glenn beck's group as well. this is statement from the tea party patriots, the irs, quote, lied, they lied before congress and they lied again yesterday. we must know how many lies they have been telling and how high theup goes. >> alisyn: yesterday when we reported we thought maybe a handful of low level functions in the cincinnati office. but today it turns out higher-ups and supervisors did know this was going on. according to abc news, the woman who was in charge going doling text exempt status, lois lerner. she knew they were targeting tea party groups and even the irs commissioner had been told some of this is going on and then in testimony in 2012, he denied

this was happening. >> tucker: you almost never get this where we actually get the facts. people have suspected this for a long time. the reason that douglas shulman was testifying in the first place because a number of conservative groups were complaining they were getting audited by the irs. we know that before the testimony in congress. i think it's criminal. it will be interesting to see the after effect. who will be punished on this or brought up on charges. a class action lawsuit. >> clayton: can you go after the irs in this? we know individuals can sue the irs. can all these groups and say we were targeted. >> alisyn: in typical fashion, just the low level cincinnati office person whose head rolls for this? >> tucker: on june 29th, 2011 the woman in charge for

nonprofit exemptions learned this was going on. march 22nd, 2012, i'm quoting, shulman was adamant this wasn't happening before testimony in congress. if that is true that sleig flat out. >> clayton: we're also learned what unfolded in benghazi and there is a movement -- you recall there hasn't been any special prosecution board to actually go after and look what happened in benghazi. now, we know that there is pressure on speaker boehner this morning to try to appoint a special prosecutor to go after more details on benghazi. so far, i believe the signatures. >> alisyn: 144. there were 139 signatures. >> clayton: overnight, 139, up to 144 co-sponsors. it's putting boehner on the hot seat.

>> tucker: congress has the oversight role of the executive branch. in recent years during the '90s, bush years, we saw special prosecutors appointed by the special branch. republicans don't want that. they don't trust obama administration. it looks like the house will investigate this themselves. >> alisyn: what boehner has said he has not decided whether he wants to appoint this select committee because he believes the committees that are investigating, benghazi, for instance, or doing a fine job and he am froongly confused about what a committee could do that the house oversight committee isn't doing. >> clayton: does it come down to subpoena power? >> tucker: they have subpoena power. my understanding it may be symbolic. i want to point this out again and again. this story was not covered

basically from the end of september of last year until this week by anybody, certainly on television but fox news. there is fascinating study cheryl atkins. she is excellent and she has been covering this. many of the stories have not made air because cbs news executives said you are pushing too hard on that story. talk about vindication, she is vindicated and so is fox. >> clayton: on the subpoena power specifically, people will not come in and testify. ifer 50 years old and two kids and mortgaged, you are not going to go in and give testimony unless a subpoena is thrown your way you don't want to risk your career. >> alisyn: we'll have more throughout the show because things are breaking every hour. >> more headlines what is happening. >> this is new overnight there was standoff with a gunman who was holding three children hostage in new jersey. finally it ended more than 36

hours and police say all three children are safe. the man that barricaded himself inside after he reportedly killed a woman and one of her children. they won't say how it ended but a press conference is expected later this morning. >> there are clues about ariel castro the man charged with raping three women in his hell house. ten years ago people say they saw gina dejesus moments before she vanished. they reported a man talking to her. police say there is no record of that call. meanwhile, construction crews boarded up the house of horrors to protect the evidence inside. >> there is growing concern this morning for one neighborhood in the northern california town of lake port. hillside underneath it is sinking. let's look at this house. it is dangling on the edge. so far eight homes had to be

business and he is suing over it. we are joining by dr. steven hosi, founder of health and wellness center. >> nice to be with you clayton. >> clayton: how does it specifically go after obamacare. how are you suing? >> if you ask me on a legal grounds. we are suing on two major points. first, the origination clause. as you probably well aware, chief justice roberts declared eight tax. all tax revenue bills must started in the house of representatives. revenue portion started in the senate. so we are suing on the origination clause which is article 7, section 1. we are suing on the fifth amendment under the takes clause. government cannot mandate me or any individual to do business with another private individual. it can take our money and redistribute our wealth but

cannot force us to do business with anybody. so those are the legal grounds on which we're suing. on a taxing, we're the most conservative state in the entire union. we do not like obamacare down here. it's unpopular in texas. texans have always stood up against tyrannical forms of government encroachment. this is federal encroachment in what should be a personal responsibility. >> clayton: so let's get specific how the encroachment would hurt your bottom line. you have 70 employees there and you rely on health savings account. what would obamacare do to these 75 employees? >> the health savings account is part of our program to provide healthcare for our staff members so we have a high deductible which we self fund this. so what we've been able to do is keep our insurance costs down

for our employees by providing them a portion of health savings account matching them dollar important dollar and high deductible. so the premiums are low and health insurance doesn't cost much. we do natural approaches to health and people on our program we keep them in in a program that helps them maintain health. we have very low costs. this is going to force our organization to have to buy health insurance with he deductibles, high premiums. it's really not going to be able to allow us to fund the health savings account which is going to be worth less because the insurance will allegedly cover everything. it takes away customer health insurance policies so insurance companies are going to make us spend more money. >> clayton: where does the lawsuit stand now? >> the lawsuit is in federal district court in houston.

within two weeks we will file for a temporary injunction blocking obamacare no matter what happens it decision will be appealed to the fifth circuit which is new orleans. that is a very conservative circuit and we anticipate to be upheld and go on to supreme court. >> clayton: another supreme court health care battle. >> it's going to be a great summer. as i'm saying, as texans we're excited to take on the federal government again. >> clayton: thanks for waking up early. >> coming up here on the show the benghazi gated deepens what will congress do? congressman willie gomers joins us. the last time prince harry was overexposed in vegas. now, he is back in the states and becoming a warrior.

the person that ultimately gave the first order to stand down. >> tucker: is it so hard to find out? >> we have people impeding the investigation. we heard that wednesday. i've been really honored to work with darrell issa and his committee and have talked to numerous people that are involved. >> tucker: on its face, you are in congress and have oversight. its simple question. >> people felt like coming to congress is a game. it's not a game. you look at 1505, more people need to read this. whoever by threats or threatening letter, communication influences, obstructs or impedes basically an investigation of congress goes to prison for up to five years or eight years if it

involves a death or terrorism. this is quite serious. it also goes with the story you were reporting earlier when the irs has come before congress and not truthful. >> tucker: here a precise example. june loisler lerner learns that irs has been has link conservative groups. the head of irs goes up the next year, 2012 and says, there is absolutely no targeting. this is kind of back and forth that happens. its flat out lie. >> we've got to get back to the rule of law and this administration, for example, has given documents in discovery to terrorists and won't even give them to congress.

they have impeded investigation after investigation, whether it's fast and furious, whether it's the irs. would you consider it impeding when somebody gets a call and say don't cooperate with the congressman who is coming. >> tucker: that is totally illegal. but in this case, shulman no runs the irs, still runs the irs. nobody has been fired. >> that is where we have to finally -- and i hope our leadership will step up to the plate. this is too serious. this is about a separation of powers. if we do not stand up for the vacation of powers and the oversight authority of congress, then you might as well crown somebody king and go on because we have allowed this great experiment in democracy to crumble. >> tucker: if the administration will use the irs to punish it's political enemy, what won't it

do? >> that is what we need to find out. they will order military members to stand down who are ready to save our military members. the administration released a report that glen dougherty died when seeking cover. that was lie when they released it. they were heroes. other individual had his leg blown off with ty, he is still undergoing surgery and rehab. there are answers and we should not stop until we get them. that includes punishing anyone who has impeded the investigation. this is too serious. people that throw out the word political. obviously we have found out this was political by this administration to get elected again, just like richard nixon did in breaking into a political headquarters. just like covering things up --

nation, 13.3% then they would still tax more than texas. in fact, california got rid of their property tax or their sales tax, they would only be slightly less than texas. why is this important? you have the president in texas last week talking about jobs. if you look at the two biggest states in the country where one fifth of americans live, california is most like the president wishes to have. how many jobs has created in california since he has become president? on per capita basis, texas has ten times as many jobs than california. >> alisyn: what do californians get for their high tax burden other than nice weather? >> well, that is a great question. they get a lot of regulations. with all of those bureaucrats they have among the highest

regulatory burden in the country. there was study that was done when i was in legislature. i served there for six years. average small business in california pays about $134,000 per year in regulatory compliance costs. that is what the burden of government does for the golden state. >> tucker: one of the reasons that texas is booming is energy, were in the midst of a energy boom. california could participate in that boom but they haven't so far because they may have about two-thirds of nation's shale oil underneath land in the center of the state but they can't get to it because of political prohibitions against it? >> this is absolutely correct. what is happening in california, they want to regulate the oil before it comes out of ground. there has been a move afoot to curtail or even prevent fracking what is the technology which has

revitalizeded the texas oil and gas fields. once it gets to the surface they wanted to tax it more by increasing taxes on oil and gas. this has been going on for quite a while. when i was in the legislature in california, i had a bill that would have opened up the first new offshore oil lease in california for n 40 years. it passed the state senate but the sierra club and other environmental groups squashed it when it got over to the stated assembly. >> alisyn: chuck devore, thanks for being here. >> happy mother's day. >> tucker: raising glass to mothers, best bottles of wine for mom that won't break the bank. >> alisyn: why not? hicks is not a political person. he is not a right winger. he is a registered democrat that voted for hillary in the primary and obama twice. it adds credibility to his testimony. there is no way i can write him as an activist or tea party guy. he is career military guy. >> alisyn: all the military efforts experts we have had on, maybe the air ships weren't ready to go somehow and change the course of events over those seven and a half hours. why didn't we even try? here is the general on the show last night. >> the order to actually engage troops in a rescue operation has to come from the president unless its military facility. then the commander has certain authorities, but it has to come from the president to put troops in harm's way. now, in that case because we don't know enough of the details that could have come from the

commander of the africa command that told them to stand down. play that all the way out. who told them not to allow that. when you are under attack, we are going to be there. that was the whole point of it. so to say that we didn't know enough -- i don't buy that. i think that is incredible and i think somebody needs to task over that. >> the question still unanswered as to what the president was doing that evening. we don't know minute by minute accounting of where the president was, what sort of phone calls he was taking. we certainly know every moment as the president was dealing with the osama bin laden raid. all the photos, all of the testimony, the minute by minute accounting of how it unfolded in pakistan. >> alisyn: and committee got closer on wednesday when they said they tried to get to the bottom of who gave the order to stand down. i think it was gregory hicks it was africom.

that have come under irs scrutiny? >> happy mother's day. >> alisyn: how did your news network figure out that the conservative groups were being targeted? >> our sister organization has been probably one of the most high priority organizations targeted by the irs for the last three years. they have gone through process of applying for 501 c status and asked for donor lists to every email sent by any employees. we know there was something going on but we are law abiding citizens so we went along with the process. >> alisyn: so as long ago as three years ago something was fishy. did you try to shed light on this? >> we did. the first round of questions, we expected that. we knew that most tea party

organizations know that you are going properly vetted. but irs asked for lists. we started talking about organizations, we knew something was going on. there was a couple red flags raised. thirds round came, probably about six months to a year ago where they asked for every email every social media, everything the tea party.net had written out to any of the donor lists or to anybody that signed up for emails. at that point we know there was definitely an issue. like i said, who would have thought that the united states government would target their own people. >> alisyn: and your example highlights what the irs is attempting to do makes the process much more burdensome for tea party organizations than for any other organization to gain that charitable status. is it your impression this is a group of handful of low level people but do you think it went

higher and supervisors were in on it? >> we have seen scandal after scandal in the obama administration where the buck stops at the front door of the oval office. i think especially if i look a year ago you had seven senators calling for the irs to investigate organizations like the tea party. when you have chuck schumer has the largest dog of the seven and others were lesser senators you know they are basically taking the fall for a lot of other senators that called for this action. >> alisyn: thanks for sharing your experience with this. this is story that is not going anytime soon away anytime soon. thanks so much. >> they lost their son when a helicopter carrying navy seals was shot down in 2011 but they still don't have the answers they want. they say they are sick of waiting. >> u.s. government and many high ranking military people own more

father, john branard asked me to speak this morning on behalf of him and his family about the death of his son, captain john randall branard the third who was shot down in afghanistan in a helicopter crash. he, too, is waiting on the truth from u.s. government. they have told him that they will come forward with the truth, but at this point he is still waiting. also, you need to know that other parents besides the four that stood the other day are supporting us and agree with us and waiting on answers. one thing that i want to say right up front, i understand their reluctance to come forward with the answers because it's going to be embarrassing at best. one answer they can come forth with right now, is on thursday, we exposed the video of the

ceremony at bagram air base. the parents' beef is not with islam or with the imam who prayed. it is with the united states government and the people in the military who allowed this. so far, since thursday, there has been no statement from the white house or from the pentagon. an apology. it's too late for an apology. now, what i would like you do as commander in chief, i would like you to step forward, be a man and defend the policy in this united states government that allowed the body of a slain warrior to be desecrated and allows the god of abraham, isaac and jacob to be mocked. that is the god of our family. we want you to step forward and we want that person who allowed

that policy or where that policy comes from to defend it. please do that. just as you did, just as you showed outrage when the korans were burned. just as this administration made sure to show the american people how much you honored osama bin laden's body. tell us why you didn't do it for slain american warriors. >> tucker: it would be interesting to know why an imam was there in the first place. you say in the aftermath of the aforementioned death of osama bin laden, seal team six was supposed to be classified. it was publicized. obama people thought it was to their advantage to talk up seal team six. you believe that it put your son and his comrades at mortal risk. >> we know it did.

within 24 hours joe biden outed the navy seals. get everything off of it. his voice was very nervous. what is going on. he said, mom, listen there is chatter and all of our lives are in danger including yours. we absolutely know they put a target on our son's back. we know a lot of things happening in afghanistan where we have evidence this team was being sought after. more evidence is coming out every day when it's released they killed the most high ranking figure in al-qaeda's history. >> tucker: and for political ely.ons? >> tucker: to win votes. is it your understanding that other members of seal team six were as outraged and afraid of the ramifications of this publicity? >> tucker, there is video of secretary of defense robert

brunch time with me. >> all right, let's get to news, we were telling you that it appears the irs is confirmation targeted conservative groups like the tea party over other groups. they made it much more burdensome when tea party organizations wanted to form a charitable organization. irs made the paperwork the legal things so much harder for anybody that this trearp or patriot in their name. now, we are learning it may have gone on longer and gone up higher. >> tucker: since 2001 they were targeting the political enemies of president obama. there were complaints about this. tea party groups and conservative groups went to their members of congress we are getting yanked around by the irs

and there was hearing on this in 2011 in 201 house, i was and means committee held a hearings and douglas shulman was asked if this is true. he said this -- there is absolutely no targeting. this is the kind of back and forth that happens to people. it turns out that is flat out lie. it was known within the irs at high levels this was going on and commissioner said it wasn't. >> clayton: further these groups raises the question there could be a class action lawsuit. all these groups know they have been targeted specifically and preventing from getting a 503 status. they say they lied before congress and they lied again yesterday when they admitted to these wrongdoings. we must know how many more lies they have been telling and how high up the chain the cover-up goes. we talked yesterday.

it sounds like a brad thor washington, d.c. political thriller novel that this could happen. the fact that it is happening. >> tucker: you are not allowed to use irs to crush political enemies. richard nixon did it and he was forced to leave office in 1974. it's against rule of law itself, we are going to be treated equally by our government. >> alisyn: but we don't know exactly how high it went. at first we thought it was a handful of people. i believe the since national ti office was doing it. then we found out as early as 2011, lois lerner who heads up the division that oversees tax exempt status she was aware some of these lower levels employees were doing it and he is with tea party newsletter, they have been aware of it for at least three

years. >> it's the high priority organizations targeted by the irs for the last three years. they asked for every email, over social media. everything that tea party had written out on donor list or anybody that signed up for emails. we knew there was an issue. like i said who would thought that the united states government would target their own people? >> clayton: we will continue to follow that story. we have following at fox news the story in benghazi, an update this morning. you would assume to get more answers, the attorney general and the administration would maybe wanted to appoint a special prosecutor to look more deeply into this. we now know that eric holder, they are not planning appointing any special prosecutor. now, speaker boehner is under enormous pressure from republican colleagues to appoint a special committee. >> tucker: i think it's fine

with many members of republican congress that the attorney general does not appoint a special prosecutor. they don't trust obama administration to appoint a prosecutor that is tough and fair. that is how broken in the washington. and with stories with the irs scandal, it's not surprising. >> alisyn: as you remember, i can't remember when she first appeared. when hillary clinton appeared in congress to answer questions about benghazi, she said one particular quote that many people got on. what does it matter what you call it, who what does it matter who was responsible who was killing our americans. let's remind you what she said. >> the fact is we had four dead americans whether it is a protest or guys out for a walk decided to kill americans. what difference at this point does it make. >> tucker: it makes a lot of difference to the families of

survivors and to a lot of other people that it's important to bring the perpetrators to justice. there is not a single person in custody. pat smith the mother of one who was killed had this message. >> i want to wish hillary a happy mother's day. she has her child, i don't have mine because of her. i know they felt bad. i could feel it. i could feel how they felt. that is how i felt, too. but the government doesn't care. they don't care about us people at all. all they have to do is tell me what happened and i would have gone away. but they didn't even bother. i was an unimportant person. now i'm an unimportant person that doesn't have a child for mother's day. i feel it so deeply. they cannot understand how i feel. >> alisyn: that is heartbreaking to hear on mother's day.

obviously the victims' families want more answers. apparently and now that the whistleblowers have testified it does seem like more and more information is coming out every day on this. let's hope they get answers. >> alisyn: meanwhile, more to tell you about, overnight a standoff with a gunman holding three children in hostage in new jersey have finally ended. police say all three of those children are safe but the man barricaded himself after he repeatedly killed a woman and her child. a press conference is expected two hours from now. growing concern in a northern california town of lake port. hillside under the entire community is sinking. look at this house is dancing on the edge. so far eight homes had to be evacuated and ten others are in danger right now. >> we've always loved it up here. it's just devastating.

all of this has been happening within two months. we're trying to stay optimistic. >> alisyn: engineers believe water that has bubbled to the surface is playing a role. a burglar stole everything from a florida family's garage and decided to give it all back? a security camera caught him loading up his truck with family's belongings. they were trying to track it down. yesterday he returned to the home. >> i saw the guy from the footage putting back over my wall from the front yard all the stuff that he took last week. >> alisyn: not only did he put everything back he also threw in an extra $50 and high wrote a note. in his note the man said he not the home was empty. he apologized. that is wonderful story.

irs is under fire for targeting the political enemies of president obama and then lying to congress about it. >> clayton: the agency apologized for that raising groups but officials knew about

it as early as 2011. also here to weigh in is chris wallace. how big a deal is this? >> it's a big deal. i will tell you, it's a big deal among other reasons because it crosses party lines we saw rough editorials, not only the "wall street journal" but in the generally liberal "washington post." remember during watergate, one of the great concerns that president nixon had used the irs for political purposes. this crosses party lines, all sides are afraid of the idea and certainly no indication at this point that the white house was involved in this, but the idea that the irs is using police powers for political purposes. >> clayton: you better watch yourself with tough questions on fox news sunday. you may end up being audited as a result of it. you have to watch yourself? >> let me say that is why -- i

think i'm safe. in any case, i'm careful on my returns. i don't take any deductions that i'm not entirely sure of. >> clayton: this is the question. these political opponents, just the cincinnati office with some lower level folks in the cincinnati office. do we have a sense of where it is going? could it blow up if it goes up higher? >> it could but we don't know. when the story originally came out on friday it was a mid-level irs manager the person in charge of the tax exempt applications who said she had found out that her staff that it was last year in 2012. the inspector general is going to come out with a report this week that indicates she first learned about in june of 2011. she said she then ordered there

be an end be put to this immediately. in 2012 a number of conservative groups, tea party groups were still getting intrusive demands from the irs for information that they shouldn't have had to employ like their donors because the fact they were tea party or patriot organizations. we know that later in the spring of 2012, then irs commissioner shulman denied there was any political ramifications. it certainly was wrong but whether or not he knew and whether or not he knew about the policy. >> who is on show this morning? >> we will be talking about this and then talking about benghazi which, of course, is blown up with all the indications that the talking points were politically scrubbed by the state department and white house in the days after the 9/11 attack. we'll be talking to the chairman of house intelligence committee, mike rogers and top democrat on the house armed services

she is watching right now. is this a myth? >> what we do know that is definitely a myth. the hair grows in the follicle. there is nothing you can do to affect what is going on deep down in the follicle. the reason this is myth and the reason why people think there is some truth when you shave you shave off the top of hair so it seems thicker but it's not actually true. >> so you are sitting in your restaurant and you you don't want to put it under table and you swallow and your mom that will remain for in your stomach or decades? >> that not true. the problem with chewing gum, it's not usually digestible. it will pass through you. it doesn't cause problems. except for a few rare ports,

if jay carney and president obama and others are to be believed, white house is nothing more than a mouthpiece for the c.i.a. and/or the state department. >> alisyn: we do know now as a result of this week that the state department did change the c.i.a. talking points, original c.i.a. talking points had a half of dozen references to an an al-qaeda or an affiliated group. they expunged references to al-qaeda. is there often this sort of fight between state department and c.i.a. where they both take a crack at talking points? >> it's not easily a fight but a collaborative process. another the behest of whatever administration is in charge. because the white house, they are the owners of the talking points. they are the ones that have to go out there, whether it was the ambassador susan rice or whatever the situation is, they

are talking points. so the c.i.a. is basically what they always are, an objective analysis and collection point for intelligence. for months and months before the attack, they were report becoming a deteriorating security situation. they were reporting on the numerous attacks that had taken place on the various entities and organizations that were leaving benghazi because of that problem, about al-qaeda and sharia, about surveillance of the benghazi facilities. they were reporting all this. when they put that in original talking points, the white house looked at it, this doesn't fit our narrative. go back and do it again. they directed that through the state department. i suspect what is going to happen, state department is going to be, i think, the fallback and they will be tossed under the bus.

i know you just received the g.i. spirit award. that's exciting. >> i'm going to wear -- if they pin me, i'm going to wear it on my pajamas because after today i will just be a mom doing chores. i will be wearing my, i'm so fabulous pin to remind my teenagers how much the military loves me. >> that's fantastic. i know teenagers sometimes need to be reminded, though i would be stunned if they don't know about your fabulocity. let's talk about how you received this award for your charitable work with the military. there are so many charities out there the military could get involved with. why this one? >> i met this guy named christian terow, who has done this documentary about a horn hornet's nest and father and son and the next ning i know we're writing a soundtrack and here i am in d.c. with serious mojo, as i walk into the screening of the film with the generals and the

powers that be and just knowing since i was 18 years old with bob hope singing to the vet's on vet's day at the veteran's wall, i've been a part of the military families since 1984. this is just a continuation of what my passion is, which is the military. this isn't about war for me, about the family, fellowship and community and the fact music is a healer. when i go and sing these songs, this is who i'm singing to. these are my fans. >> you have performed private concerts for wounded warriors and welcomed home the troops at fort campbell on multiple occasions. what's it like to work with the military? >> it's a piece of my life i do that reminds me there's a bigger picture that my stuff is small compared to the big picture. meeting mike has been just an amazing experience, him as well as his son. this documentary is nev never -- it's an unlike anything

you've ever seen documentary, no line, no actors. >> before i let you go, tell us a little bit about "the hornet's nest." >> "the hornet's nest" is basically men who are brothers and i'm talking about the kind of oath i don't know you and i would be willing to make, you are for me and i'm for you in whatever circumstance. if you are in trouble, i will carry you if you're in trouble from being exiled or killed. it's a documentary unlike anything else, where you actually see these men literally walking into the hornet's nest and saving each other. their oath is, we're brothers and nothing can change that and nothing will change that. that is pretty deep stuff. >> it really is. thanks so much for explaining it to us and being such a supporter of the troops. it's powerful to listen to you this morning. wynonna judd. thanks so much. >> we live in the greatest country in the world. let us be grateful.
