marking 150 years since gettysburg, a turning point tomorrow. fox in gettysburg reporting on historic events. don't miss it. have a great week, everybody. go. tonight on huckabee, edward go. snowden is charged with espionage and called a traitor tonight on huckabee. edward snowden has been charged with espionage and called a traitor. >> i am not scrambling jets to get a 29-year-old hacker. >> why is the rest of the world defying the leader of the free world? >> our enemies have absolutely no respect for us. and the senate passes immigration reform. >> 40,000 border patrol agents, $4 billion of technology backing them up. 700 miles of fence completed. >> ice agents are not satisfied. their union leader explains why.

historical, natural law definition of marriage of one man, one woman. now, even if you think people of the same gender should marry, i'd like to think you might feel such a major cultural shift ought to be in the hands of the people that are supposed to hold ultimate authority under our government. even in the decision on defense of marriage or doma, legislation was passed overwhelmingly by both houses of congress, in a bipartisan vote, and it was signed by a democrat, president bill clinton. no matter that some people that voted for it say they have evolved and that they are now against it, but if that's so, put it back before the world's greatest deliberative body and the people's house and see how it flies. same-sex marriage is newer than google and the ipod, and the first nation to even codify it into law didn't do so until the year 2000. i am told i need to get on the right side of history and support the marriage of two people of the same gender.
5:03 pm
well, i respectfully believe that i am on the right side of history because the history is pretty long on marriage between a man and a woman, not so much for other versions. despite frothing of advocates to the contrary, i am neither a homophobe nor a hater. i am simple enough to believe marriage of one man and one woman not only is the only biological combination capable of creating the next generation, but in the context of a monogamous, committed relationship it is the best context for children to learn how to replace their parents. if we're determined to change the definition of marriage to accommodate how people feel and what they wish to do because of their mutual consent, then we should immediately release those incarcerated for practicing polygamy or bigamy. and frankly, make all consensual adult behaviors legal, whether prostitution, assisted suicide, or drinking 16 ounce sodas in

new york city. [ applause ] as much as i love to be loved and admired by all, i can't defy the definition of marriage any more than i can defy the law of gravity. god created both. at the point i decided to follow him in my christian commitment, my life nor its rules belong to me any more. as for the argument it is a matter of equality, let me gently point out the issue is not equality but sameness. it would guarantee a right to vote, rent or buy a house, go to school, receive medical care. quality of worth doesn't create sameness. there are differences between men and women and votes of congress nor the extreme court can change that. after 39 years of marriage i won't pretend that i understand women, but i do know there's a difference. court said in 1857 that black people weren't fully human the

court was wrong. they said in 1962 we couldn't pray in school, and the court was wrong. in 1973, they said unborn children were disposable, expendable, and 56 million dead children later they were wrong, and this week for those of us to believe god created male and female and who believe jesus said a man shall leave his father and mother, a woman shall leave her home, the two become one flesh, well, to us the court was wrong yet again. [ applause [ applause ] joining me, elly mistle, and kara. good to have you both back. kelly, let me start with you. your reaction to supreme court decisions this week may be different than mine.

>> a little bit. as a person in a traditional straight marriage, after doma decision, i lost nothing. nothing was taken from me, nothing taken from my marriage. i gained seeing my gay and lesbian friends experience what i experienced, i feel is beautiful and unifying. i can't speak intelligently about many things. i cab speak somewhat intelligently about the law. the law says people are entitled not to sameness but equal protection. marriage is really an issue about protecting a unit from practical things like unfair taxation, adoption rights, and practical things of that nature. i think what the court said, somewhat convolutedly in that doma decision, people are entitled to equal protection of their unity, regardless whether that is between -- >> but in order to do that, one must have a legal definition of marriage that substantially changes the historical
5:07 pm
definition. >> that's right. >> so tara, let me let you react to that. your thoughts as you heard about the court's decisions on both prop 8 and defense of marriage act. >> i think the court complicated the issue, and i am with you, governor, 100% of the way. this isn't equal protection under the law, you can do it with civil unions. you don't have to redefine what thousands of years of tradition defined as marriage is between a man and woman, the sanctity of marriage should be preserved in that respect. we could have argument about where the government comes in, telling you who you can and can't marry, that's an intellectual argument to have. i don't think it is necessary to redefine marriage to get something that they want, which is tax benefits or, you know, access to visitation. i don't think anybody has any problem with loving who you want to love, if you want to have
5:08 pm
certain contractual equal protection, we can have that. redefining marriage is i think unnecessary and not a good thing for this country. where do you draw the line? >> the president has been under fire for a number of scandals since he started his second term. no longer is he immune from late night comics. jay leno on "the tonight show" commented a little this week. >> in the middle of the scandals, president obama got good news. the irs ruled he can write off the first half of the second term as a total loss. not a problem. write it off. >> all right. it is not just the late night comedians cracking jokes. earlier this week, russian president vladimir putin compared dealing with obama's administration request for return of nsa whistleblower edward snowden to sheering a squealing pig. that can't be good.
5:09 pm
the question is obviously are we at a point now where we're not getting the respect that we once got? i thought it was going to be so much better when president obama came, that's what he promised, that he was going to usher in a new level of world cooperation. tara, are we seeing that new era of world respect and cooperation? >> let's think about this. so putin spits in our face. that's not working. president obama went and bowed to our enemies and apologized for america, one of the first things he did as an apology tour when he got elected the first term. let's see how that turned out in the middle east. we have a dead ambassador in libya, his libya policy didn't work. he set artificial red lines in syria, i don't think we should go there, he talked tough, said if syria does this, we're going to do -- what are we doing there? it has been a failure. afghanistan is a mess. iraq is a mess. what foreign policy wins has
5:10 pm
this president had? none. and i don't want to hear the bin laden thing. that was foundation that was laid under bush and obama made the decision as commander in chief, the obvious one, if he is there, go get him. >> why not talk about the osama bin laden thing? i think obama has proved if he wants to find you, he is going to find you. if he needs to find you, he will find you. he has shown that. it is snowden, we don't need batman. if edward snowden needs to be caught, he will be gotten. i am pretty sure he has proven that. >> he minimized that. we have john kerry, secretary of state saying what snowden did, he is a traitor, could cost people their lives, only ten people in the history of the act have been charged under that. they sake it seriously there. then you have obama being very, you know, arrogant saying i'm
5:11 pm
not going to send jets to get a 29-year-old hacker. you got to be kidding me? which is it? >> should invade russian air space to get a 29-year-old hacker? probably shouldn't do that. probably shouldn't start world war three. >> tara, hold on a second. let me get to elie. hold it. got to get to el i.e., be fair here. >> do you think he is handling the snowden thing, alan dershowitz was on the show saying if they were smart, they wouldn't charge him with espionage, just simple theft, then it wouldn't be extradition issue. charging it with espionage escalate td to a political issue. i wonder can the president have it both ways, most dangerous thing that happened? it is some flake hacker there. >> i think dershowitz is right. there's difficulty with the snowden thing because on the one hand there are a lot of people, progressives and conservatives on both sides of the aisle that don't think what snowden did was
5:12 pm
all that wrong. on the other hand, he clearly violated u.s. law. so i think it is a very difficult thing to figure out what he should be charged with, how he should be brought to justice. what i don't think is reasonable, it shows obama is a failure because he won't invade russian air space to get a kid. i think what we need is cooler heads, figure out what we actually want to do with this guy, and once we figure that out, i'm sure we will be able to achieve it. >> all right. that's where we have to leave it for now. we will come back with both of you in a moment. we know the president is a great campaigner, looks like he is a good illusionist, too. he is telling us the economy is recovering, the numbers show otherwise. we will have elie and tara comment next. i would like to hear from you, go to my website, mikehuckabee.com. tell me what you think on lead feedba -- leave feedback section.

5:17 pm
i don't think that's a liberal conservative thing, that's americans are financially illiterate thing. we need to encourage americans to save more and spend less. that has nothing to do with liberals and conservatives. has to do with basic financial literacy of the country. >> tara, saying lead by example. talking about government spending? >> of course. how dare you lecture us, okay, about saving and being prudent with our finances when this president, this government, republicans, too, under bush, but this president has been unbelievable spending everybody else's money. we are $17 trillion in debt. and we have a president on $100 million vacation basically in africa. and you're asking the american people to tighten their belts and save? no. how about we have the government do their job, which is back off small businesses, stop taxing people to death. stop trying to create environment of jealousy when people are successful, which is

reasons, governor. i hope they're going to come out in the weeks and months to come because the american public needs to know how bad this legislation is. let me give you one example. 40% of the illegal aliens present in the united states, again, that's 40%, almost half our entire immigration problem isn't even addressed by this bill. these are individuals that came here on visas, came to the united states legally. doesn't matter if you have 10,000, 20,000 border patrol agents, they can't stop people that come legally and visas and overstay those visas. this bill completely ignores enforcement of the 40%, almost half the entire illegal immigration problem in the united states now. >> chris, a distinction many don't understand, the difference between border patrol agents that control the border itself and the immigration agents like yourself, the i.c.e. agents, that deal with immigrants once they cross that border. so here's an important question.
5:35 pm
we hear a lot about border security is going to be increased. how much increase in this bill is directed toward those of you whose job it is to deal with 40% of illegal immigrants already here and those who might yet come? >> well, we actually have zero new officers and agents. we have zero new resources in this legislation. and like you pointed out, border patrol stands on the line, they stand on the border, try to keep illegal immigration out of the country at the border. everything in between the borders is policed by i.c.e. agents. we currently have 5,000 i.c.e. agents, i.c.e. immigration officers in 50 states, guam, puerto rico, trying to enforce our nation's immigration laws. we're completely overwhelmed. the los angeles police department has 10,000 officers and we only have 5,000, so again, we got zero new officers and resources in this bill. >> zero additional assistance, but a lot of burden will fall on you guys.

did you communicate this to people like senator rubio and others, and if you did, what kind of response did you get? >> well, we did communicate directly with senator rubio, i actually met with him on two separate occasions personally. i met with his staff on multiple other occasions, senator rubio and his staff assured us in writing that there would be amendments to the bill that would provide for interior enforcement. he appeared shocked when we talked to him about the problems we're having out in the field, and with how the small number of officers that we have to do this job. again, they assured us we would have that in this legislation and it never happened. we tried to keep lines of communication open with his office, at some point they stopped communicating with us, and nothing was added to the bill to address these problems. >> have you talked with members of the house and are you more optimistic when it gets there, they will listen to the fact that there's a big issue? i can't believe you only have 5,000 agents for the entire
