held accountable? don't hold your breath. we are still waiting for fast and furious. hello and welcome to justice, i'm judge jeanine pirro. i have so much more to say about the president and his irs in just a few but first there are two criminal cases that are gripping the nation. george zimmerman and aaron hernandez. we begin tonight with the zimmerman case. this week the star witness for the prosecution rachel took the stand to give her account on the night trayvon martin died. almost immediately commentary started on her appearance and demeanor. good evening? >> hi, judge jeanine. >> in my time trying cases,

witnesses come in all sizes and all shapes. we don't pick them. they don't even pick themselves. there is certainly not out of central casting. some are articulate and some not. the criticism of this witness, tloos speak to trayvon was almost universal. what is your take on it? >> first of all, when you look at rachel, she is 17 years old but she looks much older. i think vitsd difficult for people to understand that she is note really was to the an adult when this all happened. she was basically judged by entire jury and everybody out there. her demeanor was not good first day she had a black shirt on and the earrings and took the stand. she was hostile. she didn't want to be there. she was frustrated. you could tell in her voice inflexion, rolling of her eyes and tone of her

language. >> judge jeanine: if you have your own personal experience, why don't you share it. >> this is the first time that i have shared this on national television, when i was age 15, i myself was a star witness in a murder trial. i was a baby-sitter in whom i was supposed to be baby-sitting. i was called and not to show up, but i was around the corner at a home at my girlfriend's house. someone had entered her home and stabbed her 21 times. >> judge jeanine: so you are a major with it. how old were you? >> absolutely. i was 15 years old. i was the main person that put him behind bars for second-degree murder. >> judge jeanine: affect you relate to the demeanor at all of rachel? >> what i can relate to is

actually enormous amount of fear, what it is like to be face to face with a killer. where someone that you are looking at, i'm going one putting behind bars. it's very frightening. >> judge jeanine: all right. >> the unfamiliarity being in courtroom having to stay silent and not being able to tell anybody because you are minor and having all the attention around you and people looking at you and grasping every word. >> judge jeanine: okay. i wanted to go to santina. what do you think of rachel and the fact she is universally criticized? >> i have to tell you she was not what we expected. this is so composed young lady.

we didn't expected trayvon's girlfriend to be so dark and so lovely. we are in a look serving society. we still have a lot of contempt for dark, dark skinned people. beyond that... her manner, her defiance was stunning to people. she was determined to tell trayvon's story. i can agree with my colleague by other guest this was a tremendous burden for this young woman, although she is 19 she was child then. she has a tremendous responsibility. she is the star witness. she could put someone away for life. she is trying to figure how it is the police told this man stay in the car and her friend ended up dead. >> judge jeanine: the person that cross-examined her, we beat stupidity,

not defending himself but trayvon is dead. how do we know? can we get a complete story here? >> i don't think that you ever will. that is very common in criminal trials. you have one party to the action and is deceased. but we put together as much at we can and hope that all the big pieces are in the correct places. we have a lot of back and forth. at this point there is some evidence there may have been valid claim of self-defense but there is evidence that george zimmerman was the aggressor. we're halfway through the case. we do have to hear from the coroner. autopsy will be extremely important to show what kind of defensive wounds trayvon martin may have had. trajectory of the bullet. we have a lot more to go. >> judge jeanine: as marsha says. there has been a lot of testimony, testimony regarding the blood on

zimmerman. is there any clear picture of yet what happened? >> i think it's very clear picture. you can't overlook the wounds on zimmerman. there are wounds in the front and back and lacerations in the back of his head. they are consistent with what his story is and the testimony of the neighbor john goode, he testified it's in the color of the clothing and martin was on top. he believed that he saw what he described as a ground maneuver with martin being the one on top. >> judge jeanine: martial arts. so person on top. the guy that was taking the martial arts classes. >> maybe he wasn't paying attention in class. >> he had a broken nose, black eyes and wounds in the back of his head. >> judge jeanine: what he is saying, he had injuries,

but is that enough to justify shooting trayvon martin? >> that is the issue. that is issue. yes, of course, he is injured we knew it from the started. we knew there was a struggle between them. nee we knew there was contact between them and trayvon got some licks in. we'll find out what happened to trayvon but at the end of the day, the jury has to decide are the wounds that zimmerman suffered evidence of suspicious force having used on him that he was fearful of imminent death or great bodily injury. i look at the back 69 head and front of the face, it doesn't look that bad. on the other hand somebody can be beaten up and feel as though the end is near regardless of what the injuries look like. >> judge jeanine: so objectively, this guy didn't even go to the

hospital. they bandaged him up. in his own mind, in his subjective perception that would dictate whether or not he was justified in taking a gun and shooting trayvon. >> not subjective. that irrelevant. he has to objectively, reasonable person has to fear for imminent death regardless of what zimmerman personally felt. you have to stand outside a reasonable person would feel that way too. >> judge jeanine: if there is a subjective feeling, i'm going to lose it here then? >> if it comes down to the wire, it's very close on the reasonable man standard. he gets up on that stand, he has to get up on the stand and saying i was fearing for my life. look at my nose, black eyes and wounds back to the back of my head. this is how i felt. you have to feel how i felt on that day.

if he is urge, he is going home. >> judge jeanine: do you think he will stake the stand? >> no, i don't. i don't think they wanted him to. at the point in time we're at and we're not done with the case, they have enough evidence in the record to get an instruction on self-defense. if he does take the stand and say something like what was just framed, then it's entirely possible the jury will think at the least he personally believed -- if the jury thinks that, he thought so but i don't think objectively speaking a reasonable person would, that would be a manslaughter charge. >> judge jeanine: so do you think there is going to be not guilty right off the bat? >> i do. >> judge jeanine: supported by an argument? >> i think it speaks for themselves and the testimony of the neighbors support the wounds. each of these witnesses

>> judge jeanine: not exactly a role model, actually more of a thug. in addition to facing charges of shooting death of an acquaintance he is being investigated in a double homicide in 2012. as you see in the picture can it be used as a road map to direct investigators in a murder case. with me is bristol county sheriff whose jail her nachb december sits and former sheriff david clark. i'll go right to you sheriff hodson, you are going trying to link this guy to gangs without compromising the investigation. what can you tell us. >> judge, i can't get into the specifics about what our investigators have found. the purpose of doing this in the prison is to make sure that when we place this person classification into a particular unit if we our intelligence

officers find some symbol or something that may indicate he has a gang affiliation at one time or another, we not put him in a unit with a rival gang member where potentially be a risk to him and to the other inmates in our facility. >> judge jeanine: what you are saying the identification of gang members based upon a review of those body tattoos is more for his protection. i'm going to go to sheriff clark. you've done a lot of these homicide investigations, body tattoos, your experience? >> good evening, judge. they are warning signs and it's hard to ignore. he has the word blood tattooed on his hand or wrist. and it's in color red, color of choice for the blood street gang. then also when you pull the forefinger and hold up three fingers that is sign

of blood street gang. warning signs and kind of hard to ignore. >> judge jeanine: also some of the tears, some of the tear drops are generally done to indicate a member of your gang that has died or has been killed? >> that is one of the other symbols. the thing that gang members don't try to hide their involvement. a lot of that is done to kind of show that this is the gang i belong to. they want other gang members to know. it's not going to be that these things are hidden amongst the other tattoos and body art he has going on there. >> judge jeanine: there are those that say the fact that he is not admitting to being a member of a gang may be an indication he really doesn't want to prove himself in the jail? >> look, it's very

dangerous -- it's a different ballgame when you are in prison and unit with rival gang members. we have major gang issues in our county. the other thing that makes it sort of difficult is that he is a high profile person, has star qualities. even just whether he is in a gang or not there may be someone who might think, hey, if i could prove something to some friends that i did something to hurt this guy, that might increase my stature among the group i hang with. >> judge jeanine: how is this role model doing in prison? >> actually, we are monitoring and he is in a single cell. he seems to be doing fairly well. i checked in twice when he went for a bail review and we'll be watching him over the next couple of days and doing another

classification review. so far he has been very polite and respectful. pretty much a model inmate. he hasn't had any issues thus far. >> judge jeanine: finally, the evidence do you think is solid against him? >> it's not looking good for mr. hernandez. kudos to the investigators at the scene. it led investigators back to the perpetrator. obviously these are allegations right now, but if you were to ask me based on my experience, i would say it doesn't look good for o for mr. hernandez. >> judge jeanine: i agree with you, the circumstance at evidence is very strong. the issue now is 2012 homicide. thank you so much for being with us this evening. >> coming up after the break. cookie jar and the irs. my opening statement. you won't want to miss it. and obama administration wants the n.f.l. and the

spoken to shulman, lerner or rosen. under intense questioning you pivot to the obama playbook. first no, then i don't know, then there is no evidence, then you proved there is wrongdoing, i challenge your question. then you are looking into the facts. now, you are going to wait for the justice department to do an investigation. great. with holder gets another investigation he won't do. does this remind you of anything? remember benghazi, that hillary appointed they didn't get the facts but they had a conclusion. they didn't speak to hillary, they didn't ask the president if he made cross border authority. such a happy ending and everybody is still working at the state department. folks, this is how it is done in washington.

they don't want the truth. no one has been fired, sanctioned, prosecuted, people are on vacation getting paid for not working and not doing their job. they say at the irs that they are sorry about the conferences and the lavish spending and targeting of conservatives and they want our forgiveness. i believe in redemption, but in this case i think we should leave the forgiving to god. what is good for the goose is good for the gander. imagine you told the irs you are sorry, you didn't keep the receipts. do you think they are going to say, oh, no, problem and then go away? if you make a mistake with the irs, you lose. there are certain fights you can't win like if you bring a knife to a gunfight, or you go into a fight and you have to look all the

way up at the other guy -- you get my drift? i have an idea. until you the irs come clean, people made accountable and people start losing their job, our tax dollars should go into an escrow account. you shouldn't be able to see it or spend another penny of our money on your selves let alone get millions in bonuses and target the rest of us. you are a bunch of bullies. they say in our society we have zero tolerance for bullies. i'm not so sure that is the case here. >> with me now is florida congressman rhonda santos joins us from florida. congressman, thanks for being with us. you are a harvard trained lawyer, i understand you were a military prosecutor, as well. is there any hope for getting the truth out of

the irs? >> well, judge, it's very difficult when you have so many people pleading the fifth amendment. we were able to do it about lois lerner. what she tried to do was proclaim her innocence. she made about nine factual statements and then she said she wasn't going to answer questions on cross-examination. we think she waived her right under the fifth amendment. you aren't allowed to pull stunts like that. think we're going to bring her back and see what she has to do. in your statement that you made is what i feel, people and misconduct within this bureaucracy and zero accountability. you can take the fifth amendment and you don't even lose your job. you get reassigned and continue to get paid. this is very frustrating because i think the american people don't believe that there is any

accountability. >> judge jeanine: and lois lerner not only did she keep our her job, he is not working and she is getting paid. she is in line for one of those bonuses. i understand she has gotten six figure bonuses. the woman that is managing the targeting have conservatives and tea party says in line for a six figure bonus? >> it's obviously unacceptable. these bonuses with the irs has gotten completely out of hand. they have contempt for the taxpayer. here they are, they have immense power yet they treat the american people in ways that i think are just completely unacceptable. so she is going to have to make a decision about coming and speaking with us. if she still refuses to testify, then our committee is going to have to act, perhaps holding her in contempt of congress.

they are happy to spend other people's money. in this propaganda campaign the n.f.l. has apparently announced now -- i'm not convinced yet -- that they are not going participate this. n.b.a. may still participate in it. this is cheesy and smacks of did he say operational. i'm concerned this is negative precedent. if president bush had them out there on invasion of iraq or pro-life, liberals would be very upset about this. the other element of this judge is that california effort where they are funding with our dollars again nearly $40 million in california alone to have school teachers essentially indoctrinate or brainwash children in the school system so they will be dispatched to their homes to convince that obamacare is a great thing. this is crazy. >> judge jeanine: mark,

what chris is talking about is that there is a grant being used to train kids in school or teach kidz in school about health insurance. $37 million in grants. what do you think of that, mark? >> yeah, talk about both points that chris made were well made. first, there was an effort by the bush administration to sponsor, for example, nascar. u.s. army did. that that was part of the government, chris i didn't interrupt you, let me speak. in massachusetts we launched a universal healthcare under mitt romney a republican and nobody had complaints and we had a boston red sox educating the public about this plan. the one thing about this important legislation is it requires the general public to know about the options that are available to them. one can easily imagine why lebron james would want in the neighborhood where he

this is smoothing the roads for the 2014 election with an unpopular law that they wanted to make more popular? >> it doesn't bear resemblance to army sponsoring a nascar team. that is different thing. everything this administration does is geared toward the next elections. there is no doubt about that. they are using our money to popularize an unpopular scheme. >> judge jeanine: i have to talk about the public health care, up to half a billion dollars to educate our kids about obamacare. coming up ambassador chris stephens diary published on line, ten months after the attack in benghazi. why are there still no answers? and this is your last chance to vote in our poll. should taxpayer money be used for obamacare.

was afraid for his own life. what do you take from this? >> no. absolutely. absolutely. first of all, i and a lot of other people would like to thank you for keeping this story alive and somewhere near the front burner despite the administration's best efforts to try to make it go away. it's ten months since at tack. we're going on the first anniversary. i just -- i'm still just gob smacked that we're almost to the one-year mark and we have no real answers to very simple questions. but in terms of the diary, when you read this diary from ambassador stevens, the last thing he wrote in there is never ending security threats. never ending security threats. then he's dead. and, you know, we were led to believe, you know, after the attack and for quite some time afterwards that, you know, everything was fine. we were making progress and this is just a protest out of control. as far as publishing the diary, the family didn't want to

publish it. i'm keen to see the story move forward until we get the answers. i know what the people that published it were thinking. part of me says we should respect the family's wishes. >> you know what? a lot of the stuff in the diary, there is so much about security and the threats and his concern for his own well-being. some of it is personal as well. i can understand the family being concerned about that. but let me just jump apparently there is a book deal that has been entered into by four of the survivors from benghazi. it's interesting that we haven't heard from any of them. now what we're hearing is there a book deal. what do you know about there? >> yeah. i guess unfortunately that shouldn't be too much of a shock. it sounds as if four individuals and it is members of the security team which means they may have been members of the global response staff that was there to help provide in part security for all the folks doing their jobs there like ty and
