hasan's request for another trial delay. jury selection was scheduled to start today. hasan says he needs a three month delay to prepare for his defense. survivors outraged now that hasan plans to argue he was defending the taliban. hasan telling the court, quote, the leadership of the taliban was immediate danger -- in immediate danger from troops at ft. hood because the u.s. has attacked and continued to attack the taliban. well, lindsey vonn forced to undergo a mandatory drug test. that whole incident happening at the council of fashion designers america awards on monday night. according to the new york "post," vonn was actually on the red carpet, then she got a call that several drug testers were at the glamorous event waiting for her outside. reports say the ioc then tested her sample right on the spot and told her to have fun after she passed the drug test.

vonn is training for next year's winter olympics in russia. and that is your five at 5:00. well, now a fox business alert. in a rare move, chrysler ignoring a government's order to recall more than 2 million older model jeeps because of concerns about fires like the one you see there. so how can they do this? and is this a sign that the government is just too involved? lauren simonette joins us. >> yeah, this is a big one. chrysler versus the u.s. government. national highway safety administration opened an investigation into jeeps back in 2010. looking at the design of its fuel tanks concluding that they're below the rear bumper and behind the rear axle, so more susceptible to rupture and gas leaks. they sent a letter to cries ter willing them to recall 2.7 million grand cherokees from the

1 1993 to 2004 and liberties from 2004 to 2007. but in a rare move we haven't seen since 1996, chrysler is refusing that recall. now, the national highway traffic safety administration can order a recall, but a court has to approve it, so we have to see where it goes. it could cost let's say about $300 million if chrysler did it obey with the recall and actually mix affected vehicles. >> and in the past, has this happened in the past and what happened there? >> it's happened in the past, but you chrysler has problems with the data that the government is citing. they say it is incomplete and in many cases a little exaggerated. so that's why some people are saying it is the government going too far because the more recent tests with newer models, they haven't seen the cars really have this effect with the the pul tank beifuel tank beingg place. >> all right.

thanks so much. extreme weather to tell you about now. a missouri town is on high alert this morning. look at this right here. the rising mississippi river threatens to take over that town. floodwaters breaking through sand bag barriers and then breaching a levee there. about 40 homes right now are in danger and officials are urging people to evacuate now. just 15% apparently of folks in that town have left the area, but the fire chief says everyone else is are ready to leave at a moment's notice. let's check in with maria who is tracking the conditions. boy, last summer driving down the mississippi river, that thing was down, way down. and now we have this. >> yeah, you're exactly right. we're talking about over the past several months drought conditions along the mississippi river, well below average water levels. and now extreme flooding occurring along multiple locations along the mississippi river and missouri river, as well. do want to bring you the details on that particular flash flood warning in effect until 2:00

p.m. today. a levee breach has been reported across the st. charles county emergency operations center. it's located along the mississippi river just below melvin pipe block and dam. so we're talking about water overtopping some of those areas. so we could be looking at extreme flooding. that's just to the north of the city of st. louis. but take a look at the number of flood warnings that do remain in effect in illinois, missouri, all the way down into memphis, tennessee. so again, a widespread area looking for the potential for flooding. and we could be looking at showers and storms moving through parts of the mississippi river and areas even farther west. oklahoma city, you could be looking at more storms. parts of northern texas, damaging winds, large hail. an isolated tornado is possible across parts of the plains throughout the day. temperatures south of the system in the 90s in texas. otherwise northeast very pleasant again, 75 for the high in new york city. and heather, i want to mention showers and storms out here in

getting top notch hotel rool, free drinks, all at a $34 million soirn california conference. and the more than 2,000 people who did attend, they got gifts for coming and enjoyed a keynote speaker who cost taxpayers more than $27,000. and house ways and means committee opened hearings yesterday to take testimony from members of tea party and other conservative groups that say all during these conferences, they were mistreated by the irs. listen. >> the copies of our own tax returns that we have in our organization are clean copies. we filed them with the icht rs electronically and when they get filed electronically, the irs puts a code on them. the redaction that we were unable to unlayer has that irs code on it. so we know for a fact this came from within the irs. don't know who did it. we've asked for investigation from the department of justice as well as the inspector general. we've been stone walled in finding out any information about those investigations. >> well, we also learned yesterday conservative groups claim they have proof of agency leaked their donor lists. as the attention shifts to the

environmental protection agency, it's now accused of targeting conservative groups, as well. the allegations are the epa has been charging conservative groups fees while largely not doing the same for on liberal groups. the fees are applied to the freedom of information act request. allegedly the epa waives them for liberal groups far more often than conservative ones. >> seems like it's a rampant practice in this administration in particular. and it's a practice that's very convenient because it's an excuse not to disclose a lot of information either to congress or to the public through foia request. i think it's a it tool that a lot of folks are using to hide important information. >> the epa has denied any favorite tim. back to you. >> all right. more troubling news for the white house this morning. let's take a look at who is talking because so many folks are talking about this. you all remember this.

president obama said that his administration would be the most transparent in history. that was the big theme of the campaign. >> but a new report is revealing top administration employees have be using secret government e-mail accounts. the white house pushing back now and denying those allegations. >> let's be clear. this is a practice consistent with prior administrations of both parties and as the story itself made clear, any request includes a search in all of the e-mail accounts used by any political appointee. are these work accounts secret, the answer is no because they are subject to foia requests. >> republican senator rand paul isn't buying that. he says the news should be very troubling for americans. >> now we have this whole culture of corruption where we've got these secret e-mail

accounts. for example, it would be a problem if they're communicating with lobbyists secretly, if they're saying to certain people that might make money off of the health care, this is what brought down clinton's health care plan in 1994 is they found out the secret meetings oing to make money off of the reform. so people make money in all ways in government, so that's why we want to know who they're talking to and it should be open to the public. >> hard to keep a secret for too long in washington, so they may find out the answer to that one. most federal agencies have failed to turn over the list of political appointee e-mail addresses. it was south under the freedom of information act more than three honesmonths ago. and coming up, this little girl's life depends on kathleen sebelius, but she's saying sorry, little sarah, it's not fair if i get involved. and then it sounds like something right out of a movie. the government may actually use

she has cystic fibrosis. and is right now on a ventilator as you can see. her theres say she has just weeks to live and what is stopping her from getting the adult lung she needs? her age. she doesn't qualify up she's 12 years old. sarah wants that transplant rule changed for all children. we'll keep you posted on that very sad story. a man accused of opening fire inside a crowd krod colorado movie theater now claims he's not guilty of murder, not guilty because he was insane he says at the time of the shooting. >> james holmes will now undergo, listen to this, a lengthy mental evaluation by state doctors and that's something that could drag on for months. but prosecutors may even get the chance to interview him while he's under the influence of a so-called truth serum. so it has to be determined if he knew right from wrong at the time he's suspected of shooting dead 12 people and hurting dozens more inside that packed aurora movie theater last

a fox news alert to bring you. a star university of alabama basketball player has been charged in connection with the kidnapping of a 6-year-old girl in mississippi. the little girl was snatched from her school but then returned home the next day. six people including his mother have been arrested. cops say his mom was the ring leader of this. no word exactly on how he was involved. investigators are trying it find the source of the gas leak that sparked an explosion on a small christian college campus in new york. seven people including one

student were hurt in the blast. the people reported smelling an odor of gas and on on their way out of the building when that explosion happened. that blast could be felt blocks away. it is deadline day for attorney general eric holder. republicans gave him until today to explain his involvement in issuing a search warrant for a fox news rotter's e-mails and phone records. last night on hannity, karl rove says so far holder's response to allegations has been inadequate. >> they're shredding their own credibility. he goes before congress on the 15th of may and says i would have nothing to do wheith this kind of thing. and then of course ga they have had to acknowledge since then that he has. but they're trying to square the circle and say that there is no conflict between saying i didn't have anything to do with and i did it. and the explanations are making it worse. they should have simply said he misspoke.

first. it is now 5:30 on the tot do temperature. shocking news is rocking the baseball world this morning. major league baseball reportedly waiting in the on deck circle to suspend about 20 players. for using performance enhancing drugs. the list includes some of the biggest names in baseball including a-rod and the 12011 mvp ryan braun. anna has the latest. >> good morning. if what we're hearing is true, it would be the largest doping scandal in sports history. this is the guy it all centers around, tony bosch. he's the founder of the now defunct biogenesis anti-aging clinic in florida. he's been under investigation for months, but reportedly he's reached a deal to talk and name names. in exchange, he won't face any charges or lawsuits. the biggest name linked to the

>> thanks so much, anna. and now for your five at 5:00. new overnight, a murder mystery in arizona. five sets of human remains found in a remote desert about 130 miles south of phoenix. investigators think that they could be murder victims from mexico. the age, sex and time of death of the five victims yet to be determined. some new york high school students claiming they were kicked off an air trans flight because they're jewish. about 100 teens were headed from new york to atlanta. the airline says they repeatedly asked the students to sit down and then turn off their cell phones. when the students apparently refused, the entire group was ordered off the plane. they were later rebooked on another flight. the school says it's investigating the incident. boston bombing suspect joke car s tsarnaev is reportedly receiving

mail trays. she was collecting workers' comp payments since injuring herself on the job back in 2004. she will be sentenced in acce s september. and that's your five at 5:00. the can deadly twister that ripped apart el reno, oklahoma last week is now the widest tornado ever reported. it reached an incredible 2.6 miles wide. in that 19 people were killed. and the region still dealing with some very severe weather. maria molina has the latest. you were telling us about that in the last half hour. what do we know right now? >> we'll be seeing showers and storms across parts of oklahoma, texas, and even into arkansas throughout the afternoon and evening hours today. but i do want to mention a tornado was confirmed in el reno, it had winds close to 300

miles an hour. the record, strongest tornado is just a little bit more than 300. about 318. in oklahoma, as well. so it did almost have the strongest recorded winds as well as the widest tornado ever recorded. today not as much of a risk. we are looking at a slight chance, though, for damaging winds, large hail and maybe an isolated tornado. just stay alert in texas, oklahoma and into arkansas. we could be seeing rain across sections of the mississippi river where we currently have ongoing flood warnings. otherwise temperatures hot in texas in the 90s, and nice day in new york city, 75 for the high here. >> marimarie, thank you so much. the irs is getting ready to return to congressional hot seat after alleged victims had their say on capitol hill yesterday. and also more shocking details are now emerging about how much of your money was wasted on a whole bunch of irs

meetings. doug is live in washington for us. >> we'll talk about the irs and the epa. also involved in kind of a brewing scandal. we'll start with the irs which faces two big problems right now. first this report detailing lavish spending at conferences, and second this group of organizations telling a very emotional story. as we saw yesterday on on capitol hill, representatives of six conservative groups talked about being alleged victims of irs political targeting. they were invited to congress to tell their stories. representatives of conservative groups described running a gauntlet of irs road blocks when they applied for tax exempt status and one said the agency even leaked a list of his organization's donors. >> they were harassed, assaulted on on the streets, van damme leezed in their property. >> i'm not interested in scoring political points. i want to protect and preserve the america that i grew up in. the america that people cross

oceans and risk their lives to become a part of. and i'm terrified it is slipping away. >> and to make matters worse for the irs, inspector general's report show it spent lavishly on conferences including one that cost more than $4 million, $60,000 spent on video satires starring ers employees including that star trek spoof. switching now from one go. government agency to another, the environmental protection agency, epa, has been an accused of politicalfavoritism, of almost always charging conservative groups for freedom of information requests when groups on the left were generally able to get the fees waived. >> batting 17 out of 19, sierra club was the worst at 70% granted, 11 out of 15. you add up other groups and we

are defective because the location of the gas tank makes them he susceptible to on rupture in a rear end or rollover crash. chrysler said in a statement yesterday the company does not agree with the nhtsa 's conclusions and does not intend to recall the vehicles. the subject vehicles are safe and not defective. chrysler maintains the design is commonly accepted and used in many other vehicles. as for the findings, the company says they're based on high speed, high energy accidents in which a different design would have made no difference in that is the first time since 1996 that an automaker has refused a recall request. in that case again chrysler which was an independent u.s. company at the time won a federal court decision over the nhtsa request to recover the seat belt systems on 91,000 cars. this time around the company now called by fiat says it stil plans to work with agency to resolve the dispute and nhtsa
