4:02 pm
the trial gripped the nation. now reaction to the not guilty verdict is intense, law, and spanning a wide range of emotions. both the zimmerman and martin families are speaking out, including george zimmerman's brother robert, who joined us here at fox news headquarters earlier. he told me about his brother's reaction when that verdict was read. >> and your brother, what has he said about the last few seconds right before and then right after the verdict was read? >> he hasn't said. >> really? >> no, he's resting, recovering. i think people should understand that george has been under in essence house arrest for a long time, the whole notion of freedom, of being a free man, is something new to him all over again. >> trayvon martin's family also reacting, asking for calm in the wake of the verdict. trayvon martin's heartbroken mother, sybrina fulton taking to twitter, saying lord during my

tide of gun violence that claims too many lives across the country on a daily basis. on the sunday talk shows, a variety of opinions expressed. here are just a few of them. >> the evidence didn't support prosecution and the justice department engaged in this, the president engaged in this, turned it into a political issue, should have been handled with law and order. >> accept the verdict, take a look at the law that they have in florida that is so unusual. >> the stand your ground law. self defense law. >> i think that's up to the state. i think they should revisit that. >> the rule is you have to prove guilt beyond a reasonable doubt. there were plenty of reasonable doubts there. it is still a very serious set of problems that exist. >> reporter: and the justice department did issue a statement tonight, saying it is continuing to evaluate the evidence in this case to determine whether civil rights charges might be filed. in washington, i'm steve centanni. harris, back to you.
4:09 pm
>> steve, thank you very much. steve mentioned george zimmerman's legal battle is far from over, the justice department is considering civil rights charges against him. there's also possibility of a civil lawsuit from the martin family. joining me now, judge alex ferrare, host of judge alex. we watched it come down together last night. now this development with the doj. they had been evaluating it all along, but they're stepping up efforts now. the significance of this? >> there are two different judicial systems, the state and federal government. you don't have double jeopardy, as we know in rodney king, feds came in after the officers were acquitted of beating rodney king in state court. it wasn't double jeopardy in that case. the reason they were able to do it is because the civil rights statute, federal civil rights statute, section 1983, applies to people operating under color of law, and that would apply to police officers, persons that have that authority. there's no way that i see that applying in any way, shape or

form to george zimmerman. neighborhood watch, he is not deputize deputized. >> are they stretching the law? >> may look for filing charges on the hate crime, the hate crime statute that they have applies to killings based on race or color. i have to say based on the evidence we've seen, this killing was not based on race or color. in fact, they have done their own investigation, spoken to dozens of his friends and people that know him and have come up with nothing to indicate that it was based on race or color, and evidence in the trial if anything indicated the contrary. >> the fbi report released last july showed a civil rights investigation found, and i am going to quote, no evidence of racial bias or animous in the martin killing. >> i don't know how the justice department would say well, this
4:11 pm
one is based on race, but we're not going to prosecute these others as well. >> let's move on to the possibility for civil lawsuit here, that would be the trayvon martin family trying to get paid basically. >> sure. >> in a lawsuit form. what is the likelihood of that? >> well, in florida it would be very difficult because florida stand your ground law, one component is immunity for the person that's been absolved because they were acting under self defense, prevents them being prosecuted or sued for their actions they took, sued civilly. the prosecution would have been if o'mara requested immunity before trial, he didn't. he let it go to the jury, probably for good reason related to the civil lawsuit as well, because he has the burden of proving it in that one. he didn't want to do that before trial. secondly, on the civil side, he can claim immunity, then if he is sued, if george zimmerman is sued, he is actually entitled to
4:12 pm
attorney fees, loss of work expenses, things like that, against anybody that sues him, if he is granted immunity. >> the family would have to pay that if they lose. >> if he wins the hearing. >> interesting. >> so in florida he probably wouldn't be subject to lawsuit. there's possibility of a federal lawsuit, a civil action for civil rights violation, and i honestly can't tell you whether immunity in florida. >> that's a lot of layers, i don't mean to cut in, maybe other people are asking this, when is it over? >> i think it is over when people accept the jury verdict came down, they don't have to like it. you know, i was listening to the tweet that mr. martin tweeted about after the verdict, and i have to say, you know, it is moving how the parents have basically accepted it. and the way they have accepted this tragedy. i don't know that i would be as classy as they have been dealing with the tragedy, because of the horror of it. >> as we saw benjamin crump say
