talk about this real quickly. today, we have got a pretty decent start to the day. real extreme cold air out there. after what we have been talking about for such a long time that's good news. get ready, it comes back on monday. another artic blast on monday. for now we will start with conditions looking pretty good. satellite radar picture shows us. eastern side of the country where we will be problems this weekend. areas of the south, texas and oklahoma we will be looking at severe weather later on today. anywhere where you see that yellow. that's where we are going to see this afternoon more storms fire up and tornadoes as well. we will continue to watch that not a big tornado outbreak by any means but enough severe weather we'll be on the lookout later on this afternoon. all right, your easter first alert forecast looking pretty good for almost everybody except rain across the central california coast line and some pesky showers and thunderstorms across the southeast into the mid-atlantic. i think most people will be able to get an easer egg hunt thought midday

tomorrow. back to you inside the story. >> did you say gintle and gazmos? >> i did. >> alisyn: gidget likes that? >> it's going to be that kind of morning. >> alisyn: i hope not. let me tell what you is happening as you you wake up. north korea making new threats saying it has entered a state of war with south korea. this comes as the country just released this photo of ruler kim jong un meeting with his generals. just yesterday troops rallied in north korea supporting his decision to put missile units on stand by to attack u.s. military bases. u.s. officials say the latest threats are nothing more than talk. well, there has been a tragic accident that has left a member of the elite's seal team six dead and another injured. they were doing routine free fall training at a base in arizona when the two men collided mid-air. they were rushed to the hospital. one died his name has not

been released. stable condition this morning. the military is investigating this accident. nearly 3 dozen georgia educators, including a former superintendent, indicted in one of the nation's largest test cheating scan tells. the indictment claims that atlanta public school employees conspired to conceal sheeting or even retaliate against whistle blowers in an effort to bolster standardized test scores. 2011 state investigation found cheating on test by nearly 180 educators in 44 atlanta schools. clayton, tell us what's happening in sports. >> clayton: cinderella is dead this morning. >> alisyn: i say she is not. >> clayton: dancing is over for florida gulf coast the eagles got off to a quick start but couldn't hold off the florida gators. the gators win comfortably and cinderella is dead 62 to 50, florida gulf coast is out out.

tracks. would he need to spend more to get this economy going. listen to the president. >> we still have too many ports that aren't equipped for today's world commerce. we have still got too many rail lines that too slow and clogged up. we have still got too many roads that are in disrepair and too many bridges that are not safe. we don't have to accept that for america. we can do better. we can build better. in a time of tight budgets, we have got to do it in a way to make sure that taxpayer dollars are spent wisely. >> alisyn: that was the president's what was touted as new plan as a port in miami. sounds like the old plan. some people thought that these $787 billion allocated for stimulus spending, i think it went up to 814 for 10 years was for all those shovel ready projects. all of those infrastructure. the rebuilding of roads. the shoring up of bridges. so it came as a surprise to

some people that, no, actually that didn't happen with stimulus. and now we still need to do that fast our infrastructure. >> kelly: high degree of uncertainty out there because of the fact that the stimulus has not kicked in to do all of the things it was supposed to do. such as creating more jobs, putting america back to woncht the president going back on the campaign-style trail basically saying america can do better. the question is, how can we do better when the stimulus package is not working. now you have to bring in the private sector. and, remember, for a while during the stem lus package put the private sector aside and it was all about government. government creating jobs. now we are finding out that we have to go back to the private sector. charles krauthammer points out this public vs. private thing. here is what he said. >> this is the same stuff he gives us all the time. his idea is that the engine of growth, which we all know is the private economy, is waiting to get a little bit of a stimulus, an injection from the government or it's not going to move. which is absurd.

the housing market is on the move. it's recovering on its own. and on the other side of the argument, obama passed four years ago the largest stimulus in galactic history to kick start the economy and it didn't kick start. this is a private economy that has to be encouraged by reducing regulation and taxation and then it takes off. >> clayton: didn't kick start. here sun employment numbers private sector. private 8.1% unemployment. public, 3.8%. so it's been helping public sector employees. the president's plan though specifically, so to alli's point. we have done this. we have spent billions of dollars in things that we have talked about in roads and tunnels and bridges. >> alisyn: they weren't as shovel ready as the president had hoped. >> clayton: here is the specifics of what the president is now calling for. $4 billion in new spending on two infrastructure programs is what the

president is now asking for. higher caps on private activity bonds to encourage more private spending on highways and other infrastructure project. >> alisyn: i'm con confused by that one. those are state and local go. s that will apparently use bonds to lure private sector companies. so is that private money or is that public money if you are using bonds to lure the private sector? i mean -- >> kelly: there is upfront government money. the length of the contract can be dictated by, you know, how much these bid in these contract purposes. >> clayton: in a former life i had a family presented it who was a civil engineer. he would bid back and forth contracts for bridges and retention ponds you are building through the states. a private company but also getting some federal dollars. >> kelly: to add to that clayton and alli, i have seen in the state of maryland where i live where you drive by certain areas where they are doing some road construction and resurfacing the roads or

dealing with bridges and then you see a big sign saying this your stimulus dollar at work. and to that point, i think that's been putting those people back to work. what the president has been saying we can do do better because it's not enough. he is going back to the well and talking about this $4 billion. the question is will members of congress be in favor of that? it's likely unlikely at this point in time. >> clayton: more spending? i don't know if they have an appetite for that. >> alisyn: ongoing saginaw with the fort hood massacre. you will remember in 2008, the suspect, major nidal hasan killed 13 people at this texas army base as well as injured others. so now comes the time to prosecute him. and as you know, that is complicated because the government is not willing to say that what happened there was terrorism, that his motivation was terrorism. and the victims themselves are now asking for being recognized and receiving purple hearts but the government is not willing

to do that. >> clayton: wounded in battle, they say, by all accounts and to any person with a brain it was an act of terrorism. the guy runs in, shouts al al bar, opens fire. talked about openly as an act of terrorism. these kids individuals, because it's not being classified as terrorism, and work place violence, they then in the line of duty cannot receive purple hearts. here is specifically what the defense department says. astonishing. read. this. >> passage of this legislation could directly and indirectly influence potential court martial panels and members, witnesses, or the chain of command all of whom exercise a critical role under the uniform code of uniform justice. the defense counsel will argue that nidal hasan because a branch of the government has declared that major hasan can is a terrorist that he is

criminally culpable. >> puts families in flux and has those wounded and survived this unfortunate circumstance that was a terrorist attack such as speaks out about this not only him but those who are trying to survive and and try to move on. listen to what he said. >> as if what happened to us doesn't matter. it's not showing a high level of importance. those of us that are in the military are kind of being rushed out and the benefits that we typically would receive, if this was a combat event, as he a he opposed to being called work place violence is a huge difference is a smack in the face how we have been treated service we have giving to our nation. >> clayton: family benefits and not to mention the purple hearts. let us know what you think about that friends

>> alisyn: most of us dread filing our taxes this time of year. that's not all we should be worried about. it's also a prime time for identity thieves. how can we protect ourselves when filing our taxes. let's ask harry hawkeye who has dealt with this on a regular basis. why is this such a season for identity theft right now. dumpster diving? digitally grabbing our records? how are they getting this stuff. >> there is many different ways they can get it. basically, you know, there are these typical tips that you give people out there regarding this kind of thing going through your

garbage like you said. a lot of your information is already out there. a lot of people do not guard their social security number, their date of birth. that should be just like a pin number to you. >> alisyn: that's a tough one because it's already online. here you have some tips for how we should be extra careful and protect ourselves this season. file your taxes as soon as possible. why does that help? >> right. because we want you to beat the bad guys. so, if you can file your taxes as soon as you get your w-2s, the less likely that you could become victim of this crime. so, as soon as you get your information, just go ahead and file those taxes and this way you will beat them and then you won't become a victim. >> clayton: a lot of people wait until the last minute and go to the post office with that envelope. they stamp it to make sure it's ready by april 15th. you say to do it electronically that way you are beating the thieves even more. we hear about cyber attacks. wouldn't that be more problematic? >> you are probably least likely to get your income

tax return taken somewhere from the internet. all right? basically, what you should do is just file your taxes, you know, electronically so the information gets there directly to the irs. you don't have to worry about something getting stolen in the mail. if you are a victim and you file electronically, it will kick back automatically. now you know that you become a victim and you have got to contact the irs. >> alisyn: interesting. you say don't give a business your social security number when they ask. how do you do that? i was just at a bank and they asked for my social security number. you have to give your number sometimes. >> right. sometimes you have to in financial instances. let's say remember all the video clubs from back in the day? >> clayton: yes. the mg music club. >> a lot of those places wanted your social security number. you didn't have to give it to. they all right? see, a lot of the information out there, got nothing to do with finances. you don't have to give it to them. all right? so, i keep away from giving anybody my social security number unless it's a bank

or some kind of credit card company. >> alisyn: try saying no first and see if they stop asking. >> they should. i mean, the problem here is the more technologically advanced we get, the more vulnerable we become with these type of frauds. >> clayton: it's it wonder when i go to radio shack why they need my phone number. you don't need my phone number. i'm here by buying a cable. >> alisyn: they think you are cute. >> clayton: no it's a dude. number four a tax prepare who requires a portion of your previous return. 2008, 2008. why should you be worried about that. >> not like portions of your return. basically what they do is say, listen, i will do your taxes and, you don't have to pay me just give me 10% of what you get back. >> clayton: taking a percentage. >> taking a percentage of your new return. what they will do is inflate your return so that you get a larger refund, all right, and then six months down the road the irs will take a look at you and say listen, you weren't

teams. mr. clean, dapper and he danced, too. >> kelly: i love -- >> alisyn: i love it a story that had many of you outraged that is this florida atlantic university professor who was trying to do -- his name is deandre poole. he was trying it to do he says, a lesson about symbols in our culture. so, he had his students write on a piece of paper the word -- the name jesus and then he told them to put that on the floor in to stomp on that piece of paper. one student refused to do so. and then all of this chaos ensued and now that professor has been put on administrative leave. >> kelly: this was part of a lesson plan that was to try to provide context or historical context to your point about symbols. but and in this lesson plan it said many students will.

>> alisyn: we all know that doctors work crazy hours, particularly when he they're just starting out. efforts to reduce their hours may have the unintended consequences of putting patients in danger. an intern health study found that trying to reduce doctors' shifts to just 16 hours. resulted in some harmful errors. the number went up to 23% of errors had they tried to reduce it how can you keep yourself safe? joining us now is board certified yiewrge you're logical you are row

you're logical surgeons. they are sleeping on a cot somewhere. they are working all nighters first of all in this study we don't know if there was increased reporting. small study that they looked at small singer gel institution study. there are some concerns with reducing doctor's hours scenarioly when i was training i would do 100 hours a week. often you reduce communication because you have to have good -- you don't know the patients as well. certainly as well when you are working shifts you may be covering a number of specialties. so you don't necessarily own those patients and say it's very important that we have good handover. if you don't have good handover between doctors and between doctors and nurses, then that's when

medical error can happen particularly with medication. that's what this study found it was the handoff. if you you are just in charge of your patient's case load, you don't makes a many mistakes. one of the big estherers they found that doctors are making you don't write the correct prescription. that's troubling it is troubling. right medication. it has to be spelled correctly. we have to have the correct dose, the correct number of times per day to prescribe it we have to be very careful to make hauer there is no interaction. we have to remember to check that the patient is not allergic to these medications. if you know the patient very well. you know what the patients are allergic to medication. subtle changes in doses and good communication, that obviously is transmitted. if there is a breakdown in communication, or notes are not clear or patients are moving from ward to ward and there isn't the knowledge of those patients, then that's when the errors can happen. that was the thing the

study revealed in the shorter work hours you don't learn as much about the patient. you have already mentioned that doesn't ask the right question. how can working shorter hours. i would think working hundred hours a week how could you not work the right questions if you are working shorter hours? >> from past experience. when i was working 100 hours a week in the hospital. when you are busy the adrenaline is flowing. that's what keeps you flowing. when you stop and go home, that's when the tiredness kicks. in key communication is the issue here. also we know with residents when they are working shifts, they are often working night shifts and education during the day can suffer if they're spending less time in the hospital. >> that's interesting. you have a laser like focus when the adrenaline is coursing through your vams. last thing they found doctors who work fewer hours don't look at the bigger medical picture. what does that mean. >> we are becoming more and more specialized. cardiac look at the cardiac issues. the surgeons look at the

watch, we have the time. >> thanks, james. thank you, james, great to see you. let's talk about an update on the fort hood massacre. you will remember that was shooting in 2009 on the army base. the suspect is major nidal hasan. well, the victims in this case, the survivors who were injured feel very strongly that what they were subjected to that day warrants a purple heart. some sort of commendation or recognition that they were on the battlefield of a terrorist attack. >> why would they think that? because nidal hasan when he stormed in there yelled allah iraq bar and had talked in the past some of his writings and some of the other evidence that exist that he was a terrorist. by all accounts a terrorist. it has been labeled work place violence thus far. now the victims and the victims families have been pushing for these purple hearts. it doesn't look like it's going to happen because it could throw the whole trial into chaos. >> very disturbing when you have the defense department basically giving this kind of statement, let's read

this right now. passage of this legislation could directly and indirectly influence court martial panel members, witnesses or the chain of command. all of which exercise a critical role under the uniformed code of military justice. defense counsel will argue that major hasan cannot receive a fair trial because of abrarge of government has indirectly declared that major hasan is a terrorist, that he is criminally culpable. well, if you have that, how do you move forward in getting the purple heart for these men and women who deserve it. >> it doesn't sound like they can. the argument from the department of defense as you just heard is that it would prejudice the jury. you hear this all the time. it's not just in this case. you hear all the time in criminal cases that the rights of the accused or more better protected than the justice of the victim. that's how our criminal justice system is set up. in this case it goes either further because they are not refusing, because they

are refusing to talk about the motive. there was a motive here. but they think that by discussing the motive of terrorism, that it prejudices the jury and that they can't do it to your point, a motive that was praised by anwar al-awlaki who is no longer with us thanks to a drone attack. he was one of the chief persons who helped influence nidal hasan to carry out this attack praised by al qaeda. >> clayton: speaking of the victims. one of the individuals who was actually a vism the fort hood shooting spoke to us a short time ago. alonzo lunsford. he says this is just appalling. listen. as if what happened to us doesn't matter, not showing a high level of importance. and those of us that are in the military, we are kind of being rushed out the benefits we typically would receive if this was a combat event opposed to being called work place violence is is a huge

policy foundation. chuck, nice to see you this morning. >> good to see you. >> well, what is wrong in the state of california with bringing in disadvantaged workers to account for about 10% of this overall project? that includes veterans that includes teens and others who are out of work in and it, yes, it includes felons, what's wrong with that? >> well, first of all, this policy is simply window dressing to cover up the requiring a project labor agreement to build the railroad. in other words union labor or paid like union labor. when you look at the 10% requirement, this is ridiculous about a quarter of californians are veterans lark number of immigrants. they are not going to have a hard time finding 10% of the people to fit their definition of disadvantaged workers it's not going to be a issue. >> when we quote that number on the project that number has gone up significantly.

the president's speech and what could the president have done differently in this 100 days to get the kind of bipartisan gun legislation that is he calling for. >> clayton, i say first shame on the president for trying to make this a political issue rather than really get to the heart of what touched everyone in america. the tragedy at sandy hook was not caused by lack of gun laws lack of enforcement of the law weetion have. we have not dealt responsibly with the mental health issue. people who might have been identified to the point of needing to be hospitalized now quote mainstreamed. none of the laws, not one of the laws that he is proposing would have prevented sandy hook. so if he is talking about what can we do to prevent it? then let's talk about what can we do to prevent it. punishing legal, lawful gun owners, some of whom shoot for self-protection. some for sport, some for hunting, but all have the constitutional right for whatever purpose they choose, they shouldn't be demonized as this president has tried to do and the

utter lack of knowledge, the complete ignorance of what certain guns do has also been appalling to me. joe biden telling women to get a shotgun, shoot through the door and off the balcony both of which are felonies. if we are going to have a conversation, let's have one. let's have responsible adult level conversation. >> you are right there in little rock. as you know little rock is no stranger to some the gun violence that we talk about. there have been shootings there. just criminal activity as we have seen major cities throughout the country. you are talking about the president should be talking about what can be done to prevent it as a former governor of the state of arkansas, what did you see and how did you actually put laws out there to help people not only from a mental health standpoint but also combat crime? >> well, kelly, first of all, you have got to make sure that you have adequate, i would say punishment and penalties for people who commit gun crimes. that's part of it. you just don't let it be a revolving door and put them

back on the streets. a second thing you do is you put police where the high crime areas are most of the time if you look at urban crime situations. you can con sen. communities who do that. see a drop in violence. kind of violence you see from whether it's aurora or sandy hook. sometimes you don't those coming. in this case it was -- the shooter in sandy hook, for example, clearly spent all of his days playing violent video games. the president hasn't said one thing about the entertainment industry. not one thing. the democrats love to talk balance. let's talk balance. we're not talking about it. >> alisyn: governor, one of the things i want to get to in the president's plan is to limit magazine rounds to, i think 10. and we know from the records that were just released this week that adam lanza, the shooter at newtown was able to fire off 150 rounds in the space of five minutes.

you said that there is no laws that can prevent what happened in newtown. could it have slowed him down if he didn't have that level of ammo to shoot 150 rounds in five minutes. could, i'm just asking because i don't know the answer. could the 10 round limit have slowed down the massacre? >> a few seconds. a few seconds because it takes about maybe a second and a half to two seconds to knock one clip out and put the other one back. in we're not talking about that it would have changed the difference in some dramatic way. the fact is when you say let's limit the size of magazines. look, they are already on the market. they are already out there. people aren't golden globe gonna, you know, if they are criminals, if they're crazy, they are not going to say oh i can only load six rounds today. the criminals aren't going to say as governor cuomo in new york said that seven round limit. they don't even make them. he said well have a 10 round just only put seven bullets in it. how ridiculous. do you honestly think the

that person will not respect them the moment they give it away. those are things we ought to be teaching the value of the individual. the person hood of every individual. and the fact that they should never treat what they have uniquely as something that is cheap, that is disposable and that they themselves are not someone else's toy or play thing to be used and tossed away with a lot of broken feelings. and then, i think we would have a much stronger basis then to talk about the physical aspects. but if you don't talk about the personal, the emotional, and the character and integrity issues. teaching mechanics is a waste of time. >> clayton: aren't we assuming though that the parents are great parents and that they're teaching this to their children and very often that's not the case? >> i think we have to assume. i would assume clayton they are not doing it if parents were doing a better job we wouldn't have the discussion. it wouldn't even be necessary. i'm going back to my point. before you teach the

talk about our infrastructure. you're out there driving and notice the potholes and the decrepit bridges and railways, we haven't heard too much of that from the president we have been talking about gun control legislation and immigration reform, but the president went to miami to talk about focusing once again on infrastructure spending. take a listen. >> he we still have too many ports that aren't equipped for today's world commerce. we've still got too many rail lines too slow and clogged up. we've still got too many roads that are disrepair, too many bridges that aren't safe. we don't have to accept that for america. we can do better. we can build better and in a time of tight budgets, we've got to do it in a way to make sure that taxpayers dollars are spent wisely. >> alisyn: the president is absolutely right about that. we do have a crumbling infrastructure. if you go to any of the new york city area airports. >> talking about the roads down here?

>> i mean, the bridges are in disrepair, the airports look like you're flying to a third world city. he's right about that. what's confusing a little to people, some thought that's what surplus spending was supposed to be two years ago, three years ago, 787 three years ago, 787 for projects that were supposed to be shovel ready. >> clayton: keep in mind a lot of the president's men and women said all along he didn't ask for enough for the stimulus package. nows' working a new public works spending plan that calls for 4 billion dollars in new spending on two infrastructure programs, higher caps on private activity bond to encourage more private spending on highways and other infrastructure projects, giving foreign pension funds tax exempt status when selling u.s. infrastructure, property more real estate assets, also renewed call for a 10 billion

dollars national infrastructure bank. which may have some bipartisan support, it's unclear at this hour if that would go forward, but having that sort of savings account, a rainy day fund so if we need that bridge on philadelphia street fixed. certainly do if you cross it, worried you're going into the river. and your point-- thank you. to your point this was money we thought was already spent on stimulus money we were hearing about the during the the recovery and need americans back to work. what better way than to get them out there sort of like fdr did, getting people out there building bridges during the depression, and building parks and infrastructure projects and this was the money that we thought was spent well or in part. >> alisyn: and the stimulus created or saved 2.5 million jobs, obviously, that's good. but so far, the funds shelled out 744 billion so at a cost per job of almost 300,000. the president says that the

reason that he used that miami port was a back drop. that's exhibit a, what he's hoping to do. they got 2 billion dollars in a grant-- a combo of private funds and government money, but for giving more public money and federal dollars. >> kelly: speaking of the appetite being low. a person said it more suscinctly was charles krauthammer talking about the public versus private plan and here is what he's saying about the president's plan so far. let's listen. >> this is the stuff he uses all the time. his idea is that the engine of growth, which he we all know is the private economy, is waiting to get a stimulus injection from the government. the housing market is on the move. it's recovering on its own, and on the other side of the argument, obama passed four

years ago, the largest stimulus in galactic history to kickstart the economy and it didn't kick start. this is an economy that has to be reduced taxes and regulation. galactic, never want to disagree with charles krauthammer buff when we talk about the housing recovery on its own. you have banks buying up hundreds and hundreds of properties, they look better, but it's artificially inflated when hedge funds are buying up houses. >> alisyn: it's geographic, some places it is and-- >> i have to agree with clayton. some companies out there receiving government infusion taxpayers dollars in order to buoy their resources and not lending out the money as they should. >> donald trump's biggest gripe, we give them the money and they don't lend it out to

government has indirectly declared that major hassan was a terrorist. >> clayton: so this trial could be thrown into flux if these victims receive purple hearts because they would have received them had they been in a combat zone. that's the conundrum here, right? it is a combat zone. he was a terrorist. they're not receiving purple hearts all because the trial could be labeling him a terrorist. and on the shooting and aftermath, a victim says not only the purple hearts at usual here, it's the rights and payments had we been on a combat field instead of in the office. >> it's as if what happened to us doesn't matter, not shown a high level of importance. those of us in the military were kind of being rushed out and the benefit that we typically would receive if this was a combat event, opposed to being called

background checks, look at prosecutions, alisyn, the prosecutions for people who fw through a background check and not qualified to buy guns are so unbelievably low. no data to back it up, he's not telling the truth. >> alisyn: 40% of gun purchases do not go through a background check, you're taking objection with that number. let's move onto the magazine clip, another controversial element of the plan. the president wants magazine clips to hold no more than ten rounds. >> we know from the newly released documents, that adam lanza had three, 30 wound clips and able to fire off 150 rounds in the space of five minutes. if he had been limited to ten rounds wouldn't that have slowed him down and possibly saved lives? >> alisyn, in the secret service we can change out a magazine in one and a half seconds and some guys better trained less than that. now who determines the amount of rounds who you need in a gun fight to protect yourself

and your family? not you, the bad guy. he doesn't stop shooting in ten rounds and doesn't care about a magazine restriction, he's going to have a standard capacity magazine while you're restricted to ten rounds, so the president with no background in security at all, he was a lawyer, a constitutional attorney, should back down on this, it's a ridiculous restriction, it's not going to do a thing to prevent gun violence at all. >> alisyn: quickly, dan, you've been on front lines, being a secret service agent. what is the solution? >> we don't even have mental health records right now and the gun background check system that we're using now. if you've been declared mentally incompetent or danger to yourself or others, what about the schools, the bad guys are going to get the weapons and we're not going to be able to stop them with harsh language. the president has his children protected by guns and i deserve to have the same
