there after giving their lives in the past two months. >> america stands at a crossroads. even as we turn a page on a decade of conflict, even as we look forward, let us never forget as we gather here today that our nation is still at war. it should be self-evident. >> reporter: it doesn't seem self-evident enough on tightening restrictions on drone attacks and closed guantanamo bay. he wants to end the perpetual war on terror but chris say it's far too soon to do that. >> the chemical weapons in syria is about to kill thousands and millions of people have been compromised. iran is marching toward a nuclear weapon.

with that gruesome broad daylight attack last week. the two suspects found at the scene are still recovering in the hospital after being shot by police. a little later in the newscast we'll take a look how one of them pay have a history of terror charges and the emotional milestone for the victim's family as they return to the site where he was killed. >> jamie: back here at home, fox news weather alert out of san antonio, texas. a weekend of record-breaking flooding has led the deaths to three people. it all started on friday night. they had a massive storm system and it moved over the area quickly dumping more than ten inches of water in a matter of hours. then by saturday, entire streets and neighborhoods were completely under water. we want to show you this intersection. look at this. you can't even see the don't walk sign. it's there somewhere. it stands ten feet tall and

barely visible. there is a typical highway there and it's completely submerged now. now, we are hearing the severe weather threat may not be over. janice dean has had a busy few days. any good signs? >> we'll be dealing with severe flooding and tornadoes throughout the workweek. unfortunately san antonio as you mentioned close to ten inches of rain. that is second greatest rainfall on record. not only texas, but across the midwest, as well. they are dealing with close to ten inches in 48 hours in parts of iowa extending through missouri and illinois. a lot of areas saturated from storms in the past. this is just adding more salt to the wounds so to speak. not only flooding we had record snow over the memorial day holiday weekend. take a look at this. this is a picture from white

face mountain, 36 inches, three feet of snow in this region. in parts of vermont over a foot. record-breaking snow over memorial day, really shouldn't be talking about snow on the unofficial start to summer. also want to make mentioned the potential for severe weather, not only hail and damaging winds we could see tornadoes. the storms are training over the same areas that got close to a foot of rain over the last 12-24 hours. the threat of severe weather really extended go from parts of plains towards the great lakes across the ohio river valley down to texas with a bull's-eye we could see potential for long track tornadoes through the afternoon and evening. this is going to continue unfortunately into tomorrow. even wednesday the threat for strong to severe weather across portions of oklahoma, the same areas devastated by the ef-5 tornado last week. unfortunately, it's going to be

an active week for severe weather and flooding across the heart land. >> jamie: all the more reason to help those folks if you can. we'll check back with you with all this activity. thank you. ♪ ♪ >> gregg: another milestone this memorial day as we mark exactly one week since the deadly tornadoes that ravaged the town of moore, oklahoma. as the community makes its way down the long road to recovery, they are getting first person support from the president himself. casey stegall is live with more. >> reporter: hi, gregg, we were on the air yesterday while president obama was on the ground where he met with storm survivors. he also got a look at the destruction firsthand. all too common sign the president has been to in terms of joplin and the storms in

alabama. he visited with some of the parents who also lost their children at plaza towers elementary school, the seven children that died there. there was also a very moving memorial service last night. we wanted to take you there now. about 2,000 people in attendance where we heard from clergy, oklahoma governor and a teacher from briarwood elementary. that is the other school destroyed in moore where all of the students survived. listen to how the teacher tried to keep them occupied when the twister tore through their school. >> he has got the whole world in his hands, we sung, they made up new verses. he has big dog ignition in his hands. we were laughing. around me other teachers were singing songs like the

♪ ♪ >> gregg: getting new details in a foiled school massacre plot in oregon. we are learning that a 17-year-old student plotting to blow his high school in a, quote columbine style attack was talking about bombs with classmates weeks before his arrest. reportedly to police that were tipped off to a 911 caller, grant accord had as many as six

bombs tucked away in his bedroom. he also created a checklist and time line for his attack. that he even asked his friends to film the incident when it happened. a search of the high school did not turn up any additional explosives. the suspect will be charged as an adult. >> jamie: brand-new angle on america's war on terror. as we remember this weekend, all of the men and women who gave their lives keeping our country safe. police, of course, are still making arrests in london and investigators continue searching for clues in both the boston and benghazi attacks. while all of this is going on one lawmaker things the president's bush p tour repeal the law that authorized the war on terror is poorly timed at best. >> we need to resolve a retreat. talking about the war being over what do you think the iranians are thinking? at the end of the day this is

most tone deaf president i could ever imagine. >> jamie: left turn colonel tony schaffer, great to have you here thank you for your service? >> thank you. >> jamie: i know you feel, how do you feel about the president. is he sounding retreat? >> it's in the eye of the beholder. there is nothing wrong with reviewing it because al-qaeda folks are 90% gone. we need to adapt the law and regulations to today today's warfare. the president acknowledged for the first time clearly that there is a terrorist threat but at the same time it's diminished to pre-9/11 levels in my judgment not positive borne out by the evidence. more importantly we have to look how al-qaeda has adapted. they were not the same al-qaeda in 2001. they have adapted greatly.

frankly everywhere where we're worried about in middle east we need to acknowledge that fact. >> jamie: even beyond that, there are so many splinter groups, it's hard to keep track. one of the things the president says, at least in agreement that law needs to be revised up to today's war on terror. maybe he is saying there is a war on terror, i'm not sure -- what i am sure he wants to curtail the use of drones. years ago we didn't even admit we had a program and it has been effective. are you concerned if we don't have those resources? >> i'm concerned about the fact it's a crux of the politicians rely upon for the appearance of progress. to be clear on this, the program he talks is a kill capture program. which completely focused on the kill parted, c.i.a. is taking the lead on that. it's not given the results necessary for us to continue to prosecute what he wants to do, defeat the network. you have to penetrate the network and get inside their

thinking so you can roll it back. it's like cancer. simply cutting off the cancer each time by assassinated go the leader does not make it go into remission. to transfer to the dod, department of defense will give it more oversight. i think it will be a better mix and match to everything we're doing overon all in the war on global terror. but he has to make clear that the war is not over and he may be telegraphing that we are retreating. that is very dangerous, that we're backing off because they ain't. >> jamie: call it a pet peevoo, wo why would you make an announcement and backing off anything, and drones save americans lives because we don't have to send in ground forces? >> that point is well taken.

if we go and grab people when i was there what we talk about. it was to go into pakistan and grab folks and bring them back and interrogate them. its balanced approach. we need to get a certain amount of who the network is and you do that by captured them and interrogating them. >> jamie: let's give credit for intelligence to continue to work in line with our military. let me ask you about the speaker of intelligence, interrogation, president has said again, closure of guantanamo, he has been on this, back and forth. seem closer to closure. where do you think they should go? >> we have to put them someplace. i talked to secretary of defense rumsfeld about this we have to go back to capturing folks. guantanamo is still going to be the place. goat this.... >> jamie: where should they go.

a lot of people are concerned. >> that is an issue. >> jamie: do you want to bring them in our neighborhood? >> they wanted to bring them to virginia back south, when representative connolly said not here. >> jamie: you are a professional in this field of fighting. where do you want them? do you want them in your neighborhood? >> i want them in a place where we can actually bring them to justice at the same time and interrogate them. simply closing guantanamo does not solve the issue. has been just corpus, to bring justice one way to them. we have to do it some way. guantanamo is as good as place as any. it's a policy that persistent. i don't think closing guantanamo is going to get us anything but allowing him to keep a promise he has made during the first round of his elections. that does not solve anything. >> jamie: well taken. thank you so much on your insight on this.

war. the annual observance at the vietnam veterans memorial in washington. event kicked off last night with a candlelight vigil. marine corps veteran jack mcclain is among the features speakers. today's event remembering the 58,000 soldiers who died in the vietnam war. >> jamie: this is going to be fiery debate. white house is struggling to manage three big controversies. first is the irs targeting of conservative groups. there are so many questions about the night of the benghazi attack. then the allegations of overreach at the justice department. a top republican raising new questions about the president's moral authority and ability to govern. listen. >> i think the constellation of these three scandals takes away from his moral authority to lead the nation.

president has been trying to pursue, the republicans want something they can tie to president obama. in absence being able to do that now they are turning to rhetoric. it's pretty pathetic. >> jamie: define what morally we have to expect from the president? >> tell me where he has lost that morality. i would be happy to say when he has not shown moral leadership, deported more fathers and mothers than any other president in the history or the use of drone strikes. those are legitimate to have but to suggest implication of moral leadership because some scandal has happened while he has been president that he has not been tied to and appropriately respond to, we're grasping at straws here. >> jamie: what do you think we're getting morally from this president? >> a president derives his power from his policies and he has failed us.

we talk about morality, people expect, especially those who serve our country and who died for our country. those people deserve the kind of respect and credibility from their leader that they have given to the country. the president is losing his credibility. people don't believe this president when he talks about benghazi, when he is indifferent to the targeting of the americans by the irs or the targeting of the press. this is not what we expect from a president. as long as the president ago we to the scandal. acquiesce to the scandals. in some cases he promotes the people to higher positions. >> jamie: brad, you are basing on this on news this week and certain people that were involved in certain questions and scandals are getting promotions or allowed to not testify.

♪ ♪ >> jamie: welcome back. a day out at nascar turned out for ten fans that were injured at shar khar lot motor speedway. a cable broke and overhead camera landed on the track. seven fans treated for mine cuts and scrapes at the scene but three had to be admitted to the hospital. they have since been released. here the picture of the camera before the crash and the camera had been suspended as they research what happened. incident occurring on lap 121 of the 400 lap race. the drivers were all okay. >> gregg: potentially major week in the george zimmerman murder trial as a judge prepares to rule on a stack of new evidence presented by the defense team last week. zimmerman's attorney claims that the information they have

gleaned from his cellphone gives him a three dimensional picture of at suspect in this case. from the dozens of text messages to the pictures of pot plants, none of the evidence if a judge decides it can't be admitted in front of jurors at trial. doug, let me start with you. let's take the gun and pot evidence separately. that is what the judge is going to do. on trayvon martin's cellphone, there are these text messages he sent out talking about being a fighter and a gangster. you know a picture of a 44 caliber handgun. if martin had a history of aggressiveness and violence, isn't that relevant to the issue of who attacked whom and thus admissible? >> i think it's a close call, gregg. i don't disagree with you it might be admissible. i have a couple things to say. first, a lot of judges i would

not be surprised with ruling in advantages, "a" to see how the evidence develops during the trial and then "b" more specifically as both of you know to see whether the prosecution may open the door by suggesting that he was a hundred percent peaceful and never went near any firearms or any type of drugs. then it would clearly come. in i'm not saying if i were the judge but i would not be surprised if he leaves the ruling open. the last thing i want to say i think the key to this is what happened at the moment of the encounter. was the defendant in fear of his life? that may not be relevant. >> gregg: and the testimony of accused would be critical in that regard. of course, the alleged vick tim trayvon martin isn't there to say otherwise. it's a propensity for violence relevant in a case for self-defense when a defendant

says he was attacked and not vice versa and shouldn't jurors consider that or know that in the context of all these pictures and text messages? >> i think its dangerous precedent you are setting when you bring in general character evidence about a victim who a murder victim by the defendant here. it doesn't matter. >> i would argue it's not character evidence but goes to his state of mind and demeanor. >> but george zimmerman didn't know trayvon's history. he doesn't know he got suspended from school for five months from having marijuana. the only thing he knows what and happened that moment. >> gregg: what if the text messages were close in time to incident? >> that fight occurred months prior to this incident. >> gregg: if you call the recipient on the witness stand, you don't know what is he going to say. he may say, we had a conversation two days before he was angry and hostile?

>> but george zimmerman doesn't know any of that. did he reasonably believe at the time he killed trayvon martin. >> gregg: a propensity or pattern of conduct wouldn't it, doug? >> mu i hated to say, i somewhat agree with someone i'm supposed to be debating. in all seriousness, i think that is right. it's really going to be did he specifically in his mind sympathy that he was in danger for his life. fact of the matter is, if this guy had a pro pens it and violence for videos. >> he didn't know it. >> gregg: i'm trying to play devil's advocate. >> kind do that. >> gregg: i wanted to talk about the other issue, on trayvon martin's cellphone are the text messages, smoking poll and photos what appear to be healthy marijuana plants. remember, faith, in his call to

police just before the shootings he described martin as acting as if he were on drugs. we know toxicology evidence suggests that there was traces of marijuana in his body. does that make pot evidence relevant and admissible. >> there are two issues, trayvon tested positive for having traces of marijuana at the system at the time of the incident, i think that may come in. because george zimmerman he appears to be on drugs or something. the other evidence, trayvon being suspended from school for possibly having marijuana or pictures of marijuana on his phone again, i don't think that comes in because it's not relevant to the incident that occurred at the time. it's not relevant to self defense. if teenagers are not great teenagers and smoking marijuana and being suspended from school that is not the reason why, that doesn't justify a reason for killing them.

>> gregg: i'm not sure they need the pictures of the pot because they have toxicology. >> if the person supposedly feeling he is attacked on the record as saying he seemed to be on some type of drug, that does give you an evidentiary anchor and it would come in, i think. >> gregg: there is going to be a motion to delay the trial and given all of the thorny issues that has to be wrestled by the judge and evidence dump that occurred rather recently. are we going to have delay of trial here? >> i think so. generally, if press ask for a delay and defendant is in custody, may run into problems. the defense says i wanted a delay i don't see it as a problem. >> gregg: do you agree? >> i think the judge wants to move it unless there is a risk of prejudice here i think the trial will move forward.
