us. let not your heart be troubled. greta van susteren is standing by live to go "on the record." thanks for being with us this evening. greta, take it away. tonight, it is day number one of a five-week vacation. >> this is an administration which has done everything to distance itself from everything that's happened that's gone wrong in this country. >> what's going on in the country, and that includes the president, this is not a good time to be taking vaitation. you lead by example, and vacation is not what this country wants to do right now. >> president obama is going next week to martha's vineyard and the house and senate take their recess. many say they will do constituent work, i believe they are, but in terms of prioritizing they have done alousing job with the national finances, and they are all going away without doing their jobs first? >> i agree with you, and if you recall four years ago we were going through a very similar thing with the whole health care situation and they went home, and the american people rose up.

>> you have awakened the sleeping giant. >> this is not a federal government issue! this is a people issue! >> stay out of my business! stay out of my health care! >> the whole bill needs to be started over and concentrate on those things that are not going to cost anything. >> in terms of the president's activities for august, his calendar still coming together for that month. unlike congress, the president will be at work for most of the month. >> sooner or later it will stop, and it really will and them going away for vacation. if they went away for three or four years and took the president with them, i think i might like that. >> we have a president who after four and a half years still isn't accountable, still is on the campaign trail and still trying to make people think that nothing that happened is his fault, that nothing has happened he's had anything to do with. >> is this a good time for congress to slip away from washington and take a five-week vacation and what about the president jetting off to martha's vineyard? is this a good time for him to do that?

we asked donald trump. donald, nice to talk to you. >> hi, greta. >> okay, donald. any thoughts on congress taking a five-week vacation? >> well, with what's going on in the country, and that includes the president, this is not a good time to be taking vacation. you lead by example and vacation is not what this country wants to see right now. you have a debt ceiling coming up, lots of other things happening. the country is a mess. we have 17 trillion now in debt which is hard to believe but 17 trillion. this is not a good time to be taking a vacation. >> i did a little research which i also posted on greta wire. the reason they are taking a five-week vacation goes back to 1791, and that's pause it was so hot in washington in august. it was very tough on the legislatures, but i should point out they have had air conditioning in the u.s. capitol since about 1950, so the reason why they are taking a vacation dates back to 1791. what do you think about that? >> well, it's amazing how great

air conditioning systems work today. i'm installing a big one in doral, and they really do work well. that's no longer an excuse though, i don't know, this is the problem. when they use an excuse like that we have problems. >> indeed we do. the continuing resolution is set to expire on the last day of september. that's very important to the government, the economy, so they are not going to be around for five weeks to make a decision so there's a lot of pressure in september. would a make a difference to you if they did their work sooner rather than later as a business person job creator? >> it makes a big difference because we go back to the word certainty. so little certainty in this country. don't know what's going to happen with the debt ceiling. is it going to be a war again or easily approved? we think it's probably not going to be easily approved but will it be approved. you really have to get to work on this stuff.

it's plex, a huge negotiation and many of the people we've talked about have never negotiated before. haven't been in private business. don't know what it is to make a payroll or look at a balance sheet and frankly for them to be going away right now sets such a pad example for the country and even the world to watch. >> why do you think they do it? if i were in congress and saw the state of the country and knew i had the death ceiling looming, continuing resolution soon to expire, that i would have to start on an important issue like immigration, talk about the tax code and all i do is put more specialties into it for my buddies. at some point wouldn't you think doing your job comes first. i don't care if they take the whole year off but do your job first. >> the president has to lead. you have a man at the top that's going to be the leader and he has to call everybody together and say come on, let's not leave. let's all sit together. come to the white house. come to wherever you want to come and let's get together and

make a deal. >> but there doesn't seem to be that kind of talk. a lot of people want deals and they are so divergent and different and you have non-deal-makers trying to make a very complicated deal and actually if you lock at it it's not so complicated. pretty obvious what has to be done. you're dealing with non-deal-makers. you have to have great leadership, and if the leadership isn't going to come to fore it's going to be a big problem and come later on, september 30th, you could have a real disaster in this country. >> i suspect supporters of the president would say is every president does it. every president takes time off. how can you complain now if it's just not your guy? >> well, they do and some don't. we've had some very, very hard working presidents and some legendary for not having worked so hard but in this case we really need leadership. we've never been in a position

where we owe $17 trillion, a lot of it to the chinese, by the way, $17 trillion, never been in that position. this country has such incredible potential and economic potential. and by the way, you mention the word economics, and you mentioned financial. that's good in terms of social security, in terms of medicare and medicaid. we need wealth to take care of people. i mean it's not a bad word. wealth is not a bad word. need it to take care of people but you need somebody who knows what he or she is doing. you're going to iowa this weekend and so is someone -- i think maybe senator rand paul and maybe senator ted cruz. every time we see people going to iowa we in the media become suspicious that there's 2016 on your mind. is that one of the reasons you're going to iowa.

>> the reason is bob vanderplatz, the leader there as far as that is concerned and a great one is a friend of mine and asked me if i would go and i said yes, and a lot of people are reading a lot of things into that and i will say this in a very braggadocios manner, tickets are going through the roof. are you surprised by that? >> i'm never surprised. i know about "the apprentice" so none of that surprises me and i've been to your office so that doesn't surprise me. what doesn't surprise me is i can't get a read of whether you truly have an interesting interest in 2016 or whether you like to make us crazy in the media and just tees us. >> i have an interest in the country ant country is doing poorly. it's disguysed a little bit because the stock market is up and other things are up but we have a real unemployment rate of 15%, 16%, you know that, i know that, not 7.4%. >> could you change that as president? if donald trump were president,

tell me -- >> you have to put people back to work. >> you have to stop foreign countries from making all our goods and products through manipulation of their currencies. that's how they are making it. we make better product than china. mick a much better when they manipulate their currency it makes it impossible for us to buy in our own country people are not going to be working so you have a vast unemployment rate and we need to put these people back to work. we need to get foreign countries to stop outsmarting our politicians which is what they were doing. >> had you been president the last go round you would have done a better job than president obama. are you saying that? i see that as an intercation of whether or not you'd be a good president in 2016. if i decided to run, i'd back mitt romney. i was leading in all the polls. if i decided to run and i had won we'd be in a lot better shape and i wouldn't be on vacation. >> speaking of being in better shape. a-rod, the news tonight he's been suspended for the remainder

of this season and next season. your thoughts about that? >> i think it's great. he's been taking this stuff all of his life and when he stopped taking it he became a lousy baseball player or certainly just less than average. i think it's great and sets an example and not very popular in new york. lived in one of my buildings, derek jeter, and many of the yankees. many of the players played in my building and i can tell the ones that people like and the ones they don't like. if i say to the doorman, what do you think of derek? oh, we like derek, and if i say what do you think of a-rod? they say forget about. i don't understand the yankees. they should have stopped paying him two years ago because the contract of what they signed is not what they were bargaining for so i don't understand why the yankees kept paying him but maybe they are very generous, who knows. >> very random. should pete rose be in the hall

take the same heat during this year's summer vacation. freedom works president matt kibbe joins us. nice to see you, matt. >> hey, greta. >> that was 2009 and now you're calling for more town halls this summer. why in the world would any member of congress venture out if they are going to take that kind of heat? >> one of their first responsibilities as representatives of the people. it's their job to go back home in august. it used to be a de facto american right to get to look your paid representative in the eye and say this is what i think. it used to be sort of a norman rockwell thing to do. now they don't do it anymore. they are hiding. they don't put the schedule online. they don't tell people what's going to go on. sometimes they do teletown halls where they manipulate who gets to talk and who doesn't so we figure the only way to get these town hall meetings, this de facto right of every american, is for citizens to crowd source it, demand it and to share that information with everybody else

because one way or another the shareholders should get a chance to speak to the ceos. >> is it fair though to expect -- like one thing, you know, passion and really want to talk to your member of congress or your senator and communicate how you feel very strongly and another thing to sort of throw verbal, you know, bombs at them and to scream at them. i mean, is there some way to sort of put the lid on so constituents, american citizens can that v that passionate debate without basically trashing the member of congress? >> yeah, i think that's the best way to do it. if you get up to the microphone be assertive and let the congressman respond. i think the great thing about what we saw in 2009 was that frustration in the process by which congress was trying to jam something through without hearing from the american people, and now all of those theoretical arguments about obama care are real and visceral. people are starting to run the numbers. they are starting to see that congress and the obama

administration are trying to exempt the insiders at the expense of us, and you're going to have this fight coming out in september and october, and i do think the american people deserve a right to talk to their members of congress. >> all right. how many so far, members of congress do you know who are going out there and will hold town halls and speak to their constituents during this five weeks? >> so we've set up a website demandatownhall.com, and it's just getting started now. folks are calling their representatives, and we have about 26 events posted there right now which is kind of pathetic. i think that all members of congress really need to be held accountable, and we're asking activists if your member won't show up, we're going to hold a town hall without them, and that's already happening in states like texas and south carolina, but the frustration is only going to build if the american people don't get a voice in this process. >> but do you -- do you actually know of any members of congress right now, house or senate, who have said, yes, i'm going to

have a town hall, i'm going to speak to my constituents during this five-week period, i'm going to do face-to-face? >> absolutely. they are posted on our website. mike lee in utah is hosting a whole series of them, and i find it interesting. the folks that so far have agreed to hold town halls, have agreed to make them public, have agreed to let everybody show up and express their opinion are the folks that are standing by principle and comfortable with the positions that they ran on, the positions they are voting on today and what they are doing to represent their constituents. >> you know, a lot of them say that the reason that they want this five-week recess is so that they can reach out to their constituents which isn't a bad idea. i think they should do their work back here in washington and afterwards they can go home for the five weeks. i don't care if they take off the whole year if they get their work done, the unfinished business, but i don't see a huge appetite by the members of congress to do this. i think they are a little gun shy after 2009. >> well, they are, andhe

township's monthly meeting. a pocono record reporter was at the time in the building, and he says he saw smoke and plaster flying from the walls, and people were ducking for cover. police have captured the gunman. no word yet on his identity or motive. stay with fox news channel for the latest on this breaking news. >> new evidence tonight that the irs political targeting goes beyond the irs. the new evidence raises suspicions about the president's lawyer bob bauer. why did he e-mail the s.e.c. about a conservative group and the s.e.c. then e-mailed lois lerner at the irs? s.e.c. vice chairman don mccann joins us. >> nice to see you. >> why is the fec in this? >> the fec is in this because there were some fec staff that reached out to the irs in 2008 regarding a few conservative groups and as you know the irs has already come under fire for targeting conservative groups.

this was made public somewhat recently by folks in the house of representatives. >> what business does the fec have going to the irs for information? was this public or private information? >> originally an fec investigator reached out to the irs directly to lois lerner, the person who has come under most fire at irs asking for more information about a group called the american future fund and the request was for information generally, and the irs cannot provide general information. eventually the irs did provide some public information. what is interesting is, first of all, why would an fec investigator be reaching out to the irs without commission approval. the way the fec works -- >> you're on the commission. >> i'm vice chairman currently. the commission needs to approve any sort of investigations so first you have an investigator reaching out to the irs.

second, if her asking for public information, why reach out to lois lerner, to a website or directly to the irs and pull the file and make a photocopy, the sort of thing that you might do. what's interesting is after this initial contact which happened in july of 2008, a mere two business days later, the irs sent a questionnaire to the american future fund. now perhaps this is benign, perhaps it was already in the pipeline. very real questions that the irs needs to answer. the congress has asked both the fec and the irs to produce any communications between the two agencies. i'm glad they have done that to get to the bottom what have could be a new development in the irs debacle. >> well, before it even gets to the fec, what's peculiar, bob bauer, the lawyer in town for democratic politics, on the president's -- now at the white house but before that he was on the president's team for re-election, incidentally is married to anita dunn who can't stand fox news and did a total

campaign against us, full disclosure, but bob bauer contacted the fec about the conservative group and the fec takes that water and carries it over to the irs to lois lerner. >> sort of. >> there's two groups at issue. one is the american future fund which i mentioned and the american issues project. >> the one bob bauer was asking about? >> the presidential campaigns filed a group against them as did a reform group from washington, d.c. they were pretty hot and heavy about an ad that ran at the time of the democratic national convention and claimed the ad was illegal because it was banned political speech and as we know since the citizens united decision struck that ban, much of that complaint went away. >> anything that bob bauer did, i'm going back to obama, anything that bob bauer did that was peculiar as he's making this question q to the fec? >> i don't think there's anything peculiar at the time that he filed a complaint. campaigns file complaints all the time against people they don't like and messages they would rather not have people focus on.

what was a little bit different was the obama campaign also raised the specter of criminal prosecution and claimed that the activity was criminal. kind of a stretch when you deal with first amendment speech to claim it could be criminal. combined with what's happened since, whether it's the president criticizing the citizens united speech in the state of the union address and the massive call for additional disclosure action, the disclose act pushed by the democratic leadership, calling on other agencies to do things about these so-called shadowy groups, the 401-c-4s, starts to look pretty bad when one tried to raise a criminal specter on what's otherwise protected political speech. >> and prior to 2001 i think it was, lois lerner was actually at the fec and then moved over to the irs. >> she was the head of the enforcement division for a little bit at the fec, and -- and that had somewhat of mixed

reviews. the christian coalition had some issues with enforcement cases that the commission tried to bring. the commission went to court against the christian coalition and lost the case rather decisively for the most part. >> think it's safe to say that there's enough there to investigate, to warrant further investigation, right? >> congress needs to continue to do oversight of the fec and irs and need to see where the facts take us at this point. we do have communications between the fec which is not in the ordinary course of the fec's business. it seems odd. seems odd that an investigator would be reaching out to lois lerner directly, and i think congress correctly is asking for documents and hopefully they will do their job. >> we'll see where this goes. >> and we'll see where this takes us. >> mr. vice chairman, thank you. >> thank you. >> coming up, the truth behind the jobs numbers. find out why the white house was not high-fiving with the july news and you'll hear from one frustrated job seeker. that's next, and what is it with politicians tweeting pictures? we'll show you another one.

congress and the president have a lot of nerve. congress passed obama care and president obama signing a law that was supposed to cover everybody. members of congress didn't bother to read the law before they passed it and now they discovered they don't like it. they surely don't want it for themselves or their staff so guess what they did, sneaked behind closed doors and agreed amongst themselves and went to president obama and the president gave them a special exemption from the opm that exempts them from the law that they passed themselves. president obama is not giving you that special exemption. knot now is that fair? the owner of the factory service agency joins us. good evening, sir. >> good evening. what do you think about the fact that congress passed this law and now has -- last friday they

basically got a dole from the president that they will be exempted? what do you think of that? >> frustrating as a small business owner, everything is going to the bureaucrats or big business. as a small business owner nobody is looking out for us. it's very frustrating. keep beating our heads against the wall. trying to repeal the health insurance tax and we don't seem to be making much progress on that and everything that the president seems to do. he just seems to overlook the requirements of the law and, unfortunately, we can't do those kinds of things. >> now you have how many employees, sir? >> we stay around ten employees. >> do you provide health insurance for them? >> we provide health insurance, always have and pay 100% of the premiums for our employees and the changes that keep happening with obama care we sides driving us crazy, we had an indication if we waited to do our annual renewal, our premiums are going

up between 25% and 30% so we've had to compensate by pumping up the re-enrollment rate and we can keep it down to 6% to 7%. between those increases and the health insurance tax putting another $500 on our premiums, it's getting tougher and tougher for us to compete. >> would you like the same exemption that congress just got for itself and its staff members? would that be something you like? >> we would love someone to offer us a subsidy for our health insurance premiums and to help us understand what's going on with the health care bill. that's one of the biggest problems. the national small business association about our mid-year economics survey and a small majority don't understand how the health care bill works and better than a third of the real small businesses have no idea what it's going to take to comply. all of the statistics will be released tomorrow with the survey that we've done but we keep going in circles and the don't seem to get any answers an get no relief. we're not a big company. we're not the unions and we're not the federal government so

there's nobody offering us any kind of dividends or payback to help us pay our premiums. >> well, what's sort of interesting is when the law was passed it was senator chuck grassley that put in a provision that said congress would have to have it for themselves and staff and they didn't like what chuck grassley did and what politico writes they hurried to get the deal with the president on friday because the enrollment starts october 1st, and they are just getting back from vacation, you know, in september, and it wouldn't have time to change, it yet the continuing resolution which affects all of us expires september 30th and they left that one high and dry so they took care of themselves before the rest of us. >> exactly. any other -- and the other big part of the problem, we keep hearing we try to repeal like the health insurance tax on these things. one side of the aisle keeps looking for what the payback is, how we're going to pay for this, and i've yet to hear anybody say when you eliminate all of these congressional staffers and

congressmen themselves not having to pay for their premiums that it's going to be paid by the federal government, where is that payback coming from. we'd like a little equity there and give us some breaks, too. >> sir, thank you very much. and good luck, sir. >> thank you, ma'am, appreciate it. >> now to the real story behind the latest jobs numbers. turns out 65% of job growth in july was for part-time work. so what does that mean for people looking for jobs? griff jenkins first spoke with kevin knight last april. >> reporter: kevin knight moved to washington, d.c. after graduating from hillsdale college two years ago with a degree in politics. while working on his masters at night, he's had seven internships and sent in more than 200 applications. now the real pressure is on for him to find a job. >> if i don't have a job by the end of july, i'll definitely have to move back to michigan. hopefully with my experience in washington it will make me a little bit more of a high-end prospect. >> reporter: how difficult is this job?

>> it's not fun at all. youth unemployment is extremely high, underemployment is ridiculously high. you neath heed to network and meet people. it's not what you know but who you know. >> reporter: did kevin knight find a job? he joins us. >> nice to be here, greta. >> have you found a full-time job? >> no, i haven't. all i was able to find is a part-time job. >> what is that part-time job? >> i currently work at a bar, but back in 2008 economists told us that this would be a jobless recovery, and my experience is showing that that's exactly what we're seeing. when 65% of jobs created last month, according to the study that you just cited are in part-time work, in traditionally low-paying jobs, by the way, you know, is this a new normal? >> i should point out that the a.p., the statistic from the associated press, a.p. reporting 77% of job growth in the whole year so far is part-time so it's

been 77% of all the job growth since january 1. what -- what kind of job do you want? what are you looking for? >> you know, at this point it's sort of dictated by the market, but obviously what i would really ideally lying to this is think tank relate or non-profit work. i have a background in international relations but also in politics, and so something having to do with improving u.s. relations abroad, u.s. job growth domestically and increasing trade overseas which would also lead to increased job growth here in the united states, too. >> since you spoke to griff jenkins my colleague, about how many jobs have you applied for or inquired about? >> since i spoke with griff i sent in 50 more resumes but the only thing i've come up with is this one part-time job. >> what do they say to you, the jobs you qualify for and seems

to be the perfect job for you? what do they say to you? >> typically i don't hear back because they get so many resumes. oftentimes i get a canned response saying thank you for aplimpingt whi aplimpingt. while you have a great resume we've already filled the position. >> what do you think is happening? >> tough to say. when we have the millennial generation being called lazy but yet no generation up to this point has achieved this much academically, the fact of the matter is there's simply no actual job growth to be had. when another study cites that 967,000 jobs were created in the last six months but only 936,000 are part-time jobs, that's 27,000 full-time jobs in the last six months. what are we supposed to do with that? >> i don't know. it's really grim, and you know what i wish, i wish the politicians were back in washington and working on things like the continuing resolution and the debt ceiling just so there's certain for other businesses to know what to do
