that. >> heather: strong words. steve centanni is live in washington. judging from the sunday talk shows. what is next on in the ongoing benghazi controversy? >> as you heard senator mccain talking there. she demanding a select committee investigate the meat. republicans are claiming there was cover-up as the administration tried to make the attack look like the aftermath of a spontaneous demonstration instead of the preplanned terrorist attack that it was. four americans including the u.s. ambassador to libya were killed. darrell issa who led the congressional charge against the handling of affair, too many questions still remain unanswered. >> was the response correct? could it have been better? why weren't things at least tried? those are important questions. how could you change talking points 12 times from what seems to be relatively right to what seems to be completely wrong.

>> reporter: lawmakers are livid over reports that the federal government apparently used it powers of tax aches to unfairly targeted certain groups. a report reveals that the word tea party and patriot were among triggers that sent several months of applications for tax exempt status to a team of specialists. >> the conclusion they did have agents engaged in intimidation of political groups. i don't care if you are a conservative, a liberal democratic or republican, this should send a chill up your spine. >> reporter: jay carney believes that the american people expects and deserves to have the very best public servants with the highest level of integrity on their behalf. carney said the president expects swift punishment for the

th misconduct. it's both parties and both houses of congress for an investigation. >> i'm concerned about that. my understanding is the inspector general is doing a report that report should be out shortly. i think we have to take a good look at it. >> they targeted conservatives for tax exempt status but bottom line they used key words to go after conservative. this is something you have to institute changes to make sure it doesn't happen again. >> reporter: congressman issa accused the irs of league the inspector general's report to spin it in their favor. >> gregg: peter, thank you. >> heather: fox news alert for you now. several new development needed the case of three women rescued from a cleveland home after being held captive for nearly a decade. for the first time. look at this. we're sealing the dramatic rescue as it actually unfolded.

it was captured by two girls that captured it the moment it went down. it shows police trying to pry open the front door. all three women releasing a statement today saying that they are extremely grateful and happy to be back at home with their families. live from cleveland, ohio with more. so what else did these women have to say? >> they certainly wanted to thank everyone for the outpouring of love and support this past week. really over the past ten years. gina dejesus saying i am so happy to be home. the three women, they also said at some point they might want to tell their story but until then, they are just asking for time. take a listen. >> they have asked in fact have pleaded for privacy at this time so they can continue to heal and reconnect with their families

and their lives. >> today, of course, is especially important day. it's the first mother's day they will have the opportunity to be with their families in the past ten years. >> heather: so, how has the community responded to these women? >> it's really been incredible. people in the city, they have been seeing these names and faces on flyers over the past ten years. there is so many people that feel connected and are celebrating their safe return. they've been getting gifts. there have been marches and rallies and fund-raisers and gifts ranging from flowers and cards to a kid's bicycle. several local car dealerships has expressed interest in special welcome home gifts. more than $50,000 has been raised in a part of the cleveland courage fund that will help these women as they

continue their long and difficult process. it's been amazing to see the celebrations that are citywide. so many people feel connected these women and are happy they are safe and home again. >> heather: important to hold on the positive aspect of this when so many gruesome details come out as to what happened while they were being held. thank you garret. >> gregg: a very tense standoff coming to an end after 37 hours in trenton, new jersey. police storming house early this morning. the suspect, a 38-year-old convicted sex offender barricading himself inside with three girlfriend's children as hostages. officers managed to save the kids but the captain was killed in the process. >> teams members made entry to the upstairs apartment, confronted murphy and rescued the three children following our entry.

a single shot was fired by our entry team to stop the threatening action against one of the children by murphy. murphy was wounded. he was taken into custody and transported to the full ton medical center by trenton. he has since died of his injuries. >> gregg: inside the home they found decomposing bodies of the suspect's girlfriend and teenage son and appeared to have died two weeks ago. >> heather: now to another shocking arrest, this in the murder of a little girl in northern california. two weeks ago, eight-year-old layla fowler she was stabbed to death in her home. they searched for a possible intruder but a heartbreaking result. william is live in los angeles with more. >> this is the last person people suspected of brutally stabbing this girl to death with a knife. her 12-year-old brother, according to a news conference in sack that left hundred people

gasping expecting to hear that they had locked up a mad killer on the loose only to hear the suspect was one of their own. do police have a confession or just physical evidence tying this 12-year-old to a sister's murder. layla was fatally stabbed in her home on april 27th. her brother claimed he saw the killer. a tall hispanic man with long gray hair flee the house. a neighbor corroborated that story but later recanted. suddenly the boy's story became suspect. news of his arrest stunned the entire community where everyone seems to know each other. >> saw the family the other day and gave the family a hug. >> i was very shocked now. >> so the murder of such a young child made headlines.

massive numbers of volunteers looked for clues while a 12-year-old baby-sitting claimed to have seen the man running from the house and called 911. she died from multiple stab counds. police seized several knives from the home to see if one was the murd weapon. >> during the past 15 days, we have conducted and extensive investigation. these types of cases require a certain amount of time. it was our commitment to make sure that we did a thorough job as possible. >> reporter: we have chosen not to reveal the boy's name. he is a minor but it is widely available on the internet. police say he will be charged with murder. >> heather: william, thank you. >> gregg: all right. i want to show you this dramatic capture of one of the world's most wanted fugitives caught on videotape. this happened in spain, police

snuck up on the fugitive as he sunbathed by a luxury home. there you see the officers hiding below the walls as they move in on the suspect. then they decide to swing into action but the fugitive, well he didn't go down very easily. 31-year-old andrew moran tried to get away even managing to jump on a roof on a nearby outhouse before being captured. this is luxury home? and according to british police, he was armed with two guns and a knife. he has been on the run since he assaulted security guards and escaped in a trial for armed robbery and he and colleague are accused of stealing $40,000 from a mail truck. in his shorts, captured on television. >> heather: like a movie. >> gregg: there a lesson, if you are fugitive on the run, always dress well, you never know when you will be caught. >> heather: true. president obama trying to bring

thing back to life somehow? let's bring in brenda buttner, anchor of "bulls and bears." is this happening because congress said you promised this it was going to cost this much and cost overrun is ridiculous? >> it's amazing. congress has said no. it was supposed to cost about a billion dollars to implement. the cbo says it will be between $5-10 billion. that is huge difference to the point we have a secretary going around hat in hand, please contribute so we can basically make people aware of this law. >> gregg: the tactics would seem illegal. you can't use your position in official capacity to press people for cash. it's corruption. >> they are saying she is encouraging organizations and healthcare executives to donate, not actively asking for contributions.

>> gregg: but the success of obamacare depends on whether or not enough people sign up for it. >> absolutely. if young, healthy people do not sign up for the healthcare exchanges, then the chroniclely ill are going to be part of the intire plan. which means that your premiums are going up, the cost of businesses are going up. there is no way this works unless young people sign up. the penalty for not signing up is less than the insurance may likely cost. it's not clear. >> gregg: and the healthcare exchanges are a total and utter mess right now. they are not happening in many states. they won't have it for very long time. obama administration has ironed 2,000 waivers to companies and unions that supported the president which a little bit suspect. let's put up the kaiser poll. 41% of americans are not even sure whether obamacare is the law of the land or not.

>> it's confusing. certainly the 15,000-page document, i doubt many in congress know what was in it. now implementing it is turning out to be a nightmare. by october, these healthcare exchanges are supposed to be in effect. only 16 states have them. the reason for the cost overrun, is the federal government has to step if the states are not doing this. the states are saying no way, we don't want part of this. >> gregg: we remember the president making all kinds of promises associated with obamacare. >> he said obamacare would pay for itself, premiums would drop on average $2,500 per family. healthcare costs would go down and you can keep your own insurance and doctor if you want to. have any of those things come true? >> you look at for businesses, costs are going up. many people have already seen their health care costs, premium

yults go up because they are worried how much it is going to cost. any of the others, it's up for grabs. i don't think we've seen much success. they are working hard to get it going. they are shipping parts of the budget -- shifting parts of the budget in promoting this? >> gregg: fox news had couple polls, only 41% want to keep it. more people disapprove of the president's handling of healthcare than approve. maybe it's in part because of this. take a look at this. is parts of the problem the complexity. 71%, fox news poll, think that more than 15,000 pages of regulations are just over the top. nobody can understand this. >> it rivals the tax code. you remember the speaker of the house, nancy pelosi says we'll pass it and find out what is in it. >> gregg: if you can die jes congested and make sense of 15,000 pages.

oversight. >> heather: fox news one tirmg high ranking officials at irs they new they were unfairly targeting those groups as early as 2011. a government watchdog report that lois lerner who oversees tax exempt organizations knew about the targeting of june of that year. it's now 2013. she has apologized but should disciplinary action be taken? >> i agree. this is scandal and it's an outrage and there is no use for targeting anybody based on ideology. i don't care who you are. as a result of that, you it will actually would support a congressional investigation. i think the inspector general is looking into it. we should get to the bottom of this. this should not be a partisan issue. they should absolutely look into this because there is no excuse. >> heather: it should not

partisan issue but lerner found out during a meeting that groups with tea party, patriot or 912 projects under their name came under scrutiny. i have a copy of a letter here. this was the letter that was sent from darrell issa and jim jordan laying out 16 areas of which they say the tea party questionnaire seemed to overreach. it is addressed to lois lerner. have either of you heard of similar scrutiny my say occupy wall street. >> i don't know occupy wall street tax status. i don't know the details of that. i as i said earlier there is no excuse for it. there would be no excuse by tea party patriots or anybody else. look, the irs is supposed to be a bureaucracy in a good sense of the word because they are

supposed to look at the bureaucratic perspective and not partisan or political perspective. anybody under the scrutiny of the irs knows the nightmare that entails. again, we need to get to the bottom of this. everything brad said i second. it's something we need to look very carefully. >> heather: if there were no political bias were only conservative groups targeted and were these certain groups of people in an office in cincinnati? >> i don't believe that. i don't think bureaucrats on their own would have taken a political bent as julie points out. they tend to be non-political but the appointees tend to be political. that is big difference. somebody told the irs they wanted this done likely to be a political person with a political bent. the faghd to have come out. let the chips fall where they may. heather, there is nothing worse an democracy than a government scandal and government picks on a class of individuals.

government corruption is the worst no matter what administration republican or democrat it falls under. there have been plenty of scandals but there is admission that they targeted a political group at a time of political election, presidential election and that is wrong no matter what side of aisle you stand on. >> heather: does the irs have too much power? in determining tax exempt status the irs ultimately has to determination as to whether the primary activity of that group is social welfare. so, do we need to take a look at how much power the irs has? >> if they don't do it, i'm not sure who would. we do have to have somebody what your social good or whether you are a charity or not. so i suppose the irs in terms of being involved with taxes and

tax exempt status, is the determining agency. you now, regardless of who determines this, whoever actually went through this and brad is right -- if it went to the top of the irs that person should at least resign or should be prosecuted for this. it's inexcusable. i wish brad were right, this would only happen in election year. that apparently did not happen. >> heather: that is true. thanks so much for joining us. >> list for cal footnote on this. one of the impeachment charges against richard nixon, using the irs to politically target people and groups. >> heather: it has been done before. maybe now is the time to stop it. >> gregg: more charges on the way for ariel castro the former bus driver suspected of abducting and raping three women in cleveland. why the potential new charges could allow prosecutors to seek the death penalty in that case.

death of another or the unlawful termination of another's pregnancy while committing kidnapping. if you can prove it, that is aggravated murder, death penalty. >> i looked at the statute 2903. that is right. if you unlawfully terminate the presenting 'nancy of the or it can be a murder. reason it's so important because it's hard to get the death penalty unless there a homicide. there are a bunch of federal law for terrorism but they have never been tested in the supreme court. it's interesting. some law professors are saying, well how are you going to show it. if they charge him with that. >> gregg: you show causation by the testimony of the mother. who is going to refute it. >> a lawyer would be crazy to put him on the stand. you can't get limb dictate what he is going to say. these women are going to come in

and hang on what they say. >> gregg: the lawyer is going to say he did allow the birth of one child, the six-year-old daughter. and kiddy swimming pool inside. does it make sense that he would kill the unborn of the other women? >> we don't know what the women are saying. they are happy to be back home with their families. >> gregg: that going to be argument. he allowed one birth, why would he kill an unborn? >> of course, but what are they going to refute what these women are going to say. >> gregg: there is precedent in 2009, a person attacked his girlfriend and killing the unborn child. he was convicted of aggravated murder. >> 36 states, by the way, have those infanticide, fetacide. >> gregg: but not murder, death penalty? >> they have it as murder. the reality is that this defendant is poster child for

the death penalty. you would have to be kidding me. for no other reason he can't harm anybody else even while in prison. >> gregg: you know, robert, if you kill an unborn child in ohio with the mother's permission, it's legal. it's okay. if you do it without her permission, it is arguably murder. a defense attorney is going to say, wait a minute this is backwards and confused. the unborn child is only a life if the mother says so. can he do that. >> in the state of ohio you can do one thing legal and other thing illegally and we can kill you if you do it this way. we shouldn't be surprised, ohio was the fourth leading state in using the death penalty. they have a 147 people on death row. most in the country. so you can see they are not afraid to use it. >> gregg: we go back to marine
