reporter: what we're seeing right now, over 200 people who have come from harlem, and are now gathering here in downtown manhattan, at the federal course indicates, bowon say and jay-z addressed the crowd and are about to speak for the first time. this is one of over 100 of these rallies happening, vigils for trayvon martin happening across the country, from atlanta, where martin luther king, martin luther king 3'm is -- martin luther king, jr. 3 resident is set to speak and we'll see a brian na -- sybrina and reverend al sharpton so calling for a more aggressive probe by the department of justice into the george zimmerman verdict. they say that george zimmerman racially profiled trayvon martin and, therefore, violated his civil rights. these rallies are meant to call upon the federal government and

the d.o.j. to look into that. now, president barack obama, you can hear the crowd behind me but president barack obama addressed this yesterday and said the federal government really can't -- lowered expectations what the federal government can do. >> i know that eric holder is reviewing what happened down there, but i think it's important for people to have some clear expectations here. traditionally these are issues, states and local governments. the criminal codes. and law enforcement is done at the state and local levels. >> zimmerman was found guilty there have been protests and rallies across the country in new york, a thousand people went into times square in los angeles they war bit more violent. people actually blocking interstate 10, a freeway in los angeles. people have been wearing hoodies and are rallying all around. churches have been organizing,

and these vigils today are meant to be more peaceful. president obama actually said yesterday that he didn't condone any violence in my protests and any violence would actually dishonor the memory of trayvon martin. i spoke to people here, and they are, well, feeling a little hopeless. based on the verdict, but they're hoping -- still trying to hope the federal government will intervene and get involved. again, over 200 people, and people are continuing to file here, and we'll keep you updated with the latest developments as sybrina fulton and al sharpton speak to the crowd. >> thank you very much for the update. >> you know, when trayvon martin was first shot, i said that this could have been my son. another way of saying that is, trayvon martin could have been me.

35 years ago. >> the president's remarks about the verdict in the zimmerman trial directly moved him into polar rising race debate. he is asking the americans to do, in his words, soul searching, but is this politicizing the issue of race and putting more pressure on the justice department to open up a civil rights case against zimmerman? joining us now, jordan, the executive director of the american center for law and justice. welcome, great to have you here today. the fact the president stepped into this raises concerns this is fueling the race debate and trying to use the ploy to pressure the doj to step in with civil rights charges. >> it's interesting. this is the third time the president has gotten involved directly and the remarks on his own civil rights experience you can't take that away from the president. he can speak to that and he does a good job of explaining some of the outrage in the african-american community. i get that. at the same time, he is, i think, fueling this idea to

people that the doj and eric holder, he said specific lyrics they're looking at this, but he added a part which i'm not sure people have picked up on. clear expectations which i interpret as, as most importants have, there's no civil rights charges. we looked at this a year and a half ago. >> the fbi investigated this. >> there was no charges filed. so, clear expectations, and this idea that we're not supposed to have a political debate around this. so i can -- but what is -- we're really looking at the president's words. i'm not sure the folks who are at the rallies today picked that up, that the president is saying, not going to happen eventually. he is going to have eric holder pursue it. >> some people are concerned the president's remarks are doing more to create a divide in the country rather than bringing people together. >> i don't see dish pointed this out throughout the week as we have been talking about the different issues the president is phasing, controversies and issues of healthcare, the irs, and then this. the idea that george zimmerman

is no one's hero. that george zimmerman is not a -- someone to look up to as an example. what it shows to most people if you do discharge a firearm, and end up killing someone, whether they're black or white, it's serious and you may face murder charges and that's why i don't think for the most part you have seen rallies pushed on people there, was no spontaneous massive outpouring. wasn't the state attacking trayvon martin. this was individual to individual. not a rodney king situation. wasn't police brutality. >> no evidence of racism in this trial to begin with. >> no one is accuse -- george zimmerman has his own different racial background. he has mother i emigrating from peru, he was mentored for african-american kids, and so to go too far in demonizing him is not right and to try to divide people along are you on the trayvon martin side or the george zimmerman side, sometimes tragedies happen. it doesn't mean someone is guilty of murder, too and i

think here you can be angry at the prosecution who felt a lot of pressure as well. look at a miscarriage of justice, how about the state having to get involved, bringing charges they couldn't prove and then zimmerman being found not guilty. >> what about the president stepping in now and reacting to a situation that happened in the state of florida, and that state's laws, and what impact on the states that do have, for example, "stand your ground" laws, even though that wasn't part of the trial. >> which is the majority of the states. the president's team is saying though the defense didn't use it, the judge used it as part of o'instructions and the jury was told about. so zimmerman did not invoke it. he could have as an annual immunity from the civil case probably coming against him. he is not free from a lawsuit yet and that's what that is for. the idea is the president -- this is much like the clear expectations. basically said, we can look at the state laws but it's up to the states. i hope everybody who is outraged does realize that the president,

who for the most part is getting praised from those who are upset about the verdict, realized there's not going to be civil rights charges and if you have issue is with the state laws go to the state because we're not getting involved. >> thank you for your insight. i appreciate it. >> and this fox news alert. sad news out of the nation's capitol today. veteran journalist helen thomas has died. she was the first member of the white house correspondents association and the group's first female president. the club group e-mail id their members and said thomas died in her apartment this morning. she was 92 years old. and later in this hour we'll take a look back at her career that spanned ten presidencies. >> secretary of state john kerry arriving back in washington, fresh off a trip to the middle east where he announced a breakthrough in the mid east

peace process. >> expectations are fairly low for this round of talks. but the fact that secretary of state john kerry was even able to get the israelis and palestinians to come to the negotiating table is a fairly significant achievement. few authority they would get this far. last night secretary kerry announced after a three-year stalemate the two sides will meet in direct talks. but already some of the usual problems that have plagued previous talks are emerging. the palestinians are not happy that the israelis are not agreeing to negotiate along then 1967 borders, nor is israel agreeing to halt the construction of jewish settlements inside the west bank and other disputed territories, and israel doesn't want to begin talks with the palestinian authority can't guarantee an agreement would end the conflict. ham mass -- hamas is not part of

the process. secretary of state kerry wrapping up his sixth trip to this region since march. last night he praised the authority and prime minister benjamin netanyahu. if things go as expected, the representatives will meet in washington in the next week or so to hold these talks but few thingness the process ever go as expected. so we'll have to watch and see what happens. but there are some cautious optimism here that something could be in the works and maybe larger agreement, but really there's also a lot of worry that this will depend, like previous efforts have in the past, uma. >> turning now to a story that has dedicate royal watcher on edge. all eyes on the door of one london hospital for any sign that the royal baby is on the way. crews have been staked out in front of st. mary's hospital for days, hoping to catch a glimpse

of dutchess kate or prince william. the dutchess has been splitting time between her london home and her parents house outside the city. later we'll talk with our royal expect with more on the arrival of the new baby that so many people are waiting on. >> well, lawmakers on the house oversight and government reform committees are saying they saw elfed that irs efforts to target conservative groups is directly tied to higher-ups appointed by the white house. this after a former irs official testified that contrary to earlier claims that low-level agent were to blame, it was an irs chief counsel who had a direct hand in the targeting scandal. joining us, trey gowdy. thank you for joining us today. >> yes, ma'am. how are you? >> i'm fine. thank you. so, now you have a former irs tax law specialist who goes on the record saying that the irs office of chief counsel

appointed by the president was involved in the widespread targeting 0 conservative groups this. flies in the face of claims it was too rowing irs agents to be blamed for the scandal. what impact does this have now? >> well, it means that all six of the defenses so far used by our colleagues on the other side of the aisle in delves of this administration have collapsed. i've counted six defenses. one was this was two rogue agents in ohio, and that was a defense that was furthered and advanced by none other than jay carney, who repeated that false defense. so, what we know is that this was not confined to ohio. that d.c. irs office's fingerprints are all over it. one of the two political appointees -- only two political appointees at the irs. one of is the office of chief counsel. this is what is important to keep in mind. we have had political activity in this country since before the founding. 50% means what 50% has always meant.

so, why the different analysis for conservative groups starting in 2010? why this new metric for evaluat 5:01c4 organizations that are conservative? the analysis is the same. it's always been. political activity more than 50%. why does it need to go to the office thereof chief counsel in d.c. to approve these applications and some of this approval processes have taken years. >> one of those so-called rogue agents this week testified, and says she was just following orders from washington. this was the news that came out of the hearing. what does it mean if the legal counsel of the irs was in charge of the targeting scheme? >> well, it means, again, that we can't believe much that comes unfortunately from the spokesperson for the president, who, again, repeated this was a rogue operation in ohio. we can't believe that defense. we also shouldn't believe the other defenses that progressive

groups were targeted as well. i've never really understood that defense, that because we're going to act improperly towards more than one group, that's a defense. but what it means is, what we were told initially is demon stab blue false. this was not confined to ohio. it's got washington'ss all over it, and we need to be careful going forward that we view whatever we're told from this administration with a jaundiced eye. >> this week at the hearing fireworks were erupting with democrats like eigentleman cummings seeing republicans are trying to infer that the white house was directly involved in the scandal and wants it stopped do you have any direct evidence at this time of white house involvement? >> well, let me say at the outset, uma, i like elijah cummings very much but the last time i checked jay carney works

for the white house. you can't say the white house wasn't involved when the spokesperson for the leader of free free world is perpetuating a myth these were two rogue agents in ohio? how do you square that, when the spokesperson for the white house is advancing a demon -- is that in the new defense in this town, that the president himself was involved? nobody has alleged that president obama was involved, but if that's the new standard for propriety, that as long as the president himself was not orchestrating something, that there's no harm there? jay carney works for him. jay carney took it upon himself to advance this false narrative and the notion that you can now claim the white house wasn't involved is just balderdash. it's false, wrong, i would use another word but the fcc would get involved it's just wrong.

william are very, very private people. so, few firm details have actually come out of their office about things like due dates. so the first due date was speculated as the 12th, and there's been some speculation in the last couple of days, that it might be the 19th. now, if it is the 12th, i know because my daughter gave birth over here a year ago and they very, very rarely allow anybody to go beyond ten days. so, if it's the 12th, it could be immeant. if it's the 19th, we could have a little bit more of a wait. >> some very interesting -- kate has been able to take the lead on this, and shielding her privacy. she has been able to do that in spite of the world's media at her doorstep. she has, she did a lot of public duties until a month ago, and then she withdrew into seclusion. it was interesting that when the queen was pregnant, she stopped

at a time when the grant exemptions for a year for small businesses and not for individuals across the country. >> that's right. the president has told us he is not going to enforce the law against employers. those employers who have lobbyists who who can gain access to the white house. meanwhile hard working americans, families will be on the hock unless they comply with the law's exacting demands. the president is telling us he is not going to implement the law completely because it's not ready, it's too complicate. he can't. if that's the case, he notice going to follow the law, the american people shouldn't fund it and that's what i intend to do is follow that command from the american people. don't fund it, especially because he is not ready to follow it. >> some are questioning why tie the funning for obamacare to any kind of appropriations measure. >> the one power that congress still has and very jealously guards this be power of the purse so to fund something you have to go through the house and

senate and that means you have to have a lot of republicans. republicans and some democrats are recognize this law has serious problems and not ready to be implemented. those believe that need to put our money where our mouth is and say we're not going to fund it. >> what do you think is the reason behind delaying the implementation of obama care for small businesses at this time? >> it's difficult to say. the white house didn't offer much by way of explanation, but the senate would argue that this has a lot to do with partisan political considerations. going into the 2014 election cycle the president understood that companies and workers alike were concerned about what the employer mandate was going to do to the job market. and perhaps that played a role. in any event, the law doesn't give him the authority that he just took. this is legislative power that he tried to exercise. just as the supreme court rewrote obamacare twice last year, which is why i wrote a

book about it, the president has followed the supreme court's lee and has now amended obamacare. not once but twice. that's wrong it was wrong for the court to do and the president to do it and congress shouldn't fund him in that effort. >> this is the only way you feel you can hold him conditionable for what he has done and. >> the only way. this us our last stop. the continuing resolution which expires september 30th will have to be replaced. this continuing resolution debate is the last stop before obamacare kicks in january 1, 2014. so if you're against obamacare you have to be against funding for obamacare. >> behind this backdrop people are saying the implementation of this is so convoluted, it's so hard for people to really understand how this is supposed to be put into place at a time when so many businesses are struggling to stay afloat. >> businesses are struggling to stay afloat, and importantly, -- remember what we heard from the teamsters and two other big

unions this week. they, who backed the law, are now saying, look, this is a problem. we have promises, would be able to keep our own doctor or keep our own health insurance. the administration is backing away that because the law makes that's impossible. so this is an american issue now and those who are concerned about obamacare's implementation, those who understand that the president has now conceded this law is not ready to be implemented should demand their members of congress in the house and senate should refuse to volt for any continuing resolution or other appropriation measure that funds obamacare. >> do you think the gone will hold firm? the g.o.p. must hold firm because they controlled the house of representatives since the 2010 election. the g.o.p. controlledded houses continued to authorizes funding in continuing resolution for obamacare, they thought the supreme court would take care of it, or thought we might win the presidential election. that hasn't happened it. this is our last opportunity to

stop obamacare. >> senator, a pleasure. >> two u.s. navy jets dropped four unarmed bombs near the great barrier reef. the jets were running low on fuel and forced to make the emergency decision, the navy says the pilots intended to drop, didn't have clearance to drop them where they wanted to and now officials are working with australian authorities to determine how and if they can retrieve those bombs. >> well, there's a threat of thunderstorms which could cause dangerous conditions for crews battling a massive wildfire in southern california. 700 homes have been told to evacuate and a state of emergency is underway. the northeast could finally get a break from the oppressive heat but comes at a price. they may be dealing with strong storms as well, and our meteorologist is at the weather center with more on the threat of the strong storms. janice?

>> yes, we have the threat for strong storms across the ohio valley in the northeast, which will break the heat bus over parts of the southwest where firefighters are dealing with multiple wildfires, and you can see the showers and thunderstorms starting to fire up. this is technically what they call the monsoon season across the southwest, a seasonal shift in winds that brings in the moisture, but with that we could see thunderstorms and it's been so dry in this area, that could actually lead to more wildfire danger. looking at the temperatures right now, cooler along the coast but interior sections still very warm. and let's take a look at that fire that they are dealing with in southern california. it's called the mountain fire. and right now just 15% containment. temperatures are a little bit cooler but we're still looking for the potential of some thunderstorms in the area. so while we need the moisture, we don't need the dry lightning which could spark more wildfire danger. back to you. >> lots on the plate there all right, janice, thank you very much. >> well, a bizarre, horrible

now he is here to tell us how he is moving on. thank you for joining us. i know this is a veer emotional day for you. what are your thoughts as we look back on this very somber anniversary? >> it's amazing to me it's even just been a year. some days it feels like a few days. some days it feels like decade. i just feel so fortunate that i'm standing here today talking to you and that i'm able to live my life as injured as i was. that i've been able to recover. >> you are an amazing example of resilience and courage. what has been your -- the main thing that has really been able to get you through this emotionally. your faith, family? >> i had a network of friends and family around me and that made all the difference, and thankfully the people that i went to the theater with also

survived, and that's really helped in my recovery. buttoned that, the advocacy i have been with mayors for illegal guns, fighting for gun violence prevention, has been therapeutic. >> you still have shrapnel in your body because the wounds are too deep for them to come out. >> that's right. yeah. i have eight pieces in buckshot that will remain for the rest of my life. >> as you look back on the fateful day, what runs through your mind knowing that this is a situation that didn't have to happen; that you had a situation where people were just going to a movie on a wonderful summer night and they were looking forward to a great time, and yet violence can happen anywhere. >> and it was absolutely shocking to me. i at any time think about it all. it was too much before this experience, and suddenly i was kind of confronted with this
