reason. >> heather: find out why a local community is up in arms after a one teacher speaks out to his students warning them about a probing questionnaire. our legal panel debates. >> gregg: fox news extreme weather alert. on two stories developing. first southern california where a massive wildfire that broke out last week is now burning dangerously close to two foothill communities north of los angeles and threatening more than one thousand infrastructures. in oklahoma city a search remains for possible victims of heavy flooding following the outbreak of severe tornadoes. live in el reno in oklahoma but first we'll go to dominic live near the angeles national forest, more than a thousand homes could be at risk.

how bad is the damage today? >> i it will you what, these are rapid winds that are making it for fire crews to see who is at risk. in the past few minutes, right behind me, off in the distance you can see new bank of smoke that has come in. it's very thick and heading in the direction of lancaster. it looks like it broke out elizabeth lake road just on the edge of lake liz bets the community here and lake hughes. one of the most difficult things i see fire crews, because the wind turns back on itself. they keep getting caught up in that. thousand homes but in green valley they have are under risk. in a couple hours, they are not sure how many homes have to be evacuated. still mandatory evacuations right here where we are at lake hoots and elizabeth. we have had planes coming

invade sweeping up water and fleet of helicopters come in with buckets to put them down slowly. they are expecting heavy winds to pick up about two hours from now, i have to say the breeze has picked up. we were speaking to a fire crew a couple minutes ago, look, this breeze, it's strong enough to flare-up yet again. it will be incredible with the powerhouse wildfire that seems to be going to a large area of southern california. >> gregg: dominic, we'll check back with you. >> heather: over to central oklahoma where a massive recovery effort is under way after a swarm of deadly tornadoes ravaged the area friday night. will is live in el reno, one of the hardest hit areas? >> that is right. i'm sitting right in front of the local stockyard and this took a direct hit. this is where a restaurant

was in the back of stockyard and there is not much left. there is pieces of this restaurant all over the place. one thing i wanted to show you a glass counter. it's still standing. it has pieces of pie and cake and hot sauce on the problem. amazing part of this, further in, is the staircase. this is where 7 employees actually hid underneath when the tornado hit the building all managed to escaped and nobody was hurt. we just spoke with the owner of the restaurant. here is what he told us. >> you can look at it as being evil, truly god blessed us because none were hurt. what goes through my mind first, everybody was good. everybody was safe and not a scratch on them. >> reporter: now, there is more than the physical damage here. the owner tells me he has ten employees who now don't

have a job for the foreseeable future and also tells me he didn't have insurance, but he is waiting to hear how much help they will get from the state and federal levels. no matter what happens they will rebuild. >> heather: you hear the emotion in his voice. thank you very much. >> gregg: very serious situation in both oklahoma and california, will these areas see any relief at all? let's turn for some answers to meteorologist jan igs dean in extreme weather center. >> let's talk about the storms, storms that brought tornadoes up to missouri and illinois. that is on the move. we have a frontal boundary boundary for severe storms today. i don't think we're going to see large tornadoes but isolated. we have a severe thunderstorm watch in parts of the northeast new england and within this watch we are seeing some

rotation. the possibility for some tornadoes, as well. right now, severe thunderstorm warnings all up and down new england and through portions of upstate new york and pennsylvania. we will keep an eye on this. certainly we could see winds in excess of 70 miles an hour and very large hail. severe threat is widespread across the mideast and north atlantic. we'll keep an eye to the sky and local fox news weather. let's take a look severe threat across portions of new mexico and texas. heading into tuesday, a low moving out of the rockies and potential of storms in explain. look at wednesday's threat. unfortunately for areas ravaged by tornadoes within the last couple of weeks, ef-5 for parts of moore, oklahoma and ef-3 for that battered area of el reno. look what we're dealing with. couple of days of quiet

weather then, tuesday, wednesday and thursday, that is where we're seeing for stronger severe storms. on the flip side, wildfire danger across california and new mexico. potential for some showers to get in here but with the winds that could actually prompt more wildfire danger to spread. looking at the powerhouse fire where we have dominic, we have very warm temperatures. temperatures will cool slightly, but we're still dealing with erratic winds and and it's going to remain dry. unfortunately our conditions one be too good for firefighters in the next couple of days. >> gregg: janice dean. a tragic story to tell you about. >> three veteran storm chasers were among those killed by the deadly tornado. seen here in episode of discovery series storm chasers back in 2009, killed along with his son paul and long time partner

carl young. they traveled the nation in search of bad weather. that he died during what he loved -- back to janice dean. you always wonder about the reasonable and unreasonable risks? >> i was watching the footage coming in friday, are we going to have video on delay like car chasers. chasers are getting too close, not to take away from the storm researchers that have lost their lives. these are veterans that do the thing for tornado research. we can only rely need trained weather spotters on the ground, but i feel there are too many storm chasers maybe in it for the wrong reasons to get too close to the video on the roads. in el reno this was an erratic storm.

we can't outrun mother nature. it was rain wrapped. a lot of folks didn't have a chance unfortunately. it wasn't a matter of if, but it was matter of when. unfortunately these folks, their lives were taken. >> gregg: being in a car to be in the wrong place to be. >> it really is. they are sitting ducks. >> gregg: janice, thanks very much. >> heather: growing calls for eric holder to either step down for be fired as the scandal over the government spying on the media. at issue, accusations that the top law enforcement officer may have lied to congress when he testified under oath. national correspondent steve sunday tan any is live in washington. what the next step for republicans on capitol hill? >> they say they are going to investigate to find out if holder lied on congress. on may 15, he testified that he played no parted in any potential criminal

probe of reporters, but the justice department says he signed off on that investigation of fox reporter james rosen. here is this. >> well, i think we ought to subpoena the attorney general to come back and answer those questions specifically. this is congress fulfilling it's constitutional obligations and provide oversight over the executive branch of government. >> and they have demanded answers have not received a reply. >> heather: this is not good news for president obama? >> no, he has his hands full with the benghazi and irs scandal and now he has to decide what to do with the attorney general. it's serious if he faces perjury charges. democrats say there is no evidence that at this point that any perjury was committed. >> listen, yes, as i said i haven't seen a single accusation that prevents him from doing his job.

it is nearly all men who make up illegal border crossings, half of them already have jobs lined up giving us a true sense of the competition that american workers are finding in those areas. brenda buttner is joining us anchor of "bulls and bears" right here on the fox news channel. last year, 356,000 people made it across our border successfully, but the survey found that is only half of those who attempted to do it. so in other words, we're saying 50,000 made it through as undocumented workers. that is border security 50% failure rate. so when janet napolitano, border security is really effective, the facts would belie that? >> we have could to keep in mind back in 1999 more than a million beam were detained. so there is decrease

getting across. there is huge incentive and these people are desperate for work. >> gregg: getting caught has no deterrent effect? >> what happens they get september back to mexico. there is not much that happens and 50% of they will try again. the problem is, the economy in mexico is terrible. our economy is struggling but much, much better. so they are looking for jobs. they are willing to take the risk of getting caught and sent back. >> gregg: 65% are seeking work, 28% are trying to reunite with their families. they are almost all men, 94% are men and they are low skilled workers. what kind of jobs are they taking? >> exactly. they are mainly men and mainly young. they are taking jobs in

agricultural and construction. -- agriculture and construction. that is segment that has been very hard hit. that could be tough. >> gregg: what states? >> california, arizona, texas, the ones that you would expect on the border. >> gregg: critical question for a lot of americans because there is a raging debate about these, do these 356,000 undocumented workers just last year and we may have 12-15 million of them do they under cut wages and take jobs away from americans? >> a lot of people -- many labor economists on both sides do say they tend to bring down wages because they are willing to work for less. working for less is much more than they would be working for in mexico. there is some evidence they may be bringing down the

minimum wage down. >> gregg: are they taking jobs away? >> that is the real question. i mean in an economy like this where we're having trouble and there is such high unemployment, people are willing to work at jobs they may not be willing to in more boom ties times. >> they are not taking away too many skilled jobs? >> there is a big debate go b that, bringing in more skilled laborers, immigrants. >> do they use social programs like hospitals and schools that take taxpayer money and that is therefore another implication on our economy? >> most of them don't have insurance. if they get sick they will go to the emergency room and eventually the government pays for that. schools are paid for by taxpayers but they tend to petraeus roll taxes and don't use the social

would think would be a wise policy. richard, did he tell the truth or did he lie? >> further back, heather and key facts. first, the state department had information that he disclosed that was classified regarding u.s. intelligence officials penetrating the north korean leadership, it was illegal to leak that. james rosen is not disputing the fact he got information from mr. kim and published that. everybody is up in arms and he aided, mr. kim didn't put it out in public domain. james rosen did. he was aiding the leak which itself was illegal. >> heather: you are not answering the question. >> i am. the policy of doj was never to have one and every first year law student that a

prosecution begins when a prosecutor seeks to bring criminal charges against the defendant. that simply did not happen here. putting somebody's name and accusing them of an aider and abettor in a warrant does rise to the level. >> heather: i wanted you to respond to this. let me go into what richard is saying. there we do know the attorney general had personally signed off on the search warrant and the search warrant, the f.b.i. called him a criminal co-conspirator and suggested there was probable cause. i'm not an attorney but probable cause not signal potential prosecution? >> why else would they have issued the search warrant or a request for the search warrant, excuse me? eric holder is chief law enforcer of america. first he said i didn't know

anything. then we find out he signed off on a search warrant affidavit. i find his conduct and character an absolute disgrace. american people deserve more. we need answers, he should be held accountable to for that he did. >> heather: is this getting to the it in picking of wordings and what means what and definition of words? >> it certainly does not warrant an investigation. eric holder would stipulate that he remembered when he signed that warrant, but what he would say -- this is matter of law -- any first year law student would tell you a prosecution is when a prosecutor seeks to bring criminal charges. just using any kind of word that sounds like a prosecution isn't it. pursuing criminal charges, it is not nitpicking. that is what the law is about. there may be legitimate scandals and everybody

>>. >> gregg: a high school teacher in i will in hot water for telling his students they have a fifth amendment right to not answer questions after kids were given extended questionnaires for identifying kids at drugs and cheating and all kinds of things. after he got a look at survey, the teacher said you know what you could be incriminating yourself. >> several of the questions asked the students to semifinal report on what can be potentially criminal behavior. do you take alcohol, do you do illegal drugs. to do you lie or complete who are smoke tobacco? i'm not here to stir the pot. i want to protect my kids. >> gregg: the school board have disciplined him for

his actions. and joining us is our panel both defense attorneys. robert these are incredibly intrusive questions that bear almost no relevance to education. so in terms of self-incrimination, did the teacher get it right? >> absolutely. his gut reaction when he picked the survey out of his mailbox, wait a second, they are asking questions of illegal activity of my students. his reaction to tell them, you have a right social studies lesson, you have a right not to incriminate himself. >> gregg: he just taught his students bill of rights. you think he is wrong? >> there is no incrimination. just because you check a box and done drugs in the past, there is no time, place of you on kurns. >> gregg: what if you go further and you confess in a moment, i don't know morality, i'm running a meth lab or i'm peddling

coke, you could be prosecuted? >> in that scenario. it said to check a box whether or not. >> gregg: a pen and a pencil and write in the lines and elaborate? >> what was being asked in that survey was not a fifth amendment issue. therefore the teacher got it wrong, therefore the school board had a right to discipline the teacher by doing something that contrary to school policy. >> gregg: the superintendent said the fifth amendment doesn't reply here because responses are protected by student privacy rules. that is nonsense. >> during the course of investigation, we have a very large drug problem in this school. law enforcement gets involved, all they is a subpoena. police department can get their hands on those documents, a lot easier than the school wants to make you believe. >> privacy is nonsense but

my argument there is no fifth amendment because you are not incriminating yourself. >> gregg: wait a minute. under age drug use is according to the superintendent not a punishable offense, he is incorrect? >> incorrect but there is no time, place or occurrence. i did drugs on such and such a date and such and such place. >> you have to understand, they haven't told the students what their overall goal for the surveys are. these students are checking off a box and i'm going to be be honest. the school now knows, little tom jones has done drugs and giving it to other students. is it being sold in our hallways. they don't know what they are going to do with this information. >> gregg: its societal purpose. >> does this public school have in asking such intrusive questions. i'm a parent of two teenagers. they go to public schools.

i would downright angry if they asked my daughters. >> you could advise your daughters not to answer the survivors. we have a drug and alcohol epidemic in society. they are trying to get involved and discourage it. >> gregg: is this within the purview of parents and not schools? >> absolutely. they need to work together. parents, schools, there always be the parents and they are start and schools to maintain, look forewarning signs. resources they have in the schools to help identify the students that need help. >> gregg: and 4,000 people have signed a petition, it looks like to me the school board and superintendent may be at risk and not the teacher. >> my argument is not they right decision, my argument is they had the right to make the decision. >> gregg: what about f other teachers were doing the same thing?

the embattled tax agency turning over this video to congressional lawmakers on friday featuring a dozen of its employees, yes, line dancing, on stage. that video was produced for a training conference back in 2010. the cost in $1,600 for line dancing. there are two more of the videos that the i.r.s. also turned over, altogether, all of the films cost taxpayers a whopping $60,000. on top of this a house committee says a soon-to-be released treasury department report will find that i.r.s. spent $50 million to hold 220 conferences for employees between 2010 and 2012. congressman reacting to this. >> the culture of the i.r.s. during this period was one that did not particularly care about whether they spent well, the taxpayers' money.

and your home. home prices plummeted and that makes you feel much less wealthy. until the housing market starts to rebound it will be difficult to build it back. >> heather: so we are not in recovery until that happens. >> we are in recovery the economy is growing at a slow pace, it is a soft economy. >> heather: so that is why less than half of the wealth has been reaccumulated. >> securities are not spending enough. last month consumer spending declined for the first time in a year. what happens, the wealth effect, how wealthy you feel based on your home and your retirement plan and all of that, is much more powerful on the way down than it is on the way up. if home prices start to rise you don't spend as much as the decrease when houses were going

down. that is another thing, consumers don't feel as confident as they would. if they don't they will not spend, that is the way you get the economy moving. >> heather: some who have been able to re-establish wealth, those that have been in the stock market but that only affects wealthier families? >> in your 401(k)'s which a lot of people have seen, they have eastbound a huge benefit, the s&p is up 14 percent this year alone, the fastest five-month to a start since 1997 during the internet bubble, so stocks primarily are the way that people are starting to feel more wealthy. home prices are coming up, and that is something that is a positive. the problem is, if we see we have a big jobs number coming out on friday, and "wall street journal" will watch that. >> heather: give always prediction. >> the real news is, if it is soft, if it is not that good,

that is good news to the market. if it is good the market will not like it. that is because the federal reserve is watching the jobs market and it will stop the big bond-buying binge when the unemployment falls to a certain percentage. wall street is right new rooting for the economy not to do so well which is, you know, a crazy way to think. >> heather: that will not make a lot of sense to people sitting at home. >> absolutely. long-term the economy has to do well and the stock market usually is a leading indicator of what happens to the economy. if the stock market is going under the economy will rebuild. >> heather: what can be done for the average person sitting at home, middle income earner, they want to really start rebuilding their wealth at a quicker pace? >> housing prices are coming up and most the people are saveers and interest rates have been historic lows. if the fed does stop the

month he has lost seven points, a seven-point swing. >> this is serious. the president has taken whatever comfort you can take from the fact that he has not suffered, the approval has been between 47 percent and 48 percent and 50 percent but what the white house is trying to argue is the scandals involved other people, not the president, other armies, not him. given as you suggested correctly the mushrooming of the scandals, the president now is very, very worried. the numbers reflect that. >> gregg: pat, in all three scandals, the vast majority of people who were likely intimately involved behind-the-scenes have fought been interviewed yet so is this thing going to really spread? >> yes, it is going to spread a lot. you are right, no one in the white house involved have been questioned. look, the real challenge for the

opposition, the republicans, will be whether they can mount a strategic narrative. washington is wrong when it says all the wise guys say people don't care. they do care. they are following it. but they need it explained. that is what is missing. >> what about republicans? >>guest: following on what pat just said, we have new polls showing for the first time since election day republicans are leading on every issue over the democrats. that is the scandal drive down the democrats not just driving obama down but driving republicans up a bit. i agree with pat, that now is the time for the republicans to frame the three scandals into a narrative. i know what it is: the obama administration uses government power to go after people who disagree with it, whether they are reporters, conservatives, whatever, they will do anything to discredit their enemies. that is an ugly reality. >> gregg: the i.r.s. scandal

angers members more than anything else because they already fear the i.r.s. but look at this poll, a new fox news poll, more than two-thirds feel that government is threatening basic civil liberties and out of control. is this the scandal that has the most legs? could this turn into something that consumes the obama administration? >> yes is the direct answer. a couple of reasons. as you suggest, most people say, well they did it to conservative groups, the tea party, they can do it to us and how extensive is it? that is point one. point two, though, people think their ordinary day-to-day life could be impacted by the scandals in the way that rampant i.r.s. corruption could. bottom line, it could hurt and continue to hurt the president. >> gregg: it is not just the tea party groups but we hear from a whole host of other conservative groups, even

religious group whose dared to challenge the president and his policies. is this going to embold were more people to come forward? >> sure. they are already coming forward. it is big government is a threat. big government is at its worse. this ties to real people's ties and goes directly to obamacare and should they endorse it and why do they? the question about overregulation goes right to jobs and how they are targeting job creators. that is what really is important. >> gregg: it appears some of the folks at the i.r.s. have ultimate step contempt for congress. here is now the foam -- former i.r.s. commission. >> there could be many reasons you would be at the white house.
