election commission in cases involving conservative groups. is the white house keeping this up because they are afraid that more will keep coming out. to our panel, i do want to thank my buddy charles payne for filling in. i was really told i could take off a couple more weeks. [ laughter ] >> neil: i got back here as fast as my little hieny could. let me take apart what the president is picking apart here. he is saying phony, sham, but at the same time we're getting more and more data and info and stuff that comes out. >> it's quite the opposite. some of us were on planning a family vacation in africa and some of us didn't see all the things. what it means the initial policy the president gave was

insincere. it sorts of belittles all the victims of the phony scandals which in some part is almost every american. he won't acknowledge it. it's all about this. that is wrong path he is going down. he should have more of an honest discussion about thi >> ben? >> it reminds me of ron zieg ler calling watergate a third rated burglary. obviously some systematic harassment on. he can call it phony as much as he want. the news organizations will cover up for his nieny and full scope of things will come out. >> neil: i want to give you another related scandal in the case of benghazi, now cnn are doing that. dagen, what do you make of this and obviously part of it has to be based on the idea

that the irs is going to assume a far great are role. so it's in the interests to say the scandal is phony because then you are saying gig more power to the irs would a sham? >> absolutely. part of what was going on here is that the white house was using the federal election commission to target a specific conservative group, it was the american issues project. now, we find out the federal election commission and people there were in touch with the woman at irs overseeing the targeting of conservatives in that agency. not only does it smell bad at the irs, that stench is moving from one government organization to another. again, how do you fight it off? you say, you talk down to people and belittle and say there is nothing here. let me be clear -- as the president says.

sit working? no, it is not. >> neil: and when this first erupted this was serious and president will get to the bottom of this. >> i think it's the scary thing is the media reaction. they actually do follow him. i was a kid when water gated broke, then it was everybody was in on this county. >> that was a republican president? >> right. i say that is scary part. this does underscore the media bias as known as mainstream media. there are other outlets. in the old days there were just a couple. mainstream media holds a lot of sway. every tv network, most tv networks in america get their talking points from the "new york times," from the "washington post" and established players. that is the one of the problems with the story. it's hard to pick up steam when the establishment won't

go after the president over something that is really sleazy. you set the precedent that this president can get away with it, other presidents can get away with it. that is why it is hioshlg. >> neil: julie, if you will pipe down. [ laughter ] >> i'med by meig time. >> neil: do you think the irs thing is, indeed, a scandal or very least the revelations that are coming to light appear scandalous? >> i think what happened at the irs is a scandal. i have no evidence that it reached up to the white house or barack obama anybody in his inner circle. i think they are jumping to conclusions about any evidence is presented. no, you are right. i think fox news has done a good job of looking at it but no evidence whatsoever emanated from the white house. >> neil: you think its scandal there was enough going on in the irs that went

[ laughter ] >> i really do to the point i said many times..., no, but on this very network it's an independent prosecutor, darrell issa can take a break. the other issue that i think people are missing and issue i think people need to focus on. both democrats and republicans completely abuse the irs tax code, nonprofit or other things. >> here is the scary thing. i read a lot of books about water gated. woodward and bernstein thought about the president being involved with that from the beginning. they put a couple things together. this reeks of overreach.

possible issues, irs is going to be entrusted with this healthcare law, enforcing it, policing it, handing 90 financial parts of it. obviously the administration, democrats in general supporting the healthcare law will not want to see the irs dragged through the mud because it is going to slow that process down and slow implementing the irs controlling it. they have a vested interest not to pursue this. >> billions and billions of dollars are going into building of army at the irs that will go after individuals and small businesses. small amount of credibility they have. the guy in charge of irs, he is not interested. >> excluding obamacare and increase power of the agency. i'm worried about abuse within w an organization that can ruin someone's life financially and otherwise. that is the power that the irs has. the fact there is this going on, we need some answers.

i would be afraid, i know some of them. that was the problem here. >> you have a bunch of airports, san francisco, they privatized and outsourced. they are doing exactly on average the private ones as exactly the same as tsa ones. it's the same thing. >> i know the bottom line, you go to the post office and you see how slow the work is. there is certain mentality that comes along with the notion that you don't want to lose your job. >> my experience with tsa is not that with the postal service. >> i love the postal service. >> neil: you are a celebrity. love on all sides. so when you show up at a line, "a" they bring you to the front and "b" you are universe lal li a star.
