right here on fox news channel. we'll keep you posted on all the latest developments. let not your heart be troubled, greta in orlando tonight, standing by to go "on the record." we'll see you back tomorrow night. thank you for being with us. tonight, live in sanford, florida, right outside the courthouse, where a couple of hours ago the jury hearing what george zimmerman says happened the night trayvon martin was shot. >> walking back through to where my car was, and he jumped out from the bushes and said what the [ bleep ] is your problem, homie? i got my cell phone out to call 911 this time, and i said, man, i don't have a problem. and he said now have you a problem, and he punched me in the nose. >> the entire scuffle takes place. trayvon trying to keep him quiet. george is yelling, help, help, and he covers his mouth. at the time he removes the hand off the mouth, squirms down like

this and exposes the gun. >> the question, when did a perception, let's say trayvon martin perceived george zimmerman to be following him? does that allow a violent act? i don't think it does. >> what you're saying science doesn't help us in this case figure out who screamed? >> unfortunately, correct. >> and we went to the scene of the shooting, a neighbor tells us what he knows about the deadly encounter. we are at the retreat in twin lakes in sanford, florida. over my left shoulder and around the corner is where the shooting occurred on february 26, 2012. happened sometime in the evening, raining, dark, and one of the men who can tell us an awful lot about the area is frank taffy, who joins me. frank, your house is this house right here, correct? >> this is it. ground zero you might want to call it, epicenter for the entire tragedy that unfolded

that night on february 26th. >> so we can orie backyard, to the left of the street, that is the fenced area, that would be the area toward the seven-11, correct? >> that's correct. >> and the 7-eleven, according to the stamp sometime after 6:00, trayvon martin bought skittles and he bought iced tea and came back through. is there any indication he came right through your house, do you know? >> yes. according to the re-enactment video that george played out the next day with the sanford police department, he indicated to the detective, the first place he sees trayvon martin is right here in this position, just aimlessly looking out onto the road. >> where was george zimmerman if you know? has george told you from the re-enactment video? >> from the re-enactment video, he was on his way out to target to purchase groceries, turned

the corner here and first noticed trayvon right here in my yard. as he was walking in this direction toward the clubhouse, the next most critical point, george drives past him and george parks up at the clubhouse and notices that trayvon comes up on top of him. and he is looking at him, and he makes the call this guy is looking at me. he has something in his waistband, looks suspicious. >> walking up toward the clubhouse, which is the clubhouse? >> right here. >> what's the clubhouse? a gated community meeting place? >> yes. >> these two have not even spoken at this point. two men, one watching one, and the other watching the other. point out where trayvon would be stanning? which direction? >> right down here. he's on the phone. this is a mailbox, a mail area. this is where he makes the call, this is where he is your honor the awning -- >> trayvon. >> and he is on the phone with

rachel. >> he has stopped. >> stops right here, the rain is starting to come down now. at this point, trayvon is up ahead of him. not behind him, he issed ahead of him. >> with his back to george. >> yes. >> okay. >> and george follows him up in this direction here. >> in his car? >> yep. >> and i suppose it's a slow race in the car, because he's behind trayvon. >> well, i think -- i can't accurately state what pace he is going. he does notice at this point, he parks the vehicle right here. trayvon 110 yards from this spot. >> with his father's fiancee? >> yes. 110 yards. >> left or right. >> so he was going to his home. and george is pursuing him. >> no, george is walking out to the road to get an address. the dispatcher says do you have an address?

he is walking back here on the wa hpe youan from the re-enactment? trayvon confronts him? >> right here. and he said you got a problem? he said i don't have a problem. and he says you do now. he punches him in the nose and they fall to the ground right here and start scuffling, all the way down. where the entire skufl takes place. >> if he confronted him there, about 40 feet would you estimate? yeah. >> they scuffled down to here. >> markers five, six, seven, in the crime scene photo, they have items, ear buds, lighter, close proximity to the body. wasn't scattered throughout. the only thing scattered the plastic walmart bag and one other item. all of the other items were contained. >> the way i understand from george's re-enactment, george says in the tape to police --

>> he can't get out. >> when does he grab for the gun? >> trayvon is trying to keep him quiet. george is yelling help, help, covers his mouth, and at the point he leases his hand off the mouth, he skiquirms down like ts and exposes the gun, inside his belt, and then he says you are going to die tonight. >> who says that? >> trayvon. >> what happens next according to re-enactment tape. >> forensics show the hoody, a person taller than you, the hoody -- gravity pulling the hoody down, he has his tea in there too. he shoots up into the -- >> the heart area. wait a minute, first of all, first of all, george has the gun in the waist, trayvon, according to the tape, re-enactment, on top of him, right? george reaches for the gun, and

shoots like that. >> boom. one shot. >> the shooting happens, one shot, and the police are summons. the police show up how much later? >> like less than 10 seconds, came from this direction with flashlightses on. george identifies himself. he says i'm armed. cuffed him right there. >> a surprise to many in court today, prosecutors playing tapes of george zimmerman's interviews. tapes that gave a chance of zimmerman to tell his version of the story. >> he jumped out from the bushes and said what is your [ bleep ]ing problem, homie. i got my phone out to call 911 this time. and i said i don't have a problem, man. and he said now you have a problem, and he punched me in the nose. i fell down, tried to defend myself. he started punching me in the face, and i started screaming for help. i couldn't see, i couldn't

breathe, and he started taking -- >> were you still standing at this point? >> no. >> okay. >> i fell to the ground when he punched me the first time. >> okay. >> it was dark, i didn't see him getting ready to punch me. as soon as he punched me, i fell backward into the grass, and he grabbed me, was wailing on my head, and then i started yelling help. when i started for help, he grabbed my head, started hitting my head into the -- i tried to sit up and yell for help, and then he grabbed my head and started hitting it into the sidewalk. when he started doing that, i slid into the grass, to try and get out from under him so he would stop hitting my head into the sidewalk, and i'm still yelling for help. and i could see people looking and some guy yells out, call 911, and i said help me, help me, he's killing me, and he placed his hand on my nose and

mouth and said are you going to die tonight. and i don't remember much after that. i just remember i couldn't breathe and he still kept trying to hit my head against the pavement. i don't know if there was a sign or what it was. i just -- when i slid, my jacket and my shirt came up. and when he said you're going to die tonight, i felt his hand go down on my side, and i thought he was going for my firearm. i grabbed it immediately, and he banged my head again, i pulled out my firearm and shot him. >> so which side does that prosecution tape help? joining us, bernie grimm in washington, jim hammer in san francisco, and sanford, ted williams and diana tennist. ith worth noting all of the tape re-enactment, we don't have trayvon martin's version, he is the descendent and can't tell us

his version. this is presented by the prosecution. your thoughts? >> last week on the record saying that zimmerman was going to have to take the stand. after what happened today, the prosecutors planned the tape. if i was the defense, they should pay the prosecutors in this case. the prosecutors are making the defendant's case. i can only see one thing, unless there is more evidence. you either have a hung jury or not guilty, unless they can put more on, greta. >> diane, do you agree the tape presented by the prosecution is damning to the prosecution? any way they could have escaped showing that to the jury? >> absolutely horrible for the prosecution, i totally agree. very upsetting. the prb for the prosecution, have you hours of conversation with law enforcement, that if you don't bring it in and then you fight the defense when they try to bring it in, the defense gets to get up and? closing and talk about all of the hours of conversation that

law enforcement had with the defendant had at the beginning when things were fresh, able to test him, for some reason the state didn't want you to hear. i really don't think they had much of a choice, and, you don't get to pick your facts, pick your witnesses, your eyewitnesss, but i think it was very, very damaging for the state in the sense that the defense will be able to get up in closing and explain the discrepancies, because there weren't that many of them, weren't that big, and as detective cerino said, not that meaningful. they will be able to explain the discrepancies better than their client would. they won't call him. >> jim, as a former prosecutor, maybe a different look at it here in the courtroom we have a defense attorney background. can you bail out the prosecution? do we have this all wrong? something the prosecution can do? >> i would be happy to say you were all wrong, greta, but, unfortunately, i think you're right. as a prosecutor, all i did was murder cases my last couple of

years, and the biggest problem in murder cases, your best witness is dead. the victim. you get one witness typically who gives his side of the version. unless tested by cross-examination, really tough cross-examination, who knows if it's true or not. the prosecution's only hope is, and a prayer at this point, something in the story is so swro outside the evidence, so contradicted by physical evidence, that somehow they win. i think this is a huge, huge mistake. increases the chance that guy hits the stand. and if he hits the stands, i break his story in front of the jury, maybe i get a conviction then. >> the defense doesn't have to prove anything, but here you have the prosecution putting a defendant specially on tessenti stand and no chance to cross-examine. >> the one night i had cross the line and have to be a

prosecutor. what did you do, all have dinner together? i am sitting in greta's studio freezing and you are all in florida. zimmerman not only doesn't have to take the stand, when the government rests, they can stand up and say, your honor, we rest. right then and there, don't even move in a police report. the problem is zimmerman's statement, the best witness in this case is dead. a young african-american boy. if races were different. i don't even think we would be here. don't get me started. where i come from, this is a fight. if somebody punches me in the nose and i take a gun out and shoot him? this is way disproportionate. his story is nothing but hogwash. >> all right. much more with the panel. we'll take a look at another -- >> go ahead. >> the idea that out of blue. trayvon martin with skittles and a soda is now a killer, are you going to die tonight. a 17-year-old boy walking home

and suddenly becomes a killer? it's hogwash. and they probably can't cross-examine him now. >> another clip from a police officer who interviewed zimmerman. >> he asked me if i was catholic, i said no. and i asked request why he woul that? and he noticed the cross. i said no, i'm christian. why does it matter? and he said in his religion, catholic religion, it's always wrong to kill somebody, and i said, well, as far as what you've said to me, if what you are saying is true, i don't that's what god meant. you can't stand up and save your own life. >> diana tennis, at what point is the act of aggression, is it following trayvon martin, when they engage in a brawl? what is the aggressive act in terms of the law? >> the law won't give that you

fine a point. but you can't cause the problem you are complaining of or defending against. if, for example, george zimmerman pounces on tray vob martin and trayvon martin has to roll this guy over and is pummelling him in order to save his own life, george zimmerman wouldn't be justified in taking out a gun and shooting him. the problem is, i think the state is trying to get george zimmerman's hands on trayvon martin first and is having a difficult time doing it. can't quite seem to get the evidence there. if trayvon martin first physical aggressor, george zimmerman's self-defense plan is in action, we are seeing it played out and he will win. >> one question. zimmerman, it will never happen, i don't think he will take the stand. zimmerman says he goes past where trayvon is supposed to have been, and he says he's looking for an address. he's been in that neighborhood for three years, he is a

neighborhood watchperson, and i would love to ask him, mr. zimmerman, you've been in the neighborhood for three years, neighborhood watch person and you want me, the jury, to believe you don't know what street it is? >> ted, i will tell you, we did wind each other, and all the houses look alike, pretty confusing, but the place is very confusing, i don't know. bernie, if you are the prosecutor, what do you do? what's the strategy? >> in this case, i read the notes today and the prosecutor seems disturbed by two officers, one offered the opinion that essentially the guy was telling the truth. interesting, in 22 years in representing people in homicide cases, never had the homicide officer and the arresting officer come in and help my client. but that's a whole other segment. >> that's what makes it sort of such a tough case for the state. i mean, they've got their key

law enforcement people helping the defense. >> right. i heard somebody today commenting they will call ms. jeantel. you don't want to do that. she can't be resuscitated. you are the government, you need no rally. i don't know if forensics or ballistics or forensic pathologists will help them on the homestretch. i hope some of. >> jim, let's go to you. we have to go. i think ballistics are very important. the direction of the bullet into the chest will corroborate or defeat what george zimmerman says happen. the medical examiner is important. what are your thoughts? >> at the end of the day, let's not lose sight of the fact, a 17-year-old boy, not a man walking home with skittles, confronts an adult man. you don't get to leave a fight with somebody dead unarmed, unless you have a compelling reason your life was in danger. losing a fight is not enough to

families go through. >> it's tough. they have been sitting through all of the evidence heard in the case, many pictures, many 911 calls, hear the gunshot that took your child's life. heard from the witness he last spoke to on the phone and heard about how he tried to run for his life. they have heard about the altercations, they've heard george zimmerman's version of. and they know their son, homie, not a term their son would use. >> and that's a suggestion that george zimmerman said that was said about him? >> yes, yes, yes. but too as you go through the process and you hear -- even from jury selection to hear people talk about what type of parents they must have been, people who had so many misperceptions on what happened that night. >> is it cathartic, easier being in the courtroom, or make it worse? they are sitting there day after

day. >> it's easier for them to see the process going forward and to get past all the other emotions they are having and dealing with, this type of situation, it's good to be there and do this one last gesture for the sun to defend his legacy and life many. >> i have no idea how the jury will come out. admittedly, the prosecution is having some troubles in the case and evidence is -- you don't always have perfect evidence, no matter what case you are trying, but if the verdict goes against what they want, can they accept it? >> well, i don't think they have thought about that. we thought about it a little bit in terms of what we may want to do with them. what they are remaining to do, preparing for that day. however, i think in this case, though, this jury, i watched that one juror who i think might be the foreperson at the end, we -- when he published that picture of trayvon's dead body around, she held on to it. she held on to it, and i watched her, so i think that we're getting some traction here, i

think some of the contentions that mark o'mara is trying to put forward, the mma style, the clip where they talked about trayvon martin talked about it. i think good had it right. tusling and wrestling. another major point. think about the fact that mark o'mara trying to describe he had his legs on zimmerman's arms, that means the lower part of trayvon's body -- martin zimmerman's body would be covered, the allegation that trayvon would have seen the gun, not possible, beating down his head, holding down his head, focusing on his head. some real problems with that, coupled with the fact that -- you had to be listening, he said a little bit of his head on the concrete, just a little, right? so the whole notion that he was bamming his head on the concrete, and they talked about in opening statement, not really

there. >> no matter what jury verdict is either way, you will respect it? >> any lawyer who has tried cases has lost some. >> indeed i know that. i know that very well. >> what is -- what is your thought as you look across the room at george zimmerman? do you think this would have happened if this was a daylight confrontation? >> no. and it wouldn't have happened if the races were reversed of the two perpetrators. had george zimerman -- excuse me. if trayvon had killed george zimmerman, he would have been arrested. >> zimmerman has been arrested. >> but the protests were about getting him arrested. >> are we not beyond that? isn't that sort of battle over, he's been arrested and now the issue really is a fair trial to both the family and the defendant, isn't that where we are? i think we shouldn't fight old battles. >> we shouldn't fight old

battles, but we should learn a lesson what happened. anyone in that position as a prosecutor should make an informed decision about what they are doing. have you many situations across the country where prosecutors made these types of discretionary calls. >> the thing -- what i'm worried about is a jury verdict, either way. i'll accept it either way, and i hope everybody else also realizes that we have assigned it to this six people, which ever way the cards fall. >> it's funny, we get this question quite often about the makeup of the jury. >> a white jury, one hispanic member maybe. >> you have to remember, there are places in this country where there aren't many minorities so when you try a case there, you are trying a case with the people who are there. now and lawyers like you and i. >> an inner city washington, d.c., a very different jury forever. nice to see you, hope you come back. >> thank you, i will be back. >> did the prosecution do the

>> in terms of coming to the courtroom every day, he comes in through the door, not locked up. >> he's on bond, asked to be on bond, got messed up a little bit. back on bond and out. and he's around to help us. >> getting threats? >> yes. much more so in the beginning, a lot of people thought i was a devil incarnate. we all know he's not a racist and probably not a murderer, according to the evidence, and according to me, of course he's not a murderer. they have gone down, kicked back up where the trial is. >> racism, no secret, look at the jury. no african-americans on the jury. and there is always some of the risk at the enif you win your case, people are going to take size and people will see this as a racial decision and not in the evidence. any suggestions? >> well, suggestion is look at the panel we picked from. the panel we picked from is overrepresented in the population for african-americans, nobody can really complain, almost double

the number of african-americans in the panel than in the community. and the state was the first one to kick out a black juror, the one up front. i had two very well founded reasons to strike a couple of jurors for batten inquiries, and the judge said i was right. >> how do you explain that to the jury if you win? that's sort of the elephant in the room. >> you know, everyone keeps saying they are willing to believe in the system as long as the jury was picked properly, and i think they were, and as long as a fair trial is help. those who have said they will listen, as long as there is a fair trial will get a fair trial and a fair verdict. now they have to be held to their word. >> different clients are different to work with. george zimmerman, a client very involved in the case or patiently sit by and lit his lawyers do the work? >> in the middle. involved in the case, he knows we know much more about what we're doing than he does. he knows the facts well.

>> getting along with the prosecution team? >> never filed a motion for sanctions ever in 30 years in practice, and i filed six of them in this case. >> successful in any of them? >> not really. the court made a decision that the court was going to trial and we were going, even if there were discovery problems. >> you like the jury? >> it's all i'm used to. knowing what you get before you go to trial is nice. i do some federal work and we have limited discovery in federal law. here, we have a great deal of discovery. my only frustration is we have an open records law in florida, open discovery and depositions and cameras in the courtroom, so i know i'm talking about your profession a little bit, dual profession. it can be a problem when there is this much exposure.

>> what's the highlight today? >> i enjoy cross-examination, the last question was a good question to end with. >> which was to officer cerino. do you believe george zimmerman when he said he wished someone would have videotaped the fight? and he said yes. you had deposed him, so you knew what he was going to say? >> i think he was circumspect, not giving me much, but i think he give me that one, and it was correct. >> what was the question meant for? >> what had happened, it was a question of chris cerino challenged my client, hey, i think we have a video in the whole event, and he was hoping to flush out if my client was telling the truth. i have a secret videotape, you

better tell me exactly what happened. and george's response, thank god. i hope that someone would voida tape it, hoping that there would be incontroverteded evidence of his lack of guilt. >> doris singleton, i assume the defense doesn't want to show your client as someone who is vicious and wants to kill someone and enjoys it, and had a discussion about faith that your client had a discussion the night of the shooting with this officer on faith. >> they talked about faith, talked about being christian, being catholic, and a commandment that doesn't say thou shall not kill. it doesn't say thou shall not kill in self-defense. i think he has a convict in his mind. and what singleton said was apropos. and i'm sure that god didn't mean you can't take a life if you are saving your own. >> if the jury thinks your

client following trayvon martin was a point of aggression, i take you disagree with that. following him. >> following is okay. he said he followed him. >> he's making phone calls to a young woman, saying he didn't like the idea that he was being followed. >> sure. >> you didn't see that as threatening to him. >> the question is when does a perception, let's say trayvon martin perceived george to be following him. when does that allow a violent act? i don't think it does. if i follow you, it doesn't mean you can turn around and attack me with a knife or fist. so i think the way the law in florida is, you can resist like force with like force. it trayvon martin truly believed he was being followed, let's say. he can turn around and say get away from me. but what he cannot do, walk up to somebody and break his nose. >> why in the world do you think the prosecution showed the enactment film. the day after the shooting, your client went over with detectives

and re-enacted the scene. why do you think they put that on? >> i am thinking they may have put it on if they failed to put it on and came out to the jury that it was there, there would have been a real question why they were there. might have been a bitter pill to swallow. >> he also had a bandage on his head. visual bad for the prosecution. i -- you know, i mean -- in my wildest dreams, i guess i would have tried to hold it. your client has essentially testified before t never take the witness stand. >> taking the witness stand as you know, a tough decision to make for any defense attorney in any case. we always wait until we decide the state has gotten such a strong case that the jury may fund my guy guilty, then i'll make a decision if he has to testify. >> if you were making the call, would you put him on? >> the decision of whether or
