is trying to make it a reality. > 8 senators from opposite sides of the political aisle are coming together on a common sense immigration reform proposal that we believe can pass the senate. >> sean: the billion dollars 876-page bill still has a long way to go with more amendments to be proprosed and more hearings to be held. >> bottom line is we are very close. i would say we are 90% there shaun the plan has three main goals. secure the border. works clear the path for citizenship and three make it easier for some industries to hire skilled foreign workers when they're needed. >> we should make it easier for the best and brightest to come and start businesses and create jobs. >> sean: part one needs to happen first. >> they will not be able to a apply for green cards unless the border security plan is fully implemented. >> sean: only one problem.

let's talk about the bill. >> let's begin why answering why we are doing this. as a republican i can tell you this issue was going to come up in the senate with or without me. the democrats made clear they would bring an immigration bill to the floor so we had to have a position or alternative or view how to phoeni fix this. this is an issue hurting america as it is currently structured. what i begin by telling everybody that will listen is even if we didn't have a single illegal imgrant in the united states we would still have to do immigration reform. the legal immigration system we have now to legally immigrate here is broken. the one now is based on whether you have a relative living in the u.s. if you have a relative that lives in the u.s. it is easier to immigrate than if you have a special skill or talent or something to offer to the economy. immigration isn't just about people coming near work. it is about people coming here to vet. the most powerful economy in

the world. they come here as tourists and businessmen and investors and live here six months and go back to canada or some where else the other six months of the year. all of that is immigration and the process by which all of that happens is bureaucratic and broken. certain industries like agriculture do not have a reliable system to bring worker hes in. that is the first part that doesn't get a lot of attention because it is not as controversial. we have emgreat lakes laws not being enforced because we don't have the full mechanisms in place to enforce it. there is gun running at the border. there is human trafficking at the border and other things happening but the strongest magnet bringing people here illegally is jobs. we do not have a reliable national electronic verification system employers can use to verify that the people they are hiring are 100% legally here. we need to create one.

>> sean: e-verify.ou don't do u have to pay stiff penalties and fines. 40% of our illegal immigrants in the united states enter legally. they didn't jump a fence or cross the border. they came on a tourist or temporary visa. it expires and they stay. we don't know who you are. we don't register you when you go out. that needs to be fixed and the bill does those two things. that is why you are not hearing a lot about the two things. the last one is the hardest one and that is the border. you you have janet napolitano appearing before congress and saying the border is already secure. that january mines the effort. the rial etan is there have been improvements but not strong enough to stand what could come our way when the economy getser with when bill likes this passes. veto have improvements that are significant. none of these things work if we are setting ourselves up for

another wave of illegal immigration that we can't stop shuns the number one reason i wanted the -- >> sean: the number one reason i wanted the border secured was for national security reasons. it is not secure but they can secure it. that is one of the things i learned. i'm afraid somebody coming over into the country that wants to commit an act of terror. we have laws on the books now. those laws are not enforced. then it raises the question of confidence. >> right. >> sean: if we are not going to force the law now and arizona passes a law with the same language as the federal law and they are beaten up for doing what they wouldn't do nationally why would people have the confidence this would work this time? >> that is the problem is the lack of trust. republican administrations failed to do this, too. you don't get to 11 million people in the country illegally overnight. this took a couple of administrations or more for the problem to build up to the level that it has. let me describe some of the

laws are not enforced because we don't have the mechanisms to enforce. it is illegal to hire an illegal alien. business dos not have a reliable way to determine if that is truly the person. they show you a social security card. even if you ran it through e-verify you could get a false neglect seven. people who overstayed their visas, we track them when they come in but not when they leave. the boarder is not just about immigration. it is about national security and sovereignty. a sovereign country should be able to control its board her hes. i believe the nation that landed a man on the moon several times can secure its borders. people do not trust this administration and the federal government in general to do the law. it is straightforward and i tell this to people all the time. if we can figure out a way to write a bill that ensures that the border will be secure i believe immigration reform will

special edition of "han etan." we are joined by senator marco rubio and a special panel of experts to talk about the always controversial topic of immigration reform. first some of the conservatives in the country on their side of the aisle say they support the idea of immigration reform but are worried about the details. here, for example is senator rand paul. >> it says well, you have to have a plan to weld a fence. but you don't have to build a fence. and if you don't have a plan to build the fence then you get a commission. i don't know what happens if the commission doesn't do anything. that is the story of washington around here. to me it is a little bit like obamacare and i hate to bring that up but 1800 ref rep refero the secretary shall at a latinoer date decide -- later date decide things. we should write the bill, write the plan, do the things to secure the border will fence, entry, exit, write it not delegate it because what is going to happen in five years if they don't do their job it may not even be them it might be somebody else who doesn't do

their job in five years and the border is spot secure we will be blamed for the next 10 million people who come here illegally. >> sean: i think senator paul has a point here. when it comes to spending cuts and tax increases you get the tax increase, never get the spending cut. here we will find a path to a green card and maybe citizenship but when are we going to get the borders secured for sure? >> a couple of thens. his point is generally well taken. it doesn't say you can come up with a plan but not do it. a fence plan has to be he substantially completed and a border plan that has to be substantially completed. e-verify must be fully completed. and the entry exit system done before a single green card is given out. where people are saying is we don't trust the department of homeland security to come up with a good border plan or a good fencing plan and maybe the alternative is to have the congress do that.

the point is that needs to happen. that is the lynchpin of whether this will work or not. >> sean: that is the biggest area of criticism. are you working on changing that? >> that is why we have the committee process. in the past certainly before i got to the senate people would go to a room and come up with a bill and draw it up and a take it or leave it proposition. i'm not sure that is the way this is supposed to work. the weigh -- the way he is works an individual writes up a bill as a starting point but 92 other colleagues in the case of this issue that haver that own ideas and have their own ways. we are in the process of doing that in committee now, the judiciary committee with many more days of hearings and it has to go to the full process not to mention the house. >> wouldn't you have an easier time selling this to conservatives concerned about a third, fourth wave of illegal immigrants coming into the country to just secure the border first?

>> the law does mandate that we secure the border. the fundamental problem is we have 11.5 to 11 million people in the country right now illegally most of whom we do not know who they are. not paying taxes or paying taxes sporadically. maybe getting paid cash or working under someone else's social security number. i believe it is our best interest to bring them forward and identify them as soon as possible. get them paying taxes and background checks for national security and crimes and get them in a system where we know who they are and where they are. >> sean: no benefits. >> wouldn't qualify for any benefits of any kind including obama care. >> sean: they would have to come out of shadows, identify themselves. back ground checks. >> for all i'm about to describe all you get is a temporary work permit that has

to be renewed. it expires in six years. when you come forward you will be background checked for national contract and criminal purposes. the collection of biometric information lea like your fingerprint and so forth and you have to pay a fine and then go out and be gainfully employed. when you come back to reapply for the permit, you can't even apply for a green card for ten years if you haven't been gainfully employed and paying taxes you will not be able to get reauthorized for the permit moving forward. >> sean: in the interim in the secure period who is going to verify, as certain, determine that the border has been secured? >> the way the plan is now the department of homeland security has to come up with a border plan and a fencing plan. two separate plans. he wanted them is separate. some want to take the money and use it for technology. fencing is a jet cal component. there are area of the border

will fencing will work. they have to come up with the two plans. >> sean: why do we trust janet napolitano when she says the boarder is secure? >> the good news is she will be there at most for three and a half years. maybe replaced by somebody worse, maybe by somebody better. they have five years to substantially complete the two plans. two of the years will be done by somebody else, not just them. that is the point. you hit on the exact point. not just janet napolitano. people don't trust the federal government is going to come up with a good plan for the border. if we can get that part of the bill right i think people are willing to support immigration reform are. >> sean: you are are thinking maybe it wasn't the best idea to put it in janet napolitano's hands or the administration plans. there is another alternative? >> that is usually the way it works. law enforcement officials whose job toss enforce the law and tell them you must do this and here is the funding to do this and' lou them to go out and

without immigration reform. >> sean: i was down at the border six times. out on helicopter. horseback, which was a joke. i was out on all-terrain vehicles and out in boats. 6 or 7 locations around the border. i saw the tunnels from san diego from mexico and the drug warehouses when i met those guys on the front border and you are i inpy piniella co. >> we are the number one pass through county for drug and human struggling in the country. we are not even on the border because interstate 10 and 8 intersect in our county and last year, senator, there was 123,000 illegals apprehended in the tucson sector. meanwhile we have as you pointed out there is a breach of trust. secretary napolitano in order to get to this point of immigration reform she has

senator based on your experience that would help this bill and make it better? >> i just retired 20 years as an army officer and commanded 700 active duty officers in yuma. we achieved 97% reduction in illegal entries in that sector. we can do it contrary to what the secretary says. you plan does not have implemented and we have to draft it and require, 6,000 armed soldiers for a two year period and the fencing you must have that not along 2,000 miles of the border. 700 miles of predetermined areas, historical proven paths of smuggling in the high trafficked areas and urban centers south and north of the border have the technology not just cameras, infrared at light, sensors, lighting. and most importantly, senator the enforcement of the law. we had dispair rate enforcement of the law depending on what

as a latino myself who had to go through the pro o the ground sessions of a cumbersome immigrationor deal what is the plan for those entering the country illegally. i comcame here on a student vi. i could have been an undocumented immigrant if it wasn't because of marriage which shouldn't be the only way. what is the plan? i hear a lot about border security. there is a talent with people like me that come here and didn't have a way to stay while i had a job offer from a fortune 500 company? >> the bill says if you have a phd or masters in science, technology, engineering and math and you are a graduate of a u.s. school and have an offer from a u.s. company you going to get to stay. we are not worried about being overrun by phds in physics and things like that.

imagine if you are a business owner in the united states and here on a nonimmigrant visa you would have to leave the country and start from scratch. we have skill based to convert if they want to be. the job creators and people that own businesses and employ people. one of the fixes to a broken legal immigration system. the sheriff touched on something else. you have a supply of people willing to work in the united states for jobs that aren't being filled domestically. a demand for those workers here. those two things will meet. a reasonable process for them to meet or a chaotic process for them to meet? right now it is chaotic. >> thank you for all you are doing move this forward. when i was at dhs we learned it is hard to enforce the border provisions and i agree with the sheriffs and congressmen that

verification is critical. so in this respect i think your bill is weaker than what we did under bush in '07 but it is stronger on the legal immigration side. my question is if you look at the '86 amnesty literally over 60% of those offered amnesty declined it and so the path to citizenship issue is this. that has been a difficult problem. does it make sense to have a path to citizenship or better just to allow someone to have some type of legal status and eventually their children will be u.s. citizens. >> sean: jeb bush said no to citizenship and senator cruz. >> it is not -- there really isn't a path to citizenship. a path to a green card. for ten and a half years minimum some people longer depending on when they get the temporary stratus that is all they will have, work, pay taxes and travel. after that the only thing that happens is you are are no longer are prohibited from applying for a green card.

you are not awarded a green card. all that happens is you are no longer prohibited from applying for one. still have to qualify and get in line and do all of those store sorts of things to get it. in the long-term for the country i do not believe it is a good idea to have 10 million or 11 people permanently barred to ever aspiring for citizenship to a country. it has been a disaster for europe to have people trapped in that category. we want people to assimilate to america and embrace politically and cultureally and sit senship offers that. we don't want to proh hub by the people from doing that. if you have broken the immigration laws you have a long and expensive process as a consequence of breaking the law. >> sean: we will come back and try to get as many as we can in. a lot of questions, right? and i have a question about benghazi and the irs. we will continue with senator marco rubio and our panel, straight ahead. when our little girl was born,
