address to the nation to push the claim. hello, everybody. welcome to "america's news headquarters." >> kelly and i are so glad you are here. today's comments coming after president obama spent much of last week downplaying criticism against his administration in would very high-profile speeches. will was one recurrent theme. hi, molly. >> hi. yes. downplayed some of the criticism and focus order the economy and jobs. the president and his spokesperson clearly were singing for the same song sheets throughout the week. here is what they had to say. starting with a line this morning in the president's weekly radio address. >> over the past couple of years, in particular, washington has taken its eye off of the ball. parade of distractions and political posturing and phony scandals shifts focus from what needs to be done. with an endless distraction of political posturing and phony

scandals and -- lord knows what, washington keeps taking its eye off the ball. that needs to stop. >> phony scandals that have captured the attention of many here in washington, fake scandals, or things like that, we have to keep focus order the north star here. the issues that the american people want us to be focused on. >> the white house did not clarify which scandals were false or phony. the republicans are asking the president if it is baens the irs going after conservative and tea party groups, nsa surveillance program, and the justice department targeting journalists all fall into that category. >> i don't think his messaging works for him when he talks about phony scandals. that's why i think we just saw the pivot this week and has to pivot back to the economy because i think he sees that that's the only way back up the polls for him. after all, that's what it comes down to. >> jays the president believes the irs activity, for

example, was inappropriate and the president took steps to stop it. carney says republicans are trying to turn it into a bigger issue than it is. >> the media also getting a bit blamed for that. let's take a look at that. thanks, molly. what do the people directly impacted by the scandals have to say about the administration's continued use of the term phony? earlier this week, we spoke with the mother of sean smith. who could forget what happened to her son. sean was one of the men killed in last year's terror attacks in benghazi. listen. >> it is wrong. it is not phony, fake. my son is dead and why is he dead? all i'm waiting for, even to this date, is someone to get back to me and tell me what happened. >> the bureau chief for talk radio news services and angela mcglowen here as well.

glad to have you here on this topic. ellen, i will start with you. it is said that the president just wants to refocus everybody on the economy. is this an appropriate start zwroy do that? >> of course it is. well, those -- quote, unquote, scandals are not going to go away. we are not going forget. at least the journalists wlant happened to james rosen. we are not going to forget the intense nsa fine. that will not go away. on the other hand, what's congress doing except being very, very difficult and in terms of getting the president's budget passed? in terms of getting any budget passed? that impacts on over 300 million americans. >> angela? >> it was the president that brought us these phony scandals. ellen, you are right. i'm glad you acknowledge that scandal, they are not going to go away. the president is great at giving speeches but is not a great leader. lbj showed up and was a deal maker. why can't president obama take

card out of lbj's playbook and go to congress and lead this country? all bodies have to work together. but they are being obstruct. >> could you think that your recognition that the scandals won't go away and certain there media and others won't forget them, does that jive, so to speak with what the president and administration is saying that they are phony to begin with? jay carney saying that the irs was just conducting an inappropriate activity or this mom that we heard from, her son, sean smith, dying in baenenghaz and still not having an explanation of what happen. >> can you lay those scandals right at the president's door? i don't think the president is responsible for what happened in benghazi. should they be more open about letting information, freedom of information, act, on that and many other things? absolutely. however -- that -- the budget.

>> you can lay those scandals at his door because he's the commander in chief. he's the leader of the free world. when you have our ambassador killed, when you have our patriots killed, when you have the department of justice investigating james rosen, that's a problem. yes, you can lay it at his doorstep. what this president is good at is the deflection and distraction and division. >> let me ask you about that. then let ellen weigh in as well. one of the things the president has mentioned this multiple times, scandals are distractions, phony, and i think that's an interesting term at least. i would love you to weigh in on it. but -- all of this is being presented without any new policy initiatives. why call it a name without providing a solution? are we going to see that next, angela? >> we need to see some solutions. what we are seeing illusions of the obama administration.

where -- it is their troops. instead of the real truth. in 2014 you want to have americans speak out and will vote their wallet at the voting ballot. >> are democrats concerned about that, possibility, as angela is saying, perceived as illusions and not solutions? >> everybody will be concerned about who holds the senate and the house. but the fact is you can talk about scandals all you want. where is the budget? the republicans are not willing to negotiate with the president and they want to stop obama care by not -- shutting down the government. that's insanity. >> you mentioned obama care. the -- it seems like there is a bit of bipartisan disturbance or disruption in the implementation of obama care that democrats are speaking out as much as republicans about parts of it that will either be impossible to implement or very hard on middle class and business owners. what's the solution for that?

has the president provided a revised plan for his major initiative in his campaign? >> he's not going to provide a revised plan. ellen is right. i think that it is dangerous for the republicans to utilize obama care to stop the budget process and to shut down the government. you shouldn't put that out there as -- a carrot in front of the president to have him come to the table and not raise the debt ceiling. one does not have anything to do with the other. if republicans decide to close down the government, and not do a continuing resolution, i think that will backfire on the republicans. >> last thoughts? >> last thought is look, these republicans have got to work with the president to get a budget and to not just do a continuing resolution. bad idea for the republicans. >> ladies, thank you so much for presenting both sides. always great to have you here. >> thank you. >> kelly? we have a fox news alert on egypt. massive crowds in cairo right now as supporters of ousted

president mohamed morsi rally in the street. violence spreading across the country as there are reports of dozens killed overnight and into this morning. meantime, tens of thousands of egyptians packing tahrir square in the capital responding to the government's call for mass demonstrations against the muslim brotherhood. >> i'm against what they are doing. they are trying to control us in a very bad way. they have a very wrong idea about islam. they are using islam to destroy this country. >> live from our jerusalem bureau. we are hearing lots of reports like this and people stating that, you know, got to do something about the muslim brotherhood. >> there's a lot of back and forth now and a lot of division in egypt. the top military commander there has been threatening for some time that he wouldn't move

against the muslim brotherhood. calling on the muslim brotherhood to remove themselves from the street and even labeled them terrorists and last night they did just that. now, early this morning, the egyptian military opened fire on pro-muslim brotherhood killing at least 38 people. other reports the death toll is much higher. still some vagueness about how many people were killed. this is the second time the military has used deadly force to try to clear out pro-morsi demonstration which is generally have been peaceful and totaled more than 100 people have been killed in the last month during the violence. most have been muslim brotherhood supporters killed by the army. now the obama administration has largely stayed silent on the military coup but has called for president morsi to be released and being held by the army. and for a quick transition to a civilian-led democracy, despite u.s. law, the pentagon continues to provide financial aid and military support to egypt which

overwhelmingly goes to the egyptian military. in cairo some members of the coup that brought together this military coalition are even saying the military has gone too far with the latest crackdown on the muslim brotherhood and a lot of division, coalition that's supported the military crackdown and coup is beginning to having fractures in it as well. deeply divided country. any hope the country would move past this coup and get back to it sort of -- civilian-led democracy does need to be rapid -- sooemts seems to be rapidly disappearing. >> it is indeed very hard to move forward when you have fractures and division going on in the country. connor, thank you. so how did it come to this? here is how the situation in egypt deteriorated to this point. just over lee weeks ago you may recall the military steps? following days of massive protests and ousts president morsi. nearly every day since then his supporters held rallies against the capital city demanding he be

reinstated. the new military backed government now taking the first steps of legal action against morsi. launching an investigation of allegations of espionage and murder. at the same time, the government call for an end to the protests telling morsi supporters to go home. promising they won't be pursued or arrested. >> new developments in the deadly train crash that we have been reporting in spain. the driver of the train, who can be seen here with blood running down his face after the crash, is being held in police custody on suspicion of negligent homicide. the video of the crash is almost too difficult to watch. it comes here down the tracks literally careening into the wall. the railway agency saying it was the driver's responsibility to slow that train down before going into the curve. it remains unclear at this point whether the brakes failed or were never used. at least 78 people were killed. more than 100 injured. a judge has until tomorrow to

decide whether to press formal charges. here at home a hostage situation is going on in florida and ending in seven deaths. police say a gunman barricaded himself inside of a south florida apartment with hostages and the s.w.a.t. teams swiftly moved in. >> motive unclear at this time. but it does appear it started out as an altercation between them. this was in the northern suburb. started around 6:00 p.m. local time. reports are the managers who were husband and wife went to speak with the gunman and lives on the fourth floor with his mother. the manager's daughter, who also resides there says they went to skaus complaint that had been filed. that's when she heard around 15 to 20 shots.

>> i heard about 15 to 20 shots so i went outside and my neighbors were screaming, my parents have been shot. >> my mom was dead. moment she was shot. and my dad still had a pulse. >> had a pulse by the time she got to him but he later died. the shooter who has yet to be identified killed four others, two men and would women, before holding himself in one of the apartments with two hostages. police described arriving at an active shooting situation, they say, where the government was threatening to kill those people. after negotiations the s.w.a.t. team stormed the apartment around 2:00 a.m. and shot the gunman dead. the hostages survived. those killed ages between 17 and 78. police now trying to piece together what motivated the shooter that turned vialnent what is normally a quiet neighborhood. >> thank you so much. good to see you. fox news learns brand-new

sfnchlg time for the top of the news. dozens of people reportedly killed in egypt following clashes between security forces and the supporters of former president mohamed morsi. it is the deadliest wave of violence to hit the country since the military ousted morsi earlier this month. there's also a deadly hostage situation in south florida. police say that it started last might when the suspect barricaded himself inside of the apartment complex. you can see folks outside there. police say the gunman killed all six hostages before the s.w.a.t. officers killed that shooter. fox is learning new details about the benghazi attack and how the survivors waited hours

for aid from one of the most severely wounded survivors. fox news was the first news organization to make contact with david uban, diplomatic security agent, who risked his life to try to save his colleagues and help defend our consulate that night. this coming this week, a group of congressmen have sent a letter to secretary of state john kerry saying the state department has refused for months now to provide congress with contact information of the survivors. why isn't congress getting the answers it needs and what it is looking for? mike turner is a member of the house oversight and government reform committee. he joins us right now. congressman, good of you to join us today. let's get right to it. what do you want from the state department and as well as from the white house? >> you have to remember this scandal began with the administration telling the american public a fiction, that there was a spontaneous demonstration that resulted in our ambassador being killed in benghazi which we later learned from gregory hicks, deputy chief

of mission, that this was terrorist attack and known to be a terrorist attack from the beginning. also we learned from gregory hicks there were troops that could have made it to benghazi that wanted to leave and go in and provide aid but were told to stand down. we have the administration starting with the fiction and congress then beginning its investigation to find out really what happened in the -- the americans being killed and losing our ambassador. we asked both for the chain of command and those in the military chain of command and survivors. administration continues to stonewall and that's why this is a scandal. they started by not telling the truth and now won't even let us have access to those had a might tell us what happened. >> based on the information fox news learned about david uban a survivor, who risked his life, was injured, stayed on a rooftop for some 20 hours before my medical help arrived there to help him, and his injuries had been so severe he's still recovering from this, do you have or do you want access to him and why haven't you been able to get it so far?

>> that's very troubling. the state department is not making him available and certainly -- >> why not? they should have some transparency here. >> absolutely. that's -- those are the questions i think the american people immediate answered and we need answered. why is the administration stonewalling? i don't think they want us to know the administration should have been taking action that night that would have protected americans and that this unfolded clearly at the -- as a terrorist attack and should have been resources to protect the americans and they should have smonded quickly and -- for some reason the administration would prefer to leave the american public with that fiction. >> saying you were stonewall prosecuted the administration, one would have to assume something is going on that doesn't meet the eye, doesn't pass the test. >> that's why this is a real scandal. no matter what the administration tries to say, congress is creating scandals, the administration -- were not north coming to what happen

on is the administration's description of fiction and congress will get to the bottom of this and will get answers and what should have happened and hold those accountable. >> where do you go from here and how do you get to the bottom of this particularly when you are facing some stonewalling and opposition? and -- let's face it. if will is nothing wrong reveal the sources and reveal the people, bring them forward and let the american people and the members of congress hear so we can move forward from this. >> absolutely. the administration starting with a fiction has not said i'm sorry, we were wrong, here is the real answer. they said we are not going to let you get the answer. congress is not dependent on the administration to allow us to get the answer. they have powers of investigation and we will pursue those. we will hold this administration accountable and get those who know the story and come forward and eventually the administration is going to have to deal with the truth being told to the american public. it is just a shame the administration is not going to be a partner in telling the american public what really happened that night and what should have happen. >> for those that come forward, like david if and when he should come forward, will there be

retribution against his statements? >> certainly congress is going to assure there is not and will make certain the administration does not -- you know, cause people to punished for actually telling the truth. i think the thing we need to be concerned about in addition to what happened that night, fact the administration is trying to tell a fiction the american public, we have people all across the globe that are serving our nation and they need to know that when they are at risk, the american -- full force of our military and our security forces are going to be there to protect them. they are not going to be left as they were in benghazi that night wondering where is this support from the american government. >> david uban, displayed courage under fire. stayed at his post. continued to try to help out his friends. tragedy unfolded there. he is a survivor. what do you say about his heroic action on that night that terror struck in benghazi? >> that's in part why we do the investigations. we don't ever want another david

at 17%, 18% on a 30-year mortgage. to look at -- interest rates at this point in time, i think it is beneficial the take advantage of interest rates where they are and if you can refinance or if you are a first-time home buyer, it is an opportune time to invest, i think, in american real estate. now, the one thing i would say is that your horizon with this real estate first-time home purchase, you need adjust it, we look back not too long ago, we were looking at a year, two years. we have seen significant appreciation. i think that a first-time home purchase should be looked at as something over a 7 to 10-year horizon and you will see appreciation and i think you will benefit at this time by having locked in low interest rates. >> banks are brag being the rates being competitive and being the right time to get in. but are they making it harder to get those loans approved?

after all the robo signing. are we still seeing an impact of that? >> i think very much, jamie. i think banks are, you know, scrutinizing income of individuals and verifying things they didn't verify before. i think that's a good thing. this is what i would say if you are the consumer looking to enter into the real estate market. make sure you have six to nine months of income set aside because the job market is still and will continue to be, you know, very, very hazy. we have a 7.5% unemployment rate nationally. i don't think that gdp growth or the job market is going to get stronger any time soon. so i am suggesting make sure you have six to nine months of money set aside just in case there is a loss of job or less visibility in the marketplace for your sxwlefl you never know if you can have a family emergency, too. you want to be prepared for that. i wonder p the first-time home buyer profile has changed. at this point it might seem especially if you want us to put

aside that much money that it might be an older home buyer. maybe someone in their 30s as opposed to late 20s, newly married, waiting. then also, the impact of high student loans and interest rates rising on those. how difficult is it to be a first-time home buyer right now? even with these great rates. >> i say it is very difficult. it used to be you rent and then you buy. now it is you are in your mom's basement, then you rent, and then you buy. so i think that be cautious of, you know, entering into the marketplace. but i would say that i think these are opportune times and, yes, jamie, it is more difficult, you know, now to buy a home, to set aside that sort of money, and so as long as you can -- not inconvenience mom and dad, stay at home and put aside money, rent. i think now is really a good time to look at owning a piece of the american dream. look at it as a long-term

welcome back. particularly all you tall people, listen up. a study finding that some women may be at higher risk for cancer. research much finding among post-menopausal women, the taller she is, the greater her risk for developing certain types of cancer. each ten centimeter increase in height associated with a 13% higher risk of cancer. dr. david is here to join us. i was just reading about this.

144,701 women. >> yes. it is a very interesting topic. here's why we picked it. when you read this, it doesn't make much sense. it is a great study that comes out of albert einstein in new york. followed 144,000 women over 12 years. between the ages of 50 to 79. what they are find sing -- association, not -- proven and cause -- not cause or proven but what they found is that for every power inches of height, increase of 13% of the cancers. colon cancer, rectal, breast, ovary, skin cancer, which is really significant. it is a very, very interesting finding. while they don't know what the cause of this is that they think that there could be more -- we will get to it. it is for for people to know they adjust it for every other risk factor. smoking, alcohol, they ruled all of those out. screening process. the theory behind this is that whatever makes you to be taller,

could be the reason why you will be at a higher risk. let's say your diet, maybe you have been drinking too much mill whk you we -- milk when you were younger, that could produce an insulin growth factor that could lead to cancer. maybe genetically the genes for taller people are different than the ones that are shorter. genetics can play a role. also the size by itself, size of someone that's much taller has more surface area, more skin, and more exposed to skin cancer. i think that will is nothing to -- panicking if you are tall. i think it is beautiful. nothing wrong with it. ing in fact, benefit, health benefit of being taller. less chance of heart disease and stroke. i think what we learn is if you are tall, and based on this you have high risk of cancer, my advice is to make sure you get screened and get into the system and check yourself for a lot of the cancers. that's the lesson i learned from this. >> good advice. more proactive about you are screened for every kind of cancer that may be known to a
