through all of the hype and tell us how the new version of the iphone 5 really stacks up. first we begin with a fox news alert. we learn that american citizens may be among those injured in a bloody terror attack. it is in the city of nairobi, kenya. police say self-gunmen stormed an upscale shopping center, firing ak47's and throwing grenades into the crowds. and the kenyan president is now reporting that 39 were killed and 150 more were wounded in an apparent attack targeting nonmuslims. the white house is releasing this statement saying, quote, the united states condemns in the strongest terms the despicable terrorist attack on innocent civilians at the west gate shopping mall in nairobi, kenya. we extend our deepest condolences to the families and loved ones of those who have been killed or injured including the american

citizens who were injured and the staff of our embassy in kenya tragically affected by this attack. let's go to connor powell who has more from our mideast bureau. connor? >> the worst of the violence appears to be over, but there are conflicting reports about how many of the gunmen may be at large right now. initially witnesses said there were at least five attackers including one that was a female. we don't know how many were killed, but several are holed up right now in the shopping mall and they may have hostages. several people have been killed, but it appears the kenyan police have one or two or several cornered. the al-qaeda-linked group claiming responsibility for the attack. they vowed to attack nairobi after the kenyan government sent troops there try 20*g dislodge al-shabab from power.

they stormed the shopping mall around noon local time carrying ak-47's and throwing grenades. there were multiple reports they were targeting nonmuslims and even telling them to leave the area before they started opening fire. they are vowing to launch additional attacks and saying they simply will not negotiate for the released of these hostages. arthel, we have long known that they are dangerous and violent and really just a nasty organization. they are simply proving it with this attack and the fear is there are americans involved. we haven't got any official word from the state department or from eyewitnesses on the ground, but this is the type of area that the western diplomats and the businessmen would be frequenting especially on a saturday afternoon when a lot of people are there with families and children. arthel? >> indeed, connor powell, thank you for that update. this attack follows years of tension between kenya and somalia. it goes back as early as 2006

when about 35,000 somali refugees fled to kenya in order to escape drought-strick islamist rule and conflict a few years later in 2011. kenya closed the border to somalia after heavy fighting between rebels and government-backed forces. later this same year kenyan forces entered and tried to curb the violence. almost two years later they are still in somalia. that's despite repeated promises to pull them out. getting you caught up on politics, congress is in a conflict of its own about the looming debt crisis there. there are only nine days left until a government showdown. the house passing a stop gap spending bill yesterday covering the government's debts through mid-december while de funding obamacare. now it goes to the

democratic-held senate which says it will reject the bill and stay stedfast in supporting the president's plan. molly is live in washington. molly, we want to start with what did the president say about the house bill today? >> president obama blamed, quote, far right republicans for risking a government shutdown over the health care law." >> they had actually plunged this country back into recession all to deny the basic security of health care to millions of americans. that's not happening. they know it is not happening. >> republicans are not convinced it is not happening. house republican leaders say they did their part to stop the law from, quote, causing anymore damage to american families and american businesses. >> you got businesses all over the country who are not hiring because of the impact of this law. you have other business reis

deucing hours for employees because of this law. and so our message to the united states senate is simple. the american people don't want the government shutdown, and they don't want obamacare. >> but top senate democrat harry reid says he has the votes to change the house bill. insert money for obamacare into it and then send it back to the house. >> but, molly, will any senate republicans fight reid on this? >> kentucky gop senator ranked paul says there is a, quote, dumb idea to shutdown the government, but he is ready for a debate and for a fight to fund obama square. a spokesperson for ted cruz says, quote, we will use any procedural means necessary to protect the house bill and keep debate open. senator reid must not be allowed to change funding into the house-passed bill. and there is another fight over raising the nation's debt ceiling. it is a borrowing limit.

the country cannot afford another increase, but the president says congress must raise it to pay for past spending. arthel? >> and here we go again. molly, thank you very much for that report. as we just heard, one lawmaker says he is willing to do anything necessary to keep the health bill alive. that man is republican senator ted cruz. there he is. he sits down with our own chris wallace tomorrow. catch the exclusive interview on fox news sunday. check your local listings. there is more bloodshed in afghanistan. an apparent insider attack, three nato soldiers shot dead by a gunman wearing an afghan police uniform. no word yet if any of the victims were americans, but today's attack occurred in a part of eastern afghanistan where all foreign troops are believed to be americans. and a neighboring pakistan, afghan talibanormer deputy

who spent years in detention. they hope the move will pay the way for peace talks between the two countries. but the united states opposes his released amid worries he could return to the battlefield. and at least 92 people are dead after a string of attacks around a iraq today including a horrific bombing near the site of a funeral. it happened in baghdad after two bombers, one on foot and the other in a car, detonated a pair of explosives near a crowded tent filled with mournersers and killing more than 70 people. that attack coming hours after a group of insurgents launched an attack on a police building killing seven officers. all of this weeks after the reported masacre at an exile camp in iraq left dozens of iranian refugees dead. those killed are members of the mek. it was once considered a terrorist organization byes --

by the u.s. and now seen as a critical ally in creating a democratic iran. >> it was a masacre that the world greeted with silence. controversy raged about chemical weapons in syria and neighboring iraq. 52 iranians were living in an exile camp. they say this amateur video recorded on september 1st shows forces committing the slaughter. iraq denies the allegations. >> they were there to execute. they were not there to scare people off. they had targets and they shot every one of my friends and my father's friends and my father in the head jie. those killed were members of an iranian opposition group called the mek, the people's army. they sided with saddam hussein during the iraq-iran war. once considered a terrorist organization with the u.s. many experts see the mek in a

positive light. >> it is a group in favor of a democratic iran. an iran with a gender equality and nonnuclear. they are on our side on all key issues. most importantly over the last 10 years, they have been the best source of information that we get out of iran. >> the september attack took place despite 5* 2003 commitment from the u.s. that the group would be given protected status under the geneva conventions. when the u.s. ended its occupation iraq took responsibility for keeping them safe. some say the blame rests with tehran. >> what people in the united states should know is iraq has become a client state of iran. the person running iraq right now is the ayatollah. >> relatives of those killed believe the u.s. should do more to protect the more than 3,000 mek members still living in iraq. amir who lost his father says

center. i don't know what is worse, the pictures of the rain or the big orange glob behind you. >> that's right. this is the storm of the year. it was a super typhoon with winds of 160 miles per hour plus on thursday-friday. it has weakened, but it has the winds of a category 3 storm, a major hurricane. winds of 125 miles per hour as it continues to make a bee line for hong kong. this storm is 600 miles wide and it could be one of the biggest to hit hong kong in 50 years. not only will we see storm surge, but we could see incredible flooding and very strong winds. a category 3 storm and it will weaken to a cat 2. it could by qifl lept to a -- it could be equivalent to a category 2 storm. heading toward sunday we think it is going to make landfall on sunday our time 2:00 p.m.

right into hong kong. again this could be really a devastating storm. we think potentially qoo -- could have upwards of a billion dollars damage. millions of people live here. seven million people in hong kong. that is the big weather story this weekend. taking a look at what is going on across the u.s., we have a cold front that is swiping across the northeast -- sweeping across the northeast. that's where we have a lot of tropical moisture interacting with the front so we could see some heavy tropical moisture and the potential for flooding over the next 24 to 48 hours. you we are talking about anywhere from 2 to 4 to 6 inches of rain across the florida panhandle and up toward the southeast. we will keep an eye on that. flash flood watches from southern louisiana to the florida panhandle has this continues to move. we are also watching the weather carefully in colorado twher they are still into a rescue effort there. we could see rescue efforts

for strong storms and snow in the higher elevations as it gets cold this time of year and even in parts of colorado. looking at your five-day forecast, sunday is when we will see the potential for showers and thunderstorms or a dry forecast as we look to monday, tuesday and wednesday. so, arthel, we are covering the u.s. but that typhoon is going to make some headlines tomorrow. >> and then when you think about it, we are talking about 2:00 p.m. hitting landfall our time. that's middle of the night there. it is dark and it compounds things i imagine. >> but the one thing we have to take note of is they are very prepared there in that part of the world for storms. but this could be one for the record books. >> let's hope their preparedness will protect them from too much damage. jd, thank you very much. good to see you. >> coming up, a call for gop unity as the senate takes up a continuing resolution to keep the government up and running. our political panel debates if republican senators will keep the faith with their

people have died. there are still 60 people unaccounted for and more than a thousand people remain evacuated from their homes. this group of former members of the military are in colorado helping right now. they came together in 2010 during the earthquake in haiti. the name of the group is team rubicon. they picked up 12,000 volunteers and what they do is they go to disasters and they identify the areas that need help and go to work. >> when you are part of the military you are part of something bigger than yourself. when you get out of the military it becomes all about me. that's very foreign to veterans. we are looking for that to be a part of something bigger than ourselves again. >> members of team rubicon say what they find in the natural disaster areas is similar to what they found in war zones in afghanistan and iraq.

the victims of a mass shooting putting an unwelcome spotlight on the city's gun violence. on top of this, now comes a series of deadly attacks overnight that killed four people. brian is in our new york city newsroom with more. brian? >> hi, arthel. one chicago police officer tells us four murders is another normal friday night in chicago, america's murder capital which saw 500 murders in 2012 alone. but thursday night's mass shooting wounding 13 victims ages 3 to 41 at a local park during a pick up basketball game has violent-weary residents shocked and upset. >> to come and shoot a playground up, i mean that's like the end of hue man tree -- humanity. it is like this world is actually coming to an end. >> rahm emanuel and others are gathering at a peace rally in honor of the victims including a 3-year-old shot in the face. all of the victims are expected to survive and are

recovering in local hospitals. both the mayor and police superintendent is calling on stricter gun laws that ban assault weapons and high capacity magazines. >> last night it was too frequent and too familiar for some children in chicago. that has to come to an end. >> at least one gunman opened up with an assault rifle in a south side neighborhood. the gunman sprang bullets at residents and families who are trying to enjoy an evening at the park. at least 10 ambulances were responding as the wounded victims laid on the basketball court. >> it was chaos and confusion. there were bodies. i mean, it was madness. that's what i saw. i have never seen anything so chaotic and mad in my whole life. jay police have made no arrests yet, but they believe the shooting is gang-related. over the last year police in chicago have added extra foot patrols to 20 so-called

hillary clinton for president and borell sigh a fox news contributor and the director of out reach for freedom works. good to see both of you. >> i want to start with you on this one. senator cruise seems determined. is he trying to prove a political point holding the government hostage, or do you feel his tactics are making sense to you? >> i see this as good politics and good policy. what we want is for this to move forward in the senate and to force the senators to vote on this initiative, on this budget initiative. we have a number of senators up for re-election this year and that will really just play out who was in favor of the funding or the funding of obamacare. i say we get the ball rolling on this issue so the americans know where these individuals stand. overwhelmly, 53% of americans disapprove of obamacare and 53% of americans disapprove of

on you -- of how president obama is handling this health care initiative. we need to move forward with the filibuster. >> richard, you are hearing denise talk about a little more than half of the americans saying we don't want obamacare. it looks like they are trying to position it as a poison pill that you better not touch. if you do you will see results in the polls. >> for all practical purposes, obamacare was on the ballot last year, 10 months ago where governor room thee said he would repeal obamacare. at the presidential senate and house level across the board democrats got more votes. in the polls, even the ones that danene cited, there seems to be a bit of a majority. if you look at that, 16% of that 53 actually says they disapprove because they want the health care to be more liberal and not to repeal it. >> what does that mean? >> in the aggregate -- that is

not in dispute and that has been true all along. they are distorted as far as who is opposed. if you add the people who are in favor of it and should be more aggressive that is getting close to 60%. nor cruise may appeal to his base. but he has a lot of colleagues who say it is just not going to happen. >> americans are not in favor of this. as i mentioned this 53% -- americans, we were lied to. obama lied to us. they say you can keep your health care and that's not true. look at ibm and look at these other businesses. wal-mart and home depot are either letting the employers -- unfortunately they are losing their insurance or some of the spouses are losing insurance. we have been lied to. the costs will go down. the costs will go up anywhere from 24% on average and then if you are in wisconsin, up to 125%.

so clearly we were lied to. >> go ahead and finish your thought. >> it is not ready for prime time. america is not in favor of it. i think obama and anyone else that is not in favor of de funding this is on the wrong side of public opinion. >> let's say the senate comes back with alterations with funding for obamacare. talk to me and talk to the american people, richard, in terms of what would make folks more comfortable with having health care for everyone. >> certainly people are comfortable with the individual provisions. they don't want to be discriminated against. they don't want to be tossed out when they get sick. they want kids to be on the program until age 26. they want to have preventive care. they like the individual components. what they don't like is because there has been all of this talk. we are hearing it from daneen and we see these crazy ads. they have a bad association with the word obamacare.

i would say to daneen and everybody else, let's see it get implemented. only 36 of the public want repeal. the rest say either let's see how it plays out or maybe even fund it more. >> a vast array of people are not in favor of this. even president obama who delayed the employer mandate initiative. he is a democrat and he called it a train wreck. even some of the union leaders dism represent -- and representatives, they don't want anything to do with it. they are walking backward. clearly it is a train wreck. it is a nightmare. it will kill our economy. the hours are being cut and people are being let go. it is not going to help our country. it is not going to help our economy. it is a nightmare. >> let me jump in and give you the last 20 seconds. the unions are having a problem with this. itis it a big picture problem

or are there people with personal gains who are not being met which is why they have a problem with it? >> with every program like this, medicare and social security. when they were first enacted there were changes along the way. it took decades for social security and medicare to look the way they do today from where they were. of course it is not perfect. it is something that the public -- democrats and republicans alike have been wanting this for the past half century. let's see how it plays out. the prices are coming down and the price curve is being bent downward. >> even the exchanges are not ready. the health care exchanges are not even ready and the millions of dollars that have been spent to get the calculater working. >> i have to leave it there. thank you very much for the spirited conversation. appreciate your time. it has been used to show our economy is recovering, but now a stunning new report reveals

that the unemployment rate may not be falling as much as we think it is. many of the same workers who are no longer eligible for those funds are turning to disability benefits instead. gary is the fox news contributor and good to see you, gary. how are you on this saturday? >> good to see you, thank you. >> gary, what is going on here? how does this work? do you lose your job and get yourself on disability? explain to me what is going on and why is this happening? >> well, disability has become the long-term unemployment insurance. remember, unemployment runs out, disability goes basically forever and ever and ever. i am not really here to say that people are taking advantage of it, but when it is out there they take advantage of it. all of a sudden people have pains and bad hips and bad knees and can't work anymore. they collect every month. >> how do you get yourself on disability? i don't understand. >> you basically go to the

government and say i can't work anymore. help me. i guess they have people that look at you and say okay you can't work. here is a check every month. it is as simple as that. >> is there enough oversight? there are people who really do need and are receiving disability benefits, yet they are the folks who don't qualify. how do you make sure that some people aren't robbing the system? >> there is oversight, but here is a number. $1.5 billion are fraud in disability insurance and there in lies the problem. it is not just disability, it is everything. food stamps is up five fold. five fold and we advertise as a government for people to get on there. we are at a point where people say hey, this is what i can do. not just to work, but to get a check and it is becoming the

norm and that's why the numbers are sky rocketing. >> are there any chances of a different betting procedure? you go to weight watchers and you have to weigh in to make sure you are not cheating. can the government do more of an efficient job to check the disability rolls? disability roles? >> they can always do more, but it always falls through the cracks. the amount of fraud in our system, i call it the big, gigantic blob. there is no way of catching all of it. there is a vicious cycle out there. there are not enough jobs and people are losing their jobs and losing their unemployment insurance. then they his the disability role. it is tough to gauge whether somebody has a bad hip or not. there is only so much you can do to look at that. that's our situation and it is tough to watch. >> it is too bad. it is taxing on taxpayers and then again there are people who really to need the services. somehow hopefully the ball of

>> we are learning more about the contractor used to vet the navy yard shooter. the same firm, usic dash usis did the check on edward snowden. now, a new report saying the former employees were under merciless deadlines to pass through paperwork and raising questions to how well our vetting process works and how we can change it to protect our nation's secrets. >> how well is the individual background check and security clearance itself being accomplished? they will have plenty of evidence to determine what the quality of that work is and how systemic the problem is. they should be able to get after it and fix it. >> there are several million of those around the world. i just think we have gotten so big we don't know and stuff will fall through the cracks. >> joining us is the usc professor of law and political sigh yenls. good to see you. >> good to see you. >> we just heard that, look,

when it gets too big the staff and too many dots to connect these things are bound to happen. that's not good enough. what is your take on all of this, susan? >> that really isn't good enough. what seems to be happening is that the government instead of doing this themselves with no profit motive involved has contracted out half of the security clearance to private companies who will only make money if you do it quickly and get that paper done. the real motive -- if the bottom line is profit you have to ask yourself are they putting profit ahead of thoroughness? i had an experience last week. a former assistant of mine has taken a job with usaid. they were doing a security clearance. the woman doing the check, literally the agent working for the government, flew from washington to los angeles to

meet with me in person so that we could have an in depth conversation and she assumed that with each person was on the list. you do that kind of security clearance and it costs money. but it gets done right. >> and then you get to this, susan, and it gets done right. we have a lot of people in particular in our audience who are opposed to big government. is this a case where those -- some of those cutting down of the budget is the result when you are picking away at various organizations and departments? >> i think, art, in this sense. we have seen this in a lot of areas. it lacks like government is smaller. in fact what is happening is that jobs that should be done by trained government agents who understand the only thing that matters is getting it right are being contracted out on the basis of a bidding process and given to the low

bidder. that works some of the time. but when we talk about our nation's security it seems that is not good enough. when you have a situation like this, two guys in, what, a matter of months who never should have gotten clearances? you have to ask yourself if this isn't something the government will do it themselves and do it right. >> you know, when things like this happen we always want to know who will be held responsible. who is going to be held responsible for this food poisoning, susan? or are there too many cooks in the kitchen to determine who is responsible? >> you know, what are they doing when everybody is pointing at each other? i assume the isis or whatever this particular organization is, the usis, they will get called hearings and they will explain this anomaly and we will have whistle-blowers and they say we are under incredible pressure. the real question, art, at least to me is not the blame

game here. what is done is done. the real question that we have got to get to the bottom of is are there people out there right now who have security clearances and shouldn't have them. in the future, how do we ensure that mistakes, and clearly there are mistakes here, don't get made? >> people want to see the government and the department cooperating because we have to protect us as americans and we are together and there are lots of people out there trying to get us, and this is where we have to stand strong and get these security measures locked in place in step. >> couldn't agree with you more. it is absolutely true. >> i have to go, and it was a pleasure and i will see you again. thank you, susan. >> thank you, art. >> absolutely. so we will switch gears and talk about this thing right here, the iphone. blah, blah, blah. everybody is so excited about it. what is the big deal? do i have it upside down? i might. i don't have one.
