be why. what was the motivation for the crimes, and were there tie to an over seas terrorist group and was there training that took place by overseas or here at home training group and were there red flags that were missed on the two young men and we'll get to all of that in the come being hourings. first, what an end it to a difficult week. here is boston's police chief ed davis on how one long day came to an incredible end. >> he walked and saw blood on the boat. he opened the tarp and saw a man covered with blood and he retreat called us. we set up a perimeter around that boat and over the course of the next hour or so, we exchange would gunfire with the suspect who inside of the boat and ultimately the hostage rescue team made an

monday was a clear attempt to kill americans and serorize americans. explain folks at home on what the difference is what you are discussing in the way he should be held and what others feel should be the course of action. >> the reason we wanted to capture him alive is find out about the attack and find out who he trained with and what connections to entered terrorism . they were on a jihad mission and the reason you want to capture a terrorist is to find out about what other terrorist are up to . under criminal law, in the united states, if you capture a citizen or noncitizen, you have to read them miranda rights and there is it a safety exception that allows you 48 hour to see if there is any bombs that may be connected with the attack. under the law of war, an enemy

combatant and someone who takes up arms against this country, including an american citizen can be held for intelligence purposes without a lawyer and miranda warningings. the best way to get information from the suspect is hold him as an enemy combatant. it a terrorist attack and not a common crime. in 30 days he would be presented before a federal judge and the judge could review the case that the government has. i am urging this administration, please do not lawyer him up tomorrow night. you have under our statutes and supreme court cases,le authority to hold him as an enemy combatant ting gather intelligence about what is coming our way in the future. >> there is great relief in boston today but a lot of

this. joining me is kt, fox national security analyst. >> let's start there and there is another direction we want to go. but in terms of him and his investigation, what can we learn? we know he already starting to be more radicalized? >> my daughter knows a class mate of hers who knows the family and said the family started out five or six years likes a normal immigrant but mom was radicalized and the kids starting to wear head scarves and talking about 9/11 was a plot by americans to kill muslims and so the family was taken, but the whole family seemed to be taken steps in that direction. how do you look for 350 million americans? you can't we'll turn into a police state. you and i talked about this before. but boston's ordeal may be done, but america's ordeal is beginning.

a statement as to what kind of condition the patient is in. that is important. a medical condition can change all of the time. the f.b.i. released a statement he was in serious condition yesterday. we don't know the condition right now and i have a feeling that it may be changing. they have a gag order and they will not say. what serious condition means by the way. the patient is ill and his vital signs are unstable but expected to survive more than 24 hours. critical would be more unstable. >> right now we are under the 48 hour public exemption of miranda rights and do we know that the high value interrogation groups is in there and if he is conscious, they will make sure to question him. the ut most concern right now is the investigation and the ability. is there anything they can to do to help empower this ailing
