violation but not punished in any significant way. the obama justice department refused to pursue criminal charges against the black panthers although there was strong evidence that they did violate the law. attorney general holder saying there simply was not enough evidence to charge the men in federal criminal court. but some believe that's not true. and politics allowed the panthers to get away with it. >> was there any political leadership involved in the decision not to pursue this particular case any further than it was? >> the decisions were made bylor let that king in consultation with steve rosenbaum who is the acting deputy assistant attorney general. >> bill: assistant attorney general perez who you just saw there is now in big trouble for making that statement. that's because the watchdog organization judicial watch filed a freedom of information foia and they received documents they obtained evidence that federal judge

reggie walton says indicates political pressure was in play. judge walton writing, quote: the documents reveal that political appointees within doj were conferring about the status and resolution of the new black panther party case in the days breeding the doj's dismissal of claims in that case. which would appear to contradict assistant attorney general perez' testimony that political leadership was not involved. in that decision, unquote. because of judge walton's ruling mr. perez may be investigated for perjury. but no matter what happens, this is another political embarrassment for the obama administration and attorney general holder. it is widely believed that mr. holder blends justice with politics at times we say that without any agenda. praised the justice department for charging andrew goodman with federal crimes, circumventing a new york

judge's insane two year prison sentence which would have put the monster back on the street within weeks. we'll have more on that in is it legal coming up. so we are not anti-justice department people here. however, this black panther thing should have been prosecuted no doubt people were intruding on apology place. video proves it now we find out the decision not to prosecute had political implications. very bad news for attorney general holder and his friend the president of united states. that's the memo. now for the top story tonight. let's bring in the president of judicial watch tom fenton, the author of the new book the corruption chronicles, obama's big corruption and big government. he joins us from washington. so what do you think exactly happened here. you know, the bush administration didn't charge the panthers criminally they could have. they charged him civilly. panthers gave the finger to the system.

didn't even show up. the system didn't do anything to them. then president obama takes over. the thing is still percolating the obama justice department does absolutely nothing. what happened inside all of that? >> filed civil case at the end of the bush administration. the obama people came in and dropped the civil case. so, in addition to not pursuing criminal charges civil charges dropped by the obama people and documents we obtain show a top official named sam herb seemingly orchestrated the effort to drop the charges. there was philosophical objections on the part of leftist generally there has been testimony about where they don't like these civil rights laws being applied against black people. they are designed to be applied against white people. that's the argument of the justice department. >> there was a hearing in federal civil court where one

of the two panthers that you saw in that tape was sanctioned, said you can't go within 100 yards of a polling place or whatever. it was nothing. that happened under the obama administration. but it was a joke because nothing really happened. they just ignored everything. they have you had been held in contempt because they didn't show up. now, sam hirsch. who is sam hirsch? who is that? >> he is a top official at the justice department. he was a deputy to the number three official. he is a former obama donor, democratic lawyer, active in litigating on behalf of the democratic party interest. now is he in the justice department making decisions like this. and he. >> bill: why we have that kind of clout though. you shaw perez. perez goes in and says no, no, no. politics had nothing to do with it. we just didn't think there was enough evidence. come on. but why would hirsch have that kind of power? >> because he was the boss of all the folks who were making the decision as to what to do

against the black panthers. not only that he was informing and collaborating and conferring with his bosses, including tom pirelli, again, another close obama guy, raises a boat load of money for obama. >> bill: these guys aren't fbi guys. these are appointees that get jobs in the department of justice. but you have got it think that holder, the attorney general because of the profile of this case because it was done on the fox news channel and some other news agencies, he had to be following this case. so, i mean what everybody wants to know is the president of the united states and the attorney general of the united states tell the justifiable department we don't want to do this. we don't want to go after these guys. is that possible? >> well, i don't think they need to. holder was certainly briefed on the case. there is two documents showing he was briefed at least twice. between pirelli and hirsch, the political side is covered. per refusally is an old obama buddy back in his days in the

harvard law review back at harvard. and he is the top obama guy in terms of helping him with the transition at the time. between the bush presidency and the obama presidency and obviously was appointed number three at the department of justice. in fact, emails show that pirelli was very active talking about these, this case in the days before it was dropped. i don't know -- perez came in after the fact. pretended none of these political people were involved and perez himself is another democratic activist. he ran for public office in maryland. >> bill: but perez is in trouble now i don't think under this justice department he would be but he could be charged with perjury because he testified under oath in front of the civil rights commission and said no, none of that. >> this -- his false testimony it. i think it's false testimony. it's been out there for some time. the justice department has refused to act on it. and this latest piece of litigation they are still defending what perez said despite all those emails that

in illinois. three years. >> longer than that i mean this happened. >> bill: he was charged. >> in 2009. >> bill: right. and it's 12 now. so why did it take so long? >> may i back up just for a second? wasn't charged until 2009 because it was ruled an accidental death. until 2007 when the fourth wife went missing. stacy peterson. then they reopened. then they charge him in 2009. is it still took a couple years to get enough evidence according to the prosecutors. they charged him in 2009. then the legal wrong blinks started with all the idea bring on. can you bring in hearsay statements? when somebody is available to take the stand and, you know, they should be the one testifying. if if you have murdered somebody than here say gets thrown out because obviously the person is una.b. available. >> bill: took three years to decide what evidence could be introduced. >> yes, appeal court after appeal court. >> bill: never heard of that you have heard of that. >> no justice excuse for this. >> bill: just incompetence by the illinois state court? >> i don't want to cast

how did he feel about the sentence. >> the factor spoke to the prosecutors in this case and they were astounding and outraged about this case. you had in this case two victims that were willing to prosecute. willing to cooperate. >> prosecution did not sign off on any deals with the judge? >> absolutely not. they filed objections with the court objecting to the intended sentence. >> this is wrong, we don't want it. >> yes. and they had state of new york the judge can override all of that and impose -- this guy could have gotten life, right? >> he pled guilty to all counts. >> bill: 48. >> open plea to the courts. there was nothing left for the prosecutors to work with to proceed on those separate charges. >> bill: still, 48 felonies of child rape sends you away for life in a decent society. >> it's absolutely outrageous. this hand should not be on the bench. this is a miscarriage of justice committing crimes against children. >> you are making the case for mandatory minimums here especially for these kind of

charles krauthammer said that president obama returned a bust of winston churchill to the british embassy of washington. well, obama administration lashed out saying that wasn't true the bust remains in the white house. there is an interesting twist to this story. joining us from washington is charles krauthammer. this is the tale of two busts. this could be ago that ago that christie here, correct? >> well what happened to bolster their charge that i was spreading a false rumor what i said was 100% false they showed a picture of obama showing david cammeron two years ago a bust of churchill in the white house residence. so that was to back up the story that it wasn't sent back to the british embassy. it was actually just moved in the white house. we found out by asking the british embassy as soon as the white house unleashed this attack on me and the embassy said no, the bust is in. the residents of the british

ambassador and has been since the beginning of the obama administration. as the british press reported at the time what happened after 9/11. britain had loaned to bush a bust of churchill as a show of solidarity for one term as the term expired they extended the for a second term. when obama won the presidency. the british government offered to extend the loan to obama but the obama administration said no. and it was returned to the british embassy. what you saw in that deceptive picture was another churchill sculpture that had been given to the united states in the johnson administration had been there for 50 years. >> bill: wasn't the one that you were talking about? not at all. been there for 50 years and kept in the collection and kept in the residence. >> bill: here is the back story, some people believe that some people don't like british churchill because of
