[ cheers and applause ] >> thank you. great audience here in new york. thanks so much for coming. and welcome to "huckabee" from the fox news studios in new york city. well, the extreme court has done it again. this week they decided that the voters of california nor god almighty himself were as wise as they were. now, while i understand the technical legal nature of the decision, the effect was to ignore a substantial majority of voters in california who twice -- twice affirmed the biblical, historical and natural law definition of marriage of

one man-one woman. now, even if you think people of the same gender should marry, i'd like to think that you might feel that such a major cultural shift ought to be in the hands of the people who are supposed to hold ultimate authority under our government. even in the decision on the defense of marriage or doma, the legislation was passed overwhelmingly by both houses of congress in a bipartisan vote, and it was signed by a democrat, president bill clinton. no matter that some people who voted for it say they have evolved, and that they are now against it. but if that's so, then put it back before the world's greatest deliberative body and the people's house and see how it flies. same-sex marriage is newer than google and the ipod. and the first nation to even codify it into law didn't do so until the year 2000. now, i'm told that i need to get on the right side of history and support the marriage of two people of the same gender. well, i respectfully believe that i am on the right side of

history, because the history is pretty long on marriage between a man and a woman, not so much for other versions. despite the frothing of the advocates to the contrary, i'm neither a homo-phobo or hater. i'm simple enough to believe that a marriage between one man and one woman not only is the only biological combination capable of creating the next generation, but in the context of a mon og mouse and committed relationship it's the best context for children to learn how to replace their parents. if we're determined to change the definition of marriage to accommodate how people feel and what they wish to do because of their mutual consent then we should immediately release those incarcerated for practicing polygamy or bigamy. let's make ought consent chal behaviors legal, prostitution, suicide or even drinking 60-ounce sodas in new york city.

[ applause ] >> as much as i'd love to be loved and admired by all, i can't defy the definition of marriage any more than i can defy the law of gravity. god created both, and at the point i decided to follow him in my christian commitment, my life nor its rules belong to me anymore. as for the argument that it's a matter of equality, let me gently point out the issue is not equality but sameness. see, equality means intrinsic worth and value and would guarantee one's right to vote or rent or buy a house, go to school or receive medical care. but equality of worth doesn't create sameness. there are differences between men and women. and votes of congress nor the extreme court can change that. after 39 years of marriage, i won't pretend they understand women. but i do know there's a difference [ laughter ] >> the court said in 1857 that black people weren't fully human. and the court was wrong. they said in 1962 that we

couldn't pray in school. and the court was wrong. in 1973, they said unborn children were disposable and expendable. and 56 million dead children later, they were wrong. and this week, for those of us who believe that god created male and female, and who believe that jesus said that a man shall leave his father and mother and a woman shall leave her home and the two will become one flesh, well, to us the court was wrong yet again. [ applause ] >> joining me now with their reaction to the supreme court ruling, editor of "above the law.com, ellie mistle and kpuncation director for california congressman dana rohrbacher, seth my er. ellie let me start with you. your reaction to the supreme court's decision this week might be a little different than mine. >> a little bit. a little bit. as a person in a traditional straight marriage, i can say that after the doma decision i

lost nothing. nothing was taken away from me. nothing was taken away from my marriage and the commitment that i have for my wife. and instead what i gained was the ability to see my gay and lesbian friends have the opportunity to experience something that i experience, and i feel is very beautiful and very unifying. i can't speak intelligently about many things. i can speak somewhat intelligently about the law. what the law says is that people are entitled not to sameness but to equal protection. and i think marriage is really an issue about protecting a unit from very practical things like unfair taxation and adoption rights and practical things of that nature. and i think what the court said somewhat convolutedly in the doma decision was that people are entitled to equal protection of their unity regardless of whether or not that unity is between -- >> but in order to do that, one must have a legal definition of marriage that substantially changes the historical definition. so -- and so tara, let me let

you react to that. your thoughts as you heard about the court's decisions on both prop 8 and the defense of marriage act. >> well, i think the court just complicated the issue. and i'm with you, governor, 100% of the way. that was an excellent monologue. you know, this is not about necessarily equal protection under the law. you could do it through domestic partnerships, civil unions. you don't have to redefine what thousands of years of tradition is defined as marriage is between man and a woman. it's the sanctity of marriage should be preserved. i don't think that it's necessary to redefine marriage in order to get something that they want, which is tax benefits or access to visitation. i don't think anybody has any problem with loving who you want to love. if you want to have certain contractual equal protections

then we can have that. but redefining marriage i think is unnecessary and it's not a good thing for this country. >> all right. >> where do you draw the line? >> let's go to this. the president has been under fire for a number of scandals since he started his second term. no longer is he immune from the late night comics. jay leno on "the tonight show" commented a little bit this week. >> well, in the middle of all these scandals president obama some good news today. irs ruled he can write off the second term as a total loss. just write it off. >> all right. it's not just the late night comedians who are cracking jokes. earlier this week, russian president vladimir putin compared dealing with obama's administration requests for the return of nsa whistle blower edward snowden to shearing a squealing pig. that can't be good. the question is obviously -- are we at a point now where we're

not getting the respect that we once got? i thought it was going to be so much better when president obama came. that's what he promised, that he was going to usher in a new level of world cooperation. tara, i'm going to start this time with you. are we seeing that new era of world respect and cooperation? >> well, let's think about this. so putin spit in our face. that's not working. we went -- president obama went and bowed to our enemies and apologized for america one of the first things he did as an apology tour when he got elected the first term. let's see how that turned out in the middle east. let's see. we have a dead ambassador in libya, libya policy didn't work. he set these art figures red lines in syria. i don't think we should go there but he's talked tough and said if syria does this we're going to do it. what are we doing there? it's been a failure. afghanistan's a mess. iraq is a mess. what foreign policy wins has this president had? none.

i don't want to here the osama bin laden thing because that really is a result of the foundation that was laid under bush, and obama made the decision as commander in chief, the obvious one which was if he's there go get him. >> why do you not want to talk about the osama bin laden thing? >> because he had nothing to do with it. our intelligence community did. >> i think obama has proved that if he wants to find you he's going to find you. send a drone and come and scare you. he's going to find you if he needs to find you. i think he's shown that. it's eric snowden. it's not a bond villain. we don't need batman. if eric snowden needs to be caught he'll be caught by obama. he's proven that. >> john kerry our secretary of state said that what eric snowden did, he's a traitor. he could cost people's lives. they charged him under the espionage act which only 10 people in the history of this act has ever been charged under. they seem to take it very seriously there. then you have obama being very arrogant saying i'm not going to go send jets to get a 29-year-old hacker.

you got to be kidding me. which is it? >> we probably shouldn't invade russian air space to go get a 29-year-old hacker. we probably shouldn't start world war iii. >> tara, hold on a second. [ overlapping speakers ] >> tara, hold it. got to get to ellie. got to be fair here. so do you think that he's handling the snowden thing -- allan derschowitz said if they were smart they wouldn't charge him with espionage. just charge him with simple theft. there wouldn't be an extradition issue. but biy charging him with espionage raises it to a political issue. it's the most dangerous thing that's ever happened? no, it's some flake hacker out there. >> i think there's some difficulty with the snowden thing. because on the one hand, there are a lot of people, progressives and conservatives on both sides of the aisle, who don't think that what snowden did was all that wrong. on the other hand, he clearly

. well, the president keeps talking about a recovering economy, but according to a new poll released by bankrate.com, three quarters of americans are living paycheck to paycheck. they don't even have enough savings to cover six months of expenses. the same survey says that more than 27% have no savings at all. the president this week says, well, we got to work on climate change that most people believe will cost a lot of americans jobs. is this the right time to be costing americans jobs? >> is this the right time to be focusing on climate change i think is the question. >> that's a good question. sure. >> well, look. i think focusing on climate change is important, is going to be expensive. you know what will be more expense i've? retrofitting everybody on the east coast with gills in 100 years so we can breathe underwater. at some point climate change is going to be amazingly expensive. i do think we have to address that at some point in terms of the economic figures you pointed out with the americans living paycheck to paycheck, i think that's really sad. i don't think that's a liberal-conservative thing. i think that's an americans are

financially illiterate thing. we need to encourage americans to save more and spend less that. has nothing to do with liberals and conservatives. we have to lead by example. >> i think we have to deal with our basic financial literacy as a country. >> tara you were saying lead by example? talking about government spending maybe? >> of course. how dare you lecture us, okay, about saving and being prudent with our finances when this president, this government, republicans, too, under bush, but this president has been unbelievable spending everybody else's money. we're $17 trillion in debt. and you know we've got a president on a $100 million vacation basically in africa. you're asking the american people to tighten their belts so they should save? no. how about we have the government do their job, which is back off small businesses, stop taxing people to death, stop trying to create an environment of jealousy when people are successful which is what the american dream is about and then punishing them for it and then

having people be jealous of their neighbors if they do so. that's what this president is doing. ing example of a hill that president reagan brought to us. he brought optimism. [ cheers and applause ] >> this president constantly puts the country down. [ overlapping speakers ] >> you don't need the iphone 5 and could money in the bank. that's something we could do too, right? >> how about the government stops spending money on food stamps. >> one at a time. >> i understand it's fashionable and fun to blame the government for all our ills. when you talk about americans living paycheck to paycheck and not saving, that's a long-term structural problem with the way that we spend in this country more than just a blame obama problem, right? >> perhaps it is. but government policies have allowed people to be irresponsible. they bail people out who don't pay their mortgages, but the people who do pay their mortgages, they don't get those kinds of breaks. i think it's been an environment, an entitlement type

of mentality progressive that is brought in this country that allow people to be irresponsible and make those decisions with no consequence. >> i agree with you on this point, ellie. i don't think the overspending is a democrat or republican problem. neither for congress because republicans have spent just ridiculously in the past. so we can't say they have completely clean hands. even as consumers, i think you've made a good point. that there is a sense in which consumers don't think about the long-term consequences of their lives. but i do think the government shouldn't create policies that make it harder for them to succeed. i can't help but believe that that's what this president is doing. but i appreciate you being here and tara being here. it's always fun, and we hope to have you back again soon. >> president president obama was campaigning for re-election, he was a fan of the coal industry. >> here's what i've done since i've been president. we have increased oil production to the highest levels in 16 years. natural gas production is the highest it's been in decades. we have seen increases in coal production, and coal employment. >> well, here's what the president had to say when he announced his plan to cut greenhouse gas emissions to combat climate change earlier this week. >> today i'm calling for an end of public financing for new coal plants overseas unless they deploy carbon capture technologies or there's no other viable way for the poorest countries to generate electricity. and i urge other countries to

join this effort. and i'm directing my administration to launch negotiations toward global free trade in environmental goods and services, including clean energy technology, to help more countries skip past the dirty phase of development and join a global low-carbon economy. they don't have to repeat all the same mistakes that we make. >> all right. joining me now from west virginia is josh nelson who works for a mine repair company. he's also a member of the state's house of delegates. also his father mark, member of united mine workers union, who recently went back to work as a bulldozer operator after a long layoff. good to have both of you here. [ applause ] >> mark let me start with you. it was about a year ago when you were on the show. you'd been laid off from your job at the coal mine. you've heard the president's comments this week about the coal industry. what kind of comments are you hearing in your community there in west virginia? >> well, governor, we're looking

at the way things are now, just for me, example, when i go to work at night, come up to the yard shack and i wonder am i going to get through? just a couple of weeks ago, 160 men drove up to that same yard shack and were turned around and laid off. >> and josh, let me ask you about the coal mining industry. you were also a member of the house of delegates in west virginia. this has the potential for a huge economic impact on your state. describe what could happen if the president's words this week become the policy of america. >> well, governor, a large majority of the tax revenue of the state of west virginia comes from the coal industry. essential services and repairs that we need to make as a state are going to go down. we don't know how we're going to make those repairs. the economy of west virginia was built around coal. and west virginia's powered the entire united states of america for a very long time. so we're not real sure what we're going to do at this point.

hopefully bring in new jobs. but if they put new restrictions on burning coal that has an affect of laying off hundreds of guys that work so hard underground because if people are not burning coal we can't sell coal. therefore we can't mine coal. and people at home wondering how they're going to feed their families. >> the president said that this is a global initiative. it's not just the united states, he's going to request, negotiate and push for this to happen all over the world. does that give you some comfort in west virginia, that everybody's going to just voluntarily jump up and quit using coal? >> absolutely not. i mean, other countries are driving forward and fighting to become a new superpower. they're going to do whatever is economically successful to drive their countries forward. i don't think that we here as americans should be so much worried about what's going on overseas. i think we should be more worried about the people like my two cousins that were laid off last week who just want to go back to work. that's the story across all of

america. it's not just the coal industry, it's all industries. we just want to go back to work. >> mark, talking about going back to work, a lot of the folks in west virginia have had a struggle because of the attacks on the coal industry and the uncertainty of it. this can't be helpful. and i'm seeing things like your own democratic senator joe manchin, former governor there, friend of mine, saying the president has declared war on his state, west virginia. i'm wondering what are you hearing from the democrats of west virginia about the president's policies? are others ready to sort of say, look, we're done with president obama even though we're democrats? because this would ruin our state. >> i think a lot of people have seen what this president is doing. he's destroying jobs, he's not creating jobs. putting more restrictions on the coal industry. and it's just -- the president is supposed to create jobs. he's not supposed to destroy jobs. what i'm seeing, that's all he's accomplished. >> mark and josh, i want to thank both of you for being back

19 firefighters have been killed battling a wildfire in central arizona that. fire burning in the small community of yarnell 35 miles southwest of prescott. according to the prescott fire department, the 19 firefighters who were killed were part of the prescott granite mountain hot shots and they were battling the yarnell yarnell hill fire when they were reportedly involved as in a serious incident. the fire that burn nearly 2,000 acres so far was likely caused by a lightning strike on saturday night. it's been getting dangerously close to homes. hundreds of people have been evacuated. again, word from the prescott fire department in arizona that 19 firefighters have been killed battling a massive wildfire near yarnell, arizona. stay with fox news for the latest on this developing story. i'm marian rafferty. now back to "huckabee." on thursday, the senate

passed immigration reform that's sets a path for millions of immigrants who are here illegally and calls for billions of dollars and more agents to help secure our border with mexico. but the bill may not make it all the way through the house. >> the house is not going to take up and vote on whatever the senate passes. we're going to do our own bill. immigration reform has to be grounded in real border security. >> joining me now is the president of the national immigration customs enforcement council chris crane, back with us. chris, thank you for being with us again. >> thank you for having me on, governor. >> this week the senate passed overwhelmingly the gang of eight immigration bill that has the hoven-corking amendment that added border security. your union not quite ready to say this is a great idea. why not? >> well, there are so many reasons, governor. i hope that they are going to come out in the weeks and months to come, because the american

public really needs to know how bad this legislation is. just let me give you one example. 40% of the illegal aliens currently present in the united states -- again that's 40%, almost half of our entire immigration problem -- isn't even addressed by this bill. these are individuals that came here on visas. they came into the united states legally. it doesn't matter if we have 10,000, 20,000, 2 million border patrol agents. they'll never be able to stop people that come here legally on visas and then overstay those visas. like i said, this bill completely ignores the enforcement of those 40% or almost half of our up entire illegal immigrant problem in the united states now. >> a distinction a lot of people may not understand is the difference between the border patrol agents who actually control the border itself and the immigration agents like yourself, the i.c.e. agents, who deal with the immigrants once they've crossed that border. so here's an important question. we hear a lot about border security is going to be

increased. how much increase in this bill is directed toward those of you whose job it is to deal with the 40% of the illegal immigrants who are already here and those who might yet come? >> well, we actually have zero new officers and agents. we have zero new resources in this legislation. and like you pointed out, the border patrol stands on the line. they stand on the border and they try to keep illegal immigration out of our country at the border. everything in between those borders is policed by i.c.e. agents. we currently have 5,000 i.c.e. agents, i.c.e. immigration officers in 50 states, guam and puerto rico trying to enforce our immigration laws. we're completely overwhelmed. the los angeles police department has 10,000 officers and we only have 5,000. again, we got zero new resources and officers in this bill. >> zero additional assistance, but a lot of the burden is going to fall on you guys. did you communicate this to people like senator rubio and

others? and if you did, what kind of response did you get? >> well, we did communicate directly with senator rubio, i actually met with him on two separate occasions personally. i met with his staff on multiple other occasions. senator rubio and his staff assured us in writing that there would be amendments to this bill that would provide for interior enforcement. he appeared shocked when we talk to him about the problems that we're having out in the field and with how the small number of officers that we have to do this job. again they assured us we would have that in this legislation and it never happened. and we continued to try to keep the lines of communication open with his office. at some point they just kind of stopped communicating with us. and nothing was ever added to the people to address these problems. >> have you talked with members of the house? and are you more optimistic when it gets over there that they willisen to the fact that there is a big issue? i can't believe you only have 5,000 agents for the entire united states of america. that's a shock.

>> it is shocking, governor. and there's so much more to be said about it. we also are responsible for policing approximately 30 million legal aliens in the united states who may commit crimes and be convicted of those crimes that maybe need to be removed from the united states because they violated their status here. but yes, we have been talking on the house side. and it's a day and night difference. folks on the house side are wanting to work with us. they have been working with us. there are two pieces of legislation out there right now, one from democrat congressman john barrow in georgia as well as republican congressman trey goudy. and they address a lot of these concerns that we have. they pro viewed more i.c.e. officers for the interior of the united states. and they also do important things like allow us to assist gang task forces in local communities and drug task forces in local communities. let us work more closely with law enforcement, crack down on sex offenders, fraud and other aggravated felonies, things that

the senate bill don't do. i moan, people don't realize that the senate people allows a path to citizenship for members of criminal street gangs. it allows a path to citizenship for people who have been convicted of three or more criminal offenses. it's a terrible bill. and i'm not sure if you're aware of this or not, governor, but the border patrol came out in opposition to this bill yesterday. i.c.e. is already in opposition to it. citizenship and immigration services, the organization that screens these visas, these visa applications for fraud and terrorists and criminal activities, they are opposed to this. there are hundreds of sheriffs nation-wide who have come out in opposition to this, including 80% of the sheriffs in north carolina. law enforcement across the nation, it's historic the law enforcement opposition to this bill. >> chris, it's always enlightening to have you. and i appreciate again your being here and giving us a perspective that i think maybe

congress ought to listen to. and that would be yours. sadly, your organization has had to actually sue the federal government just for the demand to be able to enforce the laws. we'll follow up with you on that. thanks again for being here. it's always a pleasure. will not participate in same-sex marriage. there are already churches who have decided that they can't host a same sex wedding. and if your record on this is going to be similar to that of the obama care issue where you've said that religious businesses and religious people and institutions, including religious hospitals, have to provide for contraceptives and forms of abortion because that's the law, then i'm afraid it's a little tough to believe that you're really going to leave churches alone an let them continue to practice their faith as they believe it and as they accept it. well, a vote on a texas bill that would force abortion clinics to have clinical facilities and to ban abortion past 20 weeks was delayed after texas democratic state senator wendy davis filibustered for 13 hours. texas governor rick perry wasn't real happy about it. he's called for lawmakers to come back to austin on july 1st for another special session.

but president sent out a tweet in support of davis during her filibuster. he said this "something special is happening in austin tonight. #standwithwendy. mr. president, i don't know if you realize what was in that bill. a friend of mine, dan patrick, a state senator in texas -- -- a woman who was going to the clinic had the same kind of medical care and capacity as would be any other surgical center in the state. in other words, because abortion is a surgical procedure, wouldn't it be in the interests of women's health to make sure that if something went wrong that there was at least some type of basic fundamental equipment to take care of that mother? is abortion so important that we don't care about the mother?

and by the way, to protect a baby from feeling pain? i can't imagine that any of us would be against that. we live in a world where we try so hard to alleviate all of our pain, and then to be willing to inflict it upon an unborn child? i'm sorry. i'm not going to congratulate anyone who thinks that's okay. [ applause ] well, an irs official is under investigation for a suspicious veterans disability claim. the so-called injury was obtained in military prep school. try explaining that to tammy duckworth, democratic congresswoman from illinois who lost both legs and use of her arm while serving in iraq. >> shame on you. you may not have broken any laws. we're not sure yet. you did misrepresent to the sba. but you certainly broke the trust of this great nation. you broke the trust of veterans. iraq and afghanistan veterans right now are waiting an average of 237 days for an initial
