deliberations a juror has been dismissed accused of looking on-line for what would constitute juror coercion. she claims she was being harassed by fellow jurors. members of the city council are accused of inflating their part-time salaries up to $100,000. hernandez claims he was too uneducated to know his actions were wrong. the jury must start deliberations over again. >> talk about an unlikely pair. dennis rod man is no stranger to the spotlight but this time it isn't for his wild behavior. as you can see, he's sitting court side with north korean leader kim jong un. rodman is there filming "basketball diplomacy." >>brian: you know what kim jong un said?

he believes it can bring our countries closer together. they hit it off. they had that magic. >>steve: can we live without him? >>gretchen: he's been out of the news for awhile. i think we can hand him over there for a couple of years. see if he can get something done. >>brian: we'll follow dennis rodman. also if we have time, sequester talk. no deal as of late. the deadline without lawmakers reaching a deal. at 11:59 tonight it will kick in. >> remember, large majorities of both houses of congress voted in favor of the budget control act knowing that if the debt-reducing super committee failed then sequestration was possible. that super committee did fail back in 2011 and fast forward to yesterday when congress adjourned for the weekend with no deal in place to avoid the automatic cuts that go into effect by midnight. republican senator lindsay graham said the white house

and congress share the blame for what's coming. >> you've got one obligation that nobody in this body has. you're the commander in chief of the united states. they trust you. they need you. how any commander in chief could have been comfortable with the idea that if the super committee fails we're going to gut the military, and you haven't lifted a finger in the last year to do anything about it, this is pathetic leadership by the commander in chief. this is an abandon. republican party's belief of peace through strength. this is the low point of my time in the united states congress. >> but president obama doesn't think any of the pain caused by sequestration is his fault. he released this statement last night that placed the blame squarely on the shoulders of republicans in the senate saying -- quote -- "republicans in the senate faced a choice about how to grow our economy and reduce our deficit. and instead of closing a single tax loophole that benefits the well-off and well-connected, they chose

to cut vital services for children, seniors, our men and women in uniform and their families." the president will meet with the leader of the republican senate he blames for sequestration -- mitch mcconnell -- four hours from now. speaker boehner will join them as well democratic leaders harry reid and nancy pelosi. but remember, congress is presently adjourned until monday. >>steve: peter, thank you very much. we've heard charles krauthammer say the thing the white house is worried about is the sequester happens and america doesn't really notice beau the changes are -- notice because the changes are so minute. but maxine waters said up to 170 million people will lose their jobs. we're going to have a lot of people from other countries come in to lose their jobs for that number to work outs. i ask you a question. who said this yesterday: rise up, oh god, and save

us from ourselves? >>steve: dennis rodman. >>brian: no. barry black, the house chaplain, said can we please stop the sequester and save us from ourselves. because that is what is happening. aufplt cuts are -- automatic cuts are going to kick in. what do you think about controlling the spending? fox news did a poll. where do they find the time. they asked this questions: voters were asked is sequester needed to make congress cut back on spending? most of you said yes. 57% only with automatic cuts. 29% lawmakers can do it on their own. they never have. 14% unsure. >>gretchen: these are educated people answering this question because they realize the senate has not passed a budget in however many years. to an extent they're correct. they need help to do this. is this the beginning of the help or is it going to happen in the wrong way?

here is another question: prefer new budget deal? what would you prefer the new budget deal to focus on? only on cutting spending? 33%. mostly on cuts, some taxes. 19%. an equal mix of cuts and taxes. that is what the president is banking on, that 36% number. he keeps talking about fair share, equal balance, a mix of cuts and taxes. that competes directly with only cutting spending. >>brian: we opened up phones yesterday on the radio. people were saying why don't they give the president more power. they tried to give the president more power. their last suggestion was let's give the president power to put sequester aside and let him cut where he needs to cut to get to the $85 billion. that got voted down 62-35. the democrats wanted to replace cuts with higher taxes on millionaires. that won 51-49 but you need 60 votes. >>gretchen: the president himself said two days ago he didn't -- amazingly so

he said as the leader of the free world that he did not want the power to have to make these decisions, even though he could have had the power in an executive order and chosen which way these cuts would actually happen. >>steve: because he wants to blame the kwepbz. -- republicans. meanwhile the "wall street journal" says bob woodward has been -- quote -- "ex-communicated from the revelation church of obama. why? because he simply dared to tell the truth in his book and in a column in "the washington post" this past weekend he said the sequester was the invention of this white house and it came down to revenues and the sequester, they have moved the goal post." yesterday we talked about how he was in a tussle with gene sperling, one of the president's economic guys. and gene sperling yelled at him for about half an hour and wrote him an e-mail where he said you're going to regret doing something you believe in. some thought that was a threat. last night with sean hannity he explained

exactly how he did feel. >> it was a half-hour in which he was shouting at me. i've known him for 20 years, and i e-mailed back, i don't worry about shouts, but he was really worked up. and then he sent me that e-mail apologizing and saying i'm going to regret taking this stand. the problem is there are all kinds of reporters who are much less experienced, who are younger. and if they're going to get roughed up in this way -- and i flooded with e-mails from the press saying this is exactly the way the white house works. they're trying to control and they don't want to be challenged or crossed. >>steve: he's concerned about the intimidation, and he does say that this is not the way to operate. >>gretchen: when something like this happens, usually it's the tip of the iceberg. now we're hearing from other people who say they also have gone through the

same kind of treatment. specifically manny davis, another democrat. you remember his name because he worked within the clinton administration. he says that the "washington times" -- that the white house threatened "the washington times" because he had a column in that particular newspaper. he claims that they would suffer limited access to white house officials and might have white house credentials revoked if they didn't change and take his column basically out of their newspaper. he talked about this for the very first time yesterday. >> received a phone call from a senior obama white house official who didn't like some of my colleagues, even though i'm a supporter of obama, i couldn't imagine why this call was made. and he did threaten. what i was told was the word threaten by this editor, that if he continued to run my columns, he would lose or his reporters would lose their white house credentials. >>brian: lani davis yesterday. he went on o'reilly and said could i release the name of the person who offered the threat. the guy said i rather you

not because i don't want to cause a dust-up with the white house. i want to keep my access. lanny davis said i looked at my writings. 90% of it was complementary towards president obama and was shocked. >>steve: roger goodell was a reporter for carter in the 1970's. he wrote a column called woodward versus the white house. he says this president is the closest thing to richard nixon we have seen in something like 40 years. he says while obama may not share the nixon pedigree, he and his white house are the closest thing to the nixon regime of anything we have seen anything since then to the extent of their paranoia and their willingness to push the boundaries of the law. >>gretchen: he says he was on nixon's enemy list

>> the sequester will weaken america's economic recovery. it will weaken our military readiness. and it will weaken the basic services the american people depend on every single day. >>brian: while president obama warning voters that without the deal on sequester massive budget cuts will jeopardize our massive r national security and military. we have no deal so far, so what should we expect in the military? joining us is the senior enlisted advisor of the civilian joint chiefs of staff. welcome. how does th-fl inside -- how does this feel inside the pentagon? >> there's worry and concern. we're all sitting on the edge of our seats. if sequestration is triggered, we're all going

to get stung as the department of defense. >>brian: do you ever say to yourself how do you get us involved in this? no matter what the costs are, why is the military forced to shoulder 50% of those cuts? >> we are part of america. over the past decade we were fighting a conflict in iraq and afghanistan. as you've heard maybe the saying freedom is not free. we have an obligation to our country. i think there's an obligation to its military as well that we have to remain ready. so despite whether skraeugs is triggered -- sequestration is triggered or not, we have an obligation to our nation. >>brian: this could happen at 11:59 tonight and you guys are known as planners for all contingency operations. what changes monday? what changes in two weeks? three weeks? >> there's planning in place. we're going to keep our fingers crossed and hopefully an agreement is reached before 23:59 tonight or just before midnight. if sequestration is avoided

and we have as a military department the $468 billion over the next ten years, we have a pretty good plan for that. it's going to hurt, but we can do that and maintain some degree of readiness for our nation to protect our homeland and borders. >>brian: when they don't bring the aircraft carrier into the persian gulf because of dollar concerns, people think that's political posturing. is the pentagon involved with political posturing? >> well from my standpoint and my perspective, i don't get involved in the political posturing aspect of it. and so the decision, one made by the chairman of the joint chiefs of staff, secretary of defense and chief of naval operations, to delay the appointment of that carrier and its accompanying ships, not necessarily a political decision but the best interest of our force. >>brian: right. and what do you have to say to the american people when they talk about readiness to fight two wars at one time? is that now off the table after decades of being ready to do just that?

killing the driver who crashed into a taxi. the two people inside that cab also killed. >>brian: how do you keep students safe at school? have the police move in. that's what a town in minnesota decided to do. officers are setting up satellite offices in jordan. the hope is armed officers will scare off attackers. the city council and school board voted to approve the plan. >>gretchen: he carried a gun in vietnam but now the vietnam vet is being denied the right to own one? jeffrey schrader got into a fight with navy buddies before being shipped off to war in 196. he was charged a misdemeanor. 45 years later he wants to buy a gun but that misdemeanor landed him on the firearms ban list. >> i looked at everything trying to figure this out because it didn't make any sense. >> he says he's an avid fisher man and a hunter. >>steve: it's the video

because right now it's 25 in minneapolis, 27 in chicago, 29 in k.c. 36 in atlanta. taking a look at what it feels like with the winds, it feels like 17 in cleveland and 15 in minneapolis. it's going to remain cold through the weekend and into early next week. freeze advisories in place for georgia. that is going to spread eastward and southward. 32 in atlanta for low tonight. it is going to dip as far south as miami. 15 to 20 degrees below average. we don't have major storm systems right now. just lingering snow across the ohio river valley and in towards the interior northeast. we've got a system moving into the pacific northwest. that will be our next weather maker as we head into next week. we are tracking the potential for maybe a mid week nor'easter. winter not over yet, but spring is just around the

i think it's a combination of these cuts are really worrisome for a lot of people in the establishment, plus it reflects the kind of poisonous nature of our politics now. everything gets magnified. everything becomes hyperdramatic. it is symptomatic of that syndrome. >>steve: when franklin delano roosevelt was at his inauguration in 1933, the country was in deep financial trouble, and he very famously said this: >> the only thing we have to fear is fear itself. >>steve: nick, i think a lot of people who are listening in on the radio and they're in attendance in washington, d.c. felt reassured and said we're all in this together. >> that was f.d.r.'s inaugural speech in 1933. it was one of the great lines of the presidency. and he chose to talk about conquering fear and

relifting the american spirit rather than getting into policy or blaming hoover and it worked. he got the american people on his side. he got the new deal program. it is kind of the memorable line from his presidency. >>steve: yesterday on this program we had phil gramm who rephraoeupbded us in 19 -- who reminded us in 1986 there was a sequester that kicked in. he was pretty much the guy who wrote the bill. the government did close down when bill clinton was president and he said this. >> we can balance the budget without doing what they seek to do. we can balance the budget without deep cuts in education, without deep cuts in the environment, without letting medicare wither on the vine. what's your analysis of what he was saying right there? >> and he took a lot of heat for that. you remember speaker gingrich and others on the right said you're scaring older people about the wither on the vine about medicare. that was pretty dramatic language for back then

which if you compare to the rhetoric now it seems tame and mild. he was making the case that these cuts will be unfair. they'll hurt people unfairly. was it effective? president clinton won that budget showdown. the government closed down. he sort of came out of that unscathed. he went into reelection and won big. one could say that worked. whether it was politically correct or fair is a different story. >>steve: nick, it does seem like it's kind of a 180 from what this president is doing. and this president has got a compliant mainstream media that isn't really questioning what he's saying. >> i think bob woodward tried to question a little bit. that's turned into a story. i do think as we get closer to the deadline people are taking a closer look at what the white house is saying, what the congress is saying. i think this is a reflection of how poisonous our politics have become. >>steve: i think you're right. nick ragone, thank you for dropping in. have a great weekend. it's now 11 minutes before the top of the hour.

>>gretchen: welcome back. some parents in massachusetts are upset after receiving so-called fat letters from their kids' school system. the controversial letters are sent to the homes of kids who are deemed to be obese by state standards. tracy watson received one of the letters about her ten-year-old son. she joins me along with letter son cameron. good morning to the two of you. >> good morning. >>gretchen: i'm looking at you cameron and you look like an average fourth grader to me. i don't see anything obese

about you. in fact you were born a preemie. tell me about this letter. >> it says i fell into the obese category. >>gretchen: mom? tracy, how could that be? >> hi. it's -- the letters are mandated to the school systems by the department of public health here in massachusetts. and they're based solely on b.m.i. testing. b.m.i. testing without a doubt has its flaws. so cameron ended up falling into the 95th percentile which puts him in the obese category. >>gretchen: let's take a look at how you break down b.m.i. that's body mass index. it's the amount of body fat based on your height and your weight. if you're less than 5% you're underweight and then so-called normal, even though i hate that word, 5% to 84%. overweight, b.m.i. of 95 to

94%. obese, 95% and above. tracy what was your reaction when you found out the little boy you live with every day is obese? >> when we first received the letter, my husband and my initial reaction was to laugh because we live with cameron every day and we know how active he is. my second reaction, though, was where is this letter exactly coming from? why is it coming? and how much does it cost us to send these letters? >>gretchen: good point. it actually comes from the government. i understand that parents in your school tkreubgt, you're supposed to have the abiy to opt out but you say you were never given that notice? >> i don't recall receiving the opt out letter. with all the parents i've spoken to, and we've spoken to a lot of parents across the state recently, everyone remembers getting the letter but no one remembers getting the

opt-out letter. >>gretchen: what kind of impact can this have? the other side of the argument is some kids who are overweight, there is a problem in our country and so maybe some of those parents arguably could be getting letters, maybe that might be a good thing. so what happens in this case when it is inaccurate? what does that do to the psyche of the child, to the family, et cetera? >> we're not fighting the fact that we're a fast-food nation and there is a weight problem with some children. but what bothers us most is that all of these letters and all of these statistics in massachusetts are being based on b.m.i. only. any good doctor, any good nutritionist, any good trainer will tell you that you can't base someone's health on b.m.i. only. what we saw was that it really affected some children in a detrimental way. >>gretchen: i can imagine. cameron, how did it affect you? >> well, it didn't really affect me because i know

and is about to go, the sequester gets rung in at 11:59 tonight. but he's blaming congress at the same time. peter doocy life in washington. >> by the time congressional leaders meet with president obama at the white house this morning at 10, sequestration will be 14 hours away, but these automatic and across the board cuts and the rate of spending growth have been a possibility for 18 months ever since overwhelming majority of both houses in congress passed the budget control acts with the understanding that if the debt reducing super committee failed, sequestration would happen. that committee did fail and lindsey graham is now saying everyone in washington is at fault. >> you've got one obligation that nobody in this body has. you're the commander in chief of the united states. they trust you. they need you. how any commander in chief could have been comfortable with the

idea that if the super committee fails we're going to gut the military and you haven't lift add finger in the last year to do anything about it. this is pathetic behavior by the commander in chiefment this is the low point in my time in the united states congress. >> today's meeting at the white house will include senator harry reid, congresswoman nancy pelosi, speaker of the house john boehner, and senate minority leader mitch mcconnell whose caucus is being blamed by president obama for not voting on a bill to replace sequestration. president obama said last night republicans in the senate faced a choice about how to grow our economy and reduce our deficit and instead of closing a single tax loophole that benefits the well off and well connected, they chose to cut vital services for children, seniors, our men and women in uniform and their families. president obama says today's meeting at the white house will be to talk about a path forward. but it will be tough, not impossible, but tough to turn any sort of agreement they make

into law because congress has adjourned until monday. >> gretchen: thanks very much. we asked you this question, i think this is very significant. what do you think about whether or not congress could trial do these cuts on their own? do they need something like southwest tore get the ball rolling? you say yep. that the only way you'll get cuts on capitol hill is with automatic cuts. 57% of you said that appears to be the case. lawmakers can do it on their own, 29%. unsure, 14%. >> steve: keep in mind, we've been reminding you that we're talking about cuts -- not really cuts per se, but rather a decrease in the increase in what they're going to spend going forward, is just about 2.3 pennies on the dollar. and the administration actually does have some wiggle room on how to move things around in different accounts so things aren't as painful. but right now to many on the right, it looks to them as if this administration is trying to do is exact maximum pain for

political gain. >> brian: what congress tried to do yesterday is give the president power to minimize that pain, get rid of some conferences, get rid of some leases and maybe minimize the pain and maybe not cut to the bone the transportation or departments of interior, the president didn't want it. his party didn't want it. 63-35 the democrats said no. so they said let's raise taxes on millionaires. let's see how that goes over. that did not get close to 60 votes. so the president teed off on republicans and we have the stand-off. goudie, who likes to weigh in, weighed in last night on greta. >> finding $85 billion in a budget this size? you ought to be able to find that in the extra tray in your car of a budget this size. you would think that the sky was going to fall tomorrow and that we won't have air traffic controllers and we won't have tsa agents and f.b.i. agents. what's gog happen is people are going to wake up and say, you

know what? it's uncomfortable, but that's what happens when you get $16 trillion in debt. >> steve: you could find the money in the ashtray of your car or perhaps here in the cushions of the curvy couch. >> brian: which we are going to check. >> gretchen: be careful. there could be other stuff back there. >> brian: clayton left a laptop back there. >> gretchen: and other things. senator tom coburn from oklahoma, remember, he comes out every year with this book of what he deems to be a lot of waste that's going on in the u.s. government. some of these ideas, maybe some of these. should we be cutting some of these things instead of some of the more drastic things like military and air traffic controllers? how about the climate change musical for $697,000? instead, you can argue, they're freeing illegal immigrants in the at $164 a day. >> steve: also our government spent $325,000. this was really needed.

how many times have we said, we really need robotic squirrels on this planet? instead of cutting that, they're cutting medicare. >> gretchen: instead of cutting the taxpayer funded vodka -- this one i might have to say we need. just a little. vodka, whiskey and gin, $99,000. instead of that, they're going to furlough one t.d. a worker. >> brian: instead of cutting nasa develop mars menu, they don't go up there hungry, we're furloughing border control agents. charles krauthammer says there is 44 overlapping job training programs. 18 different nutritional programs, 82 teacher quality programs, all of these agencies are duplicates. they could be folded in. they could be paired down. 56 different agencies on financial literacy and that adds up to between 100 and $200 billion. so you can cut them. >> steve: it should not be hard. >> gretchen: let's get in some other headlines.

protect the country. that's kind of madness that i haven't heard in a long time. >> steve: john mccain is here. he's a member of the armed services committee. real pleasure. >> did you see me with the dogs there? reminds me of the old harry truman now, a friend in washington, go buy a dog. >> steve: that's so true. what did you think of what mr. woodward said right there regarding madness? >> i think he's got a good point. this is all madness. i'll remind you, in the campaign, the president of the united states said in two sentences, one, sequestration won't happen. >> steve: right. >> obviously that was wrong. and two, he said that it was congress' idea. we now find out from mr. woodward that that was obviously not the case. it was not congress' idea. it was the white house's idea. so we're starting out with a credibility gap, at least in my view, that's rather serious. let me just say that these cuts are half in defense. defense is about one out of

every $5. 19 that we spend, not counting medicaid and medicare and social security. so we are cutting -- make half the cuts in defense of what is 19% of the spending, and they exempted about two-thirds of the programs that like fannie mae and freddie mac, pell grants. >> steve: when you look at the whole piece of pie -- >> but on defense,'s enormous. >> steve: a number of senators and house members say let's give the president the flexibility to figure out, move money around and make the cuts he wants. you think that is the dumbest idea ever. >> i do because i believe that congress constitutionally has the responsibility to authorize and appropriate the funding. the president proposes the congress disposes. suppose that in the name of fiscal austerity the president decides to close bases, decides -- he makes decisions and the congress, under that

scenario, would have required a two-thirds vote to override those decisions of the president. turns the constitution on its head, in my view, and i say that with respect to my republican colleagues. this is a dangerous world. you saw this morning, north korea, the tensions are there. the sent finals are spinning in tehran. one of these places could explode at any moment. we're going to have further cuts? we've already had $487 billion in cuts in defense taking place as we speak. >> steve: we're running out of time, but it looks to some like the republican party might actually have a winner on their hands right here because if you hold on to the sequester, the government would have to pass a bill to fund the rest of the year at the end of the month and if there is no bill, the government shuts down. do democrats really want to have to go out there and say, no, we should shut down the government? >> i don't think so, but i'd like to point out, again, the

powerful concentration of executive power on earth. i mean, they're saying to you essentially -- access is everything to them. if you don't play along, your access will be denied. that's very, very intimidating. >> brian: what about david plouffe coming forward and saying he's washed up. he lost his fast ball. comparing it to mike schmidt. now there is backlash from the senior organization that says no one is helping contribute -- they called david fluff an as -- must have an ass. >> steve: they calculated that they would win this fight, by doing these press opportunities with first responders behind them. i'm surprised they didn't bring in hungry children or head start kids. they really tried their best to mount this enormous pressure because woodward is right, there was the august 2011 deal did not include new taxes. i believe there should be closing tax loopholes and tax revenue, but it shouldn't be part of this crisis.

various people and contractors $115 billion. that's more than the sequester. this could be resolved and managed. having been a small business owner for 22 years, there is a way to do this. >> steve: i think the white house is worried that if people see a little 2% cut in federal spending is possible without a catastrophe, they might -- the people of america might realize that we don't need a government as big as it's growing. >> yet, this administration wants a bigger government. it wants higher taxes. yet, it hasn't even submitted its own budget. four out of five years, the president has not submitted a budget on time. this is the next year, it's supposed to be february 4. here it's almost the 4th of march. they say, maybe middle of march. come o. get off the plane. if you grounded air force one, you would save 180,000 bucks an hour. how many tsa workers wouldn't have to be furloughed if you just didn't go on the never ending campaign? >> steve: wouldn't that be a refreshing question, if somebody asked that in the white house briefing room? >> it could happen. >> steve: you never know. all right.
