complaint they didn't want their friend to get in trouble. i quote, kadyrbayev placed the trash bag into a dumpster. for this they could receive five years behind bars. also in court today, robel phillipos, accused of repeatedly lying to investigators. i lied during three separate interviews according to the criminal complaint. finally in the fourth interview he confessed he wasn't telling the truth to agents. also we learned more about the alleged bomber, dzhokhar tsarnaev. he allegedly told his friends one month before the twin explosions that he knew how to make a bomb. sean? >> sean: david, thank you. also tonight there's a report that the united states in fact received a letter from saudi arabia, the saudi government in 2012, warning them about suspect number one, but the white house and the embassy are denying the report.

for more on this developing story, we go to former lapd detective mark fuhrman and jay seculo. mark, we were told by the homeland security secretary that there was no broader plot. i thought at the time she couldn't make such a statement, but she did. >> she makes a lot of statements she can't make. she has no law enforcement, military or security experience before she was the head of homeland security. she's relying on what people feed her or off the cuff. the larger plot, sean, is we're at war with radical islam. that's it in a nutshell. and we're not getting on board. it's a wake-up call, and we're not coming to the game. >> sean: when you read the criminal complaint, going through this as it was

unfolding, and we kept talking a lot about surveillance tape, and photographs, all of that is mentioned repeatedly in this complaint. so clearly law enforcement worked quickly, got a lot done, but then we've got this other side of law enforcement where the older brother was on the cia watch list and the fbi interviewed him and there was no follow-up. the russian government warned us. frankly i don't think we've gotten good answers to these questions. why? >> we haven't gotten good answers, sean. in that fbi office in boston, or a mysterious place, there's a vault of information where they do investigations on possible terrorists and hide them so law enforcement can't ever see them and compare the photos and investigation to a crime that just occurred. what happened with these three young men, look at, this it was exactly like they know a murder occurred. they took the murder weapon and tried to destroy it. that in a nutshell is what they

did. >> sean: well, two of them admitted they agreed to get rid of this material after concluding from news reports that the suspect number two was in fact one of the boston marathon bombers. let's talk about that, jay. that's a huge problem they acknowledged and admitted that. >> absolutely. mark is absolutely correct also. this is no different than a murder weapon being hidden. some are acting as if these three students that are men, they are adults, and they're acting as if this was some kind of cheating scandal they were trying to cover up. this was a terror attack, and they were trying to cover up evidence. the text messaging that they got, the statements they made, showed they committed a crime. something deeper, where are the answers to these questions? are we so insistent -- homeland

security, the president -- saying they're lone wolves, saying these were self-radicalized. what does that mean anyway? if you watch an internet site long enough, what's the difference of being there, watching it on your computer screen, and hearing a guy in a mosque? i don't think there's a difference. exactly what mark said, we're in a war with radical jihadists. as soon as we realize that, we wouldn't let college students get away with this. >> sean: they're admitting to doing this, at this particular point, if you believe the criminal complaint. what i i don't understand, the first instinct of our government is not to suspect what is obvious, that there's a good chance that radical islamist jihadists are involved. that's number one. in the case of fort hood, they lie to the american people, saying it's workplace violence.

we all know differently. then to tell the american people in this instance there's a broader prom. plot. we find out there were watch list, they were warned. you would think they would be watching anybody that posted jihadist videos like the old brother. >> sean, you're right. when you look at this, you're asking the question why does the federal government, why does the white house, why do the mouthpieces for the white house say what they say. well, they say it because it's easier. it's harder to track down terrorists. the bar is much higher and you need to be much, much more into the game of security and antiterrorism, and that takes effort. that takes training. it takes throwing political correctness out the window. you need to call things as they

are. radical vandalis islam is radic. >> sean: these three that we learned about today, they willingly destroyed, concealed, covered up evidence on the part of suspect number two, dzhokhar, and lied to investigators. if you're their lawyers, what are you thinking about how much culpability there may be and what penalty they're facing? >> one faces an eight-year penalty, the other five years. i would be worried about additional charges. i don't know what the rush was for the u.s. attorney's office to file the complaint here. again, you know, you've got two that aren't american citizens. so this whole are they enemy combatants? i don't know what they are. we don't know who they are. we know one thing. they did attempt to destroy weapons. you know what this really is, sean, none of this is fitting into the white house's narrative

radical islam for the world to see. mr. president, our systems are not working. >> sean: the russians warned us. the fbi interviewed him. the cia had him on their watch list. >> yeah. >> sean: you're right. i mean, very few people in the media have discussed this youtube channel of his filled with radicalism. my question is, why was there no follow-up? was he not put in a database that said, hey, watch this guy, watch when his name shows up on the internet? certainly would have been a telltale sign. >> that's the ultimate question. less than 2% of the people in the database are american citizens, here on legal status. we can't have a system where you interview a guy where you've been tipped off by a foreign government, you have a radical in your midst. he leaves the country, you don't know about it. he comes back, gets on the internet for the whole world to see, and he embraces radical islam, and it's either political correctness, stovepiping, criminalization of the war.

bombings, there are questions being raised about why former terrorists from the weather underground are allowed to teach at prestigious institutions. kathy boudin teaches at columbia, and spent 22 years in prison for her role in an armed robbery that killed two police officers and a brinks guard. and don't check in the group's founder, bill ayers, a scholar, a man who has refused to apologize for his role in bombings across the u.s. are these really people we want indoctrinating our miles an chi? michelle malkin and juan williams join us. juan, 22 years from today, and dzhokhar tsarnaev, the younger brother, the bomber that lived

in the boston marathon bombings, can you imagine any senator, he's involved in a bombin bombit kills four people, including an 8-year-old, a police officer, people lose their legs and limbs, etc., could you ever imagine a scenario in which he becomes a -- let's say a professor at harvard university, teaching kids? could you imagine that? >> no, no. >> so then how does kathy boudin involved in killing two police officers and an armed guard, how does she get to teach at columbia? how does bill ayers get to teach? >> you're doing a rhetorical thing. she was convicted, served her time. >> sean: paroled. this is the best columbia university can offer its students, a convicted terrorist, domestic terrorist cop killer? >> i didn't know that you're now an expert on faculty hiring at

journalist, but i started writing about this case in 2002 and 2003. there are families who lost loved ones, who were defending the frontlines, protecting and serving, and this woman essentially is laughing in their faces by continuing to have this prestigious position. >> here's what i know, michelle. you can comment on this. what i've read is that she wrote an essay in 2004 for the fellowship for reconciliation newsletter that said she's filled with remorse. she literally used the words "i am sorry." she said she's met one of the people who was left fatherless by the crime she committed, the murder she was involved with, and they're -- >> what i know is that at her parole hearing -- >> this is not someone without remorse. >> yeah. at her parole hearing she invoked every left wing kanard,

blamed white guilt for murdering in cold blood. maybe there was one remote relative who accepted that apology, but there are still people living today -- it's not just that particular case. remember, before she was arrested in that case, she was a fugitive involved in the bombing of a townhouse in new york, that still remain unsolved, and she ran from justice. some repentance there. >> sean: the weather underground's incidents of violence. we'll put it up on the screen. i want to remind everybody, it was the morning of september 11th, 2001, in the "new york times," there's bill ayers being quoted as saying, i'm paraphrasing, i don't regret setting bombs, i wish i had done more. >> stomping on the american flag, literally. >> sean: i'm shocked, juan. i mean, this is the best our ivy

>> mr. president, you are 100 days into your second term. on the gun bill, you put it seems everything into it to try to get it passed. obviously it didn't. congress has ignored your efforts to try to get them to undo the sequester cuts. there was even a bill you threatened to veto that got 92 democrats in the house voting yet. my question to you is, do you still have the juice to get the rest of your agenda through this congress? >> well, if you put it that way, jonathan, maybe i should just pack up and go home. golly. you know, i think it's a little -- as mark twain said, "rumors of my demise may be exaggerated at this point." >> sean: that was the president yesterday downplaying the notion that obama mania has run its course. the first 101 days of his second

term suggest that. here to break it down, karl rove. how are you? >> fantastic. >> sean: global warming doa, budget dead on arrival, the confessionatiosequestration faie immigration talks. on top of that, obamacare, even his own party says it's a disaster. >> yeah. not a good start to the year. look, the president has two problems. you've touched on one of them. that is that the agenda he's pursuing is not popular, even within members of his own party. guns, the sequester strategy, the budget -- do you realize we rated from february until april for the president to present his budget? he presented it three months late. there's no democrat who's rushing to have it voted on in either the house or the senate. so the issues he chose and the positions he took, and the substance of what he was advocating was simply not popular among even his own

party. there's a separate problem, and that's the tone and approach. he kicked off the year by taking his campaign apparatus, obama for america, turning it into organizing for action, so he'll use his campaign as a pressure group, as a lobby group to pressure his agenda through, hold up members of congress back in his district. his partisan tone, everything is the republicans' fault, very harsh attacks. this guy is still campaigning. he's not gotten over it. when his aides go to the "washington post" and say his legacy as president of the second term will be to regain control of the house of representatives in 2014, that's all about politics, not a good way to start a second term. >> sean: if that's the case, i don't see anything happening for him. when obamacare kicks in 2014, people see the ramifications of this, none of this is going to be good. >> yeah.

look, you touched on something else here. that news conference the other day was unbelievable when it came to the affordable care act. president obama said, well, if you've got health insurance, you're already enjoying the benefits, you know how great it is, and nothing else will affect you. you've got all the good stuff and you'll come to enjoy and understand how much good stuff you have. first of all, your premiums have rocketed. the premiums are up by $1500 since the passage of this thing. >> sean: and going higher. >> and going higher. >> sean: united healthcare is going up 115% next year. >> not only that, but a lot of people who have got health insurance are hearing from their employer, you may not have it much longer. we've heard about restaurant companies putting people on 30 hours or less so they don't have to pay the $2,000 a person fine for dropping their insurance. the other day we had a friend, hosting a shower for them. they've got a baby coming in two months. he lost his job. he was the number one salesman

for his company the last two years running. they called him up and said, you're done, we're going to hire somebody, pay them 30 hours a week so we don't have to pay healthcare. two months from now, his wife gives birth to a child. >> sean: a lot of companies will do it, because that's the only way to get by and not be hit by the penalty. how big an impact will it have on 2014? >> a substantial impact. the president might be able to get back in the game if he has a supreme court vacancy this summer, getting his people riled up again. on the economy, deficit, spending, affordable care act, people don't like this administration. >> sean: are you predicting a retirement or two? >> i think there might be a retirement this summer. justice ginsburg i guess not in the best of health. more likely justice ginsburg. that happened in the past. it gives the president a chance to get back in the game.

him. >> everything is going wrong, and the republicans need to fight on principle. they need to stand up and show america that the conservative principles that they're supposed to embrace, show them it's the solution, that we can have a better america. >> sean: yes, the house republicans have done good things, deserve credit, passed some bills, but i don't feel they're communicating the way i want them to communicate. >> there's no message for the republican party. >> sean: like obama has messaged discipline. >> right. it is a message of redistribution, which i think is the wrong message, but the republicans are all over the lot. as george w. bush said they are leader-less. bottom line, the best ally president obama has is the republican party. >> sean: that's the only thing he has going for him is the republicans? >> yeah, because he's not gotten his agenda through. he's shown no willingness to really effect a real compromise, notwithstanding the dinners. bottom line, it just isn't happening. >> sean: if obama says that republicans are extreme, every
