thought that this prosecution should occur to a judge. so i mean i don't know how both can possibly be true. it is certainly one of -- he is either falsified his statements to the judge in the form of affidavits or he falsified information to the congress. no way to reconcile the two of those issues. >> sean: that was my point i was trying to make to juan williams cash. if he wasn't a target but had to lay the case out to the judge. congressman forbes do you believe eric holder lied before congress two weeks ago? >> well, sean, he certainly didn't tell the truth. trent and i have a unique position. we sat in the committee room and listened to the questions and watched mr. holder. it is important to note he didn't talk about prosecutions. he talked about potential prosecutions and said he hadn't heard of any. as you mentioned and trent talked about this is a copy of

the search warrant. it says there a probable cause a crime had been committed. if they were filing the application and there wasn't even the potential for a prosecution, somebody not only needs to lose their job they need to lose their license to practice law. if this was true what was in the affidavit then i think we he found that the attorney general of the united states was misrepresenting himself to the congress of the united states. >> sean: so when eric holder said this is not something i have been involved in, heard of or would think would be wise policy but yet he was either then misleading congress which would be a violation of law or lying to a judge to get the judge to approve the sweeping search warrant. it has to be one or the other, congressman franks? >> i think it is articulated well. something you have to say once awhile on national tv randing

randforbes articulated it perfectly. he said specifically he released all pertinent e-mails and when i questioned him and it is on the record asked him had any of the e-mails been sent by him is became clear that he had not disclosed any e-mails he wrote and that he pointed out that he did not intend to do so. no way that both could be true either that he disclosed the e-mails or that he didn't intend to. something again is impossible to reconcile. and you know, it almost makes a conservative ms. janet reno. >> sean: that is saying a lot congressman. we also know in 2011 with operation fast and furious, documents were uncovered that in fact showed he knew about ten months in sad ranse of when knew of it.

possibility of prosecution or ignore what was said in the the subpoena. as long as we didn't prosecute him we didn't mean it. in other words, holder lied to a judge and had no intention of treating rosen as a criminal and said that in order to get the subpoena because that was the test to get the subpoena. carney is asked flat out do you see conflict between what holder said in response to congressman hank johnson of georgia on the 15th and the fact that he now turns out to have signed the rosen one and i loved it. carney says "i don't see the conflict." i mean really? what planet are you on? this was -- this is not only nixonian. it was clintonian. a definition of what is lie it. >> sean: you had all of the senators and democratic congress men. durbin and summer and franken wrote letters to the irs saying go investigate the groups.

now, they are feigning outrage that they actually did what they requested. >> dick durbin went on sunday with chris wallace and he asked him about the letter october 10, 2010 in which he went after crossroads a group i have been associated with. i will say that about dick durbin he is not like schumer and others running away from the letters they said fe ibming surprise that the irs would do what they told him to do. durbin said, of course, i wrote that letter and i'm proud of it. i tell you why i did it because cross roads was racing millions and rove was boasting about it i wanted to pick a conservative group out. wallace said what about the fact that you didn't have any liberal groups in your letter. he said well, i thought if they investigated cross roads all of the groups would get the

message. sure, the liberal groups would be just laughing. chortling with glee that the irs used to go after a conservative group to do exactly what it they had been doing for decades in conformity i admit with the guidance and rules of the irs. the conservatives began to duplicate with the democrats and liberals had done. >> sean: an interesting point. they were doing it for a long time and without any competition. >> look, in 2007 there was a group called americans united for change that attacked republican senators up for reelection for supporting the surge. one of durbin's own aides bill burton one of your personal favorites started a 501 c 4. and i don't see dick durbin saying to investigate him for forming to elect president obama. it was a use of their power and offices to target conservatives.
