you think. and conservative groups. and dodge reading the personal e-mails and can he with a straight face say end scandals. i think the clinical tefrm is fatoush. and that quote was on msnbs. and talking to joel scarbrouf who is a host on the cable network and angry that anybody would be talking about the issues and why are you talking about the irs. you are supposed to talk about the president's middle class vision. this speech and the mess amg here to the press cooper is stop talking about irs targeting and cover up in benghazi and stop talking about the problems in the roll out and stop, stop, stop. and start talking about the president's vision for the future. lame duck status is frustrating, but particularly frustrating

again and increased domestic spending and kick start with more stimulus and jobs and hire more teachers and things like that that the economy would have improved at a faster rate. that is cool and certainly been his position. the reality for the administration, we so in the wall street journal poll, this president is losing confident. people are not confident in congress at all. their numbers are low and getting lower and staying low. and people don't like congress stipulated and this president who epijoyed a wide margin is seeing his approval numbers on the economy on the sloyd. that's not where he wants to be going on to the fight. and if you tried obama nommics before and didn't like it, the problem is that you didn't get a sufficiently large survey. what we need is more obama

i see a bunch of my former colleagues and folks whom i haven't seen in years and looking forward to saying hi to. john sullivan, my favorite is in the house. (applause) john was one of my earliest supporters when i was running for u.s. senate and it came in handy. it was like ten brothers and his wife got ten brothers and sisters and they got the entire precinct just in their family and they all looked like john, the brothers do and he doesn't want to go to every event. it is good to see them. dick durbin couldn't make it and he sends his best. we love dick. he's doing a great job.

(applause) and we have one of my favorite neighbors, the senator from missouri clare mccaskil in the house, we are going to missouri later this afternoon. and all of you are here and it is great to see you. (applause) i hope everybody is having a wonderful summer. the weather is perfect. and who ever was in charge of that, good job. so eight years ago, i came here to deliver the commencement address for the class of 2005. things were a little different back then. for example, i had no gray hair. or motorcade. didn't have a prompter.

in fact, there was a problem in terms of printing out the speech because the printer didn't work here and we had to drive it in from somewhere. it was my first big speech as senator and i was telling them how important this area was, one of the areas i spent the most time in outside of chicago, and how much it represented what is best in america and folks who are willing to work hard and doing right by their families. and i came here to talk about what a changing economy was doing for the middle class and what we as a country needed to do to give every american a chance to get a head in the 21st century. i had spent a year traveling the

states and listening to your stories and proud may tag workers and folks losing their jobs on the way down to mexico. and a teacher whose sal rows were not keeping up with the rising cost of groceries. of young people, who have the drive and energy but not the money to afford a college education. (applause) so these were stories of families who worked hard and believed in the american dream and they felt like the odds were increasingly stacked against them. and they were right. things had changed. in the period after world war ii, a growing middle-class was the engine of our prosperity. whether you owned a company or swept the floors or worked

anywhere in between. there was a basic bargain. a sense that your hard work would be a worded with fair wages and decent benefits and the chance to buy a home and to save for retirement. and most of all, a chance to hand out a better life for your kids. but over time, that engine began to stall and a lot of folks saw it. that bargain began to fray. technology made some jobs obsolete. global competition sends a lot of jobs overseas. it became harder for unions to fight for the middle-class. washington doled out bigger tax cuts to the very wealthy and smaller minimum wage increases for the working poor.

and so what happen was that the link between higher productivity and the people's wages and salaries was brokening ef. used to be profits went higher and workers got a better deal. that started changing. and so the income of the top one percent, nearly quad rupled from 1979 to 2007. but the typical family income barely budged. and toward the end of those three decades, a housing bubble, credit cards, a churning financial sector was coping the economy artificially juiced up and it papered over the long- term trends and by the time i

took off in 2009 as your president we all know that the bubble had burst and costs millions of americans their jobs and their homes and their savings and i know a lot of folks in the area were hurt pretty bad. and the decades long erosion of middle class security was suddenly laid bare for everybody to see. now, today, five years after the start of that great recession, america has fought its way back. (applause) so together we saved the auto industry. took on a broken health care system. we invested in new american

technology to reverse our addiction to foreign oil and doubled wind and solar power. together we put in place tough now rules on the big banks and protections to crack down on the worst practice of mortgage lenders and credit card companies. we changed the tax code to skew it in favor of the wealthiest in the expense of working families and changed that and looked in tax cuts for 98 percent americans and ask those in the top to pay more. >> if you would like to hear more check out the fox business network. you will be able to check it out there. we are expecting to know the name of the new royal baby in just moments and anthony weiner

her left leaning judge in the history of the public. >> well, let's first put the nomination in a broader cop text. president obama after delaying forever on making nominations to the dc circuit. and they are racing to get the nomination through the hearings on the committee. it is the most underworked court in the country. it is a left wing agenda. and it is the broader picture aiming at here. and in the case of conellia.

and her hearing is coming a month after the nomination. in the case of john roberts thinks when he had the dc circuit court of nomination. his hearing came 630 days and why the rush now on the particular nominee. it is sdeened to prevent a thorough review of her record. no one had a chance to go through the writings. i have taken a look. and if someone does indeed to have the potential to be the most left wing judge in the country. >> and we'll look at what others have written on the record. on the issue of abortion, it is necessary to help free women in the are you tone maternity and they contend that men and women

propose. and that is hotly debated in the court. those folks have discrimination of women against a class of presuchltive breeders. one author riding on it said that's what they think of you. >> it is a far left rhetoric on abortion. we see this as well. in the way she characterizes people who don't have her views. and more broadly. the comments i have gotten are unlike the comments on any other appellate nominees under president obama. and i think they look into more of what she's written. for example, she thinks that judges should rule that abstinance only sex education violates equal protection. she wrote an article and have

them micromanage sex education in order to impose her own vow. anyone misunderstanding what judges ought to do is not fit to exercise judicial power. >> there is something else that came up. the republican was questioning her about a case in which she wrote a brief. it is likened pro-life demonstrators and pick it and do things outside of the abortion clinics. it is those who were kkk members back in the day. and also on the issue of ultra-sound. on the topic of abortion. ultra-sound shows deceptive image was fetus. and anti- choice movement poplarized. and that is not a fan of at pro- life movement. >> that's not the issue. we see someone who is ready to

translate deeply held policy preferences in constitutional positions and that is troubling. and what i think ought to be disqualifying for her nomination. but again, the broader picture here. why is president obama racing to get nominees on to the dc circuit court that is underworked and doesn't need the nominees and at a time of sequestration and he wants judges to rubber stamp his a jeopardy -- agenda. >> that court deals with federal regulations and there were concerns by senators that the president was trying to stack the bench to get him more leeway. >> and new questions for the irs and whether the man appointed as chief council was meeting with white house officials before the agency ramped up the targeting

why did she stick around. >> the reason many stick around. the vision they believed the man to be and the life they envision themselves to have is why they stay. whether it is being a wife or parent or politically in power, perhaps that entire package together. and women who are independent and in power and have a family relationship, yearn and long for stability for their child and believe that their man, who ever the man might be his short comings. most powerful women believe that powerful men have a challenge because they are notperfect. >> there is a lot of push back in the local media and national media not only to him but to her. asking questions. she should play the role of honest and realistic wife. she should stand up for new yorkers and say i may be stuck it with him but you don't have

to be. >> monica? >> how a man treats his wife is how a man treats his life. >> and when you are hiring i leader, you look for intellect and stability and judgment and honesty and so far anthony weiner is not showing us. >> humma might say i am standing by my husband, but i will not stand next to him as the candidate. and she has chosen not to do that. but i think that it may be a decision will be made for them by public pressure. >> she sos her own image and they questioned her judgment for sticking around? >> i don't think that is fair to question the judgment of a woman of staying in a marriage especially with a child.

i don't think it reflects badly on her judgment. she put her credibility on the line and came out and did the press conference. whether she wanted to be there or not, what does it say about a husband who lets his wife do that. he humiliated her over and over again. if she is willing to do that, that is her choice. but he probably shouldn't have let her do that. the fact that she has to clean up the mess he created and in the press conference. he referred to the thing that happen to us, like it was a tornado or something. >> it was not. he did it. he did it to her. >> that's an interesting. that is an interesting analyt analytical of the insight. it is i. not we. that is interesting. >> and there are still questions about. that we'll see how voters feel. we'll know how you feel. nthank you all.

of publicity. the man was captured live on tv. and there is a lot of photographs out there. this does not jeopardize the prosecutions. >> i on desk duty. he had a one day suspension and will stay there until a full investigation is wrapped up. how is that playing? the decision about that desk duty? >> i think everybody understands the state police are paramilitary organization. they do have protocols, et cetera. as long as he is not fired, i think everyone will be satisfied with that outcome. we have a governor in this state and state government beset by scandals. the lieutenant-governor resigns in disgrace. national ebp scandal. the governor sort of brushes it aside and sean murphy comes along and they say he has to follow the rules. that exacerbated people as well. >> thank you both for the update. up next, see how a wrong address produced and amazingly

a wild story out of florida now. a 59-year-old nurse handcuffed by police for pulling her gun out on a group of armed men she thought were intruders but who turned out to be members of an s.w.a.t. team looking for a child rapisist mistakenly raidi the wrong apartment. >> this escalated quickly, trace. >> did it ever, shannon. louis just finished up her shift as a surgical nurse, at home with her boyfriend in her apartment looking outside her window and saw a man with a gun

and flap jacket and light shining in the window. she dropped to the floor, told her boyfriend to do the same thing and crawled to get a. .38 revolver. the man outside said they were police and open the f'ing door. she didn't believe they were cops but the door was already unlocked. >> i see the door open, so i took aim. it's the only thing i know to do. i see this bright white light and barrel of a gun. i don't see a person. he says, please [ bleep ]. >> she took aim. the cop took aim. they're both pointing guns at each other, they're both laying on the floor and somebody is about to get shot. here's louis again. >> it was really scary. he said, if you don't put your gun down, i am going to kill you. yeah, he did. >> finally the boyfriend said they should give up and they did. the couple was cuffed and questioned when police realized they had nothing at all to do with the child rapist. that's when police left.

a fox news alert. a potential new scandal in washington. yeah. another one. involving the president's pick to be the number two man at homeland security and the former brother -- the brother of the former secretary of state hillary clinton. this is a brand new hour of "america live." i'm shannon breen in for megyn kelly. the investigation allow as government program that allows foreign investors to get visas if they invest at least a half million dollars on projects within the u.s. alejandro mayorkas is currently in charge of u.s. citizen and immigration services. the inspector general's office is investigating complaints may orca helped the company get visas after the request was denied and appeal rejected.

also, believe it or not in the virginia governor's race. there's a lot of weird places this story goes. hillary clinton's brother's firm was the conduit, the go between allegedly between mr. mayorkas and a chinese national, who was twice denied one of these eb-5 visas. and then apparent there i was helped to obtain one by this dhs official. the fact that hillary clinton's brother is involved in the case could cause a little bit of a problem for her politically. there's also a black eye here to the obama administration because mr. mayorkas is their appointee to be the second highest official in dhs, in fact, would run that organization until secretary napolitano's replacement is installed. as i mentioned, there's also a brewing temp pest here for terry mcauliffe, a long-time close advocate for the clintons and sort of close tie to them. he's running for governor in

virginia. and his failed company is also tied into hillary's brother and this potential visa scheme. it's complex. there's a lot of details in the weeds. it's certainly not putting a smile on too many democrats' faces in the beltway. >> you refer to these eb-5 visas. what that does, if there are those who come in and invest between half a million and a million dollars and all aimed at getting investors into this country who will create jobs in the u.s., so if they qualify, if they're vetted, forever they meet the criteria, they can get a special investor visa. what we understand the company run by anthony rodham, hillary rodham clinton's brother, does that kind of work, brings in investors and helps them make inroads in the u.s. and bringing in foreign money. i have to read you something we got from that company, gulfcoast funds management. yes, we are an eb-5 regional center meaning they help process these special vis sass. our management abides by all

regulations and their contact with immigration services has been limited to procedural inquiries the words they use. not sought assistance to resolve a rejected appeal. we're not aware of any investor visa application associated with our center being denied and say they're not part of any investigation by dhs. it's all very carefully worded and could be completely and factually true. this is their position so we take them at their word. clearly, there's something going on here that is admitted, there is some kind of investigation going on whether they did wrongdoing or not, that will be proven or disproven. there are suggestions here there are a lot of questions. >> that's definitely true. what's interesting about the statement you just read in the context of these eb-5 visas, a lot of your viewers listen to the explanation what the point of these visas really is, that makes sense. of course, we want high level investors even if they're foreign to create american jobs

a worthwhile government goal. the key there is to make sure the people coming in, the people paying essentially really for these visas are on the up and up, they are legit, which is why a robust vetting process is important. in this particular case involving this trashiparticular controversy being looked into by the inspector general the applicant who wanted the visa is a chinese businessman twice was told no by the u.s. government. the fact you had the man who could be number two at dhs behind the scenes going to bat for him after those two rejections in a potential abuse of his power, that's a serious allegation, which is why the inspector general, in response to whistle-blowers within dhs has been looking into this. >> they're an independent body and we'll wait and see what they find. thank you. >> thank you, shannon. another alert from egypt, the white house announcing it will delay delivery of four f-16

know it's not two rogue agents in cincinnati and went to the highest level appointee, an office i served in when i graduated law school a long time ago, my first job was with the chief counsel's office, with the office in atlanta at the time. the idea the chief counsel just meeting and two days later happenstance creates this new set of inquiries. hard to buy it. they can answer the questions by being put under oath and address the issues and find out what the chief counsel knew. this was in the middle of the 2010 election cycle. there are significant questions. this keeps going up the ladder. it started in cincinnati, then it went to washington then to lois lerner and her level. she takes the fifth amendment. now, it's again to the chief counsel's office and people talking about the chief counsel himself and a lot of questions have to be answer. >> you mentioned carter hull, a long-time employee at the irs and asked about the tea party cases and then told to go to the

chief counsel, william wilkins and after his decades of service there and determination on these cases he was told to give them to somebody who had only been at the agency for a few months. what does that suggest to you? because it sounds like he's making a directs link william wilkins was involved? >> it sure sounds that way. i think what you have is the polarization of these applications. you had agents and attorneys reviewing interest the normal course. this was shortly after the applications were filed going through a regular review process. then in 2011, everything gets turned upside down, carter hull a 48 year veteran a defendant in our lawsuit because at the time it looked like he was one of the main focus and certainly in control of some of this and that may not be the case. we'll see. in reality he' saying he was directed by lois lerner and her staff this was to go to chief counsel. he said that under oath. i have no reason to believe he'd be lying under oath. sure he was telling the truth. i think lois leararner should b

called back and i'd give lois lerner immunity. i'm sure you will find out the situation does not get any better. they put a proposal out to do an expedite review of irs applications for our clients. they sent us a letter. let me show you what i've got here. this is our response to the irs offer for quick expedite review. these are applications pending with the irs for three years and we simply told them they need to do their job and approve the applications on their merits. this rule they put forward is not the rule supported by the law. i think the off is is in a complete -- really incapable of adjudicating these matters right now. something has to be done on an expeditious basis. so far, we're not seeing that. they're offer of resolution was completely non-acceptable and not the legal standard what these organizations are allowed to do. put a burden on them no other groups have. i think the acting commissioner needs to take more aggressive

action and we need to finds out what the chief counsel knew. >> best case scenario for the white house if it wasn't him at the meeting and they did not discuss those issues when he found out and in some way linked by the employees' sworn testimony, william wilkins, the white house's guy in the irs, is it possible he did not tell the white house about what was going on, an if he didn't, why? >> anything's possible. if he didn't it's because they're trying to shield the president. we do know the deputy chief of staff knew. you have to put the links together. lois lerner's lawyer is a former law partner of the white house council. the chief counsel of the irs, william wilkins was the attorney pro bono for jeremiah wright, president obama's pastor. these are more than just coincidental links. what you have to do, we have to get to the truth, ask the question, were you at meeting? was there a meeting at the white house, what was discussed regarding these cases or issues. it will either be yes, i was there or no, i wasn't.

they control only one house on the hill. not the white house, not the senate. if democrats, the shoe was on the other foot, wouldn't they be considering pulling the same trigger? >> no. i don't think so. >> they wouldn't! >> the republicans, they sent the message. 38 times or so they voted to repeal obamacare. everybody knows it. they got it. now, ihey're risk iing going over the line and getting blamed by the american people particularly. not only if they derail this but the entire budget and vote against the continuing resolution and create a government shutdown, i don't think that's -- we've seen this happen. both parties have seen -- the democrats watched what happened when the republicans did this before and we were -- don't do that. i just think the republicans may have to learn this lesson again. maybe i'm wrong. i think it's very dangerous what they're doing, i think while some conservatives, very conservative members who don't like obamacare are not sure they're going to be for this.

>> we've seen this before in a number of battles, this big fight over sequestration and a lot of folks are saying, hey, it was a good thing for the government to clip its wings a little bit, trim its budget as little bit, the world did not end. how could this play for republicans? >> the republicans are being fisc fiscally conservatives, a lot of cuts and cutting back on a lot of government programs. a lot of priorities of the president they're cut back on. there will be a conflict sooner or later on spending. whether you want to make the battle on obamacare and shut the government down is the serious question. if you want to do that, i think obamacare will fall apart simply because it's far more complicated than the administration pretended it was and they're having a difficult time getting feel sign into it and the rest of it and the president violated the law by basically putting this off. to a certain extent i would argue let's see where it crumbles and don't get your fingerprints on it.

the issue will be whether it occurs or not. and the majority leader said they have made a line in the sand they weren't going to make adjustments. republicans have said for a long time we will not increase the spending numbers unless you basically give us something back. there will be a conflict there. i think both sides have to communicate very effectively to the country what they're about. >> it seems like the bottom line, even the content of what they accomplish on either side or don't accomplish may be secondary to the public perception. with 2014 coming both sides will wanted to have an optical win here. >> both sides will try to score points over all this. the problem still is in the end, i think ed's right, there either has to be some compromise or there's got to be a train wreck. i think compromise is where the american people are. regardless where the two parties are, they want to see compromise not a government derailed, not a train wreck somewhere, but both parties, there are elements in

both parties think a train wreck may help them in november. >> there are some people who, when they hear the word "compromise" to them, they have a negative connotation and think it's a sellout and we are seeing challenge for republicans and people running to the right of them, and minority leader mitch mcconnell. >> the dilemma you face any time you do a budgetary process has not worked the last four years. the senate has passed a budget and the house will pass a budget soon and they should go through the process trying to figure it out. they won't basically get their priorities straight, i think, before october 1st. you will have a continuing resolution and you will have the debt ceiling, both which are monumental events. what you don't want to do end up shutting down the government. every time you shut down the government, services are cut off to innocent people and to a certain extent, sequester cut back all the rest is good stuff. shutting down the government s s not good stuff. >> this comes from the house

speaker's office, when it comes to this conversation about shutting down the government, they say the president has announced he will not sign any spending bills this year unless sequestration spending cuts are eliminated and replaced for his plan with higher job destroying taxes. and any of these laws spending bills would need and unavoidable government shutdown. a stunning announcement for a government who has decried manufactured crises in washington. even if that is the case technically, seems like democrats do a better job on shining a spotlight on the government shutdown and assigning it to republicans. by his own announcement, the president could take action that would lead in the same direction. >> that's the point. both parties are positioning towards this battle. some of it's brinksmanship. you get there, it will be a disaster, it will be a disaster, all the groups start screaming, don't do this, and then you put enough pressure on members of your caucus, both on the

democratic side and boehner on the republican side, that some of them start to cave and say, okay, let's strike a deal. if that pressure's not there, then these districts that are so safe you both sides dig in and you can't get a deal and the government does -- there isn't an agreement, there isn't a continuing resolution and you have government shutdown potentially. i think a lot of the statements on both sides right now are not reality so much as posturing to try -- not to get the other side so much of the time but to actually try to get their own party members inside and coalesce to get support. >> there is a real shot for republicans to gain the senate or at least get very close. i think anything that jeopardizes that. what you have to watch here, what game is john mccain playing this week? john mccain has been very disloyal to the conference, out cutting his own deals and

relatively torey because obviously the key thing is the time frame. it was incredibly reckless for the former congressman to get into this race knowing it might well come out he was continuing to send pictures and have these sexual exchanges with young women, months and months after he resigned from the house and had apologized and said he changed his behavior. in fact there was a puffy profile in "people" magazine of him and his wife huma and their new baby and how he had moved on and tried to change. not so much. it was about the same time he was engaged in this new texting relationship. i use my mother, who lives in weiner's former district in brooklyn as a one person focus group. when the story first vote she said she would vote for anthony weiner again despite his problems. talked to him again, she's on the fence. you mentioned the piece in "people" magazine and reentering toe back in the water saying
