reportedly chasing the suspect before both of them fell over a retaining wall. the police officer fell about 100 feet. he's now being treated for a broken leg. right now, it's not clear why the officer was chasing the suspect but witnesses did report hearing gunshots shortly before the two fell into the gorge. the star of "the dark knight rises" trying to lift the spirits of survivors of the movie theater massacre in colorado. christian bale stopping by swedish medical center to meet with some of the patients. he also spoke with staff at the hospital and thanked them for all of their hard work. bale also paying tribute to the 12 people tragically killed attending a makeshift memorial outside the theater. alleged gunman james holmes remains in solitary confinement this morning. prosecutors continuing to build their case against him. we'll have a live report from aurora in the next half-hour. he's known to generations as george jefferson. actor sherman hensley, the patriarch of the ground breaking family "moving on up" in america

well as president obama went at it in their campaign mode for mitt romney, he had to go to a place the president was the day before. that's to address the vfw at which time he brought senator feinstein and senator feinstein made some headlines. you know she's chairwoman of the intelligence committee and she's been investigating along with many others into the leaks that have evidently come from the white house. everything from the -- >> yeah. everything from the kill list to everything appearing in that -- in that book that came out about our plans including the breakdown of seal operations. >> and here's the thing about these leaks. they do look political because all of them make the president look really, really good. and so keep in mind the white house has said, ok, we're going to have -- we don't need a special council. we're going to have a couple of u.s. attorneys, one from d.c. and one from maryland, they're going to investigate which some say is political. clearly they work for the attorney general that works for the president.

anyway, we'll play you -- we'll give you both the quotation. here first is senator feinstein on monday essentially taking aim at the white house for spilling the political beans, the secret beans. >> i think the white house has to understand that some of this is coming from its ranks. i don't know specifically where. but they're, i think, they have to begin to understand that and do something about it. >> and then up next, she again another statement just yesterday and we have this one for you, too. i did not believe the president leaked classified information. i shouldn't have speculated beyond that because of the fact of the matter is i don't know the source of the leaks. but, you know, this really brings up the issue of transparency as well which is something that the obama administration has promised from day one and if you'll remember, when everything went down with valerie plame, what happened

with then senator obama was he was calling for, you know, a special investigation outside of the bush white house. >> so there you had exactly the way it happened. you had senator feinstein on monday say, you know, looks like the white house is leaking it and then on tuesday say i am so sorry, she had to walk it back. i should not have speculated. >> right. and she made those comments on monday at the world affairs council. when governor romney had to come up with a foreign policy because he's about to go overseas and will not criticize the president and rightly so when he's overseas about foreign policy, he wants to make the problems he has with the president over the last 3 1/2 years and talk about his own foreign policy, one thing he did bring up is senator feinstein's comments. listen. >> it betrays our national interests. it compromises our men and women in the field, whoever provided classified information to the media. seeking political advantage for the administration must be exposed, dismissed, and punished. let me be very clear, these events make the decision we face

in november all the more important. what kind of white house would reveal classified material for political gain? i'll tell you right now, mine will not. >> and the rnc came out yesterday and said essentially that dianne feinstein had been cory bookered. remember cory booker, the mayor of nearby newark, new jersey, a very staunch and prominent democrat who at the height of all the attacks on mitt romney said, you know, you got to stop that. they are nauseating and a couple of days later, sounds like he was called on the phone by the white house and next thing you know, just like dianne feinstein, he's walking it back. >> let's talk about something else that the republicans are jumping all over and governor romney especially. that's the president's comments saying you didn't build that. talking about the obligation that most people who are successful have not done it alone. after all, the nation, the federal government has built the roads, built the bridges and sewer system. we're working this together.

you did not build that. that's an insult according to people like governor romney and many others for entrepreneurs across the country who took tremendous risk putting tremendous hours, had tremendous focus and sacrifice in order to be successful. now president obama knows how bad this is polling. knows how bad these comments are resonating, and tried to straighten it all out but instead, he seems to have doubled down. here's an example. >> we did not build this country all alone. we built it together. if mr. romney doesn't understand that, he doesn't understand what it takes to grow this economy in the 21st century for everybody! >> he said he was taken out of context, too. and all -- but if you actually listen to the speech, it kind of looks even worse if you listen to the whole speech but you get the president's true feelings about what it takes. maybe it's resonating with some people. >> and very often, you know, in a 24-hour news cycle, these types of strong words will cycle out very quickly, not happening with these words and maybe

that's because in his first comments, the president -- those comments didn't over so well. 72% of people think small business owners did build that. >> only 2% according to rasmussen think they don't work as hard. brian, you just brought up those comments. if you're -- you know, and keep in mind, the president has been out there and he's now got a political ad that is up in a number of the swing states where he says, you know, i've been taken out of context. don't believe what mitt romney is saying. all right. here's what the president said that got him into trouble with the republicans. >> if you've been successful, you didn't get there on your own. you didn't get there on your own. i'm always struck by people who think wow, it must be because i was so smart. there are a lot of smart people out there. it must be because i worked harder than everybody else. let me tell you something, there are a whole bunch of hard working people out there. if you got a business, you didn't build that.

somebody else made that happen. >> it just -- one thing, where is that coming from? i don't know many cocky people saying i'm brilliant, i'm the best. i think people work hard and understand you need some breaks in this world and the people that haven't gotten the breaks yet are not quitting. they don't believe the american dream has burst and doesn't exist. they believe they're on a path. it hasn't happened yet, perhaps, or happened, you went down and came up again. >> the problem with that soundbite, it plays into a lot of people's suspicions that barack obama is a big government guy and his entire career he never worked really in private business so he doesn't have sympathy for people who are in that. i wouldn't be surprised if ultimately, while the economy is the overriding issue, whether or not this question of where does prosperity come from? does it come from private business or does it come from the government? i think that's one of the real choices people are going to have in november. >> yeah and also, how do you deem success? is success being a billionaire? is it having a great job and working 40 hours a week and having a great family and making

$45,000 a year? i don't understand the context of the comments and why we're always talking about this, the american dream that's impossible to acquire and 72% of the people, that's the poll that went up a short while ago while anna was talking, 72% of the people, people believe that people who start small businesses are likely responsible for the success or failure. >> and a true gift to the romney campaign for sure and what we're starting to see in those other swing states, we're starting to see, you know, all sorts of attack ads using barack obama's words, you know, against him and probably continue to do so for the next few months. >> including for the next guest. one of our guests shortly, senator scott brown. coming up straight ahead next on the rundown, i should say, congressional budget office says obamacare will cost less after the supreme court ruling. that might not actually be a good thing. guess who is paying for, stuart varney is here to explain. he always gets here just in time. >> doesn't look happy about it.

>> there you are. thanks for being with us. 16 minutes after the hour. good news from the congressional budget office, the president's health care law will cost the president less than expected. >> that's good, right? well, there's some bad news. because it's going to cost businesses more and leave millions of americans without any health coverage at all. stuart varney joins us live. stuart, ok, so it's a -- it's a little silver lining there. but then there's some storm clouds. >> that was a neat headline. obama care costs less. >> that's the one that you saw. >> that's right. >> now look to the second line. the second line should read, yeah, obamacare costs less only

if you use less of it. this congressional budget office scoring of the cost of obamacare, report came out late yesterday, it says, look, because of the supreme court decision that says obamacare is ok, it also said states can opt out so the cbo says well, some states will opt out. they will not offer obamacare. therefore, less obamacare will be offered. therefore, obamacare will cost $84 billion less but it will still, therefore, leave three million people uninsured. what you've got here is an absolute mess of 15% of the american economy, we don't know what's going on with it. >> part of the fine print as well in this particular cbo report is that business owners are going to wind up paying $4 billion more in penalties or taxes and individuals are probably going to pay about $1 or $1.5 billion more in taxes

and penalties. >> when we started discussing health care reform, the primary objective was to get the cost of health care delivery down. >> that's how it was sold. >> that was how it was sold. that's what we needed to do. we have not done that. obamacare raises the cost of health care, the exact opposite of what it was intended to do. >> the other headline on this, too, is there is a woman who is part of the cbo that is actually an obama supporter? >> "the daily caller" dug this up. "the daily caller" says melinda buntin, the lady that did the calculation for this cbo scoring, she is the deputy assistant director of the cbo's health service department since last year, ok? she's a huge obama supporter. she helped write part of obamacare. she gave $26,000 to the obama campaign and democrats in 2008. >> so the cbo is supposed to be nonpolitical. >> precisely. it is the rules of the cbo that you are prohibited from parties and political activities. but this lady who wrote this

-- and both candidates started off by talking about the colorado shootings first and then the four veterans, you know, that were killed there and then they both went into, you know, their speeches. and obviously, i think nevada being a battleground state where they were both -- it was kind of ramping back up, you know, the campaigns and i think, you know, governor romney, talked about foreign policy and what he would do. >> and in the end, when you looked at both speeches back to back, major, who would you vote for if the voting -- if today was time to go to the ballot box? >> well, i think, you know, whoever you were going to vote for, you would probably still vote for. i think they both did what they came in to accomplish and whichever side you were on and i think with the veterans of foreign war, you know, i don't know if there's a whole lot of undecideds in that room but, you know, i think they both accomplished what they wanted to and whichever direction you were going to go, you were probably still going to go. >> you felt like governor was

hero in the batman movie, he came to visit victims of friday's shooting. christian bale made a surprise visit to the hospitals. he also stopped by the ever-growing makeshift memorial across the street from the theater. and there is new life that has arrived as one family copes with this tragedy. hugo jackson nedley was born at 7:11 mountain time yesterday morning at the university of colorado hospital where there are eight victims. five in critical including his father caleb medley. caleb, an aspiring comedian is in a medically induced coma. he and his wife katie went to see the batman movie as a last date before the baby was born. here's caleb's brother. >> we're all looking forward to this. we were all excited about this. and it is -- it is a silver lining to a very dark cloud. we know caleb. we know he's a fighter and we know he's not going to stay out of that child's life for any length of time. if he can avoid it.

>> good morning. >> first of all, what the obama administration is trying to do with welfare, saying -- we've got a list of activitys that they say would qualify as work. they say you could be getting bed rest and doing some motivational reading and getting a massage, writing in your journal, stopping smoking, losing weight, doing a pta meeting or helping somebody with chores. that's what it's come to. but this, what the administration is doing, robert is illegal. >> it's clearly illegal. the core of the 1996 welfare reform act was to say that at least a portion of the beneficiaries of the program, temporary assistance to needy families would be required to work or prepare for work as a condition for getting aid. about 85% of the american public agrees with that and when we put those requirements in effect, the case load actually dropped by 70% within a few years and

employment surged. but the left voted against welfare reform. obama is the president of the left. they've tried to do away with these work standards for 15 years and now they've used a clearly illegal trick to just wipe them out. they said we're going to waive these requirements. well, the law says no, you absolutely can't waive these requirements. they're the core of the whole bill. they're the core of the whole principle of welfare reform. but the left doesn't like them. the left doesn't believe that recipients really should be required to do anything and that welfare bureaucracies in the states which are not really dynamic agencies of change, they agree. they would prefer to just mail checks, the obama administration is saying yes, let's go back to mailing out checks. >> that's crazy. you just mentioned that poll. and let's put it up. 83% of americans say that people should work if they're going to wind up getting some welfare money. now, the way bill clinton was able to pass this was he was able to work with a lot of republicans to get it through

both chambers of the house. why is it, robert, that so many on the left say, you know what? if you're on welfare, you shouldn't have to work at all. why is that? >> they -- they believe that welfare recipients are the victims of social injustice, the victims of racism and that really requiring them to step up and contribute to their own lives particularly forcing them to do that is really adding insult to injury. it's abusing the victim. and in reality, that's not true. the recipient gains a lot by saying look, we're going to help you but we're going to expect you to take positive steps to improve your own life. everybody gains from that. the taxpayer and the recipient. but the obama administration, obama's clear goal is to redistribute the wealth and build a larger government. work requirements are an impediment to that because they keep case loads low. >> the one person we haven't heard from on this, bill clinton.

more frequently, you have to think self-rescue. the first responders, like if you've ever down loaded one, it takes 15 minutes and sometimes even hours for these guys to show up. you have to think self-rescue and get yourself out of the situation. >> you're somebody who you still combat park. you back into parking places and eat with your back against the wall. something that you do. another tip that you have, though, is you say you need to have a self-rescue mentality. what does that mean? >> that means you need to -- often times in these situations, people get frozen and paralyzed and they close their eyes and think the situation will go away or somebody will rescue them. it takes seconds to get out of that movie theater. you have to think and pull yourself out of that situation and think i need to get out of here. >> this suspect is 160 pounds and didn't have any formal training. what is the one thing that you should think about. you've got 20 seconds. >> i talk about a good tactical flashlight. this one in particular is a sure fire.

facility is spitting at guards as they walk by and therefore, is being forced to wear a face mask at times because of it. as for the investigation, the bureau of alcohol, tobacco and firearms had its agents at the theater again as did the f.b.i. the company that owns it, cinemark holdings has not commented on what it plans to do with the theaters. specifically theaters eight and nine that were impacted. additionally, we saw seven to 10 officials head back into james holmes' apartment building. they wore protective booties as they headed in. the folks who live there still cannot return and in all of this, new life. hugo jackson medley was born yesterday morning to a mother inside the theater at the time of the shooting. the mother was not injured. hugo, born at university of colorado hospital is one floor above where his father, caleb medley lies in critical condition and is in a medically induced coma. caleb's brother seth says the mother katie is exhausted but doing well.

colorado. couple of years ago, they tried to outlaw the death penalty and lost on that issue. i see there's about six different aggravating factors that could apply to the movie massacre here that would call for the death penalty. the first is that is it an especially heinous or cruel crime? did the defendant intentionally put the lives of others at risk in addition to all the victims? the defendant killed the victims while lying in wait. i think this is this case. the murder took place as persons were being held, chemical weapons and did he intentionally kill more than one person? multiple murders in the attack. so it absolutely does qualify for the death penalty. >> the question is for the death penalty, does the jury have to rule unanimously? >> it does. and the other important thing is even if he's acquitted on not --

even if he's not successful on the insanity plea and then he's convicted of the crime, his emotional state and his ability to know right from wrong will come into the penalty phase of the trial. so the jury for the second time will have an opportunity to consider his mental state at the time of the crime. you know, we hear this discussion, we heard it earlier about trying to find out what the motive was. and so you say well, why do we need the motive? we know what he's alleged to have done. we know what witnesses have said he's done. the motive is important because on the insanity defense, anger or hatred as a motive is excluded from the insanity defense. so if anger or hatred provoked his mental disease or defect, then he cannot take advantage of the insanity defense. so they're combing through records to see what's the basis of any anger at all, if there's a rational anger that caused

is that what is what's behind these changes to welfare and immigration? >> i can't get inside their heads, but i can certainly see the effects. take latinos, for example. back in 2008, obama carried hispanics and latinos by 36 percentage points much it was massive over mccain. guess what he's leading by right now among latinos and hispanics? 48%. so it's having some impact, obviously. these decisions have increased his support and there aren't many sub groups like hispanics. obama has fallen among many other key subgroups, between 2008 and 2012. >> steve: the big question is, will it -- okay. so he's very popular with these particular demographics, but do the latino, the people who are getting the welfare, are they going to wind up going to the polls first tuesday in november? >> i think that's one of the big questions, is the enthusiasm level the same as in 2008?

the early answer is no. in fact, it appears to be well down among many democratic groups from young people to minorities. so that's the other side of this equation. you also have to add that the largest group of all is still caucasians, still white voters and among white voters, obama lost by 12 percentage points in 2008. this time he's losing by at least 15 percentage points to romney. that's a giant group of voters. >> steve: in particular, the blue collar white voter. and has he made any headway or is mr. romney opening the field there? >> he's opening the field with blue collar workers. they've never liked obama. they supported hillary clinton in the democratic primaries in 2008. then you layer on this bad economy. by the way, that's the countercutting edge that the republicans have this year, even with minority groups. they can say yes, you may
