on your side. i know that they get cranky and they are looking for things to write about. one thing i thought was interesting that we have seen over the last couple of days, these e-mails are coming from the obama campaign. i have seen one on rob portman and the other was on marco rubio. saying that these two guys might be on the shortlist for bp. they are from your state and it looks like they are targeting people in ohio and florida. if you have any bad experiences with them, we need to know now. it is almost like they are enlisting the general public to help them do opposition research. >> it is just another way to fund raise and to get the grassroots fired up and to say -- i assume what they will get back is that these are terrible republicans and two concerted and rotten, rotten, rotten because they don't want people to have health insurance and stuff like that. that is most of what they will do it. this is mostly a way to engage them that way. you can better believe that there is an army of opposition research who have poured through everything these people have

done. every public interaction, anybody on the shortlist. that is the job of the folks in boston. they have to be just as good. the romney campaign has to be just as good at weeding out any potential scandal a problem because they definitely don't want to be caught unaware. shannon: i cannot resist to ask. this rumor out there that someone within the white house, maybe even the president himself, allegedly thinks that general betray us could be on the shortlist for vp. >> let me put it this way. it is not the greatest assertion possible. he is the best known military men in the united states. general david betray us. and he he would certainly help his public an ability on foreign issues. we don't know yet, but it lines up very well with some things that would be good for mitt romney. this is what the next 10 days will bring if romney picks his

taxpayers taxpayers shouldn't be here for. in fact, the entire immigration system massively violates that. the government does not enforce that public charge provision at all. for example, one third of the immigrants in the united states today are high school dropouts. those households will receive at least $3 in government benefits for every dollar that they pay in taxes. over the course of a lifetime, they trust the u.s. taxpayer, it cost them about $2 million per household. it is extremely expensive, it's a burden. but the immigration system says come on in, the more the merrier. shannon: if someone appeared illegally in a due process of some kind of federal aid, is immigration status taken into account when a decision is being made, whether or not to issue them benefits? >> yes, it is. illegal immigrants, per se, cannot get welfare benefits. but many illegal immigrants have children that they have in the united states, and those children are eligible for all

welfare as well as free public education. this means that those illegal immigrants pose a very strong cost on u.s. taxpayers, as well as taking away 426 million jobs from americans who need jobs. shannon: in this letter, inton say that going through the paperwork, two of 80 welfare programs are factored in. when they are asked about are you on this kind of assistance or help. is that legal? we have laws that state something otherwise should be done when they are screening people? >> the general principle of the law that has not been enforced and is completely disregarded by the obama administration is that you are not supposed to have an immigration system that brings in people that are going to be a net cost on the u.s. taxpayer. our immigration system in general disregard for that

entirely. for example, at least half of the immigrants coming into the united states are either high school dropouts or have a high school degree only. those individuals on average would receive about $10,000 per year in welfare benefits. they should not be here, according to the law. but the law is basically ignored. shannon: is this something you mentioned specifically? something new to the administration or the chipping away, has it been enforcing the law on the books? something that has been happening for a long period of time? >> it has happened for a long three of time. in fact, close to halfimmigrante last 20 or 30 years really should not be here, invisible, because they are a cost on the taxpayer. the obama administration has put frosting on the cake by aggressively promoting the use of these welfare benefits among

immigrants. shannon: i want to ask you about that. senator sessions signed on to this letter and he raised concerns that there are programs here in the u.s. that they are essentially immaterial that are reaching out to people that are not here legally. saying that we have benefits come you should take part in those benefits, that is his primary concern before you get to how it impacts applications. the usda took down those materials are made some change. do you think this administration, when confronted with these issues is going to be willing to back off on some of this? >> no, they have no intention of enforcing the public charge provisions whatsoever. they treat them as a kind of pointless joke. the reality is that, for example, in a program like food stamps, if you are an illegal immigrant parent and you have a child that was born in the united states and they are about

caused hours of delay for stranded passengers. that woman is nowhere to be found. trace gallagher is here with the latest. reporter: i can tell you within two hours, tsa made two major wonders. the first one happened at 8:45 a.m. sunday morning. that is what we were talking about during the culinary screening process. the woman tested positive for trace explosives and then somehow seriously the tsa, they simply lost track of her. she made her way inside the terminal and of course, it took a while, but the airport went into alert mode. they put the airport on lockdown. one hundred flights were canceled, dozens more delay. the woman they were looking for had already gone on the plane, flown and landed in cleveland. she was never questioned were screened and never id. the passengers come as you can see there that did get rescreened and delayed were not happy. >> the whole terminal was

jampacked. it was hot and sweaty. just not really very happy. tsa was not giving much information. >> it concerns me that we are still having issues like this in the international airports. especially with the screening procedures. >> two hours before the tsa lost the woman who tested positive for trace explosives, they lost a bag that had tested positive for trace explosives. the flyers again had to be rescreened. that bag ended up on the tarmac. he took the bomb squad about 2.5 hours before they could clear the bag. this is the very same airport that back in june, seven tsa agents were fired because they were sleeping on the job. congressman peter king says this is absolutely unacceptable. shannon: something tells me it will be. thank you very much. a new twist and a raging debate

shannon: and fox news alert. jay carney was repeatedly pressed about controversial comments from senator harry reid. the governor mitt romney hasn't he taxes for a decade. here is what mr. carney had to say about it today. >> i think the dispute here is between the romney campaign and harry reid. senator reid is, you know, he

shannon: a center of the first amendment finds itself having an issue over a cross in this town. a copy attention of a group called the americans united for the separation of church and state. they are threatening to sue if the cross is not taken down. it was erected two years ago, and local reports say the town wants to salvage the property to someone who is willing to let

the cross stay right there on that land. new questions on whether the university of colorado can be held responsible in the mass shooting in the movie theater. a new report suggests that james holmes's psychiatrist warned authorities of what she described as his bizarre behavior. while it is not knowing what the information dead, to police outside that realm of information or anyone else. we have a guest who is going to join us with an insight on this. professor, think you for joining us. she was still worried, the psychologist was, that she did reach out to a police officer. how concerned would she have to be to make that call? >> she can break the confidentiality only if she knows it is a serious threat of

imminent violence. since she talked to the cops, we know that in her mind it was there and she is under an obligation to prevent them do what she reasonably can to prevent the tragedy, so far as we know, she didn't do it come the cop did not do it, the behavioral analysis unit, which is supposed to do exactly that, also didn't follow up, even though there were obvious signs and finally on top of that, as fox has reported before, the university was apparently negligent in delivering to the psychologist a package, which it delivered on time, might have prevented the tragedy. yes, there is a strong chance that they will be soon. certainly it is a more viable defendant. they have more money and are more likely to settle to avoid the embarrassment of further evolutions in the trial and other situations have done. shannon: you touched onhis. within the university they have a behavioral evaluation and

threat assessment team called the data assessment team. they held a formal meeting, specifically about the alleged gunman in a case. there is speculation that maybe they didn't follow up because they eventually had him drop out of the university, he was walking away from the school. would that absolve them of any liability if they no longer go there? it seems to me that we have somebody who was forced out of a prestigious program and the university. he loses his only income, so far as we know, and he is being forced out of the apartment. these are what we call major stresses. the analysis team should have followed up. and they should set with all this going on, isn't getting any worse? they did not. many experts think they should have. that wasn't brought up in the trial. once again, in many of these cases, most cases, the university settle rather than getting to court and having these revelations come out and

have the embarrassment of the trial. in this case, the university had the head of this program somebody who had been reprimanded for mental health abuse. -- drug abuse. he wants all that coming in from the courtroom, coming before a jury? shannon: what kind of legal issues with the university be facing and what kind of damage and? you mentioned negligence? are there additional things they you think the victims or survivors with soup or? >> i think the major charge would be one of negligence. there are other collateral issues. the extent to which university has a duty. the university is liable whenever one of its students does something. but most universities have to take reasonable care to prevent things like this from happening, whether it is this kind of violence or something simpler like sexual harassment.

also in colorado there is a thing called sovereignty, which women and the amount of damages but the university could settle for those damages if they want to import the embarrassment of a trial, which is what is happening at penn state right now. robert morris has been hired to provide a report, just like penn state hired someone as well. the university is settling, and the same thing will happen here with the university of colorado. shannon: we will take a close eye to this and keep an eye on it. a disturbing new investigation may be shedding light on the union position. speaking with the reporter behind it all. about some of the e-mails that he said revealed the administration cut benefits for thousands of nonunion retirees, in order to save money for their union counterparts at one of the world's largest automotive parts manufacturers. olympic gold wasn't good enough

let's check in with scott rasmussen and joe trippi. the manager of howard deans's campaign and a fox news contributor. scott, it looks like a dead heat overall but what does it say when you dig inside the numbers. when people were asked whether our best days are ahead or behind, and more think behind than ahead. >> that's right. the race for the white house is a tossup. there is a lot of economic reports that will come out between now and elect days that are likely to have a big impact on who wins. but only 32% think our country's best days are the future. there is a growing sense of desperation across the country. normally you would say that's very bad news for the incumbent. only a third of the voters say if barack obama is reelected the economy will get better.

but it's also bad news for mitt romney. there is a sense out there that neither of these guys knows what's going on and that's where the frustration comes in. shannon: despite the pessimism about moving forward and who can do best with the economy, the president in a lot of important polls continues to pull ahead. this one is within the margin of error and there are key swing states where he seems to be doing well as well. so it seems like the president must be doing something right to overcome the doubts about his leadership or our economy. >> one of the things the obama campaign has been doing is keeping romney so off balance. raising -- harry reid doing the tax stuff on him and all these other issues that are where romney can't get it to the fight that he wants to make this campaign about. that's one of the reasons not only is it a tie statistically.

but why in the past few weeks you have started seeing in ohio and michigan and wisconsin, the president starting to drift up a little bit towards that magic 50% number that should cause the romney folks some fear if that keeps going on. it's clearly will be it is about the economy and scott is right. there are a lot of jobs and other things that will come out between the elect that could snap this thing right back into a situation where bad economic news gives romney a boost. but right now the obama campaign has done a pretty good job of keeping them off balance and that's one of the reasons you are seeing this discrepancy between how people feel and what we are seeing in the poll numbers. shannon: scott, you track this day by day, probably hour by hour sometimes. are you seeing trends in a specific direction one way or

hospital-based practices and sometime those practices are taking medicaid. but it's a problem. 17% of doctors aren't going to take new medicare or private insurance. there is a doctor shortage looming nobody is talking about. i don't think the healthcare act is going to be able to handle all these moving parts and really handle it. just because you have insurance doesn't mean you have access to care. shannon: a lot of places aren't interested anymore. you can pay cash or figure out something else. you mentioned the shortage of doctors. something that keeps bubbling up that people are worried there aren't as many people getting through medical school. and taking the chagellen of being a doctor and dealing with the complications. how concerned are you about the next generation. the next wave in encouraging people to get into the medical field. >> for a while back when managed care first started they thought everyone would be so healthy and

they held medical slots to a steady stake. now they are trying to increase medical school slots and encourage people to go. but there is a predicted shortage, 90,000 by 2020 and 2030. there are four years of college and medical school. then 3-4 years of training. once you are already kind of behind the 8 ball it will take years to catch up. shannon: if we had the influx we needed, the reimbursement rates won't so great. >> that's an issue. these are the most vulnerable population. there is the indigent population. there are children. so it's an issue. once again as an e.r. doctor we don't turn anybody away. we end up caring for these patients. if there is a serious problem you will be able to get care in this country. but just going out and finding a doctor. i have friends that tell me they

can't find an internist. they have private insurance. people aren't expecting new patients and doctors are get together age where there is retirement. besides there are not enough new doctors coming in. so it's something that we have to look at. it's very come mid-atlantic. i don't know just the healthcare law is going to be able to manage it all. shannon: do you think the reimbursement rates will change in any foreseeable way so these doctors will be encouraged to treat those folks? >> besides the reimbursement rates having to go up, we have to hold healthcare costs down. part of that is liability reform. nobody is addressing that in the new law. so it's a combination of things that have to come together. if they don't it's like a perfect storm waiting to brew. shannon: doctor, thank you. we thank you for being willing to treat folks when they need it most. a school program that offers a free lunch for low income
