field. to do so we must enforce consequences for those that break the law and breach their commitment to protect classified information. but a free press is also essential for our democracy. that is who we are and i'm troubled by the possibility that leak investigations may chill the investigative journalism that holds government accountable. >> jon: president obama attempting to quiet the backlash over his administration's spying on journalists. a washington report broke the story. it turns on the justice department did spying on the news gathering activities of a fox news reporter as a potential crime in relation to classified leaks from the state department about north korea. chief correspondent james rosen is the target. in one document and f.b.i. agent labels him a co-conspirator. they pulled his security badge records, phone logs and personal

emails, but they never charged him with a crime. reaction is fierce. executive vice president of to be news, we are outraged to learn that james rosen was named a criminal co-conspirator for doing his job. it's downright chilling. as the story developments in more details, fox news chairman roger ailes reacted. the administration's attempt to intimidate fox news and its employees will not succeed and their excuses will neither stand the test of law, test of decency nor the test of time. we won't allow a kli mat of intimidation unseen since the mccarthy rar to frighten us from the truth. that was pretty dark day. >> that was the early '50s and many people lived in fear. i think periods are comparable.

questions about what this justice department is up to are raised by this kind of a search warrant, not only against james rosen but also against the a.p., and eric holder doesn't remember how many of these warrants he signed? how many he turned back for modifications. the president continues to maintain confidence in him raises a lot of questions. >> jon: we are also getting word the guy assigned to investigate these issues within the justice department is the head of the justice department. eric holder is going to be investigating himself. what is reaction to that in the media? >> the whole story has been pooh poohed from the beginning. this is not the obama administration going after leakers. they make the obama administration look bad. you can't compare james rosen

and david sangar. he has been getting intel four months in when he started reporting on north korea. he has not been given the same scrutiny that james rosen has simply because david sangar reports in a very fluffy way in a positive way. james rosen has not done that. a.p. didn't do that and those are the ones that are getting pressured. >> jon: i want to get your reaction to what dana wrote. for treating a reporter as a criminal for doing his job deprives americans first amendment which all constitutional rights are based. so if they are accusing criminality just for asking questions, who knows what else this crowd is capable of doing. your thoughts? >> i am a member of the white house press corps and white

house press association. it took a while for them to react. i was in the basement in the white house when this broke and people were outraged. not only is james rosen is a colleague of ours but it's frankly very chilling. >> policy is set from the top. from the beginning of this information, from robert gibbs to david axelrod, fox news has been singled out as a special target not only of the white house but of the left generally. axelrod says it's not a legitimate news organization. robert gibbs mocked some of the questioners from the white house correspondence. i think it sends a certain message throughout the administration that fox can be a target. >> it was interesting base who accepts this administration, both the far right and far let, because the left basically came out with an article that said, if this had been done under bush

or reagan there would have been a lot of screaming. >> jon: here is what nbc report. eric holder signed off on a controversial search warrant that identified james rosen as a possible co-conspirator in violation of the espionage act and authorized seizure of private emails. in may of this year, before the house judiciary committee. he said this, with regard to potential prosecution of the press for disclosure of material that is not something i have been involved in or would think would be wise policy. >> as karl rove on friday said, it would appear that holder misled the congress. others can decide what misleading in terms of legal implications. he said over and over again, i recuse myself. he couldn't find his recuse al document. a rare lawyer that doesn't write things down and keep records.

>>. why was the culture such under your watch that an employee felt comfortable talking conservative groups? did you investigate that? >> from my reading of the report i can't tell if it was political motivation or if it was tone deaf, somebody trying --.

people are uncomfortable with that. as a civil libertarian, i have to point out you have to give her the benefit of the doubt. >> jon: lois lerner of the irs whose office that determined got tax exempt status. >> i think the media is giving this adequate attention. i couldn't believe my ears. [ laughter ] >> media researchers have extensively documented for example the news about obama from the senior prom got way more attention on the morning talk scandals. come on judy, give us a break. >> jon: there seems to be underway here that g.o.p. reaction is going to hurt them in the next election cycle. it's really about the reaction to the scandal rather the

scandals themselves this? >> started in march of 2012. alan from the associated press wrote about irs targeting conservatives. his whole take this is typical complaining. fast forward to this week, we had mpr doing two different stories, brian mailer engulfing liberal groups, well it took us a long time to get tax exempt status. then you have the npr white house reporter who chalked up the whole thing the law is confusing. i don't think judy is right at all. i don't think the media is taking this seriously. >> jon: some critics say the coverage leans more toward political partisanship. >> there certainly was. some people who are reporters who linda into past reporting such as chuck todd from nbc, reporters republicans that are

not overreach because this would come back to haunt them. i was shocked when i heard them say that. >> jon: why? >> because he is supposed to be a reporter and not a commentary person. >> that is new one. >> jon: is it possible for republicans to look into this without appearing partisan? >> everything is partisan in washington. you would have to completely neutered, from another planet. these hearings are very useful. carried on fox and c-span. in the old days you had to rely on the three broad casts to put snippets but people can watch these clowns squirming after taking their oaths, it's very useful especially with the irs which nobody likes. >> jon: that is correct. we're going to have to move to break. next on news watch the challenges of covering disasters.

what do you say to people you're doing these sort of interviews because you're trying to manipulate people and trying to manipulate the press? >> well, there is no possible way. if anything whatever i say is going to be edited and sliced and put together however they want to put it together. >> jon: convicted murderer jodi

arias in an interview she gave to the press while a jury struggles to decide whether she gets death or life in prison. they hung on that question. what about it? did she play the press here, cal? >> we played right along with her. in the history of war, art and film the tradition of the fem fatale we are desized in more ways than one. this is what captures the imagination, this is trailer trash on steroids. >> jon: so do cases like this get too much attention? >> sky news said what made the press so interested in this the graphic detail is impossible to ignore. >> jon: i guess so. jim, what about it. every time she spoke the cameras were there? >> she is the perfect tv personality. she is pretty. she is glib. she is a good talker.

she is murderer, of course, so her tv career will presumably be cut short. >> if she goes to death row she loses rights to talk the media but if she gets life she can continue to do the interviews. >> that is truly a horrifying prospect. speaking of someone that is against capital punishment. we in the president are her enablers. she not only convicted murderer, she is deeply disturbed tushd woman they have allowed us to blame her for the murder and it's truly appalling. >> jon: and the monster tornado that hit oklahoma. the news media do their best to try and tell that story. >> coming up, we'll show you the entire path of tornado, that raked across this oklahoma city suburb. we'll show you the damage, the destruction the recovery efforts

and you'll meet the people in the middle of it all. >> jon: so, rick, what about that, trying to convey the damage and the heartache in a story like that, it's really tough for reporters to do. what is your assessment of their performance? >> i actually thought they did a very good job here. it is a terrible story. the visuals show the terrible story. there are heartwarming moments of humanity that i think they did a good job to pull out. i know that columbia journalism review said they didn't like it. there were too many happy moments within the tragedy. i think the visuals shows incredible tragedy and the human interest stories need to come out. people want to see there light at the end of the tunnel. >> jon: let me add to that what the colombia journal review.
