take it away. this is a fox news alert. there is new information about the terrorists who attacked a shopping mall in kenya. tonight the foreign minister telling pbs two or three americans and one brit were among the vicious terrorists who carried out the massacre. foreign minister saying the terrorists were 1820 to 19 years old and lived in minnesota or missouri. tonight, the state department insisting it doesn't know the nationalities of the terrorists. more than 60 people were killed when gunmen stormed the nairobi mall. the kenyan military is still battling the terrorists.

>> how do you prevent senator reid from essentially stripping out the defunding part of the house bill and send ing it right back to the house which is strictly the continuing resolution to be voted on? how do you stop him from taking out the defunding part? >> tell him in clear terms there are ways to handle this. number one, he can bring the bill up. let us vote for it. up or down, b as is. number two, he can bring it up and say we'll allow amendments. we will debate, discuss and vote on them. what's not fine if he wants to say, i want my cake and eat it, too. i want only one amendment. that will be to strip out the defunding language, to gut what the house did in support of the american people. we can't let them have that. >> that's behind door number three. he can pick what's behind door three. behind doors one and two which you can live with do you have your republican brethren willing to push, for instance, to have

open amendments to the bill? >> i don't know any of my republican colleagues who would oppose either door one or two. if he pulls door number three we ought to oppose it w everything we've got. anything that will make it easier for him to undo what the house did. >> given the opportunity are you willing to filibuster or -- do you plan on filibustering any aspect of this? >> oppose any procedural motion. >> does that mean filibuster? >> the word filibuster carries different connotations in the united states. >> let me give you the one. where you stand up and keep talking until someone cries uncle. >> it's not always possible given whether or not there is a floor agreement governing time. another definition includes voting no on the cloture vote. that's the mechanism by which we could fight harry reid on door number three. to vote no on cloture on the bill.

give us all the e-mails from lois lerner, et cetera, we'll keep pushing and get to the bottom of it. today, the day lois lesh lerner is retiring is the same day sara hall ingram was interviewed. she was lerner's boss and then moved over to move the imple men tags of the affordable care act, obamacare. we finally got her in front of the committee for a deposition today. we'll continue to dig and get to the truth. >> that was my next question. i i knew she was deposed. what did she say? >> haven't had a chance to go through the deposition, the transcript and get the answers and look at everything yet. we are schedule ling her to come in front of the committee in the near future and we'll have a chance to look at it. i can't get into details of what she did. again it's been since may since they knew about this. we finally get the lady in front of the committee staff to be deposed. i can't wait for her to be in front of the committee.

misspoke or we misassigned the idea that raising the debt limit isn't going the to raise the debt? >> i think the president is confused. senator barack obama said there is a failure of leadership. for the president to believe that pushing the debt ceiling out even further -- and full disclosure. i voted for the budget control back in august of 2011 because i uh saw a 70 to 75% solution. i don't think people in washington, d.c. really want to solve the debt crisis for the united states of america. when you look at the debt to gdp ratio we now owe more than we are producing. furthermore you have a federal government spending 25% of your gross domestic product. that's on the way to about 32%. >> the example is given and it's the perfect example. if you have a $5,000 limit on a credit card and you have hit the $5,000 limit and you call to get it raised to $7,000. you spend $7,000 you have

then there are people who may have a green card or something, have legal standing. then there are people here illegally. is the state of california including in the category of people who might be able to serve on juries as people who are here illegally and as poll watchers? >> no. it only affects immigrants here legally. >> in terms of there is another aspect. i read some place else in california if you are not a citizen you could still become a lawyer and practice law and be licensed to practice in the state. is that correct? >> yes. that could affect some immigrants here illegally and were brought as a child by their parents. essentially sort of a dream act

type of situation. that was passed by i the legislature as well. >> is this bill popular among people in california or are people up in arms about having people here legally but having noncitizens serve on juries or monitor polls? >>it's divisive. it's a question of what it means to be a citizen in the country and in california. a lot of republicans opposed the bill to allow noncitizens on juries because the people making the laws are american citizens. they wonder why should we have noncitizens interpreting, implement ing the laws when they sit on juries. >> in terms of governor brown he's in favor. he signed one and he will likely sign the other, right? >> we're not sure what he would do with a jury situation. he hasn't indicated one way or the other. he holds his cards close to the chest on this.

if you see it as a duty, which i do. i get called once every two years. we spend a lot of time on jury duty here . i don't see a problem with legal residents being called. lawyers ask tough questions. we throw citizens off the jury, we'll gladly throw legal residents off if they are a bad juror. >> i haven't head the case in 1880. it talks about the jury being composed of your peers. it says people having the same legal status in society as that which he holds. >> that was the case in west virginia. a law said back then the statute said colored people can't serve on juries. thank god a well written supreme court opinion where they said the 14th amendment was created to over rule slavery and get them on juries. >> which is a different issue than here. >> the destrada decision which i have read about. it's different when you talk about these individuals and peers. i have to go back to peers. i am not saying legal immigrants should serve on juries. they do fay taxes. if they are lawful abiding citizens they should have some of the safe guards. >> it bothers me people watching polls that why we would want
