judge and da i proudly served lady justice. her image always next to me in my office. a source of inspiration. a constant reminder that justice is blind, a constant reminder of my idealism as a young attorney. i served her proudly and i still do. all of us in justice serve her. welcome to "justice" i am judge jeanine pirro. thank you for being with us tonight. this week the citadel on the hill the united states department of justice is under a cloud because of the actions of its head attorney general eric holder. jury continues to mount as he is asked to clarify what he appears to be per injujerous testimony the midst of a hearing on what is perhaps the broadest attack on the free press of this

history. this most recent scandal is nothing new for eric holder. it has been marked by repeated miss steps questionable illegal procedures and questionable judgments. he has been held in contempt of congress, a vote not just by republicans but by democrats as well. his tenure also marred his department shipping assault weapons directly to the mexican cartel used to kill hundreds of innocent civilians as well as an american border patrol agent and a customs agent. he clearly does not have the ability to investigate what is happening in his own department as evidenced a letter submitted congress that contained a play tant lie. that letter stating there was no gun walking and it was withdrawn 8 months later. his attempts were also his wrong doings in his latest press scandal by arranging to meet with the tarring gets of his

subpoenas and search warrants under the guise of changing the justice department rules show how much of an amateur he really is. prosecutors simply do not meet with targets for a kooum by awe session. won wonders how the top in the nation has 10,000 lawyers working for him and 200 years of case law, precedence and legal treattis is on the press and first amendment needs to meet with the press to discuss how hard he should go the next time he wants their records. his lack of candor as well as refusal to hand over subpoena documents and repeated claims of ignorance continues to cloud the department of justice. he never appears to be prepared to address predictable scandals. >> i don't know. i don't know what has happened in this matter. i don't know. i don't know.

i assume he was but i don't know. that i don't know. i don't know why that happened. i don't know. that i am not sure, we probably have to get back to you with an answer on that. i just don't know. i don't know whether or not what funds are being used or whether that letter would apply to that effort. i don't know. yeah, i don't know. i simply don't know. >> he doesn't have good instincts as a new attorney general. he reopened the criminal investigation of cia interrogation of terrorists. not only had that investigation already been cleared by career justice department prosecutors, but seven former cia directors said such action was unwarranted. his hare-brained idea of bringing five terrorists to new york city already in guantanamo to try in civilian courts to prove to the rest of the world how great our justice system really is was universally criticized and subsequently reversed. before a civilian trial could

even get underway congress barred the transfer of detainees like ksm which effective floirsed the case back to a military commission. his botched gun trafficking as well as the cops are a member. his special prosecutor for his miss step and miss steps of his department saying instead he will investigate basically equates to his investigating himself or no investigation at all. they don't have the intellect or integrity to run the citadel on the hill. the department of justice can no longer stand a leader who has such disregard for truth and justice. i have always been an idealist. i believe in truth and justice and right and wrong. that can no longer be

politicized. those of us who spent our careers serving lady justice are not only disappointed, we are angry. lady justice may be blind, but she can see through those bandages enough to know that the american people deserve better. jim from the house judd dish air recommittee and coauthor of the letter of eric holder demanding answers. good evening, congressman. >> thank you for having me, judge. >> congressman, let's get right to it. you sent a letter to eric holder this week asking that he clarify statements that were made as of may 15th in front of your committee when he said, let's see, we have that here, guys? >> with regard to the potential prosecution of the press for the disclosure of materials that is not something that i have ever been involved in heard of or would think would be a wise

policy. >> all right. did he commit perjury? >> i don't know if he hit all of the points for perjury. at minimum he misled the committee by saying that which is also a federal crime. but what nobody has said including mr. holder is that the affidavit that he apparently knew about, according to a justice department correction nine days after the hearing, actually accused fox news reporter james rose enthat there was probable cause that mr. rose encommitted a violation of the espionage act, not just being a co conspirator or aiding and abiting a conspiracy but committing a violation of the espionage act. furthermore the search for the third -- search warrant the

judge issued after being turned on by two other federal judges, and i am going to read this, said that the department granted an act not only rose en's communications with the state department steven kim who had been violated for violating the espionage act but any document in its record or information concerning the national defense and other department of defense u.s. military and/or weapons material and any communications concerning such document images or records. >> congressman there's no question it's very broad. the concern here is whether or not you lied before your committee or at the very least committed a false statement. now what we find out as you accurately say you judge to get that search warrant because two others wouldn't give it to him. at the end of the day is there anything that he can say to you, which would cause you to say

that that is not in absolute contradiction to what he has already said? >> well, i'll give him the opportunity if he wants to say it on the record. but there are a lot of people in my career that have offered me a bridge in brooklyn for a very reasonable price. this might be another shot at that. you know, congressman it was shocking to hear that he called this reporter a co conspirator an aider and abetter when certainly the individual he then says was not someone he intended to prosecute and that goes to the very question of whether or not the application for the search warrant contained a lie or whether or not the attorney general lied again. >> the application for the search warrant was very clear it said there was probable cause to believe that mr. rose enviolated the espionage act. that's more than being a co conspirator that's accusing rose

enof committing a crime for doing his job. whatever else he says absolutely chilling to the freedom of the press. if you are doing your job and then you are accused of committing a crime for doing that then what's there left besides going to the courts or going to congress to deal with the issue. >> not only that the first amendment protects him. very quickly coming up against a break. you gave him until this past friday i believe to answer or explain. have you heard from him? >> it's wednesday the 5th by close of business. as of last friday we not gotten the response to the seven questions that chairm the chairman and i have posed. i hope that he will meet that deadline. if he doesn't, i think he's going to be accused of a cover up. >> all right congressman. thank you so much for being with us this evening. >> thank you, judge. >> coming up, much more on the scandal facing the obama

why now is he coming out and saying this? i got it during the election and i get benghazi because benghazi could be by that video protest but why is he saying this now? >> i think it's important for him to say this right now because if you remember right before the irs story broke what we were all talking about is benghazi. it is very important the president everything having to do with benghazi he has a black swan attack. it is unforeseeable. the administration doesn't have to take the hit for foreign policy continue to create a greater public probability of terrorist attacks on american forces and on american allies across the world. and eric, i mean, by his saying that basically the war on terrorism has said' it's all god it goes along with the narrative benghazi had nothing do with anything other than a video and it is a democratic revolution. >> these are all just isolated

incidents. mo along, folks. nothing to see here. benghazi, boston, a be heading in broad daylight in london. none of this is interconnected. that's the message president obama is giving. i have to tell you this is all part of a global jihad. yes, we are at war. war has to declare on us. a key point in this speech president obama talked about al qaeda and pakistan and afghanistan. judge to listen to him you would think we are only fighting al qaeda in pakistan. that's it. he doesn't mention the muslim brotherhood he's empowered at every turn, iran, hezbollah, self starters like london and boston. i would argue this jihadist threat is more vie verse and pervasive than any time since the- -- 9-11. don't worry it's all over. >> is the president by saying this is all over with and we are all safe now, how does he explain going forward why we are

still fighting this war on the other side of the world? >> well, he has to shore up his lap. he is going to be interested in painting the war as over. he really wants to make clear to folks in the united states that the war on terror is over and that everything is going on is basically a big distraction from his massive domestic agenda. when conservatives talk about benghazi it is because we are politically motivated not because we think it heightens the risk of terrorist attacks. they have this spineless foreign policy that says islamic terrorists is random cases of terror not a coordinated or idea logically driven assault weapon. >> you say this sends the wrong message to our enemies. do we even need to send them the message we are a paper tiger. look what happened in benghazi. we didn't send any one after americans. >> yeah, exactly. our actions speak even louder than our words in this case, judge. he willfully miss leads the
