>>brian: that is an example of a phrase. >>steve: you want people to define what's he singing about? >>brian: right. we'll talk to him at 7:30 eastern time and then watch him sing. this will be exciting. >>steve: i'm playing susaphone. ♪ when a man loves a woman ♪ we've got a busy day. anna is joining us. >> good morning. >>brian: cars go plunging from 50 feet high into the water after a bridge collapses in washington state. this morning we're learning there were warning signs that could have been missed. >> our reporter is following the breaking developments for us. good morning, heather. >> a short time ago we learned three people who were pulled to safety from their cars are luckily all in stable condition this morning. no deaths have been reported thank goodness. you can see the vehicles right here, and they were tossed into a river in washington state.

this collapse happening about 7:00 p.m. last night in mount vernon. that is about an hour north of seattle. a survivor says he and his wife were driving across that bridge when the bridge just disappeared right in front of them in a big puff of dust. a portion of that four-lane bridge apparently giving way in both directions. listen to this. >> we were very fortunate that when this call initially came in some of the deputy boat operators were on duty and were within minutes of being able to launch a boat and be out there and try to rescue the people that were in need of help. >> how lucky they were. no one was killed in that and authorities are now talking to a commercial truck driver whose rig they believe actually hit the bridge and caused the collapse. listen. >> we do have the drubbing drubbing -- truck driver who remained at the scene. we had initial conversations with him to get an indication as to what occurred. that will be ongoing in terms of the investigation.

>> we are also learning this morning that the design of that bridge is apparently outdated. it was built in 1955, according to federal records. its sufficiency rating is well below the statewide average rating. that bridge served as the main route between seattle and canada and now access has been cut off and that could impact traffic for some time ahead. all of this just ahead of memorial day weekend. you may remember that last major interstate bridge collapse happened in minnesota back in 2007, and that resulted in 13 deaths. about 150 injuries at the time. so this could have been a whole lot worse. we'll bring in more as we get it. >>steve: in other news, you know lois lerner, the woman who ran that unit in cincinnati at the heart of the targeting of conservatives scandal at the i.r.s. if you ask me about lois lerner, i take the fifth. here's the thing apparently she was asked by somebody at the i.r.s., lois, you're

going to have to resign. she said i'm not going to quit. instead what they have done is they have put her on administrative leave, and she's getting paid. and she's getting paid a lot. >> should we be paying this woman's salary indefinitely. in 2009179,000 plus bonus. 2010, the same thing. in 2011, 177 thousand dollars. same in 2012. when you put bonuses in there, lerner was paid a total of $741,000 almost for the four-year period. >>brian: she stood up and took the fifth after declaring her innocence. we know if you take the fifth, i know theoretically you're innocent. but if you have nothing to hide, you should be talking. she takes the fifth, makes this to the administration more embarrassing than it already is if that could be possible. i think after the press secretary jay carney had a chance to get questions from the very ticked off

press who were wondering i thought people would be held accountable, she says no. what kind of world is this when you can say no when people ask you to resign because you're doing a poor and corrupt job and she says no i'll take the leave with pay. she gets a memorial day where she wears a smock and cooks for the entire neighborhood while still getting paid on tuesday. >>steve: she is getting paid right now $177,000. remember, she doesn't run the i.r.s. she's not even a really high-ranking officer. she is an official at the i.r.s. in charge of that unit. but she makes $177,000. that is more than a u.s. senator or more than a u.s. congressman. they make $174,000. she's making $3,000 more plus bonuses. rand paul says she's still here? what? listen. >> i would have suspended her without pay. the other thing is we have to watch closely because what they tend to do is

they transfer people around and change their titles. with benghazi, no one was punished for the fact that for six months they begged for security and it was denied by hillary clinton and the state department. she says i know nothing. i'm in charge around here but that decision wasn't made by me. the same with the president. i know nothing. i'm in charge of the country but i don't know anything about that. attorney general holder has sort of same opinion. i'm in charge around here but i think i recused myself from that decision. i wasn't involved. we have all of these people, nobody wants to take responsibility. and when they say someone was reassigned or fired, we find out they're still in their position at the state department. >>brian: one thing consistent: nobody ever takes responsibility for anything. it is never your fault, the person in charge didn't know about it. it just seems to be okay. when you have congress men and women totally exasperated by people supposed to be in charge not taking responsibility for things they know went

wrong, it is not the way things are supposed to work. >> pointing fingers. where's the accountability in this? really to rand paul's point being promoted for politics, state department official victoria nuland, she is the one who changed the benghazi talking points, or one of the ones who did that, she is getting nominated for assistant secretary of state. where's the accountability on this one? >>brian: i don't blame her at all. she seemed to be the mouthpiece of higher ups who said hey, c.i.a. -- >>steve: we don't know exactly what her -- we know that she asked the white house and the c.i.a., go back and whitewash the talking points. there she is back when she had that job. we don't know exactly what her capacity was -- >>brian: in the e-mails she indicates higher up in the state department would like this changed. it doesn't say i, victoria nuland, want this changed. for example, when people get mad at jay carney, if you don't like the way he's spinning it, he's not setting the spoil.

>>steve: as we continue the scandal palooza at the white house, you know james rosen, investigated by the white house, also u.s. attorney general came up with crazy trumped up charges and tried to get a judge to sign -- and he did. also he was essentially a coconspirator in violation of the espionage act. who ultimately signed off on the search warrant of james rosen? the answer is eric holder, the attorney general for the united states. and what's delicious about this and troubling at the same time is that you know yesterday the president of the united states ordered a 45-day review of the leak investigation. and who did he put in charge of it? eric holder. in other words, eric holder will be investigating eric holder. here's the thing -- pwroeupb he has a habit of recusing himself without telling anybody -plt maybe

two-year-old son. he joined the army in 2006 and served in afghanistan. the brave cub scout leader who confronted one of the terrorists head on says she was not even scared. >> [inaudible] >> she says the attacker told her he wanted to start a war in london and she told him you're going to lose. this morning more about the massive twister that tore there oklahoma this week, destroying 12,000 homes, meantime there are incredible stories still coming out of more like this one. sandra adams reunited with the guardsman who helped save her life. she wanted to give him back his jacket. he gave it to her during her rescue. >>brian: let's hope one day we don't need that banner. while the i.r.s. scandal continues to grow, reports suggesting they are not the only industry intimidating conservative groups. requests for freedom of information documents frequently delayed and denied to conservative groups, and now stuart varney says that is just the start of it. you mean it's bigger than the i.r.s.? >> yes, it is bigger than the i.r.s. there is the suspicion here the machinery of government has been used to suppress

conservatives. the election in fact was not a level playing field. there was a tilt and it was orchestrated by government bureaucrats. you just mentioned the e.p.a., environmental protection agency. almost always when liberal groups apply for a waiver of document fees, they were granted that waiver. conservative groups had to pay. that's a form of financial pressure on conservative groups. you've got disaster relief funds. four states, red states run by republican governors, denied disaster relief funds. then you've got the i.r.s. it's not just a tax-exempt office. conservative supporters, supporters of conservative groups were audited as republican donors audited. there is a consistent pattern here. so republicans, conservatives, they're looking back over the last four years and saying there is a pattern. there is a pattern of going after conservatives which affected the election. the government bureaucracy

was used as a hammer in a way in which it is not supposed to be used. >>brian: it is hard to argue with the examples you put forward because you have living breathing people who have proof of it. we still don't know who is the conductor of this orchestration. >> we don't. that is what congress is trying to find out with all these investigations and hearing. how far up the food chain does it go. whether or not you establish a connection between the campaign and these events or the white house and these events, i don't think that's the story. the story is was government used to hammer the president's political opponents. these examples suggest it was. where the order came from, that's an entirely different story. but if the government was used in that way, that is wrong, flatout wrong. >>brian: one more thing. out of nowhere last spring after mitt romney gets the nomination, we hear we need his taxes released. harry reid makes the speech, i have proof he

hour, hours meeting with them afterwards just being one of them. joking, feeding them lunch, being a host. he's truly one of them. let's have a look. >> during my presidency and post presidency, i've tried to let the families of our troops and the troops know how much i admire them and respect them. one way to send that signal is to invite them here to our ranch and ride mountain bikes with them. so we've got a handful of wounded vets with us here. but it's really a signal to all the vets that laura and i love them and respect them. >> actually the 15 wounded warriors who rode yesterday -- amputees, post traumatic stress order, traumatic brain injury -- they consider president bush a fellow soldier and still consider him the commander in chief. let's watch. >> he's the one that i served most under. it was great to be able to

16-year olds hacked into their teachers' computers and changed their grades. >> the f.b.i. showed up, and two of the three kids got hauled away in handcuffs. >> they do need to be punished for something like that. i don't think you should ever change your grades. >>anna: cops say the students admitted they did it and now face criminal charges. >>steve: amanda bynes will be in a new york city courtroom this morning after she was arrested for pot possession. that is her under the hair. sources tell tmz -- >>anna: looks like a wig. >>steve: sources tell them a building official saw bynes in the lobby with a joint, but by the time the cops arrived she was in her apartment and let officers in. that's when they spotted a bong and she allegedly tossed it out the 36th floor window. bynes was briefly taken to a hospital for a psychiatric evaluation

health insurance, and obamacare was intended to remedy that. that's what the president said. but what happens when employers can't afford to insure their employees? the result? more hours cut. workers earning less money. and the bottom line in some cases employees being laid off. our next guests are stuck between a rock and hard place. with us is andrew hemmingway and alan farp, c.e.o. of the restaurant chain lion and rose, which i believe is an irish pub. good morning to both of you. andrew, when obamacare went through, and as we get closer to the complete implementation, you sat down with your accountant and you guys figured what with regard to how many employees you can have on staff? >> this is one of the great questions. when we sat down and started talking even several months ago when obamacare was passed, there was very little guidelines given from the administration on exactly

how this bill was going to be implemented. and even today there's still lots of questions. i read this week that they're writing over 400 new pages a day of implementation guidelines. even today, even talking to my accountant in the last couple of days we've said we have no idea how all of this is going to be implemented. in my business we used a lot of subcontractors and there's a lot of questions about what do these subcontractors count as? are they going to be included? >>steve: your company, allen, went through the same thing. you had to take full-time employees and do what to their hours? >> we had to cut a lot of our employees. all the hourly employees from 40 to 28 hours a week. with the news lately, the scandals, obamacare has taken a back seat recently but this thing is headed for us like a train. and we, the american people, are on the tracks.

in 2014 this employer penalty is going to kick in. at least it will unless there's enough states that stand up and are able to stymie the progress. but if it does kick in, in 2014 i believe you will see thousands of businesses close the doors because they can't afford to provide the government-mandated level of health care. and th-pb they can't a -- and then they can't afford to pay the penalties if they don't. if thousands of businesses close, you lose thousands of jobs, it shrinks the tax base. i believe that could plunge us into a great depression. >>steve: into a depression, i hope you're wrong. >> obamacare could be the trigger. >>steve: it could be the trigger. andrew, when you look at your business, this is the last thing you need right now, isn't it? >> of course. it really is challenging just to make a profit in good times. running a business is a difficult thing. and then to have your government constantly

working against you, you know, honestly, i told the producer i was a little nervous about coming on the show talking against obamacare in light of what the i.r.s. has been doing. you know, knowing that potentially putting my name and company's name out there, am i opening myself up to scrutiny? i don't know. those things compile and every single day we're learning new things about how our government is literally working against us trying to, for all intents and purposes put us out of business. it's disheartening. >>steve: alan, i'll give you the final word. >> i'm so concerned about the consequences of this that we've actually joined other employers and individuals and filed a suit against the government over this. the reason i did this was to fight for my employees and their right to work a full-time 40-hour week should they choose to do so and the right of our businesses to continue to keep doors open and the right of other business

this morning they are in stable condition in the hospital. miraculously, no one tie died. it happened in washington state, sending two cars plunging into the water. you can see the vehicles in mount vernon north of seattle. the collapse rapid around 7:00 last night. a survivor said he and his wife were driving when the bridge disappeared in a big puff of dust. a portion of the four-lane bridge completely gave way in both directions. take a listen. >> a few people had been over it just before it collapsed. that's pretty scary. >> no one died. authorities say they do not believe other cars are in the river at this time. they are talking to a commercial truck driver whose rig they believe hit the bridge and may have contributed to the collapse. listen. >> we do have the truck driver who remained at the scene.

we have had conversations to get an indication as to what occurred. that will be ongoing in terms of the investigation. >> we are learning that the design of the bridge is apparently outdated. it was built in 1955. according to federal records its sufficiency rating is well below the state average. an investigation under way to determine what caused the collapse. the bridge served as the main route between seattle and canada and has cut off access. that could snarl traffic ahead of the memorial day weekend. many of our viewers will recall the last major interstate bridge collapse happened in 2007. that was in minnesota where 13 people were killed and more than 140 injured. the nts brkb cited a design fla. i'm sure we'll hear the name of the river from viewers. >> they know everything. that will cause a gigantic traffic tie-up for the holiday

in terms of relative population there are more muslims in the united kingdom than in the united states. we have a population of 330 million. their population is smaller, 60, 70 million. they have a problem in dealing with the radicalization of young people. they really -- as onerous as it may be, they have to really enhance their own domestic security. they have to have sources within the community. i really believe that every major mosque, particularly where the preacher is someone who has a history of radicalized sermons has to really be plugged in, in a sense. look at the surveillance we have here against reporters, as besign as you could get. people doing their job. we have justice department and the fbi probing them, following them, sniffing down -- >> eric holder signed off on it. >> it is deeply distressing. it is the evidence of overkill. that's the kind of asset and those kinds of fbi probers of

now some are calling for a special prosecutor or counsel to in fa investigate the irs tactics. could it be to the benefit of the white house? let's talk to robert ray who, as you know as independent counsel joins us live. >> good morning. >> there are actually benefitses to the white house if an independent counsel were appointed. >> sure. you have a huge public outcry. hard to know whether that will continue into next week after the holiday weekend. if it does, it sbeinterferes wi the president's agenda. it calls for appointing a special counsel. >> like what. >> it allows for the president to move on. time for an independent person to conduct an investigation. it allows the white house to say we can't comment further because there is an ongoing investigation. >> some have suggested, look, one of the reasons, you know, the networks led with the president talking about drones. yesterday it was to divert attention from the fact that lernor promised to tell the

truth and took the 5th. that's embarrassing for the white house. you figure jag carney would love to say, i would love to answer your questions about the irs controversy -- not scandal. but i can't. independent counsel is looking into it. >> when a witness takes the 5th amendment and that's a government official it spells trouble. the question is whether or not the ordinary processes of the department of justice are capable of doing this. they are clearly capable from the standpoint that they are professional. but if republicans continue to contend then, the public agrees that really they are not in the best position to do a credible, independent investigation. inevitably we may get to the point where a special counsel is necessary. >> plus, it could take two years. by then people have forgotten about it. we are talking about hillary clinton, chris christie and everybody else. that's something else. what's the down side to a special counsel for the white house? >> there are significant down sides. the most readily apparent is you lose control over the

the bridge collapse that sent cars plunging from 50 feet high into the icy water below. three people were hurt. our reporter brian blakeley is live on the ground with details we are learning. what can you tell us? >> good morning. here from the pacific northwest with what's being described as a miracle. you can see the bridge that's collapsed here over i-5, a major interstate. you can see all the twisted metal and the cars in there. that happened last night when a semi truck struck the bridge and caused only three cars to go into the water at the time. a couple of victims. it's a miracle that not more people were on the bridge at the time when it collapsed. it sent people plunging 50 feet into the icy waters here. 45 degrees. people here, amazing stories of survival. a lot of people want to figure out why the bridge did collapse on this busy memorial day
