good morning, everyone. it is sunday, september 22nd. i'm allyson camerata. we begin with a fox news alert. there's been a mall massacre in kenya. it has turned into a massacre. among those injured are americans. there are 59 people killed. the mall is still under siege and hostages are still being held. we have all the breaking details. the president comes out swinging raising rhetoric for republicans. >> let me say as clearly as i can, it is not going to happen. we have come too far. we've overcome far darker

threats than those. we will not negotiate. >> his remarks before the congressional black caucus go too far. was that a racial dog whesle. >> and duck dynasty, one of the most popular shows on television, why did one of their t-shirts get a kid in big trouble at his school at junior high? "fox and friends" begins right now. good sunday morning, everyone. welcome in to "fox and friends." we start with a news alert now. terrorists and special forces are in kenya. they killed dozens of people in an upscale mall. take a listen. >> we believe that there are still some people in the building. we believe there are some people

in the building and that is why we say their position is very difficult. we are doing everything reasonably possible to make sure that the hostages who are still in the building come out safely. >> officials say 10 to 15 terrorists are still inside the mall, and this started when the group armed with grenades and ak-47s stormed the building. the death toll overnight rose to at least 59 people and another 175 are hurt, including at least four americans. officials say another 1,000 people have been rescued so far. this is the al qaeda linked somali militant group called al shabab. witnesses described the scene as chaotic. >> we tried escaping and they threw a grenade and grenade -- the sharp particles entered me

into my hand and my leg. there are very many people who are injured. >> the white house has condemned the attack. the secretary of state john kerry says the u.s. has offered to help the kennian government in any way possible. who is al shabab? joining us is ryan moore. thanks for joining us. >> thanks for having me. >> what do we know about al shabab? >> basically this is a group based in somalia. it's al qaeda's branch there. their focus isn't on just somalia. they want to turn it into what after begafghanistan. they've recruited over 40 americans that have joined their ranks. >> what type of operations have been effective in recruiting americans? >> they come into the somali american community, they find individuals who moved here and they say you need to help your country. you need to help save your country from the evil foreigners in the west.

they radicalize them and bring them back to somalia and get the battle experience. >> the u.s. government for reasons that aren't clear settled thousands of so he mannians there. >> right, for humanitarian reasons. a lot of the ways that al sha bob is penetrating the united states is through the mexican boarder. this needs to be included in the immigration debate. there was a man connected to al sha bob arrested in virginia. he confessed to having smuggled over 270 somalis into the united states. if he's working for al shabab, you can only imagine. >> this is what's called a soft target. it's an upscale mall. this is where people are shopping. they think that they are safe basically and what we've heard is that they targeted nonmuslims by asking people, rounding people up and asking them some questions that they thought would separate muslims and nonmuslims.

>> exactly. they didn't want to kill muslims. part of the reason is because al qaeda has experienced a backlash. they've killed eight times as many muslims as nonmuslims. that's caused a backlash. that's been a major strategic set back. >> we should be clear about what al shabab said. they claimed responsibility for this. they went on twitter almost immediately and said this is pay back for kenya's involvement in somalia, kenya having sent 4,000 troops in somalia to fight al qaeda insurge against. >> right. al qaeda, al shabab, was going to take over kenya to make it the first country directly one by al qaeda. the an fri can sources went in, including from kenya, so they're upset. >> i hate to say this out loud, but considering the u.s. has a record of involvement in somalia, how concerned are u.s. authorities concerned about

something like this happening here? >> huge. it's not just someone going on a computer and becoming radicalized and acting on their own accord, they have people in the united states that are radicalizing individuals and arranging their travel and smuggling people in over the mexican border. there are state sponsors helping al shabab. there are indications that iran and sudan are also involved with them. >> are you concerned about a broader rise of extremism? we keep hearing that al qaeda, from the administration, is on the run. we have decapitated its leadership but we see these large scale attacks in countries popping up in africa, of course, in the continent of africa and around europe. >> right. that's because the ideology hasn't been destroyed. al qaeda has done a lot of damage themselves, by killing muslims, being defeated on the battlefield, until you kill the radical ideology, you'll keep having these type of terrorists

produce. al qaeda is having a revival in their forces because syria has become like afghanistan in the 1980s. they went there and got recruits to battle the soviets. now they're going to syria to battle the syrian forces. >> thank you for your expertise. >> thank you. meanwhile, would he do have some other headlines to tell you about. overnight, a deadly attack on a church in pakistan, 260 people were killed, another 100 hurt when a bomber attacked another church. they were lining up on the front lawn for a free meal. most killed were christians. later today a memorial service will be held for monday's 12 victims of the navy yard shooting. this will be held at the marine barracks. the service is closed to the public but the navy has reportedly invited 4,000 people to attend. so far, no charges have been

filed against a driver who plowed into a group of bicyclists killing two of them and injuring two others. this happened after the start of the 40th annual granite state wheelman tri state century sea coast ride in new hampshire. >> you do that every year. you love pronouncing it. >> i do. >> car just, you know, plowed right into them, like went right into them on the wrong side of the street. >> the 20-year-old driver was treated for minor injuries. so far there's no word what caused him to crash into those folks. all right. those are your headlines at this hour. >> thank you, allyson. it is rick time. my favorite time. can you tell me why meet logically? >> meteor logically i can get but i have a feeling yours is for some other reason. >> first day of fall. >> the candy corn comes out. >> i love it. >> it's allyson's worst day of the year. >> first day of winter.

rain across the boulder area today. nothing that will cause flooding but a bit of nuisance. snow into the higher elevations across the rockies. i'm going to say snow as much as i can to annoy allyson. >> thanks so much, rick. president obama taking the opportunity to ridicule the republicans during a black caucus dinner. this is as they get ready to go to battle to avoid a shutdown. peter douce is in washington for more on what's happening and what's going to happen. >> reporter: tucker, for three years now the federal government has been divided. last night at a congressional black caucus dinner in d.c., president obama seems to hang many of the problems and inefficiencies the government has been dealing with on republicans. he said that they need to, quote, stop governing by crisis.

he also pointed to their vote this week that would keep everything running past october 1st except obama care as an example. >> you'd be willing to shut down the government and potentially default for the first time in united states history because it bothers you so much that we're actually going to make sure that everybody has affordable health care? let me say as clearly as i can, it is not going to happen. we have come too far. we've everycome far darker threats than those. we will not negotiate over whether or not america should keep its word and meet its obligations. >> but some of the republican party's most enthusiastic supporters of defunding obama care have been saying that their position is more about leverage than anything now with senator rand paul saying in michigan this weekend, quote, i'm acknowledging we can't probably defeat or get rid of obama care, but by starting with our position of not funding it,

the free. we want it to be. but it turns out it's not the land of the free, at least not economical economically, not anymore. according to a recent report, it's number 17. how did this happen, this fall from grace? we have john here from real markets.com to explain. john, what happened? >> well, it's really simple. people wonder why the economy is weak. economic growth is the simplest thing possible. you have to set the people who are producing that economy free. in the last 15 years the opposite's occurred. in a country that is based on skepticism about politicians, the u.s. government has grown by leaps and bounds. that cost is an imposition on freedom. we get up every day to trade our trade has become much less free. we've seen just in recent years an attempt to reregulate health

care, energy, all sorts of -- and banking on the way to less economic freedom and we've seen the value of the dollar shrunken. that is, our paychecks have been taken away from us in terms of the dollar's value buying much less. when you factor all of those in, we're much less free and no surprise the economy is growing a great deal. >> i want to get to your point about the dollar buying less. i want to put it on the screen. it's so depressing. here are the top five freest economies, hong kong, singapore, new zealand, switzerland, uae, they're freer in abu dhabi than we are. burma, congo, zimbabwe, and chad all synonyms for disasters, those countries. you mentioned the fact that washington seems to be ignoring that the dollar buys less. this may be a product of the fed devaluing our currency, do you think? >> it's exactly that. one of the biggest modern myths is this idea that oil and gas have become expensive.

nothing could be further from the truth. in fact, the dollar in which they're priced has been cheapend. this has been by designed by the treasury and fed in the last 12 years. it shrunk the paycheck of all-americans and it's also greatly reduced the ability of americans to find jobs. >> so it just completely screws the middle class, just hammers people who aren't rich is what you're saying? >> yeah, because the middle class are much less able to hedge the decline and the value of the dollars they earn, but it hurts them in another major way. what we can't get beyond, democrats and republicans must acknowledge that there are no companies and no jobs without investment first, but when the federal government is explicitly devaluing the dollar it tells investors, why commit capital if the returns you're going to get down the line will come back in dollars greatly devalued. >> exactly. >> instead they put their capital on strike and americans have greatly reduced job opportunities. economic growth is so easy, but when you destroy the dollar which is the lubricator of that,

you're going to necessarily see a greatly reduced hiring. >> exactly. they tell us there's no inflation. every year washington says there's no inflation. i go shopping once a year because i have a wonderful wife. she leaves town and i go to the grocery store, i can't believe how expensive it is. my dollar buys less. they should stop lying to us because it's obvious. >> it's very, very true. inflation, you can make it what you want. we know there's inflation to look at food and groceries. the federal government has stripped those out of the calculations to make it appear that we're doing fine. we also know there's inflation because the economy is so slow. when the dollar is being devalued, there's less investment. without investment you don't have new companies and jobs. >> you are one articulate character at 6:19 in the morning. >> i know, john. >> have a good day. it's a drug everyone takes

welcome back. 23 minutes past the hour. some quick headlines for you. there are no survivors of a helicopter crash that happened yesterday in arizona. witnesses say they heard the held copter making strange noises before the crash. investigators still don't know how many people were on board.

the faa says the helicopter was privately owned. a drunk pilot was arrested before he was scheduled to take off. the pilot is 54-year-old earfan fayez was four times over the legal blood alcohol limit to fly. the flight was canceled and all 174 passengers were rescheduled on later flights. ali? >> thanks, clayton. well, tens of millions of people use it every week but many don't know that it could kill them. a new report shows that acetaminophen, the a beingticti in tylenol kills people every year. is it time for the fda to slap a black box warning on these drugs. we're joined now. >> hi, how are you, alisyn.

>> acetaminophen, the drug tylenol is one of the most common prescribed painkillers. also as you know, it's an over the counter medication. when it's taken properly, it's extremely safe. if you don't follow the instructions and take more pills than the recommended dose, there are risks. >> is that how 150 people are dying, they're taking too much of it? >> absolutely. the problem with tylenol is that the window between what is a helpful dose and what is a harmful dose is a smaller window than for other medications. >> oh, that's good to know. >> it's the liver issue that's the problem. if you take too much, it can damage the liver and it's particularly a concern if you're an alcoholic or taking alcohol with tylenol, it's something to avoid, of course. >> if you take tylenol and you have a glass of wine; that dangerous? or do you mean repeated alcohol use and repeated tylenol use. >> repeated use is obviously very serious. if you're taking a lot of alcohol regularly. you should not be taking alcohol

at all if you're taking tylenol. this medication we must emphasize, if you take it properly and follow the instructions on the label, tylenol is one of the safest painkillers that are around. >> okay. thanks for that clarification. meanwhile, i want to show you this photo. it's causing some controversy online. this is a woman, she's doing the popular cross fit program, which is very rigorous. she's two weeks away from delivering a baby. that's not a beer gut, that's a baby in there, right there. should pregnant women in eight months of pregnancy being doing rigorous exercise like that? >> i agree, it's a very sensational photograph, but this lady is somebody who is doing very regular exercise before she was pregnant. she made that statement when the photograph was published. actually, the guidelines for exercise in pregnancy are to follow the same guidelines for nonpregnant ladies, but you must ask your doctor. the american society of obstetrics and gynecology

there are calls for the united states to intervene. >> reporter: it was a massacre that much of the world greeted with silence. controversy raged about chemical weapons in syria, in neighboring iraq 52 iranians living in an exile camp were killed. relatives of the victims say this amateur video recorded on september 1st shows iraqi backed forces committing the slaughter. iraq denies the allegation. a among the dead amir ramadi's 56-year-old father. >> they were not there to scare people off. they had tarktsz. they shot every single one of my friends and my father's friends and my father in the head. >> reporter: those killed were members of the iranian opposition group called the m.e.k., the people's army, which sided with saddam hussein. once considered a terrorist organization in the u.s., many see the m.e.k. in a positive light. >> it is a group that's in favor of a democratic iran, an iran

with gender equality and iran that's nonnuclear. they're on our side on all key issues. most importantly, over the last ten years they've been the best source of information that we get out of iran. >> reporter: the september attack targeting m.e.k. members took place despite a 2003 commitment from the u.s. that the group would be given protected status under the geneva conventions. when the u.s. ended the group, iraq took responsibility for keeping the group safe. nuri al mall la can i might have pulled the trigger, some people say iran may have been to blame. >> the person running iran is not mall la can i, it's the ayatollah. >> reporter: relatives believe more should be done to protect the more than 3,000 mek members living in iraq. amir says the best solution is allowing them to relocate. >> we want to make sure they're

this whole thing caught on a neighbor's surveillance camera. you can see the suspect carrying the 5-year-old over his shoulder. police say the man broke into the first floor apartment and snatched the child right out of her own bed in the middle of the night. then he took her to a nearby park but somehow she got away and ran to get help. >> he may have gotten scared and allowed her to get away, like maybe had second thoughts. >> i'm really thankful that she is okay and hope that they will catch that guy. >> let's all remind our children today to run as fast as they can if they're ever confronted with a horrible situation like that. meanwhile, this next story sounds like a scene from a movie straight out of "the hangover." like when they put mike tyson's tiger in their car, remember this. >> [ bleep ]. physically. or metaphysically. >> right. >> so clearly it's a joke. it's a line from the show if you watch the show, you recognize the line. humorlessness has so infested american education that the school couldn't tolerate it and forced the kid not to wear the shirt. here's a statement from david clark. he's the bin dwiddy high school. >> that's funny. >> if you're a "duck dynasty" fan, you understand the shirt's meaning. but if you haven't watched it, you may question the shirt implies violence. as a school, we'd like to keep stoo dents shirts as nonviolent as possible. that refers to metaviolence. >> all these schools have zero tolerance. they make these rules, no violent t-shirts. even when there's a joke, they have to stand by their zero

tolerance policy and common sense goes out the window. it is clear there is a joke. it says i will hurt you and that is technically violence. he had to take off his t-shirt. >> you described exactly what happened. of course we should remember a school's whole reason for being is to educate kids is to teach them. kids are being taught i think a really important lesson here which is that a lot of adults are totally inflexible, humorless, lacking common sense and robotically carrying out rules they don't even understand. >> what you're saying is a teachable moment. >> he why. >> the teachers, in fact, shouldn't have kicked the kid out. they should have used it in the classroom to explain how inflexible the rules are. >> by their actions they have. >> we should say, they did not kick the student out. it wasn't that he was expelled. they asked him to turn his t-shirt inside out. he didn't want to do that. he said, i'm not going to look stupid in front of all these young ladies in school. so then he had to go home --

cannot insist only on issues related to abortion, gay marriage, and the use of contraceptives. this is not possible. i have not spoken much about these things and i was reprimanded for that. the new film "francis, the pope from the new world." he joins us this morning to talk about it. andrew, nice to see you this morning. >> good to be here. >> controversial comments this week. bishops have already been calling for the pope to be more declarative on exactly where the church should stand on these issues, on abortion, contraception, gay marriage. what do you think the pope's comments did to, i don't know, make the bishops happy? did it infuriate them in some capacity? it seems like there was a bit of outrage here. >> i think people need to understand what the pope's actually saying and what he's saying is that the catholic church can't be reduced to one or two issues. one or two issues tend to dominate the coverage of the catholic church but the catholic church is about a lot more than just the one or two issues that

tend to get the focus of the cameras or the headlines. and i think that's a really important thing for people to understand. he gives a 13 page interview. >> right. >> all of the headlines deal with three paragraphs. >> of course, this is a big question though for the future of the catholic church. he was calling for balance it appeared in this interview, more balance in the catholic church, balancing these issues between tradition and modern day social issues that we're dealing with. does the church get hurt if it doesn't tackle some of these issues. >> well, i think it's very important that we take a look at what he's actually saying. what he's saying is that the church has to be embracing of everyone, has to be welcoming of everyone, has to be for giving of everyone. this is something that his predecessor said. it's interesting, he was asking the question, you haven't talked a lot about these issues. his predecessor was asking the same thing. you gave a whole speech, you didn't talk about these. the church is a positive option, it's not just a set of prohibitions.

when francis says it, stop the presses, this is new. in a way benedict also said this and francis was very pointed in his enciclycal about the importance of marriage. he gave a speech to catholic gynecologists speaking about the importance of the right to life. so it's not that he's running away from these issues in any way. >> right. >> he's simply putting them in the broader context. >> and he has been called the relatable pope. >> sure. >> you have done this big documentary on the pope. let's take a look at a clip and have you take a look. >> for me, he was very down to earth and normal. >> the fact is, he was always a person that liked to learn about reality by living it. you would always run into him in the neighborhood. he was never a desk please. >> the documentary is "francis, the pope from the new world." what did you learn? >> going down to argentina, talking to the people he worked with, the people he grew up with you come to understand that he's

upscale mall there. 59 people have been killed. nearly 200 people are injured and several hostages as we understand it are still being held at this hour. >> connor pao is live in jerusalem. we understand shots recently fired. >> reporter: it's a confusing situation there. 24 hours in fighting is still ongoing in the shopping mall. police and soldiers don't have a full grasp of the situation there. there are loud bursts of gunfire being heard throughout the morning. police have been reinforced by kenyan soldiers. they have a large part of the mall secure. there are other parts unsecured. many people are unaccounted for. authorities believe that there are still gunmen running around the mall either in the basement or upper floors. there could be 10, there could be 20. the authorities there simply really don't know. they are saying that there is an unknown number of hostages being held by those gunmen. >> we believe that there are still some people in the

building. we believe there are some people in the building and that is why we say that the situation is very delicate. we are doing everything reason bli possible to make sure that the hostages who are still in the building come out safely. >> more than 1,000 people have been rescued or escaped the building in the last 24 hours, including some that have just sort of fled the building in the past several hours or so. it is still a very ongoing situation there. they're talking about it being fluid and changing. a lot of questions about who's been injured, who's been killed. we're still getting some trickles of information from the u.s. secretary of state and also from authorities in kenya right now. right now the death toll stands at 59. but considering that al shabab gunmen are believed to be holding the hostages there are refusing to negotiate, tucker, alisyn, we feel that that number could go much higher. >> thanks so much for that update and all of the breaking news. we'll check back in with you. let's talk about who is al

shabab. it may not be a name that you're that familiar with. they are affiliated with al qaeda. they have joined forces with al qaeda. they've come to the fore. they've been labeled a terrorist group. they formed as we say here in 2006 officially and they came to the fore when they took over most of southern somalia. >> right. they became a u.s. designated foreign terrorist group in 2008. there's between 7 and 9,000 fighters, and they took to twitter almost immediately and laid claim for this attack. they say it's pay back for kenya's involvement in somalia. they had hoped, as we were talking with ryan morrow earlier on the show, al shabab had hoped or al qaeda in that area had hoped that somalia would be a home base of operations completely controlled by al qaeda. you have other african fighters who came in and stopped that. >> they're one of many groups who have emerged from somalia. they have not had a working government since 1992. blackhawk down and that very

bitter experience. somalia has been a launching ground for a lot of lunatic fring groups and islamist groups. >> make no mistake, this is an attack on the west. when you go into an upscale mall and you designate and look for people who are not muslim and you're asking them questions and pull a gun on them and shoot them when they cannot answer a mutt limb-related question in an upscale mall in nairobi, this is an attack on the west. when you hear from the administration that al qaeda is on the run, that it's incapacitated. they've been planning this attack. they said in 2011 they were going to carry this out. they plotted it for two years. >> many counter terrorism experts have objected to the president saying that al qaeda was on the run because they might just be calling themselves a different name. they might be affiliated with a different group like al shabab. let's hear what is being said

about this last night. >> al shabab and jihad is part of al qaeda. they have been threatening the kennian forces and the president not to send forces and the peace corps that are trying to standardize somalia. this is evidence that al qaeda organizes itself internationally. it's not just a local problem with the mall or an ethnic group. if we do not counter the ideology, it will create extremism. it will create things that we've heard, that the christians let the muslims go out. that we attack the christians. let the shia go out, let the sunnis stay. the whole issue is about radicalization. one of the problems we have in washington is we have ignored the fact that there is an ideology. this is what happens when you ignore the ideology producing that kind of extremism. >> are we ignoring the ideology? aren't there all sorts of programs trying to build schools for children in afghanistan to

let girls go to school so that people can understand what the world is more like? >> absolutely. >> what the west is like? of course you have to tackle the ideology. >> and none of it works because i think you're absolutely right, there is billions, billions being spent by us to improve the life for people in the middle east and south asia. the idea is that they will love us once they see how progressive we are. the truth is this is a religious work. it's hard for the western mind to understand. we don't have religious wars, we don't think that way. it may be that the average person in somalia doesn't want gifrls to go to school. it's antithetical to our values. it has proven that you can kill the leaders. >> even saudi arabia tried to tackle this in their own country. the radical schools, even the saudi arabian government couldn't tackle radical islam. >> talk about pay backs since they've been paying for radical schools for mastians and for all

kinds of indoctrination around the world. they've been paying for this for a long time. >> you can weigh in and let us know your thoughts. meanwhile, let's get to your headlines. there's new video in of a deadly attack on a church in pakistan. more than 50 people were killed and another 100 hurt when a bomber attacked the church at the end of today's service. this happened while worshippers were lining up on the front lawn for a free meal. most of those killed were christians. >> new overnight, iran's president said he's ready for nuclear talks with the u.s. assad rouhani is going to attend the u.n. general assembly this week. the two talking, well, it's really a moot point. >> understand rouhani does not control their nuclear program. he doesn't have that portfolio. the supreme leader has that

benefit of the doubt. i try to anyway. he's saying, a, that republicans are against this because they just don't want to give people health care. they have some irrational aversion to health and, b, to the congressional black caucus that we've overcome far darker threats than these. if that's not a dog whistle, i don't know what the term means. >> exactly. you combine this with his comments last week about extorsion and you really can't go anywhere from there. what kind of debate is it when you're simply accusing republicans of extorsion saying people don't want you to have health care. when president obama says he wants to give affordable health care to everyone, obama care is not the way to do that. we know that. when it comes to negotiating with congress and the people that he's berating here and using this language against, president obama seems to be fine with negotiating with people like iran and president putin but he doesn't seem interested in negotiating with people like john boehner despite the american people saying by a 44-22 margin according to a wall

street journal poll last week, this that they don't want the debt ceiling raised. >> that rhetoric is so outrageous and so over the top and for a guy who's smart and understands language, i think the president cares about language, to use words like that really tells you how desperate they are. let me ask you though in fairness, the president's refuse being ing to negotiate with john boehner. are they really fractured? >> the republican party is fractured because they're afraid of the fallout of what would happen should we not increase the debt ceiling, but you look at 9 polling as i just mentioned and the american people don't want more debt. and when it comes to president obama repeatedly blaming republicans and somehow telling them that they're not willing to help people with health care or that they're extorting the american people for not raising the debt ceiling or that kind of language, let's go back to 2006 when president obama himself said an increase in the debt ceiling was a failure of

kids are done playing. ali. thanks. some parents of students in lees elementary school in alabama were in for a shock when some children came in with a consent form to issue corporal punishment. failure to return the form would be authorization, permission. corporal punishment is legal in 19 states. is it a fair way for schools to discipline students. here is blogger of mean moms rule, denise shipani. senior policy research center, peter. peter, would you sign a permission slip allowing teachers to issue corporal punishment to your child? >> i personally might not but that's because i would want the school to notify me of the disciplinary infraction. i might discipline corporal

punishment at home in response to that. i understand there are some parents who see this as a legitimate form of punishment and are perfectly happy to delegate their authority and right to use disciplinary spanking to the school as a way of supporting the methods of discipline that they use at home. >> denise, in places where corporal punishment is outlawed, in those states it's surprising for those of us who live there to hear that in 19 states it's still legal and it's still happening in public schools. >> yes. >> this was a public elementary school. you are a mommy blogger. do you think that there are some cases, obviously there are some kids who are very disruptive, do you think there are some cases where teachers should be hitting kids? >> no, i don't. in fact, i think it's never right to hit a child whether it's at home, definitely not in school. these kids are looking to their teachers as role models, as people they should be looking up to, and i feel as though teachers have so many weapons in their arsenal to keep control of the classroom that resorting to

physical violence just seems like a bad message to send. >> peter, we talk all the time about how it's sort of irresponsible for parents to outsource so much parenting to schools, to the state government. so why outsource this kind of discipline? >> i don't see this as outsourcing discipline. this is allowing the school during the hours when the school has authority over your child to exercise discipline over the child. when the child is home they're under your authority and you have the power to decide the discipline. i think that ultimately the decision should be up to the parents, but because there was a form sent home allowing the parents to make that choice, i don't see that the school did anything wrong here. >> now the -- again, as we said in the intro, the form did -- it was implied that if you do not send the form back, then you give your tacit permission, denise. i mean, again, this speaks to some parents d some things are

sometimes lost in the backpack. >> yes. >> you know, sometimes you don't see all of those forms. >> right. right. that's the first thought i had, that my kids come home with piles of papers and there might be things that i don't see. and i also feel as though if there's a problem with my child in school, i'd rather the teacher come in and talk to me or have me come in and talk to them. i just -- again, i just think hitting a child is just never, ever the right way to handle things. >> peter, does it change your opinion that this is okay to learn of the study that came out last year, a fairly comprehensive study from "the american journal of pediatrics" that found there was a link between corporal punishment and mental disorders in kids, that it increased anxiety and depression in children? >> the problem with studies like that that address, quote, unquote, corporal punishment, is that they lump together ordinary disciplinary spanking with beating, whipping, and other more abusive forms of corporal punishment. studies which actually separate out ordinary disciplinary

of the aca with respect to getting the medicaid benefit. those people in those states if they want to go to exchange have to go to a federally set up exchange. these exchanges are places for individuals and business owners to go purchase or acquire insurance for their employees or individuals. >> so how should if i'm a small business owner go about getting insurance coverage for my employees and for myself starting at 100 days? right. >> 2014. countdown is now. we're a licensed insurance agent in all 50 states. we would strongly suggest that you use a broker because these exchanges are extremely difficult to navigate. matter of fact, they kick off on october 1 in many states but we don't really think they'ring there gob 100% functional. >> how are they difficult? >> extremely complicated. the purchase of insurance is not like buying an apple for $1, $1.05. there's the cost of it, the type of product and then you have to look at the quality of thenetwo.

maybe the network is overtaxed. you call up dr. a or b and you find out you can't get an appointment for two months, three months, four months. they're not easy to navigate. >> what about taxes? >> one of the issues of the affordable health care act is it's now taken a complicated purchase of health insurance and it's combined it with the tax return because individuals and business owners can get tax subsidies which are supposed to offset the increase of premiums. this is how this was set up. so it is extremely complicated. not all the rules are written from the irs in terms of how you get the particular subsidies. >> can we look at walgreens example? is that something small businesses should consider which is that they've gotten subsidies or gave subsidies to their employees to allow them to go out and get their own health care insurance coverage? >> we seem to think that this

to take home and -- like milk. this says sell by monday, september 23rd. well, that milk, you can take it home and you can consume it for the rest of the week because it will still be good, but people think that sell by means it's bad after that date and a lot of food gets wasted that day. >> people toss it immediately. what a great marketing device for food manufacturers. if you want to sell more milk, get people to throw out more milk. >> right. and that's why there is no -- some of these sell by dates, they can differ. some people -- some companies might put that date seven days from now. some might put it ten days. so there's no standardization. some of these things are fine because they'll say quality best if used by, but any of these use by dates or sell by dates, they have nothing to do with food safety. >> so if you're the consumer and you see a sandwich or milk that says use by or sell by a certain date, how do you know if it's safe to eat? >> well, it will be safe assume

that go there hasn't been temperature abuse. assuming that the milk hasn't sat out at, you know, 70 degrees. so for milk and those things, if you're concerned. try to look for a pack on date. >> does that have that? >> this one doesn't but, for example, this sandwich says that it was packed on the 19th and it can be sold until monday, till the 23rd. now you can still eat it after that, but if you're buying this in the store, you probably want one that's packed on the same day. >> you wouldn't want to eat it because it's a sandwich in plastic. you wouldn't want to eat that. >> what about sniffing food? >> sniffing food is fine if you can actually smell it and it isn't all wrapped up. >> like milk. i'm wondering is the milk -- i shake it, no chunks, doesn't smell bad. >> then it's fine. >> now, okay. does yogurt -- do the same rules apply to yogurt? yogurt is already curdled? >> no, yogurt is actually fine for much longer than the use by

"fox & friends" hour three starts right now. now we begin this hour with a fox news alert. at this hour terrorists are engaged in a gun battle with special forces in kenya, nairobi to be exact, after killing dozens of people at an upscale mall there. 59 people are dead at this point. >> we're live in jerusalem this morning. good morning, connor. >> reporter: good morning. the worst of the fighting seems to be over. 24 hours into this there is still fighting going on. there are reports of loud explosions and gunfire erupting from inside the mall and from that area. witnesses say al shabab gunmen stormed an upscale shopping market and mall around noon local time yesterday carrying

ak-47s and throwing hand grenades. they were targeting nonmuslims and westerners. as of now police and kenyan soldiers have much of the mall secure. parts of the mall are unsecure. they believe there are 10 or 20 al shabab gunmen still inside the mall or hiding in a basement area and that there are an unknown number of hostages being held right now. >> we believe that there are still some people in the building. we believe there are some people in the building and that is why we say the situation is very delicate. we are doing everything reasonably possible to make sure the hostages who are still in the building come out safely. >> now more than 1,000 people have either escaped from the building or come out safely being rescued earlier in the day, even just a few hours ago. there are reports that hostages or people stuck inside the building facility had actually

escaped early this morning. right now the death toll is at 95 but we expect that number could actually go higher because al shabab, the gunmen are refusing to negotiate. this is a particularly violent and sort of nasty organization that is based in somalia and they have really confirmed their reputation as a violent organization, guys. >> connor, can you just clarify for us what the death toll is? we're getting conflicting numbers. what number are you using? >> we're hearing 59 but that's the last we heard from kenyan authorities. that number is likely to increase. we're hearing lots of different numbers. this is still a very fluid number. i think the kennian authorities are still trying to figure out who's been killed inside the mall. they're still pulling bodies out. >> do we know if there are hostages at this stage? >> yeah. we're hearing anywhere from sort of 10 to 30 or so hostages but, again, it doesn't sound like al shabab gunmen are communicating with kenyan authorities. we are hearing there are a lot

of hostages and they include at least women, we don't know about children. there was a large event that was going on yesterday that included children yesterday. it's very possible that you're talking about men, women, and children in there right now. a lot of conflicting reports. not a lot of good information coming from inside the mall right now, guys. >> it's a shocking story. thanks a lot for the latest. >> thanks, connor. al shabab is saying, they laid claim to this on twitter, saying we are responsible for this, that they say they've killed upwards of 100 people. they have been known in the past to inflate and exaggerate their numbers to drum up more outrage about it, but we still don't know whether or not that number is going too reach 100. we sure hope not. let's talk about who al shabab is, what we know about this terrorist group. they are a clan-based militant group. they are al qaeda linked proudly. they formed in or around 2006. somalia is their main operating base. >> somalia being really the

world definition of failed state, a country without an operating government for over 20 years. you'll remember in 1992 the famous blackhawk down incident in mow gu deshu. there has been no one in charge in mow gu did i shu. >> they say with their estimated 7 to 9,000 fighters, they have been fighting certainly the kennian government. they say -- this was a response to kenya's involvement in somalia just a few years ago. 2011 they said they were going to wage a large scale attack in response to this. >> they're believed to have trained in afghanistan alongside al qaeda terrorists. we had ryan morrow, a terrorist expert on our program earlier and he helped give us some more context. >> al qaeda, al shabab, was going to take over somalia, make it the first country in history directly run by al qaeda but

then the african forces went in, including from kenya, and stopped that from happening. and so they're very upset at that. but their focus isn't just on somalia. they want to basically turn it into what afghanistan was before 9/11, create base for themselves, and then start attacking the west. >> great points that ryan is making. and to your point, tucker, about somalia as a base of operations where al qaeda could have taken hold. the kenyan government has taken response. >> somalia has been an open wound in east africa for all of these years. it's been a home base for pirates who have disrupted shipping off the east coast of africa. it shouldn't surprise any of us that a place like that would be a perfect breeding ground for a group like al shabab and other lunatic groups with anti-western aims. >> read mark baudin's book. >> fantastic book. back home, president obama took the opportunity last night to really unload on republicans. this is at an awards dinner for

everybody has affordable health care. let me say as clearly as i can, it is not going to happen. we've come too far. we've overcome far darker threats than those. we will not negotiate over whether or not america should keep its word and meet its obligations. >> but some of the most enthusiastic supporters of defunding obama care on the right, like republican senator rand paul, are saying now the entire effort to defund obama care is more about leverage at this point. senator paul said this weekend, quote, i'm acknowledging, we can't probably defeat or get rid of obama care, but by starting with our position of not funding it maybe we can get to a position where we make it less bad. so the government is going to shut down if congress can't come together and agree on a spending bill to fund the government by the end of next monday, september 30th, but there are new reports that suggest that even if the government does shut

so you can. president obama refuses to negotiate, will the two make a deal to avert the shutdown. here to weigh in is chris wallace host of "fox news sunday." chris, as you know, the president spoke to the congressional black caucus and here's part of what he said. >> let me say as clearly as i can, it is not going to happen. we have come too far. we've overcome far darker threats than those. we will not negotiate. >> we've overcome far darker threats than those he tells a congressional black caucus. that is a dog whistle. that is the race card being played. can you see any other

explanation for it? >> oh, i don't know. i think to get to the real point though, they are not going to compromise. >> isn't it news if the president says to the congressional black caucus, we have overcome far bigger threats? that's taking rhetoric to a bigger place, is it not? >> i don't know, tucker. do you want me to talk about the health care? >> yeah, if you would. >> obama care? >> that would be great. >> okay. what i was going to say is that i don't think that there is going to be a compromise on this and i don't think that republicans think that's going to be a compromise on this. in fact, we're going to be talking to ted cruz at the top of the hour and i suspect that a lot of republicans -- well, i know this -- are upset with cruz because they feel that he has pushed them into this. what bob corker, the senator from tennessee calls a box canyon. which means there's a way in, there's no way out, where they have linked funding the government to defunding obama care and my guess is that

they're going to have to back down on this and they're not very happy with senator cruz. therein lies the problem with the party. senator mccain has called this an exercise in futility and senator rand paul has said we probably can't get rid of obama care. so senator cruz is the one who's reading from a different script. >> well, that's right. and it's going to be fascinating to talk to him at the top of the hour. i have to tell you, this has been a remarkable event this week because i have gotten unsolicited questions and research, not from democrats but from top republicans here in washington who are upset with cruz. their feeling is -- look, he kind of forced the house and john boehner, who didn't want to go down this road, into this. they wanted to have, yeah, we'll defund "bomb ma care but it would be a measure that could be taken out that they have made their point and then they go ahead and fund the government. i know some people are not happy with that, but the fact is, it's

awfully hard, in fact some people would say impossible to govern the country when you run one-half of one-third of the government. they control the house. they don't control the senate. they don't control the white house. so the problem is that they just don't seem to have the votes. and you've got cruz in a situation now where he's saying, let's block. let's filibuster the bill the house passed. the bill the house passed would defund obama care. you're now asking republicans who want to defund obama care, yeah, it's passed by the house, but let's block it. let's filibuster it so it can't come up for consideration. that's counter intuitive. >> you have senators like john mccain saying our party can't do the math. you'd need 67 votes. members of their own party making math jokes about other members of the party. seems like a big problem. >> i don't know that this is necessarily bad for the house to have taken this step, to have voted to defund obama care but, you know, we're up against a

you know we can still see you. no, you can't. pretty sure we can... try snapshot today -- no pressure. sales on existing homes hit a 6 1/2 year high with nearly 5.5 million houses sold last month. it's a surge. what's behind it? will it last? joining us is real estate expert morgan brennan. thank you very much for joining us this morning. >> thanks for having me on. >> this is good news for people who want to sell their homes? is this real? why is this happening in the middle of a soft economy? >> the first thing to remember is we are seeing a recovery in housing. how fast that recovery continues to grow remains to be seen. in large part we saw home sales grow in august because of what the national association of realtors is referring to as a temporary peak. it's because we've seen a

drastic rise in mortgage rates since may. we've seen the 30 year fixed mortgage jump by more than an entire percentage point in may. that has propelled a lot of potential home buyers to come off the sidelines and lock into rates before they get higher. >> now's definitely the time for sure. but is this also a sign that lenders are loosening up credit? i know that ordinary people were having a tough time getting, say, a 30-year fixed rate loan. >> this is still an issue. we still see tight credit. still a big issue. probably more so moving forward than rates even especially in light of the fact that the federal reserve came out this week and said that they would keep up their $85 billion per month bond buying program. a fact that will probably keep rates at about where they are, keep them from growing at the drastic rates we've seen. tight credit is an issue. another thing weighing on home sales and will be moving forward is the fact that we still see very tight inventory levels. construction coming back but not as quickly as the demands that

we see out there. i think we'll see a lot of uneven sales activity over the next couple of months because of all of these factors. >> this is good news. you always want to see commercial activity taking place like this. >> it is. >> the last time we had a housing bubble it tanked the economy. have the roots been addressed and fixed? should we be worried about this? >> we still have the government basically propelling the mortgage industry right now. we do see that recovery. one of the things that economists have been keeping a close eye on is we've been seeing that double digit rate of home appreciation in the last couple of months. that's not something that's sustainable. that's part of the reason we started to hear the "b" word, the bubble word. the fact that rates have been riding, te rising, the fact that we will see more inventory coming onto the market into next year, all of those factors will start to slow down. we're starting to see this. starting to slow down the frothy pace of home price appreciation. i don't think you'll see home

i was hoping it wouldn't. i was hoping something so simple as handing out the constitution would not be seen as a bad thing, but apparently they didn't agree. >> robert, i had a viewer write into me about this story and he was sort of on the side of the school. his point was, if you just let college kids start to protest or start to hand out whatever they want to hand out -- i'll make my point while we get the satellite back. here is what the viewer said. he had an issue on his campus where neo-nazis were handing out things. you know, that there are free speech zones, they sound absurd, but college kids will do sometimes ridiculous things if you give them free license to hand out things. >> let me answer for robert. it was constitution day. and when you have these blanket policies without any sort of human accountability behind them, common sense behind them, it's absurd.

believed that about 15 or so al shabab gunmen now control some of that shopping mall. there may be as many as 15, including one al shabab female gunman there, as well. we think there are hostages. the numbers are estimated from 50 to 200. the red cross is saying there are 49 people unaccounted for. now, fax news has learned israel has sent a special time to nairobi to help with the negotiations. the shopping mall is opened by a wealthy israeli businessman. security officials say the israelis are there only to assist with negotiations. 24 hours after al shabab stormed this upscale shopping mall, loud bursts of gunfire continued to fill the air in nairobi. the attackers were targeting anonymous limbs and westerners, yesterday even ordering mutt limps to lead a foot food court area. nearly thousands have left the mall, including some this

morning. the death toll could increase as we get more information and because the gunmen that are in the mall are refusing to negotiation or release any of these hostages. so there's a real concern that this death toll may increase in the coming days and weeks. guys, back to you. >> thank you, connor. let's break down exactly what this group is, what they say they, anyway. al qaeda linked militant group. they formed back in 2006. somalia has been their main operating base. they said because of kenya's involvement in somalia, that's why they carried out this attack. they wanted somalia all to themselves, to set up complete al qaeda camp there. >> al shabab's senior leadership is affiliated with al qaeda, proudly, they say, .they are believed to have been trained and to have fought in

afghanistan. also, al shabab became a u.s. designated foreign terrorist organization in 2008. they are estimated between 7,000 and 9,000 fighters for al shabab, and the group, as we said, has claimed affiliation with al qaeda since 2007. >> somalia is also a key point of origination for pirates. this is the latest of a lot of problems to come out of there. there are many, many thousands of somali refugees in the united states who have been resettled by religious groups and the u.s. government. >> this is the latest terrorist attack affiliated with a group, al qaeda. and you often heard from the obama administration that al qaeda is on the run. the president has said that not only during the campaign but after. but the infrastructure of al qaeda has been dismantled.

that may be true in part, but now spread with multiple heads popping up around the world. >>. >> shabab jihad are part of al qaeda. they have been threatening kenyan forces, the kenyan government and the president not to send soldiers and the peace core, and the peace forces that are trying to stabilize somalia. so this is evidence that al qaeda organizations itself internationally. it's not just a local problem with that mall or a local problem with an ethnic group. if you do not counter the ideology, it's going to create extremist, create things that we've heard, that we attack the christians or in pakistani or iraq, let the shia go out, let the pakistanis say. the sheer issue is about radicalization. this is what happens when you ignore the ideology producing that extremist.

>> your view is there is a huge battle, as you know, among republicans in washington. how to respond to obama care. some say to fund it. others say we need to shut down the government. what's the best course of action at this point for republicans? >> well, i would be really happy if we could, in fact, defund it. but the fact is, we don't have the vote. so that's not going to happen. and my view is that the republicans should take a deep breath and they should let this house of cards collapse on its own. once the individual mandate is implemented starting in 2014, the american bub is going to actually revolt. this is going to be a huge problem. you've already got labor unions suggesting that they don't like the plan. but once those people have to buy insurance and find out that their premiums are going to be higher because there are all sorts of mandated services that are not there before. and for those people who can't afford it, they're going to end up having to pay a fine.

the american public is going to say, wait a second, this is not what we bargained for. >> and there are some saying even before implementation, a recent poll found american independents 32% approve, 60% oppose. do you think this may be the reason is president is sounding almost hysterical in his defense of health care? >> he is. and going to the black caucus and playing the race card on this issue is ridiculous. i predict even after it's fully implemented, you'll have at least 30 million people uninsured because people who are young and healthy will not buy into the system. it will be cheaper for them to pay that $95 fine in 2014 or $325 fine in 2015 than it is to go out and pay a couple thousand dollars of insurance.

>> i do like a hurkey jerksy dance. communities across the country are passing laws threatening renters with eviction if they make too many 911 emergency calls. now some domestic violence advocates argue that these laws could endanger free speech rights. ashley merchant and sandra are with us. nice to see you. >> good to see you. >> so it's kind of like a three strikes and you're out law, ashley. you agree with this, that it's okay that after the third phone call that they get evicted. tell us your thoughts on this. >> well, i think that the purpose of the law is a good purpose. it's trying to make the community safer. and we're saying that people that live in these areas don't want to have these types of situations around them. the problem -- and i understand the problem -- is that they don't want to discriminate

against victims of domestic violence. and i think that that is a valid issue. but i think that the purpose of this law is okay. i just think they need to get to a better way of enforcing this law. >> sandra, is that the issue, just the enforcement of this law? we've had cases, and one case in particular where one woman was stabbed and had to be air lifte threatened with eviction now as a result of this. >> well, wa we've seen with these laws which penalize your right to call the police and end up in your eviction is that they harm all crime victims. i represent a domestic violence survivor who, when the police came to arrest her abuser, told her this is your first strike, you will be on eviction if there's three strikes total. so after that, she was terrified to call the police. and so even when her abuser came back and now they had long ended their relationship, he stabbed her in the neck. she did want want to call the police because she was so afraid of losing her home.

>> here is a statement of the town of morristown. the provision does not in any way cripple nate against any purposes nor does it punish victims of domestic violence. the northtown police department remainses vigilant for those crimes. but ashley, the question from domestic advocates who say they want to protect against domestic violence that this person might wait out the three phone calls, wait until they know this person has exhausted their three phone calles and do something really tragic. >> it has safety calls and an appeals process. so if a person has to make three or more calls, they can appeal that three strikes. so it does allow for instances where it's true domestic violence to actually appeal and still be able to call 911. the law's whole purpose and the aim is to avoid just disturbances and calls that really shouldn't be going to

911, should be going to the non-emergency police line because we don't want 911 to be clogged up with non-emergency type calls. so it's aiming to change behavior to get folks to discriminate between an emergency call and a non-emergency call. >> so, sandra, ashley brings up an interesting point which is that they have being flooded with these calls. some are non-emergency, some don't rise to the level of police interference. would some be better suited going to some nonviolent advocacy or shelter? >> well, what we see here is that the law was enforced while my client was in the hospital recovering from a stabbing. they sent a letter to her landlord saying you must evict her. and even with that eviction was unsuccessful, they then threatened to condemn the property and forcibly remove her. so i think it's somehow misleading to say there's safety valves. there aren't in terms of how they're using these laws against survivors. and the other problem here is that the law does not let the

survivor challenge whether or not the appropriate is an appropriate strike. the letters get sent to the landlord. the landlord oftentimes does not have an incentive to challenge what the city is doing. >> ashley, with a few seconds left, i'll give you the final word. >> i think landlords have a right to have property free from police presence. and landlords want to be able to rent property. so it makes sense for landlords to want to have a property that doesn't have a lot of police intervention. >> ashley and sandra, i appreciate you for joining us this morning. coming up, the pope making waves with his comment that the catholic church will suffer if it does not make -- for gays. then it's a story we've been telling you about, hundreds of teens trash an nfl star's home when he wasn't home. so he invited them to come help clean up.

church stands on this issue. he said i've gotten a lot of criticism for not talking enough about abortion, about gay marriage, about contraception, etcetera, etcetera. he said i am purposely not talking about those things. >> why not? >> whoa, people said that's the foundation. he said that's not if foundation. the foundation is the whole message of jesus christ. that's the gospel. of course, he says, insisting only on these things happens is we end up forgetting the rest. so it's a choice he's made. i don't think he's saying -- i'm sure he's not saying, therefore, nobody should talk about those things. but i, as pope, am always talking about things than the rest of the message gets lost. >> so interesting that he doesn't want the controversy to ee clept the rest of the message. is there some indication he's taking a more lenient approach to the topic? >> it's a very different tone. he was asked about gay marriage

in this interview and he said, you know, if somebody asks me, what do you think about my homosexuality? he said i wouldn't respond by saying if jesus looked at you, he would recognize your existence and would not deny it. something along those terms. that was the whole interview in my facebook and twitter to look at. but it's a different tone. it's a very, very different tone. >> and as my point of view as a non-catholic, not that surprising. what was surprising to me was coupling the three issues together. contraception, gay marriage, but abortion is a matter of life and death. why was it coupled with the other two issues? >> he's saying these are the issues that we're always asked about. i think in part it's the media who is getting up to talk about these things, right? obviously. but he's saying, these are the controversial issues of the day and we should be careful not to be only talking about those. the tone is very, very different. and it's making me question and

i -- am i talking about go the god than people who are on a different side of these issues can experience that? >> is this an awareness of the acceptance and trying to reach a larger audience for the church? we were just in a foreign country not too long ago, went into a mass in an old church. there was a lot of people in there, but they were older, much older. and i didn't see any young people in there at all. >> but i don't think it's a strategy, a pr strategy. how do we get a few more people in the pews? he's doing it as a shepherd. i am paul, we are called to reach out to everyone. do you guys mind if i tell a very, very personal story very quickly? >> we would love pit. >> my sister is a -- she is legally married in washington to another woman this year. it's been very hard for the family. and she's been struggling with her faith a lot because of the church's stance. she wrote me this letter after she read pope francis's interview. listen to this. this is my sister, ann marie. and she gave me permission to read this.
