>> fox urgent, a u.s. navy seal team conducted a raid targeting the terror group al shabab that is the al-qaeda listeninged group that is thought to be responsible for the deadly mall attack. one person was killed in the raid. we are working to firm up details about whom that might be. the national security correspondent is live in washington with this, jennifer >> we confirm that there were top secret operations carried out by special operation forces in two separate countries today. one was in somalia. that's the one we are reporting

on. a navy seal targeted the head of al shabab. there were multiple targets in a villa in the town, that was a sea side town in somalia and can't confirm at this time whether the head of al shabab was killed in that attack. what we understand occurred in the somalia raid navy seals targets the members of al shabab and that at least one of the targets was killed. but there was a shootout that ensowed and the navy seal team decided to withdraw and they were not able to take the body with them and confirm the identity of who was killed. the pentagon is not confirming that the head of al shabab in somalia is killed though he may have been among those killed because at least one somalia was killed in the raid that occurred in somalia. we learned that there was

a second raid in libya in the capitol of tripoli and the target is a man on the u.s. most wanted list. a bbi- a l libbi. he is in custody of u.s. forces. he was wanted for the attacks on the 1998 on the u.s. embassy in kenya. and he is wanted for sometime. and in fact he has a interesting history. back in 1999 he applied for a sylum in britain. he was interviewed following the embassy bombings and he went on the lamb again and eventually made his way after a roundabout route to libya. he was the target of a strike by u.s. special operation forces and a senior u.s. official

confirms to fox that he is currently in u.s. custody. harris? >> i want to press in a little bit first of all. going back to the navy seal with regards to the mall attack in kenya if we can, jennifer. trying to learn how that would have come about? which government would we have talked with? the somalia government, i saw we were in connection with them and so we could make a hit like this in their country. >> remember the head of somalia is here meeting with the president just receiptly in the last two weeks and he was over in the pentagon as well. there has been cooperation with the president of somalia for quite sometime. it is not the first time u.s. special forces operating in somalia. and we are told from senior military forces, that the targets in the house, there were multiple targets in the sea side town in somalia.

one of the target was the head of al shabab, who was believed to be at the house. there is no way to confirm at this point in time whether he was killed in the attack. the seal team assessed the situation and because of the shooting that was occurring, they were not able to take the body with them after that shootout. and we can confirm tla there was a raid in the villa in somalia. and the pentagon can't confirm. you touched on it about the americans that are in the west gate mall in nairobi. and the connections that our own people would have had happen in the mall. we are looking at more video now. and we knew that our guys are going to assist in investigating that. we knew we had special forces

during the stand off and siege and after. and now we have learned that this is playing out in somalia. before you go, i want to ask you about the situation in trippoli. >> the original reports that there was a second raid came from libyan sources on the ground in tripoli. the target of that strike by special operation forces was a bu a l libby and he's been on the most wanted list. and there was a $5 million reward for him. he is in u.s. custody and wanted for the 1998 embassy bombings in kenya. he is currently in u.s. custody and we are told from a senior u.s. official. >> jennifer griffin, thank you

century. the take out of a senior al shabab leader if that is what happened is a plus, and the fact that the united states acted without a lot of hemming and haing and pawing at the ground and asking for author wragz is a plus. and we had the intelligence to do it is a plus and underlines keeping the intelligence intact. he didn't fall off of the pickle truck. we have to find him and we needed intelligence. >> you it said to our audience. our eyes were wide eped but you said it is important. if we don't have the back bone to use it. >> you can get all of the intel, in the world, but you don't have the capability and fortitude to use it, you might as well not

desperatos. it is an area where people of that sort can live relatively unmolested and we went in and got him and that is to our credit. my guess is, he will be backbrought back to united states for trial in new york. he was indicted there. >> he was picked up on a country that we had a diplomatic outpost hit and there he is picked up in the country. and what do you say about the relations with united states and libya right now? >> i would say they are strained and notice the difference in the raid in somalia and the raid in libya. we were apparently forewarned the somalia government and no indication of forewarning the libya government. i doubt we would have. >> quickly before i let you go.

>> day five of the partial government shut down and the senate adjourned without roaching a deal and without doing one of their most important jobs and awful those law makers are getting a paycheck. so far little process on capitol hill. earlier today the house passed a bill to give 800,000 furloughed federal workers back pay. the vote 407- 0 and showing

a rare moment of bipartisanship but agreeing that is not enough. >> you have to ask yourself with the vote for federal employees, if it is so important to ease the pain for them. what about the vets? do the democrats feel it is not important to ease the pain on them? and what about the sick children? >> it is cruel to tell workers they will receive back pay and then refuse to open the government. >> it will now go to the september. we thought this might happen today and first it was expected they would approved it. the chapses that they would give that back pay, senator reid told our producers it is not a good idea. he will have to think about it. and the pentagon ordered most

400,000 furloughed civilian employees back to work. chuck hagel said the shutdown affects our relationships around the world and cuts to the question of can the united states be relied upon. when might the senate take up the bill and get back to work? >> not before 2 o'clock p.m. on monday. the senate adjourned and without voting on the legislation back pay for furloughed federal worker. they would get the back pay when the government reopens. top senate democrat signalled he is not a fan of the legislation. >> now saying to federal employees, we'll pay you when it is all over with, but stay at home and watch tv and play chess. we'll not let you work. but look a head you will get paid. and so the absurditty of this. >> and it passed the house

unanimously and house democrats who opposed the gop efforts to reopen the agencies supported this legislation because it treated the entire federal work force as a whole. house and senate republicans say the back pay is the way to ease the pain of the shut down for the people and the law makers debate funding for obama care. >> i was reading earlier, that the president said it has to come to an end. was there any meetings planned between the president and congressional leaders? >> no, no meetings planned. the republicans say they are here and ready to talk. >> the president cancelled his trip to asia. that is a unique opportunity if he is here this weekend, we are here. and all he has to do is sit down with the republicans and democrats and we will move forward. >> president obama said he will

look at that cold front. 84 in memphis and 58 in kansas city and look at dallas. 57. and that is an impressive cold front and harris touched on the santa ana winds. this is going to continue through monday to see wind gusts of 60 or 70 miles per hour. and so a dangerous situation for southern california. it is very dry here and attaches are warm in the nines in some cases and 89 for los angeles. and very dry and gusty winds, fire danger will be high. there is carren. there is a burst of convection and heavy rain and dpufty winds on the gulf coast. even though the storm is weakening we'll see the affects monday and wednesday. and our prime time line up

>> new information on the breaking news in the top of the hour. a major terror crack down carried out today. in's raid targetling the terror group and particularly calling out for nonmuslips and killing them in kenya and we know one person was taken out of today's raid and in libya the capture of a wanted fugitive and this raid captured the al-qaeda leader suspected in the attacks on the embassy and in tanzania. they are coming back to us now as she said she would as she learns information. there was an elite hostage

taking group that moved in on one of those raids, jennifer, tell us. fbi sent the elite time hostage rescue team to the mediterranean and to the region to participate in the raid to capture a l libby, wanted for the u.s. embassy bombings in kenya and tan zania. they are used for the purpose of not just rescuing hostages as the name might suggest and they are reading the rights to a l- libby once he is interrogated by the u.s. officials at some point and we are told by u.s. official sources, that the intent is to bring him back to the u.s. to be tried for the bombings of those u.s. embassies. and there was a $5 million

reward on his head. he will be tried in new york and the justice department has prepared a case against him and that is the reason you so the fbi hrt hostage rescue team sent out as part of the national mention force. and we are getting more details of a l- libby inside of libya. first reports came to the ground from reporters and additional sources in libya that it might be one of america's most wanted was wanted and we understand from his family he was nabbed as he came back from morning prayers and the family described it to the associated press, his windo was mashed and he was grabbed from outside of his car just returning from the morning prayers and quickly taken away.

we confirmed from u.s. official it was a u.s. special operation's force time that captured a l- libby who eluded capture since 1998. harris in >> you explained the hostage rescue team. i mis spoke. the hrt team will do the first interrogation of the suspect as well? >> they will be, their principle role will be to read the rights to the suspect. and what is interesting, this will raise all sorts of issues in terms of where to take a l- libby and in if you are talking 12 years ago, he would have made his way to guantanamo bay, that is not where he will be heading and he will be tried in the u.s. court. the u.s. justice department is preparing a case against him and he will be tried in new york. but this is really an

interesting situation. and he is the most high profile high value target that is captured by u.s. forces in the recent years since the president has taken the decision to stop using guantanamo bay for holding and treating these high valued targets as any sort of person who would be sent to guantanamo bay. it will be in the hands of the justice department and the fbi will participate and they will try this one of america's most wanted and a huge day for special operation forces. first the raid in somalia and in which we still don't have confirmation and the target was the head of al shabab and navy seals did kill one person in the compound where a senior level al shabab members were staying and they were not able to take the body with them we are told from

obviously fighting a war on terror. >> in the case of somalia, there was prenotification and how much actual coordination hard to say. interestingly this attack is very near the location of a very attack by special operation forces four years ago by american forces that killed another al shabab leader. this is the kind of reaction we should have more often in terrorist attacks, the attack in nairobi was das tardily from start to finish. it is an excellent response. it is an interesting contrast with what is masked as a law enforcement operation in libya to grab the person or one of the people responsible for the known 98 embassy bombings in kenya and tanzania. it is a hang over from pre- 9/11

days and why the hostage rescue team was involved. >> a law enforcement approach in libya, can you talk with me a little bit about why that is significant? we have an interesting we needed to get into in benghazi, libya and we had an outpost there a year ago. >> it is consistent with the clenton administration and obama administration to treat terrorism like it is a law enforcement matter and after the bombing embassy we had the bombing of the cole and world trade center and others. and now after everything we have learned about al-qaeda on 9/11 and to simply return to the 1998 mentality, pre9/112001 and treat this guy like a bank robber sort

the house passing bills to pay back furloughed workers and a resolution to allow military clergy to provide services even though they are furloughed. that is what happened in the house. the senate decide we are not going to vote on anything. that doesn't mean they will not take them up on monday. this gives them time to figure. and it is suggested they might not want to take that legislation up. and he may change his mind. his pressure from federal workers. and it should be some of the bills. and that is public opinion right now and it changes on a daily basis and if things start to sway in the republicans. and take up the bills. and there is a federal emergency management agency. and the united nutrition

out for what they want. a delay or limitations for the new health care law. >> real quickly they made it a game and i will ask it this way. democrats may have to seize the grounds and republicans are winning this in terms of the public message then? and for the republicans it is winning. everybody assumed the shutdown would mean a loss for the republicans literally. and they are inching back bypassing the bills and taking the pressure off of themselves and we have the memorial. i heard tonight that there are veterans that were turned away and this looks bad for democrats and the president is ultimately responsible. and all of this stuff plays in and everybody has a lot at stake here and that makes the ultimate compromise here work in favor of the democrats and republicans. susan, thank you very much.
