and the other 9/11 hijackers and not all of them are getting a security background check. is that risk based security? i don't think so. >> in light of the discovery new security procedures are already underway. >> we found the t.s.a. has taken a number of positive steps to work in the area to help enhance security that general aviation facilities. >>heather: right now there are 500 u.s. citizens on that "no-fly list," and the t.s.a. does not have the authority to do background checks on americans who want to train at flight schools unless the person already has a certificate from the f.a.a. so the good news here, they did scoff the loophole and they are doing something about it. >>heather: we hope they close it quickly. thank you. >>heather: thank you.
