>> you send your kids off to school and you think they are going to be safe. then something like this has. i'm just thankful there was no school today. >> heather: thousands of vets and their supporters roaring to the nation's capital to honor fallen comrades this memorial day weekend. >> gregg: we begin out of moore, objections where president obama got first look at the devastation caused by monday's deadly tornado. he met with families impacted by the storm. casey stegall is live. where exactly did the president go today? >> he had a pretty business four hours. air force one came in at tinker air force base. once he was on the ground he traveled by motorcade to one of the neighborhoods hardest hit where a lot of people lost their

homes. he traveled to once a former plaza towers elementary school. what is left of it. the location where seven stoundz lost their lives on monday. he met with the mayor of moore and also some teachers from that school. he made a stop at local fire station where he met some of the first responders and families of those who lost their young children. >> let me begin by just saying whenever i come to an area that has been devastated by natural disaster, i am speaking on behalf of the entire country. our fellow americans are praying with you thinking about you. they want to help. >> some mystery action with the president being in town. they are happy he was here to pledge his support and show that the federal government is

willing to help, but some were also a little fluffed because in those areas where he visited the secret service presence was very high and some of the areas was sealed off. that actually prevented some people from getting to their homes and doing the cleanup and salvation work. so a little bit of mixed emotion a little bit of frustration from some of those people that couldn't get to what was left of their houses. >> gregg: a big memorial service a planned, is that today? >> yes, that is right. it starts at 6:00 local time, 7:00 eastern at first baptist church of moore. it has been a location over the last several days where fema has been set up and insurance companies so people can file claims and get assistance. also a place to stay, lots of relief supplies have been dropped off. this will be the first time the community has come together as a whole since this whole disaster

happened. the last six days have no doubt been filled with a lot of manual labor from those people trying to do what they can to salvage what is left of their homes or businesses. it's himself been a six days understandably filled with grief. 24 families mourning the loss of their loved ones. a handful of funerals have been happening over the next last couple days. it will also praying about the firefighters, the police, the emts more than 300 people were injured when the tornado came through. every single person in this community will tha has been touched by this disaster. >> gregg: casey stegall, thank you. >> heather: we are tracking a disturbing situation out of oregon right now. that is where 17-year-old student has been arrested for plotting a, quote, columbine style attack on his high school. according to police he had as many as six bombs tucked away in

a secret compartment in his bedroom. he created a checklist of sorts and time line for the attack. a district attorney explains what he could be facing in court. >> we are will be filing charges as an adult against the accused in this case. those charges will include attempted aggravated murder, six counts of manufacturing a destructive device, bombs, six counts of possessing completed destructive devices and six counts of unlawful possession of a weapon with intent to use against another person. >> heather: meanwhile, parents and students, they are expressing shock over the news. >> he is really quiet. you don't really hear from him a lot. some of my friends have like

classes with him. he doesn't talk a lot. >> she was very upset about it earlier. she was actually crying because had the kids been here, it kof been devastating. >> heather: a search of the high school did not turn up any additional explosives. >> gregg: fox extreme weather right now, san antonio is bracing for even more heavy rain after deadly flooding there. at least two women were killed in speculate incidents with when their car was swept away by floodwaters. search is under way for a missing tharj was lost while crossing a creek. they rescued over 200 people who were trapped in their homes and cars. listen to these folks describe the situation. >> it's really bad. like i said, i've never seen it like that. >> i wasn't expecting it to be like that. >> it is frustrating, but what

can you do. >> we put them in the house and got water in it. >> it's what they have been doing on the river. it bottlenecks all the way down in back. >> we are grateful they came for us. >> gregg: the mayor is warning people to stay off the roads because many of them are still underwater. >> heather: we have new information on a deadly daylight terror attack that happened in london on wednesday. one of the suspects was previously arrested in kenya as suspected terrorist back in 2010 and then he was deported back to great britain. police in kenya say he was preparing to train and fight with re-election linked group. the suspect no now accused of the gruesome murder of british soldier lee rigby. 25-year-old was veteran of the

afghan war. he was always father of a two-year-old little boy. meantime, his family visiting the site of killing. puts a go for a moment of reflection and leaving flowers. >> gregg: police are searching for a pan in france who stabbed a soldier in the threat. it happened yesterday in a business district just outside paris. soldier was in uniform. he was patrolling a very busy under ground shopping center and transportation hub. france's president says it doesn't appear to be link with the deadly attack in london. victim is 23-year-old and he remains in the hospital. he is expected to recover. >> new calls today for a special prosecutor to investigate the irs over the growing controversy of targeting conservative groups leading up to last year's presidential election.

steve centanni is live in washington with the very latest on this. >> while many republicans say it's too soon to bring in a special prosecutor, lindsey graham has no he is taking. he says the time is now. >> it's clearly an organized effort within the irs to target political opponents of the president. how did such a culture came about, who was involved, this really does call for a special counsel. >> reporter: other republicans like house oversight chairman darrell issa says they don't need a special prosecutor at least not yet. some don't think the process would be fair since eric holder the attorney general would be appointing that prosecutor. democrats condemn the irs targeting but they say there is no evidence of white house involvement and political motivation. the agency was trying to follow

congressional guidelines as it dealt with flood of tax exempt applications after the supreme court case that ordered door to freer political spending. >> the law we wrote as congress said that they had to exclusively be engaged in social welfare and not politics and campaigning. so here is the irs trying to decide whether or not these organizations really comply with the law. >> reporter: so far there have been three congressional hearings on this, still, a lot of unanswered questions and likely to be more hearings. >> heather: exactly. steve, thank you. the official in the middle of the irs scandal taking the fifth, but will she stay mum for long? our political panel debates it a little later. you can watch fox news sunday in entirety at 6:00 p.m. eastern with dick durbin and lindsey graham.

business senior correspondent and anchor of "bulls and bears." thank you for joining us. >> remembering our veterans this memorandum memorial day weekend. >> heather: heading down to the jersey shore but according to the small business administration. they have only approved loans to one out of every four of those business owners? >> it's the "washington post" that took a lot of the data coming from the small business administration. one in four has been approved. that is very different from times after other disasters like hurricane irene and hurricane ike. we saw 40% were approved by this time. there is a 43-day turnaround to take a look at each application. if you look back irene and ike, it was closer to two weeks. only 15% of the money has been issued. so small business owners which make up the majority of the businesses on the shore are just

not getting the money they need. these are loans they are asking for, not a flat out handout. >> heather: but also the timing. they need to get them quickly? >> absolutely. this is the big kickoff to the summer season. this is when they make most of their money. it tends to be family owned, small businesses who need this kind of money. there is a huge loyalty of people that go down to the shore. they are hoping they go down. but what we are seeing other communities, delaware or even on the outer banks, even down to the north carolina, they are not openly trying to capitalize on this disaster. they are seeing a lot of people from new jersey and new york who were looking for places to go. the rentals they have looked for and hotels just aren't available on the jersey shore. >> heather: north carolina gave

a 10% jump over last summer from some of the affected areas. i wanted to talk about oklahoma. they are taking a look at the situation and areas that are affected by sandy, wait a minute, is this going to be the same thing that happens to us as we struggle to recover? in the meantime federal emergency disaster row leaf found is $11.35 billion. will they get money in a timely manner? >> $11.5 billion should be enough to cover a lot of the damage in oklahoma. it was much more concentrated on the jersey shore. if the $11.5 billion goes to oklahoma that could cover it the trouble is, we're halfway through the year and there is expected to be a busy hurricane season. >> heather: people are loyal to the jersey shore. you think even if they pass it by this year.

priorities and they ought to fund what works. there is no question in my mind, priority is saving lives. so hopefully program will continue on and be structured in a way that will lead to self-sufficiency. >> heather: you can see more of this exclusive interview tomorrow and throughout the day on the fox news channel. >> gregg: growing controversy in the irs scandal, republican congressman darrell issa, chairman of the house oversight committee is none too happy with the official refusing to testify. she is considering to call her back before the same committee. lois lerner raised eyebrows when she appeared on wednesday. first declaring her innocence and then pleading the fifth. at issue here now, did she waive

her fifth amendment rules by delivering that statement? here is what she said before going silent. >> i have not done anything wrong. i have not broken any laws. i have not violated any irs rules or regulations, and i have not provided false information to this or any other congressional committee. >> gregg: what should happen next? let's get a fair and balanced look, doug shone, scott brown, former republican senator from massachusetts. gentlemen, good to see you. you are both lawyers, it's fair to get your legal take on this. doug, the two readings, rogers case and brown case, both make it clear that waiving the fifth happens only if you are testifying and then you stop testifying in a trial or a criminal grand jury proceeding. this was congressional hearing. thus, would you agree she is

actually entitled to invoke the fifth at any time? >> i would agree. as you say, this was a civil case and i agree with your reading of those decisions. in a case like this, if there is any question and some legal scholars disagree with your view and my view, but if there is any disagreement, we want to err on the side of not prosecuting people or putting them in harm's way for procedural matters. we want to find out what happened and why. the way to do that is with investigations, not with legal procedural issues. >> gregg: people have a first amendment right to declare their innocence, to say for example, i didn't break any laws. i didn't lie. the fifth amendment allows them thereafter, does it not, to invoke silence. isn't that what lerner did? >> certainly she has that right.

she is is testifying before congress. she did swear to tell the truth before congress. she started to testify -- i would argue that was the beginning of her testimony and would argue as a result of her moving forward she waived that. put that aside for a minute, what is going to happen next, the congressman is going to get house counsel advice. what the bigger issue is what they were doing. on the bottom line she on paid administrative leave. holder cannot do the investigation. he should have been thrown out a long time ago. there is lack of faith with holder after fast and furious and what is happening with the a.p. and with benghazi. >> gregg: let me pick up on that. holder's announced that he has launched a criminal investigation to the doj. his closeness to the president and reporter snooping scandal

would make his findings inherently suspect, wouldn't it? doesn't it demand a special counsel? >> yes, it cries out for an independent or special counsel. in that regard i agree with senator brown. look, we have to get to the bottom of what happened. 9 irs clearly informed the treasury of what they were doing with conservative groups long before they owned up to it. there is all sorts of questions about how in the f.b.i. and the justice department is operated. to me, since this goes to the essence of the functioning of our democracy. agencies of government, the white house, the treasury, we need an independent counsel. >> gregg: initial story the weights was peddling about what they knew and when, what they did turned out to be fundamentally false. senior aides apparently agreed, hey, let's not tell the president about this. let's keep him in the dark about

something that is really important. if the president is so outraged, as he says he is by what the irs did, shouldn't he fire the aides who hid it from him? >> listen, this is very similar to what we saw in benghazi. initial story and then as we learned things changed obviously. if he outraged he should be firing not only aides but people in the irs. there should be a top to bottom review of that agency. i can tell you, like any american who pay thiarz taxes, the irs is there to interpret the issues and regulations in an unbiased way. that is it. they are not supposed to be taking sides or unions spending half a million dollars helping against tea party candidates. they should be doing their jobs. it's a breakdown right now. this is exceedingly serious. we need an immediate investigation, holder can't be doing it. he shouldn't be there as i said. the people who are responsible

should be fired and we have to try to reestablish that trust between the internal revenue service and american taxpayer. >> gregg: the irs and snooping, is this systematic of a culture of intimidation that is pervasive throughout the administration and vindictive tone set by the president himself as senator mcconnell claims? >> let me start with your last point. it is absolutely the case that this is not a man who is governed with attention to changing to changing the culture of washington. it is not a red america or blue america. it's the united states of america. we haven't heard that from this 'president. we didn't ever hear from this president what former president said bush said about solving american problems. i couldn't agree more with your characterization. the reason i this think we need independent investigations of
