springs, california. ed, great to see you. the new revelations, have they overshadowed the president's meeting with the president of china? >> good to see you and no doubt it is overshadowing this mini summit. the obama administration wanted to come in with a strong hand and press the chinese on the security. there have been the revelations one after another suggesting that the obama administration has expanded the bush administration's surveillance to try and disrupt terror attacks. the president defending all of this yesterday in two different sessions with reporters saying it is limited surveillance, it is legal and a tough balance between security and privacy rights. but republicans say this is going too far. take a listen. >> we will have to find ways to deal with this data in ways that are consistent with our values and in ways that

protect people's pry -- privacy and ensure oversight and strike the right balance. >> this is a dragnet. it is an over reach and we have to find out why this is justified because the nsa wants to do some data mining. >> here is the real challenge for the president is the fact that this issue of surveillance is not happening in a vacuum. it is homing after a series of other revelations and controversies confronting the administration about the irs abuses and targeting conservative groups. the attorney general signing off on calling the fox correspondent a co conspirator and monitoring his e-mails and phone calls. this is a piece of the controversies that have really raised the american people's awareness about government over reach. >> and it seems like america is starting to pay attention to this ed. now with this controversy in the mix, will it change the

way we will have to deal with china? cyber security and hacking is a huge threat. >> it is a huge threat and before these revelations on surveillance, obama administration officials in the last week or two have been insisting that the president would really push the new chinese president on this issue. it doesn't just affect the pentagon and other agencies with real secrets. this is huge for american businesses who feel they are under assault from china, but elsewhere as well, but particularly china trying to steel intellectual properties that can give them a leg up on the glow glow balance stage, the global economy. the president said he thinks these issues are separate and that's an issue of china stealing intellectual property whereas the surveillancish knew america is about keeping americans safe. you are right. americans are aware of this now. a heightened awareness and it is raising a lot of questions.

>> questions and we will check back with you. great to see you, ed. >> great to see you. >> kelly? fox news alert out of southern california right now where we are expecting to find out details about a man who shot and killed four people before police took him out at santa monica college. according to reports the gunman killed his father and brother before hijacking a car with the woman aside. he then made several stops apparently shooting people at random before run together college library. that's where we find dominic right now live in santa monica with more details. what can you tell us? cops shot him and left a mile long bloody trail of dead and injured people. they hadn't seen anything like it. the college has 34,000 students. not all of them in the college at the time, but it caused panic throughout the neighborhood and more because

president obama was visiting at the time just 10 minutes away. authorities rushing to the scene and helicopters overhead and they were not sure what was going on. it seems it started with a house fire about a mile away. we understand that it could have been his father and his brother that lived in the house that caught fire. we don't have confirmation from the authorities that we are expecting that possibly in the next couple hours. his name has not been released. he is described as white and between 20 and 25. witnesses say he was carrying an ar15 assault rifle and he had a handgun and a belt of ammo around him and some sort of vest. he was dressed from head to toe in black. we spoke to one witness who saw him and this is how he described him. take a listen. >> like you are ready to go to war type of thing, you know? he had the helmet and a bulletproof vest and then he had like -- he had like a jacket and he had pants and

boots on. >> well, you can probably see behind me that the santa monica police are ready for a press office. and we are hoping to expand more on the report that we have been hearing that the gunman had a history of mental problems and difficult relationships with his parents. we will bring you that as soon as it goes live. back to you, kelly. >> thank you for the update. jaime? there is even more and new controversy in the irs targeting scandal. an agency employee is now blasting attempts by a former high level official to pin the targeting of conservative groups on the cinncinati office and describing it as a, quote, nuclear strike. can't wait to hear this one, molly. >> this agency employee told house investigators that she was, quote, appalled that irs higher ups were pining the scandal on rogue agents in cinncinati.

she says she and other cinncinati agents wouldn't have the autonomy to do something like target certain conservative groups. and she wept on to say, quote, i wassen fiewr yaited because they are inaccurate and everybody that has been making those statements should know they are inaccurate. i just thought when lois lerner dropped the bombshell, oh it is cinncinati's problem, and she thought it would go away, but instead it exploded. she was the head of the tax exempt division who was in charge while the targeting was going on. she said the problem started with low-level agents in cinncinati. she is now on paid administrative leave from the irs after refusing to resign. but one former irs commissioner says there is plenty of blame to go around. >> i think there were failures at three levels. they can't shirk responsibility for what they did. and then the exempt organization's leadership, lois lerner, and then right in the front office, the commissioner commissioner --

the commissioner should have done more to learn about these problems, if you will. >> so far no one has been fired over this irs scandal, but the former acting irs director, steven miller, was allowed to resign early. and there is a reason why. it is tough to -- there is a reason why it is tough to fire government employees. >> historically i think we as a society that people who work for the government, career workers shouldn't be subject to changing political wins. you don't want a situation where one party comes into power and thousands of thousands of people clear out and thousands and thousands of new people come in. >> dupreist says it can take months or even years to fire a government employee after you go through the various stages of the appeal process. jaime? >> molly, great insight. thank you. so where should and can lawmakers go from here? coming up, we will speak live with a member of the house oversight and government reform committee about what is next, what needs to be done to clean up the irs and about all

of the other oversight that is going on. and there is also news and a new twist in the ricin-laced letters. remember they were sent to president obama and michael bloomburg? the fbi has made an arrest and here is who it is. the tv actress shannon richardson who they believe mailed those poison letters, she used to be part of the "vampire diaries" show and she tried to pin it on her estranged husband. if she is convicted, the pregnant actress faces up to 10 years in prison and she did play small parts as well in popular tv dramas "the walking dead" as well. the calls are growing louder for the attorney general to step down or be fired and now even some in his own party are turning on hem. democratic senator saying it is time for the ag to consider resigning over the justice

department's media spying scandal. he served as the communications director and doug is a former spokesman for the congressional campaign committee. he also serves as the communication director to congressman chris van holland. they both join us. gentlemen, this is getting dicey to say the least. you have senator joe mansion becoming the first democrat to break ranks with his party and calling for attorney general eric holder to resign. in fact, he went on to say that, look, the bottom line is you can be a good man and do a good job and everything, but if you start expending your capital -- i am pear raw phrasing -- i am paraphrasing -- it is time to go. >> that is exactly right. it is time for attorney general eric holder to go. every day if you are at the center -- if you are at the center of the controversy and being talked about, you are not being effective at leading the organization. at the same time we are talking about a potential

perjury issue that eric holder committed. he said reporters were not being targeted as far as he knew. in fact instead he actually signed off on investigating and naming fox news correspondent james rosen as a co con conspirator, basically a criminal. i know the house judiciary committee would like him to come back and testify to go over the discrepancies over his testimony. he has a lot of problems. i don't feel he can hold on. the only way he can is if president obama decides he is good enough to stay at the agency. he should remain. >> doug, what about that? sorry, didn't mean to interrupt you, but the fact he may be losing his effectiveness as senator mansion pointed out and bear in mind senator mansion knows a thing or two about running a state and leadership, what should the message be from the president as it relates to his embattled attorney general?

>> senator mansion has as much sway in the democratic party as rush limbaugh. >> really? >> yes, he does. as someone who has been in the the -- as been an operative in the party i don't think anyone really takes what senator mansion says as -- i think he is up for re-election in 2012 and this is a good issue for him. the bigger point is whether or not eric holder is too big of a distraction. i think he is doing a very good job. i think whether or not he is a distraction or not is still an open question. and i think on that point it is important for the president to look at the issue and determine whether or not someone could be a fresh voice on the issue eric holder has put away a lot of terrorists and he enforced the laws on voting rights. i think a lot of that has to do with one of the reasons why republicans are after him.

but, you know, has he become a bigger distraction? that's an open question and i think it is personal the president who needs to consider that. >> and that is a bigger point. holder himself says he questions his work almost on a daily basis. personally all of us do that. we should. he acknowledges, however, that he does not do a perfect job for that matter. all of us always -- don't always get it right, but he is the attorney general. it goes without being said and to whom much is given and much is required, but can he meet the challenge of his office right now? >> he needs to set himself to a higher standard and that standard isn't being set. he performed an incompetent job in dealing with these news leaks by going after reporters. and the way he went about it it looks like an under handed trial lawyer so to speak and the ambulance chaser the way he went after this. he basically gained the courts and he called him a criminal

and ordered to get a warrant to look into james rosen's e-mails he needed those to examine. and another point, i really do think senator mansion's call for him to step down is significant. that can provide cover to other democratic senators if this crisis continues to allow him to call for his resignation as well. >> what about the po nie t -- the point ron is making? i know he is not an influential operative, but what if others come out and start turning? >> i don't think senator mansion speaks for the democratic party. he never has. this guy is up for re-election in 2012. it is a good issue for him to go after eric holder. >> let me get to another point. >> let me just say one thing about ron's point, the reality is is that i don't see how the

nelson mandela is hospitalized and in serious condition. an official statement released today says the 94-year-old former south african president and anti-apartied leader has been battling for several days now. he was admitted to a hospital early this morning after his condition began to deteriorate. mandela's respiratory problems date back to his time as a prisoner. this is the fourth time in

less than a year he has been hospitalized. let's get back to one of our top stories now. the new questions that are arising in the growing controversy surrounding the internal revenue service. agency officials grilled by congress over their excessive spending practices in the -- and the so-called swag bags given out at really lavish conference. >> were you thinking this will never be seen? or were you thinking how will this look? >> when we have episodes like this it has an impact on the average person. i live in a block where most people don't even make $50,000 a year. but yet still we can produce a video that has no redeeming value, none. >> these items like 3,000 of them were given to the -- were given to all of the participants over $60,000 of these types of trinkets. >> we know in the foot notes and what was in these swag

bags is it also included and i am kind of confused by saying this, but a plays steek squirreling -- but a plays assisting squirting fish. >> a republican of the house and oversight reform committee, good to see you, congressman. >> thank you for having me. >> you know, these conferences were supposed to be all about training managers of the irs. so that fish and other things in these swag bags, what was the point of those? what did they learn from this experience? >> well, it doesn't appear to have any redeeming value. on the oversight committee we basically have two goals, find out who approved this, hold them accountable and second, try to make certain this doesn't happen again. what we heard from russell george, the inspector general is basically the irs created a slush fund. they had canabalized vacant positions to have lower scrutiny and then spent it on a lavish party for themselves. >> they had the line dancing and they had the parties and

the swag bags to the tune of as was brought up in at least the one hearing more than most americans make in an entire year. how long before you know the extent of this? >> i think we need to get to the bottom of it relatively quickly. the goal of finding the source of the funds helps us. then we can make this prohibited so they are not able to do this again. canabalizing the funds that are supposed to be going to personnel and saving up to a lower level of scrutiny and then spending them on the lavish party is a practice that needs to be stopped. >> so it was deliberate and knowing? that's what you are describing. >> it is backdoor budge -- budgeting. it bears scrutiny and say they need a hundred people on a project and then they go and fill a portion of the positions and they use the monies and shift them over to other funds and throw a party. >> i hate to do this to you,

but you are double boxed with the gilligan's island takeoff that was one of the videos they produced. to most i'm sure seems ridiculous, but i want to ask about the oversight committee's role in this. there are -- was there anyway to have known this was going on ahead of time? >> since it was backdoor budgeting, we would not have known. now that the ig has found these monies and told this has happened, we can go in and troy to prohibit it. basically this gets down to who are the people at the irs? who would actually think this would be an approval government expense, that they would spend this type of hard-earned money that they would send on lavish parties for themselves. >> who should take the fall? how high up do you think you have to go to get things like this approved? and is the irs the only agency that in the back of your mind you think does this backdoor budgeting?

>> that is an interesting point. i am preparing for a bill that would prohibit this slush fund. i believe it is hundreds of millions of dollars. here we see in the irs it is over $50 million that was done in this way. clearly there are people up the chain of command that must know it is not just the people who approve the party or attended the party. somebody had to approve the transfer of these monies from the personnel accounts over to essentially a party account. >> who should happen to that person? >> that person should lose their job. >> it is not against the law what they did? >> it is definitely a crime, and that is something the ig will pursue. crimes were committed. it could be that there were extra monies commissions paid and monies in people's pockets that could have been illegal. the committees reviewing that, if there are crimes to be found, certainly people need to go to jail. >> i imagine people having to pay their tax money and aren't

getting their refunds in time are angry about this. you will get to the bottom of it and what is the white house position on this? do you think that they should address it more or ultimately take responsibility? >> absolutely. all of these agencies report to the white house. they have a culture of spending. they believe when government spends they create jobs and they don't have the level of oversight that we all expect that government should have with our hard earned tax dollars. this should have been something the white house was on. to let people throw these types of parties for themselves at taxpayers' expense is outrageous. and certainly at a time when we had budget constraints and at a time when we had sequestration that is grounding planes and the air force, certainly the white house should have looked at everybody's budget and making sure things like this don't happen. >> kind of hard to de -- to deny it happened when we have the video footage we have seen again and again. my question is this, people are really angry about this.

and people are still at their jobs? doesn't it seem wrong these people are still at their desks? >> yes, it is outrageous. and that's why we are trying to get to the bottom of it. a lot of time people make light of congressional investigations, but get together bottom of this, these agencies do not police themselves on their own. even if we are aware of abuses within them, without congressional action to find out what happened and who did it and to hold people accountable, many times people go without consequences. we will make sure there are consequences. >> and i know i work in the private sector, but if my co anchor and i made a "star trek" video or" gilligan's island" video or spent time line -- line dancing you know where we would be? out on the street. >> and you should be. absolutely. >> come back and tell us how this all works out. thank you very much. >> be glad to. thank you. >> thanks, james. >> a young pennsylvania girl

right now, a florida judge known as a crimefighter, no nonsense judge is trying to decide whether voice recognition experts should be allowed to testify in george zimmerman's second-degree murder trial. these voice experts were hired by lawyers on both sides to analyze 9-1-1 calls made with trayvon martin and the neighborhood watch volunteer, george zimmerman.

24r* are screams heard on these calls. and they could be crucial pieces of evidence to determine who the aggressor was. if only they could determine who it was. and joining us now to talk about it, defense attorney kesha heaven and brian silver. i welcome both of you here. >> thank you. >> great to see you. >> great to have you. this evidence, the judge has to make the decision before jury selection starts on monday. how difficult a decision is it? >> frankly it is unique to this particular case. in florida we have something called the fry standard which is a very high standard for the admissibility of expert testimony like this. in this case, voice analysis is something that is a little bit sketchy in my opinion. it is not like dna. it is not leak fingerprints. in this particular case the issue is we have an analysis where the expert is saying that his findings may not beacon clue sigh because of the quality of the tape. there are a lot of things that

are floating around that create a lot of moving parts. >> the supreme court has spoken and they have said that it has to be scientifically acceptable. it can't be junk science. i bet when dna evidence was started they thought that was junk at the beginning. this has been around a little longer, but not only are the voices a little tough to decipher, as lawyers we must admit we can hire an expert to say anything you want. 1k3* both -- and both of them will find it is their client screaming for help. is it of any use and is it probative or prejudicial? >> it is going to become the battle of the experts as it always does in criminal cases. like you said, both sides will have their experts. they will have their hired guns. they will say what they are hired to say. i don't think it will give in that much information to determine the outcome of this case. >> what do you think will determine the outcome of the case? >> what the determining factor

will be is the credibility of zimmerman and what happened on this particular incident. and unfortunately trayvon is not here to testify, but i think it is going to boil down to was zimmerman justified in using lethal force in this situation. >> deadly force require it be justified for imminent threat. in that very moment. his attorney waived the stand your ground. you brought up the fry hearing which is unique in florida. he is going for straight self-defense. it is his word against not trayvon. he is not here. it is a tough thing to overturn when you don't have somebody on the other side saying it wasn't self-defense. how much of a challenge is it for the defense? do they just sit back and see if the prosecutor presents a case that is believable? >> it is very challenging, but this is what it comes down to. we have other witnesses that in this case that per say didn't see the initial parts

of the fight. there are other people that heard the screaming and heard the yelling and saw one person on top of the other and most crucially, here is the key evidence that may make the determination in this case is the girlfriend who he was on the phone with that day, if you remember he was talking on his cell phone at the time he was attacked. and if this girl can come forward about what she heard and whether or not she can identify trayvon's voice on the recordings, that could make a big difference in this case one way or the other. >> they have had to apologize. they wanted to released this cell phone video showing what they said was trayvon beating up a homeless man. it was actually two other teenagers beating up each other. they had to apologize a week ago. they want character evidence to say that trayvon was on marijuana and he was bad in school. the judge ruled no at least in opening arguments. leaving the door a little bit cracked that it could come up

later. you think it will? >> i think the defense will try to bring up this character evidence, but i think it ultimately will be objected to, and the judge will sustain that objection because the character evidence they are rely ohe was suspended from school and used marijuana. that has nothing to do with what happened in this situation with zimmerman. it doesn't matter that he used marijuana to say he was the aggressor. he was suspended from school in the past. he was the aggressor. all we want to know or all the jury needs to know is what happened in this particular instance. i think that will not commend. >> i think the jury instructions are going to be so key to making sure the jury only considers that very moment. lots more to discuss in this case. i will be doing that tomorrow with a former prosecutor doug burns. thank you both very, very much. >> thank you for having us. >> we are keeping an eye on this for everybody. keep it on fox. kelly? mom always said eat your vegetables. coming up, we are going to explain perhaps why a new study looks at the surprising health benefits of following a
