totally innocent of any wrongdoing and should be alive today. he is described as a troubled man with a history of violence and sometimes played violent video games all night long. because he had clearance he was not searched when he showed up at the yard yesterday. once again, the usa is tarnished. >> there is something evil in our society that we as americans have to work to try and eradicate. it is a great country. we have to work together to get rid of this. we just cannot have one more shooting with so many people killed. >> we will have more. in a free society it is impossible to regulate crazy people. it didn't take long for anti-american people to begin exploiting the killings. russian politician tweeted, quote, a new shoot out at navy headquarters in washington, a

lone gunman and 7 corpses. nobody is surprised anymore. a clear confirmation of american exceptionalism, unquote, and that's the crux of the story, all the violence causing deep anguish and diminishing the stature of the usa. no question damage being done in the country, right, charles? >> yeah. i think of course our image around the world, but i think it is the wrong image. they have this idea of the wild west and people going around shooting each other and no discipline and no order, and that, look, there may be some reality to that as to do with our past, but in this particular case, the most remarkable information we learned about him, we learned today. which is this is a man that suffered from hallucinations, auditory hallucinations and he heard voices and there is a report in the "new york times" that he was in rhode island and he called the police in a motel and he said that some strange people were following him and

sending vibrations through his body. which prevented him from sleeping. this is the classic symptom of a paranoid schizophrenic. i have treated some of these people. this is not a reflection of our society. this is the kind of sickness that in rare, rare cases leads to the violence that we saw, and to say there is a sickness in our society as we heard earlier in the segment, i think it is not in relation with this. the one problem we have, 50 years ago if the cops you told them all of that they would have taken you to the emergency room and as a psychiatrist i would have been on duty, and i would have committed him for two weeks of treatment. that person clearly was having a psychotic episode. today, because of this idea of civil liberties, which i respect, we don't do that anymore, and we have people at large who can be dangerous. >> also, he was able to get clearance to go on the naval base even though he had a long

history of violence with gun incidents and people are saying, listen, if you can't check out all of your personnel in a military area which is sensitive, then we just have chaos. >> bill, the gun incidents do not end up being reported or being charged. the one in seattle apparently the prosecutor lost the paperwork. there was another incident where he was in charge. so there is a guy who bought the shotgun legally in a legal place in virginia. clearly they had run a background check on him and because the incidents were not reported, i presume that's why he clearly -- >> he didn't have any felony on his rap sheet. there were warning signs, just as there were with the guy in fort hood >> exactly. and warning signs were with loughner in tucson and with jared loughner, you couldn't put him in a committed situation

where he would be controlled until he killed. >> until he does the same thing with the guy in columbine. now we have slimy little weasels in moscow tweeting american exceptionalism. believe me when i tell you this is going all over the world now because perception is reality. reality is we're a violent society, out of control society, and we have absolutely no right to tell anyone else what to do. that's going to harm the usa. >> no, no, i disagree. i don't think that this is the cause of the disrespect other people have for the u.s. this is the 10s, the 20th, and a long list of incidents. you didn't get tweets out of moscow after newtown. the disrespect is the way obama is shoved around, indecisive, zigzagged on syria and draws a red line and ignores it. that's the source of the

disrespect and everybody in the world senses the u.s. is weak and indecisive with no good leadership and that's the reason it is open season. the incident yesterday provides a subject matter but that's not the cause of the disrespect. it is the weakness at the top and indecision, and that's why everybody imagines that you can be as disrespectful to america as putin is. >> that will lead to very, very big problems for america down the road. >> absolutely. obama dismisses it as an absence of style points. he doesn't understand that the leadership of the united states, the weakness and indecision he portrayed hugely harms the u.s. in many ways -- >> like the catholic church lost moral authority and america is losing moral authority as well. we'll hold over for another segment on obama care because it kicks in in two weeks.

nnchts the impact statement tonight in two weeks obama care will kick in, exchanges will open and if you don't sign up you could be fined. the actual medical coverage starts january 1st. according to a new poll most americans are not happy about this. 53% disapprove of obama care, 42% are okay with it. rejoining us from washington, charles krauthammer. had he hear about defunding obama care. is that going to happen? >> it is not going to happen. it is absolutely not going to happen. obama is invested in this. it is his signature achievement for democrats. it is an historic achievement. it is their road to national health care. it passed the house.

it passed the senate. signed by the president and supreme court upheld the constitutionality. they are not going to give it up. what might happen, what might happen is that it could be such a catastrophe, so many americans could be hurt by it and then begin to really strongly oppose it. right now they're opposing the idea of obama care. not so much the reality. >> what do you think -- >> that could collapse on its own. >> since nobody knows what it is, including me, i mean, i just don't know what it is. i tried and tried and tried to figure it out. i know the nuts and bolts, but how is it going to affect me, you, other folks, working people, retired people, i can't tell you, so what -- because you're a medical doctor. i don't know if everybody knows that. you're a medical doctor. what is the thing about obama care that is going to make americans so angry that they punish the democratic party? >> look, there is a general and

a specific. the the general is that they have instituted 10,000 pages of regulations of one of the most complex -- look at it as an ecosystem in health care where they are affecting 80 things at the same time in contradictory ways, arbitrary ways, that it has to screw up the system. it is almost a given. i will give you one specific. one example of the place where they didn't understand the implications of the law and the regulations. the effect on labor. the labor unions are beside themselves. last week at the afl-cio convention obama was barely able to prevent them from passing a resolution to repeal the damn thing. what they want are huge changes in it. it will affect labor unions. it will affect the health care plans. >> how? >> it will affect recruitment. >> how does it affect -- >> because employers are, a, going to drop them down and

reduced hours. >> part-time because they don't want to give them the 40 hours. >> exactly. secondly, there are going to be tens of thousands of employers that will drop them because it will be cheaper to pay the fine. >> cut the hours. all right. >> now these guys will be cut loose and the unions understand they will lose their members because the great attraction of a union over the last 60, 70 years was it was able to get you good benefits. now you go on an exchange and/or a subsidy, you don't need a union. the unions will collapse. >> i have to ask you a personal question. are you ready? >> well, it depends. >> you steel yourself now. >> the answer is no, i wasn't there and i never did it. >> do you think fox news is going to cut my hours down because i am in the union. am i going to get cut back? >> i think they will make an exception for a best-selling author. how is that for an answer? >> i will get an exception from obama care, a waiver from the president himself?

the follow-up segment, the talking points memo, the winners and losers in the syrian controversy which of course ended in a deal to take chemical weapons away from the syrian

government. first of all, assad is a big winner. usa could pulverize the military machine because because of the compromise the usa will not bomb him. therefore he remains in power fighting a war protected by russia. that country is the other big winner in the syrian situation. putin inserted himself as a compromiser even though it is putin who is supplying assad with weapons and encouragement. putin is telling the world he will help take chemical weapons away from his pal and many are skeptical as they should. nevertheless, putin is a winner. he is calling the shots so to speak. other winners, congress, because it will not have to vote to humiliate the president. whether you like barack obama or not,y mass can you lating him in front of the w0r8d, not a good thing for the usa and iran mullahs because they can say the

usa is weak and any descenders won't get help from us so the mullahs win. now for the losers, those fighting assad inside of syria dealt a setback. great britain because they have shown they will no longer right grievous wrongs and president obama that looked weak throughout the entire mess. even if you like the president, his leadership is falters. according to a new poll just 36% of americans approve of the way he handled syria and unbelievable hypocrisy. robinson, and senator durbin and mikulski all object to drone warfare but support the president using military force against assad. let me get this straight. a group that killed 3,000 americans on 9/11, you can't target them from the air by drones, but assad killing his own people should be bombed. i mean, come on.

that's ridiculous and unbelievably parse. when human lives are on the line, politics should not be. there will be no military strike against assad even if he doesn't give up all his gas. that story is over and we americans do not have another military conflict. that is a good thing. most of the other stuff surrounding the syrian story is anything but good. now reaction, monica crowley and allen combs, 36%. >> yep. don't handle the syria thing well. there are too many mixed messages. he is saying it is going to carry out and then urgent and then the next day says wait until congress gets back and let congress decide. too many mixed messages. >> you would have been among the 60 or so% that say he didn't handle it well. why do you think, and this is speculation but we have to ask the question. why do you think that barack obama lost control of this very

important situation so rapidly? >> he didn't have the people with him. people didn't want another war. we're war weary, didn't have congress with him. >> didn't he know that? >> he should have known that. >> but he didn't. >> and why is it in libya he goes in, doesn't get congress approval. that's another disconnect. >> we weren't doing much in libya and we had all the other people. >> two different ways. >> so you didn't answer my question. maybe you, dr. crowley. >> i hope so. i hope so. >> i answered your question. >> no, you didn't. you don't know why he lost control. >> i told you, too many disconnects. >> i always thought there would be some issue that would bubble up beyond the president's control that he wouldn't be able to manage. i didn't expect it would be syria. here is this issue that has come up and shown the emperor has no clothes. obama and sort of a rambling presser last year talked about a red line. it was not scripted. he just said it, and now he put himself into a box so when the syrian government or the rebels, not sure, actually crossed a red

line and chemical weapons were actually used, now he was in a catastrophe of his own making. once that red line was crossed and the evidence was right there, then he had to act -- >> we're not sure we are sure. the u.n. report came back and said it was definitely sarin gas and explicitly delivered by a certain way that no rebel in syria has the ability to do. and even what's the guys name, ban sun sing. >> pann keye moon. >> they wouldn't say. >> he said it. he said it. >> chemical weapons were used in this situation and obama couldn't act decisively. >> it does matter. just to be clear, mr. moon, the u.n. guy said quite clearly that assad did it. it is not in the report. >> the report, yes. >> again, neither of you have pinpointed and i am going to try now, ladies and gentlemen. i have to save the segment. why the president lost control

so quickly. here is my speculation. i think it is an educated speculation. he does not have on his staff anyone who can bring him in. he does what he wants, so therefore there is nobody in the white house that can say, come here, just for a second. the unintended consequence of drawing a red line is if they do it, you will have to smack them. don't say that. don't do that. he doesn't have anyone in the white house that we know of, no one, that reins him in. >> that's part of the problem. yorng it is the whole problem. i think you hit on something important. you have a president essentially a narcissist. >> come on, monica. come on. >> i am trying to answer your question. >> a little too broad with the criticism. >> i am not buying it. go ahead. >> this gets to your point. this is a man who only relies on barack obama. his inner circle throughout his five years as president has been

the fix in for wealthy americans? according to the associated press, 1% of american households earn close to 20% of all the income in the usa.

the average income of the 1%ers, more than a million dollars a year. here is the kicker. for 2009 to 2012 the incomes of the top 1% increased by 31% while the other 99% of the folks saw their incomes go up by less than 1%. so what the heck is going on? here now to explain fox business anchor john stals man. >> the big reason the market is going up and the rich get much richer? simply put, people with money to begin with can invest the money in the stock market or bonds or whatever they want, gold, and if they hit it, their income goes way up and regular folks living from paycheck to paycheck don't have that coming in and so that's why the disparity grows, makes perfect sense. >> and the fed is printing so much and it hurts the savers. >> no interest.

so this is capitalism and capitalism you invest in companies if you have the assets to do so. right? >> but you ask is the fix in and that's partly true, too, when we bail out the big banks and give rich people flood insurance and corporate welfare. in some ways some of it is the fix, most just a by-product of freedom. >> capitalism. >> okay. >> so now let's deal with the folks working at walmart, working as fire fighters, whatever. okay? they're not going to make a lot of money in the future. i am looking down the road now. the unions are weaker. a lot of people, a lot of states are right to work states and they don't have unions anymore, and there is no money to pay public employees anymore. all the places are broke. the big corporations are outsourcing all the manufacturing jobs overseas. so the folks have to find a different way to make money. >> that's true. i think everything else you said is wrong.

the freedom to outsource is what provides the opportunity for someone like you to go from working at carvel or this job. >> i am just saying if i am going to be a working class person, i think you have to make that decision, ladies and gentlemen. >> lack of a union may help you? >> might help you, but there is no guarantee that the working class is going to have a good salary that the unions 30 years ago said, yeah, you come in here and you make this much or that much. in most unions. right? >> there never was a guarantee. plus, what's the alternative? keep everybody poor as they do in socialist countries, all of these programs tend to keep people -- >> you have to have income redistribution. >> that doesn't work. >> income inequality. >> i know it doesn't work, but the president of the united states thinks it does and he is doing it. >> before the war on poverty began americans were lifting themselves out of poverty. progress stopped five years after welfare began.

supreme court decision in 2001. here to explain more thanes at fox news. what was that decision? >> the decision said if you are a convicted sex offender and you are an illegal alien here, you cannot be held for more than six months in detention. it is unusual and cruel and unusual punishment against the constitution. >> why can't the federal government either get these people tried or deport them in six months? >> many times it is because the country of origin won't take them. >> they don't want them. >> so they have nowhere to send them. i would give them a parachute. >> and push them off. right. >> that's the o'reilly diverse. >> and about 60,000 of them. not just sex offenders. >> so the primary reason is they can't deport them back. why don't they try them? speedy trial? >> the inefficiency in the whole system. because they can't get their job done and to minister justice in an efficient manner, they release them on the street.

todd bah sentenced stacey rambold for 30 days in prison for raping a 14-year-old girl. tragically that girl committed suicide two years after the statutory rape charge. the mother is saying the crime contributed to the suicide. after the judge rendered the sentence many montana ans were out ladies and gentlemraged andd obscenities and the state moves again him and a sentence may be changed. asked to explain his leniency he said, quote, the 14-year-old was as much many control of the situation as her defendant. he has been running from the press and jesse waters finally caught up with him. >> the judge sentenced a former senior high teacher. >> he will now serve 30 days for raping a 14-year-old student, the student later committed

could get a stiffer sentence, the state could impose it, right? >> yes, it is an illegal sentence in the state of montana, a two-year mandatory sentence. >> not only did he give an outrageous sentence, but it was illegal. >> it was an illegal sentence, and he tried to have a do-over, and change the sentence, but the montana court said no, no, no, it will have to go through the usual process. and so the perpetrator could be out in october. >> why don't they just fast track it? >> they say it could take 15 months for it to go through the judicial appeal. >> when he gets out of jail in october, if he does, does he have to stay at home? >> no, there is no monitoring of him. he has to go through sex offender treatment. and actually what happened, he fa failed and was kicked out of the
