have a great weekend, everybody. see you on "the five." hello, everyone. i'm dana perino. it's 5:00 o'clock in new york city. and this is "the five". >> with an eye on 2016, one question looms large. should the party be more conservative or libertarian? chris christie and rand paul, the new jersey governor was asked about national security and he fired this shot. >> this strain of libertarianism that's going through both parties right now and making big headlines, i think is a very dangerous thought. president obama has done nothing to change the policies of the

bush administration in the war on terrorism and i mean practically nothing. and you know why? 'cause they work. i love all these esew tearic debates that people are getting in. senator rand paul, for example. you can name any number of people and he's one of them. >> the kentucky senator thought it fit to fire back and he did so with this tweet. he said, quote, chris christie worries about the dangers of freedom. i worry about the danger of losing that freedom, spying without warrant is unconstitutional, end quote. greg, i'm going to start with you. can you tell me your thoughts on this? >> what's that supposed to mean? >> take it from me, i know. >> it happens every day. >> i forfeit my spot to these guys. >> do you have a point? >> yeah. i think this rift is the best thing that's happened to the left and to president obama. greenwald was a genius because he pleased the advera tears and

we're having one side accusing another of shredding the constitution. the other side accusing them of being soft on terror. what law enforcement does is embrace reasonableness and this is what has to happen in this debate. you do it to service -- a disservice if you position yourself on the very edges of alarm. the first casualty in a tv feud is reasonableness. we either talk about tyranny or talk about terror from above. the point is you can have both. what they talk about, what law enforcement talks about is reasonableness. it can happen. what happens is we have these groups, and we're at fault for this. we put ourselves at the edge of every argument. oh, my god, there is going to be another 9-11! oh, my god, you're shredding the constitution! actually no. shut up. it's in the middle. >> it's interesting because i think the main stream media would like republicans to have to choose. you're either this camp or that camp. actually what we want is a

composite candidate made up of lots of different people. your worlds collided between rand and christy. >> i the role of law is now dangerous to governor christie. you lost a fan in me, sir, and anyone else who believes the constitution is up for interpretation, especially by a governor, you can't interpret it your way. it's not living and breathing. it's a rule of law. let me get this straight, rand paul is dangerous, but president obama and carlos danger are okay in your world right now. governor, you said you look at people in the eye who is lost loved ones in the world trade center. i was in the world trade center in '93 when the bomb went off. i watched the planes go into the world trade center in 01. i watched friends burn in the world trade center. i watched people jump out the window. i think i have an idea of what terrorism looks like. it's not innocent americans being data mined by the nsa. it's islamic terrorist. stick to them and we're all okay. >> so now you're not for christy anymore? >> i am done with him.

be able to prosecute terrorists that is what chris kristy did, right? >> i'm for finding them before the prosecution. >> the purpose of the fourth amendment is trip up prosecutors, to make sure government doesn't get too big. what's wrong with people like rand paul saying hold on. let's have a debate about civil liberties, especially in the era of obama? i just say this to me was welcome to the 2016 primary. i think christy was trying to differentiate himself politically as well from rand paul. this is his background. paul has a different take. and the new poll shows rand paul is now leading in the republican primary field. >> let's ask bob about that. for 2016, i have two questions. first of all, do you believe they're both actually putting their toe in the water to see about 2016 and also, what do you think the republican mindset would be, will it be more conservative or libertarian or when it comes down to voting? >> it's strange libertarianism going back to eisenhower.

enormous split in 1964. it was taken over by more libertarians over the reservetive republicans. this is nothing new. it's becoming something brighter on the stage of politics 'cause you have two people who are pretty good at what they do -- we haven't had a rand paul who is an out and out libertarian in the congress for a long time. so he raises questions which i have been there for a long time -- he was never taken seriously. >> there is a difference. >> we read is it going to be more conservative or libertarian? i think that's inaccurate. i think rand paul is conservative and libertarian and i think chris christie has lost his conservative threads over this and some of the other things he's doing with the second amendment in new jersey. >> well, okay. >> specifically relating to terrorism, i don't think you can say that chris christie lost his conservative credentials. i really don't. his record is u.s. attorney is

pretty incredible. i know people are upset because he was somewhat praising president obama for following in the footsteps of bush, but i guess i don't really see it this way. >> i'm surprised of how many people -- they actually don't like either of them. some folks i spoke to -- 2016 seems a little too far out for them. but they're thinking why are we talking about tax reform? why aren't we talking about figuring out how to bring more competitiveness into the health care system? why aren't we focusing on health care reform? maybe it will be fourth amendment, but i kind of doubt it. >> if you listen to rand paul carefully, he continues to bring up syria as an opening shot across the ballast. do not do that. libertarians for the most part have been very, very reticent about committing u.s. troops overseas and for good reason. and there is always been a place for that debate. the people like the ones willing

to go anywhere, any time and do anything need to do have a force working against them and the libertarians have done that. >> not only that, they have -- you had a lot of liberals actually joining on the syria piece and also on the nsa vote that happened this week. you had a lot of democrats actually voted with a certain number of republicans -- is there a new force building? >> let's face it, it kind of shook a lot of allegiances up and you had like eric palling around with glenn greenwald, which i never thought i would ever see. that would be like me moving in with a lemur, which i did for six months actually. but the interesting thing is libertarians can embrace the idea of the nsa, the verizon piece and prism piece because libertarians know freedom requires force and force requires intel. you need intelligence. if america is a house, you have to make it a castle. the sad thing that bothers me about this whole debate and then i'll shut up, in the old days, the right would be pissed off

about the leaks. if there was a leak that made us vulnerable to our enemy, we would be pissed! but instead we're pissed off at the government for lawful actions meant to protect our families. i know we -- >> that's the line -- >> how do you know it's unlawful? >> there is nothing unlawful about it. >> oh, my god. >> no, no. >> where is the probable cause taking the information and data mining innocent -- >> there is a difference between -- >> can i point this out? we can do this again or something else. dana, i know you're getting frustrated. >> excuse me? >> on the republican side, chris christie going there was a big mistake. they need to be uniting. there is a ted cruz and rand paul who are conservatives who are very similar, but they're not fighting each other. they're not taking shots at each overt i don't think it was a good idea for christie to do that. >> i was just going to say, it actually is legal.

the problem is that technology has radically changed. so people do have a reasonable expectation of privacy. i get that. i think eric, the case should be, we need to take this back to the courts. we give up our data in google. they have our gmail. facebook. we give it up every single day. i think people would be okay with a little bit of data to catch a terrorist, but the problem is the technology changed and this administration abuses it over and over and over again. >> when you go to google and you signed off, when you sign up for google, you tell them you're okay with them doing what they're doing. >> what greg is talking about was already decided about in the supreme court. it is legal. i don't like it, but it's legal. so if you don't like it because of the technicalities of what they decided because technology has changed, go back to the court. you're both right. >> yes. that's the problem. >> you can both be right and have points here. >> so polite raising your hand. >> i was in a meeting with barry

goldwater with president carter and that is when there was a leak out of jesse helms' operation and the brothers being drug dealers. there was a sealed indictment. barry goldwater, he was supportive of the president. i said senator, he said, bob, remember something, we conservatives hate leaks like this and what he threated to do was go on the floor of the senate and say he was for the panama canal treaty. and i was absolutely struck. >> i think rand paul will have a problem with eventually is that, for example, the question of should we be a country that is more isolationist? should we mind our own business? we have nukes, so it's okay if others. i think that's a bridge too far on foreign policy that they would say we're not able to go there. >> we are the size of a phone booth. go ahead. >> libertarians and isolationism are two different things. libertarians will only go someplace if there is a clear and present danger to the united

states. >> that is actually where i support them. i think that's right. that's where they have the strongest argument. people are tired of the democracy promotion. they're tired of losing blood and treasure for these dumps like afghanistan. i do think that the libertarian party is the pause button. i actual -- >> i have my summer home there. rabbits -- anthony wiener does not choke rabbits, yet. those who enforce the law are actually getting out of having the law enforced on them. that's ridiculous. >> and this is why people should be furious. it's not that the people that will enforce the law that now want to opt out. it's the democratic power base that pushed from day one to get into this deal, like the big labor unions, to protect their big, vast, kushy health container plans. and then they asked for a carveout for themselves. so they mandated a law that we all have to face that's going to drive one third of our economy into the ground and they exempt themselves from it. people should be absolutely furious about what the unions did with this bill. they don't like it. even the people who are supposed to enforce it. >> bob? >> i'm trying to get this driving one third of the economy into the ground through my head. these labor unions are doing something -- they're negotiate to go get an extension on their carveouts as are everybody else

what is this? >> bill o'reilly delivered one of his most controversial talking points memos this week when he called on president obama and civil rights activists to recognize the real problems in the black community. people are still talking about it and o'reilley appeared with geraldo to expands on his comments. >> black americans commit homicides at a rate ten times greater in the united states than whites and hispanics combined. >> i think that black people are going to feel that you're stereotyping them. >> i don't care. i'm dealing with reality. i'm interested in helping the most vulnerable americans and those are young black children born into poverty. the african-american community, when it comes down to it, is going to have to do it themselves because they're not going to get any help from the white power structure and they're being sold out by the

harlem. >> greg, you're trying to get in there. >> is it stereotype to go point out the suicide rates of white males, which is basically twice that of blackmails? it's a fact? is that a stereotype? no. what's racist is basically assuming a community cannot handle the same standards as the rest of us and that the biggest threat, in my minds, to blacks are not gangs, but white liberals who duke everybody into excusing deadly behavior. those are statics. the same stat it tick did sit ticks about suicide among white male -- it's just a number. it's a number can't be racist. a fact cannot be racist. >> i actually thought geraldo did a disservice to the african-american community because some i talked to agreed with what bill o'reilly had to say. they thought he made a great point. dana, i want to ask you about the tone and the messaging of this. your area of expertise.

another person i talked to said that they thought he was a little bit too angry in the tone. and the message could have had a caveat with it, which is what we talked about here. maybe he should have said, you can't say all blacks. there are blacks that agree with bill o'reilly that are responsible, that don't like the behavior of some in the communities, like all whites aren't the same. >> that's true. i think any time that you are speaking about something with passion, there is a fine line where some people might see absolutely that's how i feel because they feel that frustration building up in them and also if you feel like you can't say something because somebody then won't like you or somebody on talk radio will make fun of you later, and you hold back and somebody else says it on your behalf, you kind of cheer for them. however, there is another part of that which is if you're part of the audience, here is a strong message like that and gets offended, then what bill o'reilly did, which is talking about president obama, sometimes president obama has passion.

other times he's so dispassionate. there is kind of no middle ground with him. but bill o'reilly, i think the reason that talk points memo was so effective and packed such a punch is that came straight from the heart. i think he was frustrated because people haven't been willing to talk about these issues and deal with them appropriately. and effectively. >> first of all, i agree there was a lot of passion. but passion based on an -- have you been out on the million man march? >> i've been there. >> louis farrakhan organized them. there are a lot of black fathers not living in the bronks that bill knows. >> we're dealing with facts. there is a higher number of issues going on in a community than others. like i said about suicide in whites. >> i don't expect to you understand this, bob, and frankly don't agree with a lot of things bill o'reilly said. but dana points something out, they were effective talking points and here is why. i do it. when there is a racism discussion, we have to be very

careful. i'm a white guy on television. i have to make sure i don't say something -- >> you're a tan guy. >> but i can't say something that's perceived as racist. otherwise i'm going to get destroyed by the media. so we have to conservative white guy on tv has to be very careful. what bill did was he stepped out and said, i'm not going to dance around this issue. i'm going to take it full force frontal. >> that was opening -- >> i think the liberal community has done a lot to put you in jeopardy on that, but bill was talking about things that were isolated to his world and that's not the black community. >> no. >> what did he say that was universal about the black community? >> he was saying is that the black community should -- he was very specific. he talked about discipline in the schools, for example, as being something that -- i don't think anyone would disagree with that. >> people have been saying that for years. >> okay. well. >> he's saying it's time to do something about it. >> actually, people have been saying it for years, people --

that's too broad, actually. not enough people have been saying it because of what iraq said. we kind of hold back. >> even if you have a caveat, which i did the other day on the show, i checked twitter and they said, you don't know what it's like. you probably lock your doors when a black man comes up to your car. if it's late at night, i don't care who is coming up to my car, black, white, whatever, i'm going to lock my doors. i'm a woman! it has nothing to do with race. >> there is a way to talk about race and racial differences in a very funny way. i was at the gym watching tmz. they had their whole group of guys there, black, white, female and they were talking about how when somebody drives by and does something bad to you when you're driving and then you're going to drive up and you're about to yell at them and go, oh, he's black, never mind. the black guy is telling the story and everybody is laughing. when there is honesty about race, a lot of this crap goes out window and that's hopefully one day we'll be headed that way. i think it happens in law enforcement, military when you have a lot of people together of

>> sad news f you're a fan of the simpsons or anger management or drew carey show, co-creator sam simon has just been diagnosed with colon cancer. doctors say he has about six months to live. royalties generated from his show generates tens of millions of dollars a year to him and instead of giving it away, he says he's giving it all to charity and he made this statement, which i thought was so telling. he said, i don't think the spirit of hollywood is such a spirit of generosity. i think people really begrudge giving. in new york, it's like. a lot of charities spend million dollars on a fund-raiser to make $15,000. i've been to one of those. the social swirl, they do great stuff and then it's called mission drift t. becomes more about the parties. this is a very, very generous thing for him to do a and a very, very special thing. >> i call those -- it's like a progressive dinner party without the progress. he's an amazingly talented
