to it. we will. that is all the time we have left this evening, as always, thank you for being with us, let not your heart be troubled, we will have greta van susteren coming up with on the record. >> if the irs targeting is a phony scandal, why are people taking the fifth? and while i would very much like to answer the committee's questions today, i have been advised by my council to assert my constitutional right to not testify or answer questions related to the subject matter of this hearing. >> and president obama is still pushing that phony scandal line, he said it again today. the point is with an endless distraction of political posturing and phony scandals, lord knows what, washington keeps taking its eye off the ball. >> he told everyone how bad the irs scandal was, we just could
10:01 pm
not permit this. but now that is a phony scandal? >> i think the only phony thing going on is the narrative that the white house is trying push off on to the american people. >> i think it's interesting that he calls them phony scandals when at the time they broke, he professed to be concerned about them. >> the point is, with an endless distraction of political had cal posturing and phony scandals, and lord knows what, washington keeps taking its eye off the ball. >> the department of justice seizing news media phone records the nsa data mining of millions records. niece are phony scandals? these are very real scandals. >> and tea party member said she knows first hand the irs scandal is very real. martha said the irs is targeting her. martha, we read about your story in the washington examiner.
10:02 pm
what happened? >> well, it was my childhood dream to be a farmer and i started farming. i never imagined that, you know, trying to you fulfill my dream would involve so many hurdles with government over regulating and they cited me for having a birthday party on private property for eight girls. >> that's the county. >> there's an environmental group, you have an organic farm, so the environmental group and the county were going after you and giving you a hard time about a birthday party and other things on your farm? >> that's correct. >> and that is something still going on, you are in a turf war with them? >> yes. >> and at some point, the irs decides to audit you? >> yes, and as was reported, what is unusual and unique about it, one of the officials in my county had disclosed that i was the subject of an irs audit to more than one individual in my county before i ever received the audit. >> so he -- do you have any idea
10:03 pm
how this official in the county knew about the audit before you knew about it? >> that is all part of the investigation right now. >> and in fact, the irs watch dog is looking at this, our treasury? >> yes. >> in terms of the audit that you had, what kind of questions were they asking you in the audit? >> a lot. a large volume of questions. what was unique about it, some of the questions were directly pertaining to the issues that i had with the county. >> all right. now one of the things that the county was upset about, and made an allegation that you were running a boarding house? were you running a boarding house? >> no. >> ever running a boarding house? >> why did they think you were running a boarding house and accuse you? >> good question. that is what made the audit unique. the questions were about a boarding facility, whether i had a boarding operation. >> so you have the county asking you or accusing you of having a boarding facility, and you said you do not have one and then suddenly you have an irs audit and they ask you about a boarding house. in your tax return, did you ever
10:04 pm
take any deductions or get any income reflected for a boarding house? >> not at all. >> so the idea of the boarding house comes out of the air. other than the county is asking the same questions? >> correct. >> is there anything else about the irs investigation that was peculiar? >> of course, the volume of questions was absolutely enormous. and you know, an auditor did come to the farm and ask me questions while i put eggs into egg cartons. >> so this is -- how many acres do you have? >> shy of 70. >> it's organic? >> yes. >> you farm it yourself? >> we farm it ourselves and have people that help us. >> how do you sell your product? >> until recently, people came to the farm with their families and they would, you know, collect their vegetables and eggs and honey and that is what we did. before the county came in and started over regulating it and putting in place restrictions.
10:05 pm
>> you are a tea party member, what is your affiliation? >> i'm a member of the tea party. and i am affiliated with a number of tea party groups throughout virginia. and you know, most of all, i think that this issue not only effects tea party members, it effects all americans, nobody should have to live in fear of being targeted for who they are or what they stand for and believe in. >> you ever been audited before? >> no. >> first time? >> yes. >> anything peculiar about your tax return? is it complex? >> other than i have a farm, i don't know that there's anything particularly unusual about it. >> martha, has been this terrifying or scary? >> it's absolutely terrifying. it's terrifying to know that my -- that my irs audit, my personal private tax returns were disclosed public cally by somebody before i was aware of the audit and the process has been absolutely terrifying for me and my family. >> and i should say, they are saying it's a mere coincidence.
10:06 pm
>> they say coincidences do happen. >> meanwhile at least the treasury inspector general is looking into it? >> yes. >> well, good luck, martha, there's a lot of complaints about the irs these days, we are hearing more and more. >> thank you. >> and the president of lynch pins saying that the only thing phony about the scandal is the president's response. thank you for joining us. >> i got your name wrong. >> i know, it's not an easy one. >> all right, tell me, what do you think, what is your response to the president saying these are phony scandals? >> well, as you said, the only thing phony is the administration's response. they continue to pretend that they have not violated the constitutional rights. they have unlawfully delayed and obstructed my petition for tax
10:07 pm
exempt status. and the irs continues to insist that i disclose the identity of those that i teach, some of them are minors and where i teach and my political views. >> has there been progress in terms of your getting exemtion? >> unfortunately, there's been a huge problem with my business in that on june 5th, 2013. which is the day after i appear odd this program and the day after i testified at congress, i received a call from a dear friend, long time client, that expressed that they were uncomfortable with me speaking on political views, that they did not want to be in business with me.
10:08 pm
that was 75% of my business. i want the administration to tell my family it's phony. >> he said, i reviewed the watch dog report and the misconduct that is uncovered is inexcusable. i don't know what happened between the inexcusable on may 15th, to yesterday and today that it's phony. i don't know what happened. any thoughts? >> he is contradicting himself. which you pointed out. fortunately, the truth does not depend on what barack obama says. it exists separate and apart from it. if he does not master the truth, the truth will master him. >> how painful is this for you? >> well, of course it's painful in the way that it effected my family, affected my business. remember, before i had explain they'd also, as i have testified before congress, i lost a $30,000 grant. in addition to that, when you speak the truth without regard to the consequences of speaking
10:09 pm
the truth for yourself, the inspirational part is that it gives voice to the concerns of many people. and i received after my the, over 200 e-mails from people all over the country and china and poland who were excited that i stood up for what i believe. yes, there's the negative side, but there's a positive side that someone is standing up. i'm not the only one, there's deferently, a group of us standing up together, and that gives us strength in numbers. >> thank you for joining us. i will try to do better on your name next time. >> thank you so much, greta. i appreciate it. >> we heard it from president obama and we heard it from press secretary jay carney, repeatedly calling the washington scandals phony. joining us, rick santorum. >> you messed up my name too. you got martha right. >> i did. not a good night for names for me. he said that the misconduct is inexcusable. we have government employees taking the fifth amendment and
10:10 pm
now he is saying it's phony. >> it's all crisis management. i think he believed that if he just said this was in excusable that they could bury and put it off the front pages, but it's bigger than he obviously believed he could handle and now he has to do what every president who has got caught doing something that they should not be doing that has large ramifications and that is trying to divert attention away from it, lie about it, call it things that it isn't is. what is the big problem is with the scandal, the big intrusion into people's lives. this is scaring people and now we have obama-care people coming in. we have the health records, and all the government control of the health care and dollars. now you have the angst, look at what they are doing now. the size of government and it's scheduled to get much bigger and
10:11 pm
people are saying, wait a minute, and you see his numbers going down and that is why he is reacting. >> i think it's cruel. because someone like martha, she has 64, 65 acres, an organic farmer by herself in virginia. she is just trying to do business, and you have the irs giving her a hard time. they are asking her questions about things that is not in her irs return. he thinks that is phony? i mean, it's not phony to her. this is important to her. >> the fact of the matter is that you have a liberal environmental group who knew before she did. what is going on is these liberal groups across the country that barack obama has energized have tremendous access to the halls of washington in d.c. it should scare the left and right, it's them now, but imagine we get a conservative in office, and they do the same
10:12 pm
thing. it's just wrong, and the size of government is too big. they need to end obama-care, it's time for republicans and conservatives to start fighting now that the ground is ripe to fight. >> i don't think it's some liberal environmental group. it's a bunch of rich people that do not want a farm. they are using the environmental group, i think it's a bunch of rich people in virginia that do not like it and they are using whatever tools they have. >> the smell of organic farming. >> yeah. let me tell you something else that bothers me. the continuing resolution expires on september 30th. the house and senate did not do their job in and they have the debt ceiling. so what are they doing? president obama is going to martha's vineyard and the house and senate take a recess. many say they are doing constituent work, i believe they are. but in terms of prioritizing they have done a lousy job with the national finances and they are going away without doing
10:13 pm
their jobs first? >> i agree with you. four years ago, we were going through the same thing with the whole health care situation, and they went home and the american public rose up. and so, i would just say to the folks across this country, and i know you have a very active group of folks who follow you and are very active. this is an opportunity to see a rerun of 2009, when at the town meetings people came out and said, we are tired of government doing this to us and whether it's irs or nsa or boobama-care it's time for us to send our representatives back to start fighting the enormous expansion of government and intrusion in our lives. >> i do not care if it takes six months to do their jobs. i stay here and do breaking news, the fact that they go home during a crisis is a problem. >> well, i'm hopeful that they will hear what their american people will say. it's up to the folks at home to
10:14 pm
make that happen. >> they will not hear it from the president in martha's vineyard. from the beginning, washington irs officials blaming workers in the cincinnati irs office, people say they were targeted testifying before state lawmakers. justin thomas was one of them, he joins us, nice to see you, sir. >> nice to see you again, greta. >> you have been listening to the targeting business, is this a phony scandal, give us your thoughts on this? >> phony impacts quite a few of us here. i don't know how many thousands of people qualify before we go from phony to real? >> what do you think when you hear the president say this? i mean, the president said, on may 15th, it's serious and he will not tolerate it and it's terrible. and now six or eight weeks later, something that was serious before is now phony? >> yeah.
10:15 pm
a bit of consistency issue. i can tell you it's not funny to me. my name on the questionnaire is a serious issue and has serious ri risks for me and my family. >> when you talk about your name on a questionnaire, as i understand it, it's a questionnaire given to one particular tea party group, not one that you were a member to. they basically said, what do you know about justin? what can you tell me about him? do you know him and what is going on with him? is that sort of the way it happened? >> exactly. it was a group that i had not worked. and the question said, explain your relationship with justin. >> how did they know who you were? you were in another tea party group and they just decided to ask another group about you? >> i guess that we all look the same. >> what do you want to happen? >> well, we need to make sure this doesn't happen again. it's not acceptable behavior to call out an individual and you know, to use the words of lois
10:16 pm
learner, it's an appropriate action to target the conservative groups and now we know it's larger, religious groups are in the mix as well. >> if you use her words, you may want to add i will take the fifth. and the president's word, the president now says it's phony although it's real to you and martha and other people. you know, if you want to use everybody's words, i do not have an abiding conviction that people are taking this particularly seriously when they are calling it phony. >> i agree. >> well, it is indeed, you know, it's disheartening and if all the politicians, republicans and democrats if they go home and talk to their constituents they can get a piece of everyone's mind that might like to talk to them. justin, thank you. >> thank you, greta. >> now to tonight's hot button issue on greta wire.com. should president obama apologize for saying phony scandals? yes or no. go to gretawire.com and vote in
