greg, this brother living off welfare with his wife. also both brothers grew up on welfare. if you could get in a boxing ring and if you could slug it out, don't you think could maybe get a job? >> let's face it, a lot of criminals in the united states are on welfare, so this isn't a big surprise. but we have heard of state sponsored terror. the united states is now a state that sponsors terror. it sponsors its own terror. and, frankly, welfare is no different than tenure. we already sponsored terrorists with bill ayers, burn detective dohrn. cathy boaty. they were involved in death. more death. they exchanged their pipe bombs for pipes. by the way, i want to point out that this is kind of the symbol of what has been happening in europe. intense pockets of muslim supremacy in europe. england, france, also in australia. they let it happen. bigots leave their countries because they are horrible.

problem. >> andrea: time off, eric, to sit on their couch and build bombs with our money. >> eric: here is a part of the immigration debate that needs to come up. this guy tamerlan came over in the refugee clause in the immigration policy. if you are asking for political asylum, you can get welfare benefits, a typical green card recipient would have to wait about five years to start to get welfare recipient. he got it right away. in massachusetts, the department of transitional assistance, he likely got section 8 housing, mass transit cards. ebt cards. a public defender for his domestic violence offense in 2009. and now dzhokhar, the one who is living is going to get like a hugely popular well-known public defender as well. he had scholarships, enough is enough. we really need to revamp the immigration policy and our welfare policy. >> bill: you put your finger on it. this is is the law. you may not like it and you may not agree with it but it is the law. the law has got to change.

the internet and possibly through the mosque. can i point something out we talk about the cair. council on american is a islamic relations. where is cair? they denounced the bombings on friday right after it happened, okay? but they haven't since. so i emailed ibrahim hooper, who is their representative. is he a spokesperson i said, mr. hooper, do you care to respond? he said about what? i said about what's going on? what we have learned about the bombings? he came back and gave me the april 19th presser, sound. >> kimberly: i'm letting you finish your point but we have sound. >> the point is that was april 19th. sir, give me one or two lines on what we have learned since april 19th, friday. there has been a lot of information that's come out where they study, where they prayed, et cetera. and he said just no comment. nothing came back. it's just ridiculous. this is san opportunity for american islamic relations to get better. >> andrea: i want you to respond, greg. you made this connection on the five.

>> kimberly: the defense rested its case in the trial of philadelphia doctor kermit gosnell today after calling no witnesses. closing arguments are set to begin monday and the jury could get the case as early as tuesday. meanwhile. yesterday judge jeffrey mine heart threw out three of the 8 murder counts against gosnell. so, eric, people were

surprised that the judge did. this then we were examining perhaps some kind of evidence, some kind of witnesses to it be presented during the defense case. the defense attorney jack mcmahon rested didn't call dr. gosnell which i said he wouldn't. cross-examination. he couldn't get experts to testify on his client's behalf. >> what's his high water mark. what does the defense have to do prove that there is at least a questionable doubt whether or not any of the babies were actually born with a heart beat? is that what he is looking for? >> with respect to the count of the babies to say that there is reasonable doubt as to whether or not the babies were born alive. so he he is going to from when i was in the courtroom with the medical examiner on the stand. he kept hammering the medical examiner saying you cannot say to a reasonable degree of medical certainty that those babies were born alive. you can't say it about baby a and b went through all of

them. >> they were not viable. they did not take a breath, by the way that is not an appropriate legal way to even, you know, kill a baby. these aren't abortions. these were done outside this isn't the right way. the women were drugged, the babies were drugged. >> bob: can you imagine going home and explaining to your family why out there being a defense witness for this guy? that's a big part of it it. who in their right mind would. >> they will be cross-examined because some of the other testimony in the grand jury was that these babies felt tremendous pain which this was being done with them with the scissors in the back. sning. the judge really is. i mean he is really mucked this up. first, didn't he make an error dropping the charge against baby c? wasn't there testimony that the baby was alive outside of the womb? this is buffaloing.

i don't know if this judge jeffrey meinhardt is lazy or scared. typically judges right decisions on this type of thing and write decisions for presidential reasons so people can look at precedent how people can judge it what people can do and can't do. i think this is such a high profile case. why wouldn't this judge write a decision on it? >> also you are saying why wouldn't the judge let it go to the jury? because he admits several of -- dismissed several of thesco motion to dismiss by defense attorney saying insufficiency of the evidence. i heard that testimony in the courtroom and there was eyewitness said i heard the baby crying going for air, having respiratory why wouldn't you let that go to a jury? >> bob: can i ask your co-counsel here, mr. gutfeld? >> kimberly: mr. gutfeld. >> bob: did you know judges could throw out things that people have been indicted for? i didn't know that did you know that? >> kimberly: yes. it's a huge problem. >> greg: if i can figure this out, the babies were moving but they are not

alive which kind of explains the judge. we know how complicated abortion is is. what is amazing to me how planned parenthood calls this women's health. it's like droning people is called bad weather or raising taxes. this is called revenue growth. the clue is whenever the hard left calls he it something else, and they are resorting or wellian speak, it's because they are trying to mask moral bankruptcy. it's because they are evil. i'm talking about those people. not you. >> eric: interesting that president obama was actually scheduled to headline the planned parenthood fundraiser happen tomorrow and he has now pushed it off to meeting with planned parenthood on friday. it's an interesting timing of events. >> greg: first thing he should do when he he gets up there is thank his mother. >> kimberly: the other charges that remain, four other charges that remain, if he is convicted, i would expect there is going to be a lot of appeals happening. so do you think that this judge is scared? you were in the courtroom. do you think he could be dismissing these three

charges? could it go to a higher court? he is kicking it. >> i mean, look. what is going to happen is that the jury is going to get these remaining counts. three of them carry the death penalty, one is the 40-year-old immigrant that was killed and the defense claims that was an accident. what the defense is going to try to do is argue the case. say the d.a. didn't prove it beyond a reasonable doubt. perhaps save his life get a determinative sentence and life without parole. >> bob: best thing that could happen life without parole. they are not going to let this guy go. >> kimberly: i hope they don't. evidence is more sufficient. you have eyewitness testimony babies alive on the counter for more than 20 minutes. the judge dismissed. committed by linda williams who pled guilty to the charge. the judge dismissed that charge. >> greg: do you know what this is about though? it's about bad timing. it sucks to be born at an inconvenient time. it's a fact already born are deciding on people who are unborn.
