touched down. passengers and crew evacuated using emergency slots. a deadly start to the nfl season after a fan falls to his death from a walk way at candlestick park on sunday. it happened after kickoff of the 49ers packers season opener. witnesses say the man appeared to be drunk. in indianapolis a railing collapsed, left two fans hurt during a colts game against the raiders. they were reportedly leaning against a barrier when it gave way. both suffered minor injuries. sunday at the fair turns into a nightmare. people watched in horror when a swing ride suddenly lost power throwing 12 kids right out of their seats. >> i heard this crash, all this metal and all these seats clinking together. >> the chains, seats, everything went swinging around swashing into each other. and everything came to a complete halt. kids were falling out of it. >> most of the kids suffered minor cuts and bruises fortunately.

one eight-year-old boy was hospitalized but is expected to be okay. mechanical failure is being blamed. >> to an update to a story we've been following. the daughter of congress woman bootler getting stronger. it is believed she is the first baby to survive a fatal disease. five months into the pregnancy the couple got the devastating diagnosis, told their baby's lungs and kidneys would not form properly. they got an experimental treatment and it worked. >> we get to play with her, hold her, she is doing everything a preemie her age should be doing. >> abigail's lungs are fine but she will need a kidney transplant and dialysis every day until then. >>brian: cbs was able to go over to syria and sit down with assad, and it

turns out he did not come out say -- of course you know he's running things in syria -- that i did not use chemical weapons on my enemies, the rebels, insurgents. but he did say this is no proof that i used that. then comes this german report that says there might be something to that. >>steve: assad said he didn't have anything to do with the attack, didn't even know that an attack had taken place. what's interesting, though, we haven't heard any of the sound bites yet but charlie rose who did the interview said assad does accept some of the responsibility and expressed remorse for indirectly triggering the gas attack that killed 1,400 people. so mr. assad says, look, i didn't order this out. brian, to your point, apparently the intel community in germany says they have proof that assad did not directly order the hit on the gas. >>gretchen: that doesn't mean that he didn't know about it and it doesn't mean he hasn't done it in the past. i don't think this has been the only time they've used

chemical weapons. >>brian: 12 to 14 times. >>gretchen: are we going to believe assad? not that we need to go over and attack them. i'm not sure that's the answer. but i don't believe assad and whatever he says. he's been killing his own people for years. >>brian: germany's c.i.a., their chief said we did intercept a phone call from a high-ranking member of hezbollah telling the iranian embassy that assad made a huge mistake when he gave the order to use chemicals. that according to dere spiegel who took down that quote. >>steve: i think it is extraordinary they've got crazy leaks over there like we do here where they say the germans were listening. they were in a ship off the med listening to the intercepts from syria. they also said that apparently one of the things that they did pick up is elements of his regime, it sound like. not the rebel groups. were responsible.

according to all these sources and including aed, he says -- including assad he says i wasn't in it. according to germans he wasn't directly in on it. >>gretchen: when you're a dictator, you're in on everything. >>steve: that's the great thing about being a dictator. >>gretchen: it is very easy to say he didn't know about it but somebody probably lost their head as a result of some of this information getting out. >>brian: in syria it is known the military oftentimes has more power than assad. he's an opting monthly gist by -- opthamologist by trade. >>steve: if we have our strikes go through and he has to get out of the dictator business, he'll have something to fall back in, you know, the eye business. >>brian: that's true. lens crafters is always looking for somebody to run a good franchise. -l >>gretchen: are they popular in syria? >>brian: if you can get someone to give contact

lenses that don't irritate the eye and keep the cornea free, you've got something. >>gretchen: i have a sneaking suspicion that if he is no longer ruler of syria he will be no longer with us. there's other stuff to report today including something with hillary clinton. >>steve: let's take a look. president obama federal budget off dinner with republicans sat down with -- president obama fresh off dinner with republicans, now he is going to meet with hillary today. it is the full-court press, isn't it? >> it is indeed. the president continues trying to round up support for a limited strike on libya. at the same time a possible presidential contender expected to offer some help to help the president make his case today. former secretary of state hillary clinton goes to the white house today for a wildlife event. and according to to aides, will comment on syria. she is expected to throw her support behind the president's plan for a limited military attack on syria. she has been criticized for failing to speak out after that gas attack in syria

last month. her appearance and her comments come just a few days before the one-year anniversary of benghazi. >> the thing is this administration won't even react when americans are killed in benghazi. they've done absolutely nothing. and so here's the situation in syria that doesn't involve americans and they want to get involved. to me, they've got it backwards. >> president obama has a busy day taping interviews with the tv networks, including fox. last night he made a surprise appearance at a dinner for republican senators at the residence of vice president joe biden. and according to associated press, ph obama plans to meet with the u.s. -- at the u.s. capitol with senate democrats tomorrow just hours before his speech to the american people from the white house. that speech set for 9:00 p.m. tomorrow night. back to you. >>steve: thank you very much. >>brian: he goes over to the vice president's house, stays for an hour and 20 minutes, has some dinner. he was working the phones yesterday. tuesday a huge speech. he is going all on the

offense. however, if you don't lay the groundwork with a relationship, how can you call on people to back you up when you haven't been this for them? case in point, congressman adam kissenger. >>gretchen: what he claimed is here a form air force veteran who is in favor of the plan. yet he said on this show i reached out to the white house more than a week ago. let's hear what he has to say. >> i think it's going to be very difficult for him to get votes. i think this goes back not just to the issue itself but you can't begin to build a relationship with congress for the first time when you need their support on something like this. look, a week and a half ago my office actually reached out to the white house and said we support the strike on syria. we're going to help you round up support if you need it. i haven't heard back from the white house yet. i haven't heard back from anyone. i don't even know who my white house liaison is. >>gretchen: what i find fascinating about that is this president has been so

masterful at campaigning with his team and getting the message out, getting the votes and reaching out to people, it's fascinating to me that apparently that same strategy doesn't work with working out to members of congress or it's not being employed in the same way. it's fascinating you wouldn't reach out to a republican who is in favor of your strike. >>steve: well because maybe -- and i don't know because i'm not working at the white house currently. you know, what they've really got to worry about is the democrats. in fact, the democrats, this apparently is the leverage they're using right now. unless you democrats vote for your president, his presidency will be crippled. nothing is going to get done. he will be a lame duck immediately. what's interesting, right after that interview on abc, the congressman got a call from the white house, and now they are trying to work together to get more republicans and democrats to vote for a strike in syria. >>brian: they always say dig your well before you're thirsty. he is thinker city but there is no well -- he is

thirsty but there is no dug. the president cannot connect one on one. he is not interested in the past, just the president. if you read bob woodward's book, his personal relationships are less than zero with most of these people who are not bailed out and many of them are out of a job because they backed his stimulus package and they backed his obamacare. >>gretchen: then his staff should be in trouble. if it's a known fact that he's not good at personal relationships, he should have a staff who is. this could be the most pivotal point of his presidency and he doesn't have his staff reach -- i don't care if you're republican, democrat, independent or something else, you should have a member of his staff reaching out to you. >>steve: he's the leader. he's the president -- >>gretchen: if he's not good at it, he should have a staff that is. >>brian: a jim baker, sun who has been there -- someone who has been there in the past and knows how to work. >>steve: you combine that

with the calendar, it looks as if the senate is going to be voting this week. the house maybe as early as next week. look what he's got on the calendar. tonight the season kickoff for monday night football and major league football as well is going to be tonight. they are competing for eyeballs. in new york city there is a big primary tomorrow. plus the new iphone is launching, which believe me, a lot of people are worried about and concerned about because they love technology. >>brian: and the gap has new ripped jeans. the iphone coming out, yom kippur, holidays important. the other thing that comes up too is that they say in the past nobody -- and 9/11 of course on wednesday. they say never rule out anything in august. that if you are interested in getting anything across to the american people, no one is paying attention to august. and even as crass as this may sound, in 2002 when it came to telling the american people the need to act in iraq, they waited until september. >>gretchen: the biggest thing standing in the way

>>brian: big businesses breaking for obamacare taking action to cut costs already and the latest victims? retirees. >>gretchen: i.b.m. announcing it will remove 110 retirees off its health plan. what can these former employees expect? stuart varney joining us now. actually the employer is going to give them like a stipend to buy their own retiree health insurance? >> let's get straight at it here. if you work for i.b.m. right now, you get traditional health insurance health coverage. when you retire from i.b.m., you're going to get not the traditional health coverage. you're going to get a lump sum. you take that money and you spend it as you see fit within a private health care exchange. so i.b.m. is cutting its costs. it knows what its future cost is going to be because it knows what that lump sum is going to be to those employees. >>brian: if you're somebody retiring at 65, 67, 71, you're going to get that number, so you've got to project how much you

should spend every year on a policy of your choosing? >> yes. because of the lump sum that comes to you from i.b.m. or time warner. >>brian: do you like this? it's kind of good because you don't have people competing for your business? >> the old-fashioned way of a company providing pension and insurance for retirees, that's going. that's going, going, virtually gone. that's because of the rising cost of health care. companies cannot predict what they're going to be paying in the future. they want to control those costs. they want predictability and this is one way of doing it. it is neither a good thing nor bad thing. it is reality. >>gretchen: let's look at the trend of this. if you go back in time to 1988, 66% of the companies are offering coverage. then look to 2013. i guess my point to you is going to be this was starting before obamacare or do you blame obamacare? >> this started before obamacare came along but obamacare was supposed to reduce the cost of health care coverage. that was priority number one when we went into this

thing and it failed in that objective. plus obamacare makes these generous company-provided health care plans for retirees. makes them more expensive. it taxes them. that's what you've got to remember. >>brian: another story came out today. the american dream still intact but it's a different dream. we're dreaming about focusing on getting out of debt, not maybe getting the dream house or the dream retirement. >> credit.com does a survey of youngsters. 23% of them, their american dream, for them is being debt-free. now there's a shift. only 18% dream the american dream of owning their own home. that is a switch. seems to me that youngsters, most people have been so burned by debt following the great recession that they now want to be debt-free. that's their priority. don't like it. i'm a traditional guy. buy your own home, own it, use it. that's what i think is the american dream, but it's changing. >>brian: varney and company at 9:20 featuring

>>gretchen: if you're just waking un, quick headlines. forget the n.s.a. british prime minister david cameron leaving his information in public. a passenger snapped a picture of his briefcase filled with official papers on a train. you can see the key still in it. government officials deny a security breach and say a member of the prime minister's staff was watching the whole time. anthony weiner is on the bottom. a new poll shows he's now last in the race for new york city mayor on the democratic side for the primary. maybe that's why his wife has reportedly refused to campaign with him now. >>steve: or could it have to do with that other stuff? during the presidential debate nearly a year ago, the president mocked mitt romney for romney's views about russia.

>> in the 1980's or now calling [inaudible] the foreign policy bank. the cold war has been over for 20 years. >>steve: turns out romney was right. the russian's involvement with that guy right there, edward snowden, iran and syria causing big trouble for america. what else was mitt romney right about during the campaign? and what would the country look like now if mitt romney were the president? joining us is one of mitt romney's former senior advisors, robert o'neal -- or brian that is to say, joins us from l.a. good morning to you, robert. >> good morning. >> let's start with syria. it looks like mitt romney was right about syria, wasn't he? >> well, it's a little iron i can now that joe biden was running around the campaign trail saying that mitt romney was going to get us into a war with syria. so it's, you know, it's a little funny, looking back

on that now. a little sad as well. early on in the crisis when the obama administration was casting assad as a reformer and saying we could do business with him and sending our ambassador back to syria, to damascus to give him credibility, the governor called for ambassador ford to be recalled. again the mainstream media and the obama team took a very different view and now america is paying the price. >>steve: absolutely. meanwhile something else. when governor romney said russia is america's geopolitical foe, and he was lambasted by everybody, but he was right, wasn't he? >> you see the russians sending war ships to the mediterranean, vetoing resolutions in the u.n. security council not just on syria but iran, the edward snowden asylum? the governor was spot-on. the problem we had is that the governor ran on serious politics proposals. the obama team ran on

slogans. the slogans turned out to be trite but were helpful politically at the time. >>steve: also mitt romney was talking about molly and people were going what's molly. in october they have the he said islamist extremists are capable of taking control of molly. he was right about molly. >> he was. i remember bill maher tweeting out that most americans thought mali was the name of the president's daughter. that got a lot of play. people thought that was funny. a few months later the french along with the canadians transporting them were in mali rescuing the country from al qaeda. when the governor sounded that alarm, no response from other than mocking and slogans from the left. and he was right on that one as well. >>steve: finally, when it came to detroit, romney was right about detroit. he said managed bankruptcy

i'll never forget that. >>gretchen: the accident is under investigation but authorities do not believe that the driver was drinking. >>brian: what age should women get mammograms? according to a study many women who died of breast cancer before the age of 50 were never screened. researchers suggest guidelines should be changed to encourage women to screen earlier. >>steve: a miraculous story on survival. a man lost in the andes mountains is found alive four months later. a 58-year-old man from uruguay was rescued yesterday. he had lost 45 pounds and was dehydrated but overall in pretty good health. officials said the man tried to bicycle across the andes and chile and argentina but the bicycle broke down. he tried to make the rest of the trek on foots but got disoriented by two heavy snowfalls. >>gretchen: a hot air

the northeast. where it is well above average is the center of the country. take a look at some of these high temperatures. in minnesota, upper 90's. 97 degrees for your high. in chicago, in cities like kansas city, memphis and even down into dallas. if you're over the heat out here, we have good news. we are going to be seeing those temperatures cooling down. specifically here, chicago, your five-day forecast. take a look at friday. you're seeing a significant cooldown dropping down into the 60's. that will be your high temperature. big changes coming up for many people across parts of the midwest. today showers and thunderstorms, flash flooding and severe weather will be possible in sections of the upper midwest. we also have news in the atlantic. tropical storm umberto could potentially be the first hurricane of the season. we'll keep an eye on it. no impact expected for the united states. let's head back inside. >>steve: it's about time we had at least one.

maria, thank you. >>gretchen: this week coming up on wednesday, the one-year anniversary of not only 9/11 but benghazi and what happened there. hard to believe it's already been a year. remember the whistle-blower gregory hicks. he was the former deputy chief of the mission in libya who worked with the state department. he testified in congress about the 9/11 attacks. he was very forthright and he believes now he has been punished as a result of that. really what his mission is that he believes that we im justice for those four americans who were killed. he also said in an interview yesterday that he believes that the last two americans killed, the two former navy seals, didn't have to die. they died apparently eight hours after the initial attacks. he believes their lives could have been saved. >>brian: here's gregory hicks. >> i feel that i have been punished. i don't know why i was punished. i don't know why i was shunted aside, put in a

>> apparently they had been menacing this boy and the father came running up to them to protect his son at the same time when that happened. they surrounded him and began to get close to him and it was about to get violent. i felt that it was the proper thing to step in and try to stop that from happening. >> gretchen: in this situation, it was an african-american boy who was the victim. we were looking at the three suspects there. do you believe race was involved in this? >> i can't speak to what their motivations were. i do know -- obviously what they were doing was wrong and i stepped in to help, just because i thought it was the right thing to do. >> gretchen: so many people, captain, in this day and age don't step in. the idea that you did it, was it your military training? was it something in your gut? what was it? >> you know, like i said, i've been fortunate to be surrounded by a lot of leaders and a lot of people that do do the right

thing, so perhaps it came from that. when i think about what happened and i see the messages that i've gotten mullet today of messages since friday when the story was released about what happened and the thanks and congratulations, what i'd like to see happen out of this is a lot of the messages talk about how people have used this to have a teaching moment with their families or in their schools and i'd love for that to be the message that comes out of this, that you can stand up to bullies. it's okay to do the right thing and that we need to be partnered together to do that. at the end of the day, hopefully we can be a more color blind society, use this as an inspirational moment to have dialogue between friends and family in classrooms, like i said. hopefully that can come out of that over the next week and possibly affect a few people a few families, then that would be worth it.
