applied. >> what happened here is a factual gloss that deserves analysis. i tried a case similar to this five years ago. what happened she was in an argument and left and went outside. and got the weapon and went back in. and that makes for a big, big difference factually. i agree when you say stand your ground means stand your grouped. but the argument for the prosecutors are once you have left the house, all bets are off and you shouldn't have come back in. on the practical level, i want to upon that they offed her a three- year play as oopposed to what we are exchaining now. if they offer it gaep they would take it so person.

it tripped out funding for obama care. a lot of your colleagues spent a lot of time on the floor explaining why they were going to vote no for that. why are you voting no on it and why did you vote no? >> i voted no because i vote no when the majority doesn't allow us to vote an amendment. i wanted to offer and amendment which i supported that others introduced that said we should have the level consistent with the budget control act with the level 67 rather than the level 986. and then honestly at the end of the day i wasn't able to support the cr for the same reason. we lost on that vote also we had the levels of spending that were

too high because they don't comport with the budget control agreement. having said that. i think it goes over to the house and the house is going to send it back to us and i think there will be a government shut down. >> what do you think you will get from the house maybe a temporary funding measure that delays a mandate or key parts of the bill? the house republicans stood strong together knowing that it probably wouldn't survive the democrats in the senate? what could they send back? >> they have a tough decision to make. they have to get the votes to pass something. and john boehner is going to have a tough job. one would be a short-term week or week long cr that is possible. while we work out something that

relates more to something in some way. the other is something that comes back with a one year delay and see how that fairs. i think there are probably the votes to deal with this. the bigger issue that concerns me is the other part of the budget. this deals with the third of the budget. two thirds we are not talking about. even if we ended up with the 986 that the senate just passed we wouldn't be busting the amount that we passed last year. 2/3 we are increasing spending and that is what is going to come up. the more serious discussion coming up in a couple of weeks. as you know there are laws on the books that deal with the president committing budgets on certain timelines and for years

it has not been adhered to. the law has been violated many times. do you think some of this is too far in the weeds for average americans to understand in locking up the amendment process so that they can hold their representatives possible so that they can hold the election? >> it is too complicated as well. congress is not doing its work. people would be shocked to hear that the senate has passed it's budge it in 40 years. they have only passed one on time. only one it was a military construction bill which was easy to pass. congress is not doing its work. congress is not going through the normal process to do the oversight on the federal agencies and departments and

pass the bill. if that were to happen there wouldn't be the last minute budget crunches. the house to their credit had been passing appropriations bills. i know it is tough to do. in the senate we have relied on the continuing resolutions. you don't prioritize spending you need to get rid of programs all together. you might want to improve and provide support more. we are not doing that. that is the bigger issue that my constituents do understand. for those of us who are trying to understand this better. if we don't get back to this better we are going to keep running about the deadlines. by the way, it is not only about the uncertainty. it ends up with a bad result.
