men and women. thanks for anna and mike for filling in. see you bright and early tomorrow. and a fox news alert. brand-new details on one of suspects in that gruesome murder of a british soldier right on the streets. one of the attackers reportedly arrested in kenya as suspected terrorist in 2010 and deported back to the united kingdom. police in kenya are a saying he was preparing to train and fight with the al-qaeda linked group al-shabod as officers arrest three more men in the u.k. in connection with the attack. they used stun guns to take down two of those suspects. meanwhile, the victims' family is visiting the site. he was veteran. afghan war and was hacked to

death in broad daylight on wednesday. street now turned into a makeshift shrine. also we have another fox extreme weather alert because the folks in texas are really suffering. floods and downpours that are triggering this flooding even more. at least two women killed and rescuers are searching for a third person swept away by a swollen creek. nearly 10 inches of rain fell in a matter of just hours yesterday. emergency crews rescued more than 200 people that were stranded in their homes and cars. the mayor urging people don't drive. stay off the roadways because so many of them are still under water. guess what? more rain is expected today. we'll have more on that. president obama on the way

of storm ravaged town of moore, oklahoma. to see the overwhelming damage and meet with survivors. good morning, welcome to news headquarters, i'm eric sean. >> jamie: i'm jamie colby. resilient people of more, they have proven that. they are trying to move forward with very difficult recovery efforts. this is the same community that was hit with the deadly ef-5 back in 1999. casey stegall has been surveying the damage and devastation and emotion there in moore. casey? >> reporter: good to see you. i want to show you around. this is on the edge of one of the hardest hit neighborhoods. we are coming up on a week since the tornado hit. new utility poles have gone up. they have been trying to restore the utilities. this is going to take months and months.

some of these neighborhoods are going to have to be leveled and rebuild from scratch. memorial day weekend, people not spending it barbecuing. they are trying to clean up. they are trying to move forward. it's reality a weekend filled full of funerals. 24 people died in last week's twister. ten of the victims were children. out of the ten, two were newborns. today, president obama is going to be on the ground getting an upclose and personal look at some of the damage. homes that were wiped off the map when that tornado hit last week. an ef-5 means winds of some 200 miles per hour. that is about the equivalent of category 5 hurricane. that is why the mayor of oklahoma city up to 13,000 homes were damaged or destroyed. homes like the ones that belongs to the man you are about to meet

for an extended period of time. peter doocy has more. >> reporter: good morning. two different judges reportedly told the justice department that if they were going to search our colleague james rosen's private emails they needed to notify james rosen. but the u.s. attorney found a third judge here in d.c. who overturned both previous rulings thus, keeping the investigation secret. shear the argument. investigators say to a judge they favor keeping rosen in the dark. this according to court documents. f.b.i. is engaged in an ongoing investigation of the leak that will be substantially and ad versely affected if the reporter were to prematurely to become aware of specific details. we know that eric holder signed off on the search warrant for james rosen emails. we know that because the doj told us saying, quote, the department took great care in deciding that a search warrant

was necessary, vetting the decision at the highest levels of the department including the attorney general. on may 15th of this year, he said he never signed on any search warrant for any reporter's emails. >> to the potential prosecution of the press for the disclosure of material, that is not something i've ever been involved in or heard of or would think would be a wise policy. in fact, my view is quite the opposite. >> reporter: holder said later on that day, he just wasn't sure how many search warrants he had signed off on leak investigations. with the rosen search warrant his department of justice they followed all applicable laws, regulations and policies. >> eric: thanks. could this investigation expose a major conflict of interest at the department of justice? the doj acknowledges that attorney general eric holder approved the search warrant for

james rosen's personal emails. now it is the attorney general who is reviewing agency guidelines in response to this controversy that he is personally involved in. is that proper? is that appropriate? can he do a fair job? joining us for more is ambassador john bolton. long time washington official with the american enterprise institute. good morning. holder investigating holder, what is to become of this? >> i think it's obvious it's not going to lead to the bottom of questions that have been raised about the ap subpoena and about the investigation of james rosen. from my days as an assistant attorney general i can tell you the procedures that have been followed in both cases are badly wrong. that holder is either incompetent in both cases or he is lying at least about the james rosenit's not believable e

department of justice would take an unprecedented position on the reach of the espionage act, a critical statute to protect our security. for the first time that reporter could be criminally liable and not discuss that with the attorney general, career prosecutors are not going to do that unless the order is from the top. if they did it and holder didn't know about it he is responsible for it. i think what the president needs to do is pick somebody else to conduct this investigation. there are 93 u.s. attorneys out there. pick other officials at department of justice but picking eric holder is thumb in our collective eye. >> eric: you raise the specter of the attorney general lying to congress. let's look in print what he said about two weeks ago. he testified, quote, the focus should be on those people that break their oath and put the american people at rick, no

reporters who gather this information. that should not be the focus of these investigations. with regard to the potential prosecution of the press for the disclosure of material that is not something i've ever been involved in, heard of or would think would be wise policy. that is not something i've ever been involved in. ambassador, do you think he was telling the truth or just made a mistake? >> i think he is either lying or completely incompetent. it is not believable that the career people in the department of justice would seek to reinterpret and almost ancient statute in a radically newer way and not run it past him. he either authorized them to go ahead and conveniently forgot about it. i just find -- the explanation he gave is simply not credible. i think this is going to lead to his resignation. there are lot of other reasons he should have resigned before. take the a.p. investigation

where he says he recused himself because he was witness and potentially involved in other ways but never formalized it. never wrote a letter recusing himself turning it over to the deputy attorney general. this is procedure that well understood in the department of justice. i did it myself. you have a formal recuse al record so other officials in the department understand you are not to be involved in any aspect of that case directly or indirectly. so the idea that he just forgot to do it is simply not believable. >> eric: he accused himself with the a.p. and recused himself with the fox news matter and james rosen? >> that is why i think the whole administration argument that they have prosecuted twice as many leak investigations, national security leak investigations as all prior administrations put together really deserves scrutiny here. it needs to be somebody who is

reporting to the president, not an independent counsel, that is an institution that brings more problems than it solves but somebody in the justice department, with the authority from the president to look what is happening. ultimately it is the president who is responsible. constitution says the executive power shall be vested in the president of the united states. you want to sit behind the big desk, you want the glory, take the responsibility, mr. president. >> eric: thank you so much for your legal insight this morning. >> thank you. >> jamie: let's talk about some breaking developments on another scandal for the white house. new calls from powerful republican this morning for the administration to appoint a special counsel to also investigate the irs who targeted conservative groups. critics are questioning the tax agency's role as well as chief enforcer of much of president obama's healthcare law.

joining us now is columnist of who is counting. irs is tasked for being "a", non-part an and neutral but implementing 47 provisions of obamacare. can they do this fairly? >> it's very unclear. the attorney general of oklahoma currently has a lawsuit against the federal government claiming the irs has broken the lay by taking on to itself the power to issue subsidies and various other things to the states and to people involved in obamacare. so that is very questionable. a lot of constitutional scholars are saying the irs aggregated a lot of power to itself that didn't have a right to do. there is the competition issue. inspector general of the -- competence issue. they testified back in march with the irs handling 45

provisions of the law. they are asking about obamacare. real question whether or not this agency who hasn't covered also in glory recently can do the job that congress said it should do. >> jamie: regulatory power grab because they were tasked with obamacare which is complicated enough a tax code few people understand. >> no one. >> jamie: i hope somebody does at the irs. >> call them up. you'll get two different answers. >> there are small business owners that provide more jobs than anybody else. president obama says he wants to get back to that on his agenda. they are concerned about the fines that the irs will be implementing if you don't get healthcare all your employees. the question is conservative groups admittedly targeted with exemption status. what about with the fines? >> the fines are going to create

a real problem because a lot of businesses are going to say, it's cheaper to pay the fine than continued giving healthcare coverage to my employees. that puts the line on president obama's statement, if you like the healthcare coverage, you can keep it. then another problem with the irs right now which is, i seriously doubt whether or not percent realize that they come out with a sticker shock figure. a family of four, healthcare policy brought through these exchanges will cost $20,000 a year. >> jamie: big gulp. that is amazing. then sara ingraham is going to be the run that will be running the division. so many questions came up with the exemption post she had. the other question the fight against obamacare to repeal it. it's hardly done. the situation with the irs

provide quote, unquote, ammunition for those that want to talk obamacare? >> two of most unpopular things in collision, irs and obamacare. those are both very unpopular. think there they are so unpopular democrats are panicking this will be major issue the failure of obamacare to work. i think we're going to see calls in congress by democrats of a moratorium, a pause and delay in the implementation of obamacare. think the delay is soon going to come upon us. >> jamie: we know what the impact will be on the american people. interesting john, glad we brought you in on this topic. >> eric: keeping us safe. president is proposing some major changes to the nation's counter-terrorism policy. but will the new plan better protect us. two powerful lawmakers weigh in. that is next. uh-oh! guess what day it is??

resolution giving the executive branch to the power to track down and kill terrorists. listen to senators on the state u.s. national security? >> you find in a war like atmosphere you compromise basic values and basic freedoms and liberties. i'm not going to take lightly terrorism threat against the united states but if we constantly thinking this in the context of war we stand a very real risk of doing things that compromise our freedoms. >> i think we are diminishing our national security infrastructure. sequestration is hurting the military at the time they need it most. this speech did not help. >> jamie: joining me now, chris wallace. when lindsey graham gra8 says she worried, you have to pay attention. it's bad enough we don't have fleet week but the fact that now we're going to pre-9/11 status.

what did you left-hander? >> well it's kind of a philosophical debate going on here. president interestingly enough said exactly that, the situation a threat situation we face is more akin to what we saw before 9/11 in the years immediately thereafter. that is going to cause a lot of people to break out in hives when you got al-qaeda in the arabian peninsula, al-qaeda in the islamic nations and al-sharia that killed the americans in benghazi. i think the president is saying in the case of drones we need to have limited guidelines. there need to be restrictions as brit hume said on our panel, stop me before i kill again because the president has been active using drones. the question is are that legal structure, the kind of thing that rand paul fought for in his

filibuster is that good and sensible or going weaken our ability to take on our enemies? i don't think the president is saying the war on terror is over. he specifically isn't saying that. what he said it's no longer a global war on terror. it is a specific set of actions, campaigns against specific terror networks. whether that has a practical effort or rhetorical statement is what we're going to have to wait and see. >> jamie: to me what stuck out in the speech, why are we letting the enemy know we're going curtail the president's power to engage in war? >> that is question we have had all along and some people that are critical of the speech, it's fine to say, well, this war as gone on for a long time but eventually all wars must end. incidentally this has gone 11 years cold war went on for almost half a century. but the other point can one side say the war is over.

it takes both sides and as long as there are people throughout in al-qaeda or al-qaeda followers or al-qaeda related groups or spinoffs or affiliates as long as they want to kill people in their countries or in the u.s. homeland, the war isn't over. >> jamie: i have to listen to the interviews because i'm so interested in all of our safety. chris, thank you for bringing both sides. on the other issues, it's fascinating that you got them both together. great to see you, too. >> thank you. this is appropriate conversation for memorial day weekend. >> jamie: we are at war every day until we get the bad guys. check out the conversations with dick durbin and lindsey graham. the show airs twice, 2:00 p.m. and 6:00 p.m. only on fox. >> eric: something very appropriate for memorial day
