very best craft beers on the market. first, the growing controversy surrounding the white house as president obama today continues to slam the recent waves of scandals dogging his administration as, quote, phony, and distractions. molly henneberg live in washington. what scandals is the president talking about specifically? >> we really don't know. president obama has not been clear on that point. but he and his spokesperson stated repeatedly this week what they think the problem is in washington. >> over the past couple of years in particular, washington has taken its eye off the ball, an endless parade of drinkses and political posturing and phony scandals shift focus from what needs to be done. the point is with an endless distraction of political posturing and phony scandals and lord knows what, washington teams taking its eye off the

ball. that needs to stop. >> some phony scandals that have captured the attention of many here in washington. take scandals or things like that. we have to keep focused on the north star here, the issues that the american people want us to be focused on. >> jay carney was pressed about whether the president believes the irs scandal, for example, is phony. carney says the president believes the irs targeting activity was, quote, inappropriate, and he took steps to stop it. but carney says republicans now are trying to turn it into a bigger issue than it is. >> arthel: so speaking of republican, what are they saying in response? >> they aren't buying the obama administration's argument that these scandals are phony. the gop points to the benghazi attack, the irs going after conservative and tea party groups, the nsa surveillance program, and the justice department targeting journalists. and on benghazi, one republican congressman said lawmakers are not giving up. >> the administration continues to stonewall and that's why this is a scandal. they started by not telling the

truth and now they won't even let us have access to those who might tell us what really happened. >> republicans say the president pivoted to economic speeches this week to try to divert attention from these scandals. arthel? >> arthel: molly henneberg, thank you very much for that report. house speaker john boehner describing president obama's decision to address these scandals in what was supposed to be a speech about the economy as, quote, unacceptable. so does the speaker have a point? we'll debate it later in this hour. fox news alert. dozens of people reportedly killed in egypt after new clashes between security forces and supporters of the former president mohammed morsi who was ousted from power. massive crowds in cairo continue to swarm the area around tahrir square. this week has clashes marking the deadliest wave of violence hitting the country. conner powell has more from jerusalem. >> there is a real tense that this could be a bloody and

violent weekend in cairo as the top egyptian commander called on his supporters to take to the streets to, quote, give him a mandate to fight terrorism. his statement was widely understood as a threat to crack down on the muslim brotherhood which continues to protest the military coup that removed former president mohammed morsi from power. in total, more than 100 people have been killed in post-coup clashes. the obama administration has largely stayed silent on the military coup. but has called for former president morsi to be released and for a quick transition to a civilian-led democracy. despite u.s. law, the white house continues to provide financial aid to egypt, which overwhelmingly goes to the egyptian military. in the hope that egypt can move past its recent political upheaval, it's rapidly fading. >> thanks very much. here is how the situation in egypt has gotten so bad up to

this point. over three weeks ago, the military stepped in after days of massive protests and they ousted president morsi. nearly every day since then, his supporters have held rallies around the capitol city demanding he be reinstated. the new military backed government now taking the first steps of legal action against morsi launching an investigation into allegations of espionage and murder. at the same time, the government calling for an end to the protest, telling his supporters to go home, promising they won't be pursued or arrested. >> arthel: a fox news alert out of indianapolis at a deadly bus crash there. three people are dead and many more injured after a bus overturned near interstate 465. you're looking at live pictures from the scene there. over 40 passengers, mainly teen-agers from colonial hill baptist church were returning from camp. the victims are being transported to area hospitals

and the highway has been closed. highway 465, so that crews can clean up the diesel pouring out of the bus. new developments in the deadly train crash in spain this week. the driver of that train taken to a police station from a hospital. he is now being suspected of negligent homicide. almost 80 people were killed when the train derailed and smashed into a security wall. the country's railway agency saying that it was the driver's responsibility to slow that train down before hitting the curb where the accident took place, but it remains unclear whether the brakes failed or whether they were ever used at all. >> arthel: it was 60 years ago today the korean war ended with an armistice. north korean leader marking the anniversary at a new military museum where a seized u.s. warship was unveiled. the usspueblo has been held in the country for more than four decades. meanwhile, president obama honoring those who served in the war at the korean war veterans

memorial. elizabeth prann has this report from washington. >> it's been six decades, but the memories of war for so many veterans and prisoners of war are still fresh. president obama mark the 60th anniversary of the korean war in washington today. wreath laying marks the anniversary of the end of the war which at one point involved more than 20 countries. honoring the veterans and the approximate 2.5 million people who lost their lives, about 36,000 of them, were americans. >> we can say with confidence that war was no tie. korea was a victory. when 50 million south koreans live in freedom, a vibrant democracy, one of the world's most dynamic economies in stark contrast to the repression and poverty of the north, that is a victory and that is your legacy. >> a formal peace treaty was never signed. korean peninsula is in a technical state of war in a

stalemate along the 38th parallel. troops remain on the divided line. the u.s. continues its presence in the region. >> we remain committed to helping insure peace and stability in the korean peninsula. more than 28,000 american soldiers, sailors, airmen and marines serve in korea today. >> south korea remains a close ally to the u.s. the president says the partnership remains a, quote, bedrock of stability throughout the pacific region. arthel, back to you. >> arthel: elizabeth prann, thanks. reporting from washington. the fate of the army private accused of leaking scores of u.s. secrets through the whistle blower web site wikileaks is in the hands of a military judge this hour. private first class bradley manning is charged with aiding the enemy for allegedly leaking some 700,000 classified military and diplomatic tables. prosecutors say manning is a

traitor who acted with, quote, general evil intent. but his lawyers have argued that he is a naive whistle blower who had no idea the leaked material would end up in the hands of al-qaeda and osama bin laden. the judge says she'll give a day's public notice before announcing her decision. coming up later in this hour action we'll have a closer look at this case and discuss what impact it will have moving forward. now developments in america's pursuit of edward snowden. the u.s. and russia now in talks over the nsa leaker and although the nature of those talks is unclear, snowden has been holed out at the moscow airport for about a month, as he evades espionage charges here in the u.s. attorney general assured russia that he will not face the death penalty. >> arthel: thousands taking to the streets in germany protesting the nsa's alleged

surveillance of internet users. the demonstration is in response to calls from a loose network known as hash tag stop watching us. some protesters holding signs in support of nsa leaker edward snowden. germany's chancellor also raising questions about the issue, but opposition parties are skeptical of the german government's claim that it knew nothing of the surveillance. violent end to a hostage situation in south florida. police responding to calls of shots fired at an apartment complex to find the gunman holding two people against their will. investigators say crisis team established communication with the suspect, but that the talks, quote, fell apart. dominic live from our west coast bureau with more. dominic? >> police say this is, quote, an irrational and inexplicable behavior by a gunman they know very little about.

43-year-old man started a fire last night. this is in the high i can't leah suburb. the building managers rushed to see what was going on and he more thanked from his fourth floor apartment with what witnesses say looked like a .9 millimeter pistol and shot them dead. the pair were an elderly married couple living in the complex. >> i heard about 15 to 20 shots. i went outside and my neighbors were screaming that my parents had been shot. my mom was dead. my mom and dad. she was shot and my dad still had a pulse. >> he went into a rampage while running through the complex. police say it was a random shooting around the block is how they described it and he also fired into the street. similargas killed one man, a young father who was parking his car. he then made his way to the second floor and shot at another elderly couple and also a 17-year-old girl there. >> the fact is when we found him, in the investigation he

still had plenty of live rounds of ammunition left with him. had we not cornered him, had we not acted quickly and decisively, and then entered and engaged him, this could have been a much greater tragedy. >> he took two other people hostage and a swat team moved in. they tried for around three hours to negotiate with him and when he stopped cooperating, the swat team stormed the apartment in the early hours and in a hail of bullets, similar vargas was killed. he had no history of complaints about him and from what they've learned so far, he was a quiet man who just lived there with his mother. only recently moved back to you. >> dominic, quite a story from our west coast news room. thank you >> arthel: a powerful storm rock new mexico. heavy rain and strong winds causing major flooding, as well

as power outages in the albuquerque area. flood watches remain in effect for parts of the state as more rain expected across the southwest this weekend. meteorologist janis dean live with more. hi, janis. >> hi. unfortunately, the four corners seeing more flooding rainfall not only today, but through the workweek. this is quote, unquote, marathon soon season, a seasonal shift in winds that brings the moisture from the pacific and you can see some of these showers and thunderstorms starting to erupt across the area. we have flood watches and warnings for the four corners, through parts of nevada and california as well. looking at the potential for half an inch of rain, even to an inch of rain and this desert area, it doesn't take much to flood. so taking a look at your satellite radar imry over the next several days, still looking at the potential for showers and thunderstorms. and unfortunately, some heavy rainfall. speaking of which, we have a cold front that's moving across the eastern seaboard that's bring flooding rainfall across

the carolinas. we've seen close to a foot of rain in just a matter of hours here. very powerful cold front interacting with moisture off the atlantic. we're going to continue to see the threat for flooding rainfall, as well as maybe some powerful storms, including large hail and damaging winds. how powerful a cold front are you asking? look at this. 62 in chicago in august! 62 in minneapolis. we're talking about temperatures 20 degrees below average here. 72 in cleveland. even in new york city, 77. a week ago we were talking about temperatures feeling like 100 degrees. and in the tropics, remember tropical storm dorian? well, dorian is no more. fizzled out over the last couple of hours. we'll still monitor it, but it doesn't look like it will affect the u.s. we are, however, watching tropical storm flossy in the pacific that is making a bee line towards hawaii. we think on monday, hawaii could be dealing with heavy rainfall, as well as gusty winds. so we're going to continue to

from a sand dune returning home from rehabilitation. nathan was buried in the dune for more than three hours in indiana. and former congresswoman from louisiana has died. she fought for civil rights for nearly 18 years in congress. she was 97. >> rick: with a major budgets showdown looming in washington, again, fox news is learning president obama is heading to capitol hill this week to huddle with house democrats. that will happen on wednesday. all of this as the president and the gop continue to spar over the sluggish economy. >> an endless parade of distractions and political posturing and phony scandals can't get in the way of what we need to do. >> president pivoted this week to jobs as he has been known to do on occasion. under the president's leadership, our country has fallen into the new normal of slow growth, high unemployment, and stagnant wages. i think it's unacceptable.

is finally going to huddle with the democratic members of congress. i think he hasn't done this enough. he really needs to be in there calling better plays so we can finally put some more points up on the board because there is no wonder that the american people overwhelmingly want to throw the baby out with the bath water when it comes to this congress. they want to replace all of them. if only that was an option in 2014, but it's not. the president wants to say he has been saying since 2005, it is about jobs. it is about access to an affordable education. it is about access to being able to buy your own home, have money in your retirement, and health care. these republicans have been stagnant. >> rick: that's all fine and good. but i want to just get dee dee's take on the whole idea of the labeling of the irs stuff, the benghazi stuff. you name it. other things as well, as being quote, unquote, phony. doesn't that sort of dismiss and show disrespect towards people

who are actually affected by these things? >> rick, i do think so. i'm surprised because obama is usually very good at messaging, but this is bad. why would you say phony and scandal at all? i don't think it's a good idea for him to double down and say that. so i think it's strange anyway. but with the nsa and with benghazi and what about brian terry's mother? what about the four dead americans and their families? i think it's upsetting and disrespectful for him to be saying that it's phony when these things really did happen. there is no doubt -- >> to the middle class that has not seen an increase in wages -- >> that's a separate -- >> no, no, no. with the irs, he took specific action to make sure that that will never happen again. they're holding people accountable. but john boehner and the rest of the republicans in congress, they are searching, darrell issa is searching for some connection to the white house that doesn't exist. it doesn't exist. >> it's there.

action you had republicans who actually hurt our fragile recovery. we can't have that happen again. so he said needs to get in there. go meet with them in congress. >> rick: howle are republicans going to be to sit down with this administration, with democrats in congress and work out some kind of a budget deal and figure out how to get our country going again? >> saying the phony scandals, it sounds juvenile and it doesn't help anything. it certainly doesn't help trying to bring everybody to the table in goodwill. now, obviously you've got problems on both sides, republicans and democrats, right now in washington. but to talk about the phony scandal, make a big deal about it and think it's funny, that is very bad. >> what about the republicans saying they're going to shut down the government unless obama administration i am is defunded. some senate republicans said that's outrageous. >> i don't have a problem. maybe the government should be shut down. >> really? >> perhaps. nothing is getting done now. let's see what happens. if it does get shut down, maybe americans will see how bad it is

>> rick: a tragic accidents on new york's hudson river. a boat carrying six people crashing into a construction barge sending two of them into the water. a woman who was set to get married just two weeks from now and her fiance's best man, are missing. police say they have found a body near the scene and now they're trying to identify that

body. the driver of the boat has just been charged with vehicular manslaughter. now the details on this. >> yeah. female body was recovered in the hudson river around 1:00 p.m. that fits the description of 30-year-old lindsey stewart, a bride to be. the medical examiner has yet to confirm the identity. police have just charged the driver of the boat that crashed friday night carrying six people, including stewart and her fiance. 35-year-old joe joe, faces one counts of vehicular manslaughter in the first degree and three counts of vehicular assault in the second degree. police believe john was intoxicated while operating the 19-foot boat traveling from peer months, new york to terry town when it crashed south of the bridge, 25 miles north of manhattan. the future bride and groom were two of the six people on board the boat that crashed into the side of a construction bathroom. severely wrecking the vessel.

the impact ejecting stewart and her fiance's best man, 30-year-old mark lenin, into the water and injuring the four others who who were taken to new york hospitals. lenin is still missing. >> at this hour, it's less and less likely that this would be a rescue as opposed to recovery. we have done a lot of searching both with air assets and with marine units throughout the course of the day and we have not found anything other than the body of the woman we reported earlier. >> police have suspended the search for today and will resume again tomorrow morning. rick? >> rick: brian, thanks so much. >> arthel: very sad. we turn to the economy now. new numbers suggesting a disconnect between consumption and employment. orders for big ticket items rising more than expected last month. but those numbers don't seem to be translating into more jobs. even so, a new poll shows more people believe now is a good

time to find a quality job compared to two years ago. helping us sort all of this out is david nelson, the news max anchor and chief strategist at bell pont asset management. good to see you. david, let's start here and talk about why the equation is not adding up, because there is a disconnect here, you're saying. let's start with the durable goods, the big ticket items. >> when you look at the durable goods numbers, the headline number was very good, 4.2%. but when you strip out things like transportation and particular aircraft, the numbers get a little bit not as attractive. for example, a company like boeing, they have orders going on 20 years. they're blowing out the numbers. but 20 years is a long time. it's not going to translate into jobs right here, right now. >> arthel: immediately. right. you say that you believe that the middle class is shrinking basically because of the types of jobs that are available? >> we've had an explosion of part-time employment in this nation and the blame is put on

companies. but you have to understand, companies, their job is to make profits. it's not to keep employment at a certain level. and frankly, there are so many incentives right now for companies not to hire that it's really amazing the numbers are as good as they are. >> arthel: we're going to get into what you think the incentives are to not hire momentarily, but i want to go here for a second. i get it that a lot of jobs were forced to start lowering salaries. but do you think that some of these companies are like hey, guess what? i used to have five people in this department, i'm getting this job done with two people. so now they are new normal. so they're sort of using that -- >> they are lean, mean, fighting machines. >> arthel: but they could afford perhaps to broaden the -- >> their job is not to be benevolent. it's to make money. you need to make it more attractive to bring the capital from oversea, change the tax structure, bring the money home and maybe you could have more full time employment.

>> arthel: you talk about some of the particulars in terms of why some of these companies might be skittish about hiring and you say that obamacare is perhaps one of those reasons. explain to us. >> the affordable care act, it's been so confusing and now you've moved the employer mandate out to 2015. a lot of companies, especially smaller companies, they're holding back and they want to keep their employment levels below certain mandates because they're concerned about obamacare and they're concerned about the cost. that confusion holds back the economy. that's just one item. the other item as i said earlier was tax structure. tort taxes in -- corporate taxes are way too high. it force companies to keep their money overseas. we have more than a trillion dollars overseas. that money is never coming back and eventually that money will be used for operating capital to start factories and provide jobs outside of this country. >> arthel: we hear you say that and folks at home are going -- >> it's true. >> arthel: no, no. let me finish.

i'm not saying that you're wrong. what i'm saying is folks at home are listening to that saying if that's the case, just change the tax structure. make it more attractive for these companies to have their headquarters here, bring the jobs back home. >> that's certainly a place to start. and both sides of the aisle say that they want to reform the tax code, but nothing gets done. there is 76,000 pages in the current tax code. even president obama in his speech out in the midwest, he said he wants to broaden the base and flatten the tax. it almost sounds like a republican saying that. >> arthel: if it makes sense, that's what really counts. doesn't matter if it's democrat or republican. i tell you what, if you were coming to me for a job, as dapper as you look, you got the position. i'm just saying. >> thank you. >> arthel: david nelson, thank you very much. >> thank you. >> rick: nicely done. coming up, a heroic war horse is remembered 60 years after the korean war ends. her new statue straight ahead.

leaking because he was leaking it to a web site. what do you make of that? >> well, i think she's being unfairly criticized, frankly. the question before her was should this charge be dismissed and the charge was based on the presumption, on the idea that when he leaked these documents, he knew, he had to know that they would be seen and be available to the data mined by called. and the question here, as you know, rick, is not whether that was his purpose. i'm not saying nor was anybody saying that in doing so his purpose was to aid the enemy of the united states. but under the law, under the civil law, under the criminal law and certainly under the military law, if you know that your actions will have a certain consequence, then you're responsible. that's criminal intent. even if you say, oh, look, i was driving the car straight at you

and i knew i would hit you and it would hurt you, but really that wasn't my purpose. i was just trying to get to the store. that's no defense. so i think on the law, her decision was right. >> rick: but that's basically the sort -- the naive defense, is what his team is arguing here, that he was a naive whistle blower. now we're seeing this, of course, against the backdrop of the ed snowden saga that continues to play out. one person's heroic whistle blowerrer is another person's spy or someone who has been aiding the enemy. it's sort of in the eyes of the beholder. is that the way it works with the law, too, or is it more clear cut? >> well, i think whatever his subjective desires, okay, whatever his subjective purpose, what the law asks and what you got to ask 'cause we can't have a different standard and say, oh, you're naive, so you can do whatever you want. the law asks is, did you know

when you did this what the consequences would be? he's not claiming that he was completely unaware. this is a trained intelligence officer. he's not saying oh, i didn't realize what these materials were. he knew exactly, as far as we can tell, what he was doing. he knew what the materials were. he knew what wikileaks would do with them. so to say oh, i was just naive, i don't understand, frankly, and i've taught law my whole adult life, i don't understand what naive has to do with it. perhaps at the sentencing stage it would be relevant to take into account issues like i really didn't intend to hurt the country and i was mistaken or misbegotten. but in terms of liability, you can't have a rule that says somehow you're off the hook on the naive.

>> fox urgent. members of a church group, most of them teenager on a bus returning from camp caught in a crash outside of indianapolis. the bus was carrying 40 passengers. a concombreigation from colonial hill baptist church and three people have died in this. these are pshths coming in to fox news. at least 26 others hospitalized at this hour. this happen a short timing on. this is interstate 465 outside of indy. there is the bus on its side. survivors were taken to the hospital and some air lifted. witnesses say the bus came
