jury formally charged him with murder in the first degree. prosecutors say he shot and killed his friend in the middle of the night, less than a mile from the athlete's multi-million-dollar mansion. aaron hernandez today showed up in a shirt and tie wearing handcuffs. the defense asked to have the cuffs removed and the judge agreed. he stands accused of gunning down his friend. the semipro-football player oden lloyd execution-style back in june. surveillance video from aaron hernandez' home apparently shows him carrying a gun just minutes after that shooting. but, his defense lawyer says prosecutors still do not have the evidence to prove their case beyond and to the exclusion of every reasonable doubt. the new england patriots dropped the tight end shortly after his arrest. hernandez himself has pleaded not guilty to the murder charge and five different weapons-related charges. let's get to our correspondent rick lesson that you who is outside the courthouse in fall river, massachusetts this afternoon. rick, i guess we were waiting to find out whether a gag order would be

extended and they wouldn't be able to talk about what's happening inside that courthouse. what's the word? >> well, shepard, i don't think anyone expected to see aaron hernandez take the stand during this pre-trial conference today. but it happened because the assistant da's wife works in the same law firm as one of hernandez' defense attorneys, michael fee, so the judge called him up to the stand, asked him a series of questions, including was he on drugs, he said. no did he have mental illness, he said. no then he she asked him about this conflict of interest and did he still want fee to represent him, and he said yes. in fact, in court today, one of the big questions was whether a gag order would be issued. the defense attorney says there has been an unprecedented release of pre-trial publicity and information in this case on that it's damaging their efforts or could damage their efforts to gather an impartial jury. the judge said that there is basically a gag order already in effect. a massachusetts rules of professional conduct which restricts the defense attorneys and the da's

office from discussing anything except what happens in court. so that issue -- that order is still in effect. no additional gag order has been issued. the defense attorneys also asked the prosecutors to share information and evidence with them. and the d.a.'s office says that in fact, they are in the process of turning over all of that evidence right now. >> shepard: rick, five other people charged in this case. what's up with them? >> yeah. it's a very convoluted situation. you have hernandez' fiancee, sheanna jenkins on perjury charges for lying to the grand jury. hernandez' cousin charged with conspiracy. she allegedly drove another suspect to georgia after the murder that man earnest wallace is described as hernandez' right-hand man also facing charges in connection with this murder along with carlos or tease who ortiz in this case. he and wallace at the seen on the night that the victim was shot. and then there is alexander bradley. he is the guy that filed a

civil suit against hernandez for allegedly shooting him in the face during an argument down in miami back in february. bradley was arrested by hartford police and u.s. marshals last week in order to appear before a grand jury investigating another case, a double homicide committed in boston in 2012. shep, authorities are suggesting that both the victim of the original shooting, oden lloyd and this guy, alexander bradley may have had information that hernandez was involved in that other double homicide and that's why those two may have been shot. but, again, a very convoluted series of events, situation here today. no gag order issued. we have another hearing coming up in december. >> shepard: rick lesson that you in fall river, mass. let's get to biker gang beating that happened in new york city. one of the own about to appear in court in reference to it all of, this charged in the violent attack. investigators say this undercover officer turned himself in after video showed that not only was he

at the beatdown he actually joined in the beatdown. by now you have seen this video. the helmet cam video from one of the bikers chasing an suv along manhattan side highway. as close to anything that we have here in new york city. the video cuts out right after the gang catches up and one biker bashes the suv window with his helmet. you saw this there after the camera turned off. prosecutors say bikers dragged this man into the street. this man and punched him and kicked him. his wife and 2-year-old daughter watched from the car they tell us. so far these four guys face charges in the assault along with the undercover cop. he faces charges of riot and criminal mischief. investigators say he hit and kicked the suv himself. even though his attorney had claimed that his attorney was not involved in the attack in any way and did not even witness those bikers beating the driver. so let's take this to the judge. fox news senior judicial

analyst andrew napolitano is joining us from the news deck one of the things i was concerned about here, this undercover cop who was supposedly undercover protester for occupy wall street. >> right. >> shepard: a vet of the force for like 10 years, i guess he told a story that wasn't true. but for him to have given up himself as an undercover cop that would have been wrong too. >> look. we start out with basics. the police cannot look the other way when a crime is being committed, and they have an affirmative obligation to interrupt the crime, especially if it's a crime of violence and they can protect the victim. an exception to that is an undercover cop. it's a policy exception, shep, because the government has invested so much time and money in protecting his undercover status, they don't want to lose it there. so what does he do? he has an obligation to report this as soon as possible. he has an obligation to interfere with it if he can do so in a way that will not blow his cover. and he has an absolute

positive, a firmive obligation to tell the truth as quickly as he can do so. apparently he didn't do any of those things in this case. >> he faces some serious punishments, up to seven years it's my understanding. >> yes. by not helping his colleagues he feared with their investigation. that's obstruction of justice. by banging and participating in the rioting he can be held liable to the physical injuries to the guy that was actually beaten, the driver of the car even though he didn't actually inflict those injuries himself. forget about the undercover cover is blown we haven't seen his face yet. if he he ever returns as a cop, it went be under cover. >> shepard: i wonder how often this thing happens about undercover officers not that one would participate in a crime this. >> the commissioner of new york city we know well here he would say shep, it's good that you don't know how often it happens because we don't want

>> shepard: breaking news and the president is set to nominate janet yellen. he has just come to the podium. let's listen in. >> america has fought hits way back from the worst recession since the great depression. we passed historical forms to protect consumers. over the past three and a half years our businesses have created 7.5 million new jobs. our housing market is rebounding, manufacturing is growing, the auto industry has come roaring back, and since i took

office, we've cut the deficit in half. i think everybody understands we still have a lot of work to do to rebuild the middle class, but we have made progress, and we shouldn't do anything to threaten that progress for these one gains made a difference to millions of americans and in part we can thank the extraordinary grit and resilience of the american people. in part, we can thank the dine knowism of our business. a lot has to do with create more one of the most important contributors to this whole process maybe federal reserve under the strong leadership of ben bernanke. for nearly 8 years, ben has led the fed through some of the most daunting economic challenges of our lifetime. for some time now he has made it clear that he intends to finish his service as chairman at the end of his term which is this january.

so, today i just want to take a minute to pay tribute to ben for his extraordinary service. but i want to announce my choice for next chair of the federal reserve. one of the nation's most foremost economists and policymakers, current vice chairman janet yellen. after i became president, i was proud to nominate ben for a second term and while the fed is and must always be independent, i want you to know, ben, i'm personally very grateful to you for being such a strong partner in helping america recover from recession. perhaps it's no surprise as the son of a pharmacist and a school teacher that ben bernanke is the epitome of calm and against the volume tilings of global markets, he has been a voice of wisdom and a steady hand. at the same time, when faced with potential global economic meltdown he has displayed tremendous courage and creativity.

he took bold action that was needed to avert another depression. helping us stop the free fall stabilize financial markets. shore up our banks, get credit flowing again. and all this has made a profound difference in the lives of millions of americans. a lot of people aren't necessarily sure what the chairman of the federal reserve does, but thanks to this man, to the left of me, more families are able to afford their own home, more small businesses are able to get loans, to expand and workers, more folks can pay their mortgages and their car loans. it's meant more growth and more jobs. and i would add that with his commitment to greater transparency and clarity, he has also allowed to us understand the work of the fed. you know, ben has led a new era of fed speak, and been a little more clear about how the system works, and that is good for our democracy. and i have to tell you as i travel around the world,

you know, the job of the fed chair is not just our top monetary policymaker, the world looks to the american fed chair for leadership and guidance. and, the degree to which ben is admired and respected, and the degree to which, you know, central bankers all across the world look to him for sound advice and smart policy making is remarkable. he has truly been a stabilizing force not just for our country but for the entire world. and i could not be more grateful for his extraordinary service. so, ben to you, and your wife anna and your children, joel and alyssa, i want to thank you for --r outunderstanding outstanding service, thank you so much.

[ applause ] now, as i have said, the decision on who will succeed ben is one of the most important economic decisions that i will makes a president. one of the most important appointments that any president can make. because the chair of the fed is one of the most important policymakers in the world and the next chair will help guide our economy after i have left office. i have considered a lot of factors, foremost among them is an understanding of the fed's dual mandate. make sure we keep inflation in check but also increasing employment and creating jobs which remains our most important economic challenge right now. and i have found these qualities in janet yellen. she is a proven leader. and she is tough. not just because she is from brooklyn. [ laughter ] janet is exceptionally well-qualified for this

role. she has served in leadership positions at the fed for more than a decade. as vice chair for the past through years she has been exemplary and a driving force of policies to help boost our economic recovery. janet is renowned for her good judgment. she sounded the alarm early about the housing bubble, about excesses in the financial sector and about the risks of a major recession. she doesn't have a crystal but but what she does have a marks and economy work. not just in theory but the real world. and she calls it like she sees it janet also knows how to build consensus. common goal. as one of her admire error says she one of the people who makes everybody around herbert. not surprisingly she is held in highest esteem by colleagues across the country who look to the united states and fed for leadership. janet is mitted to both sides of the fed's dual

mandate. she understands the necessity of a stable financial system where we move ahead with the reforms that we have begun to protect consumers, to ensure that no institution is too big to fail, and to make sure the taxpayers are never again left holding the bag because of the mistakes of the reckless few. at the same time, she is committed to increasing employment and she understands the human costs when americans can't find a job. she said before these are not just statistics to me, the toll is simply terrible on the mental and physical health of workers, on their marriages, on their children, so, janet understands this and miracle's workers and their families will have a champion in janet yellen. so, janet, i thank you for taking on this new assignment and given the urgent economic challenges facing our nation, i urge the senate to confirm janet without delay. i'm absolutely confident that she'll be an exceptional chair of the federal reserve. i should add that she will

be the first woman to lead the fed in 100 year history. i know a lot of americans, men and women thank you for not only your example and your excellence, but also being a role model for a lot of folks out there. so, it's been said that janet found love at the federal reserve literally. this is where she. [ laughter ] -- this is where she met her husband george, a celebrated economist in his own right. and their son is an economist as well. so you can imagine the conversation around the dinner table might be a little different than ours. [ laughter ] in fact, i have been told their idea of a great family vacation is the beach with a suitcase full of economics books. [ laughter ] but this is a family affair. we thank george and robert for their support of janet as she begins this journey. again, i want to thank ben bernanke for the outstanding work that he has done and ben bernanke will help keep our economy

moving forward during his remainder of his tenure here. we will probably have occasion for additional goodbyes, i know that janet is very much counting on him to give good advice to her as she moves into the chairman spot. but, with, this i would like to give janet a chance to say a few words. and a strong and stable financial system i would also like to thank my spouse george and my son robert. i couldn't imagine taking on this challenge without their love and support. the past six years have been tumultuous for the economy. and challenging for many americans. while i think we all agree, mr. president, that more needs to be done to strengthen the recovery, particularly for those hardest hit by the great recession, we have made progress. the economy is stronger and the financial system sounder. as you said, mr. president, considerable credit for that goes to chairman bernanke. for his wise, courageous, and skillful leadership. it has been my privilege to serve with him and learn

from him. while he we have made progress, we have farther to go. the mandate of the federal reserve is to serve all of the american people. and too many americans still can't find a job and worry how they will pay their bills and provide for their families. the federal reserve can help if it does its job effectively. we can help ensure that everyone has the opportunity to work hard and build a better life we can ensure that inflation replains in check. safeguard the financial system. the fed has powerful tools to influence the economy in the financial system. but i believe its greatest strength rests its capacity

janet yellen is in. and now the senate confirmation process. so how do we expect that to go? let's get to the white house now. our correspondent wendell goler is there should this be an easy confirmation in the president seemed to think it ought to happen pretty quick. >> i think so, shepard. the democrats obviously have control of the senate and janet yellen has the ear of wall street. this is really no surprise. the president's decision to nominate ms. yellen likely made some time ago after a near revolt in the democratic party when it seemed he was leaning whard toward the former head of national security counsel larry summers. he was accuse of being insensitive and hard to work with and most importantly he was less enthusiastic about the fed's bond buying pumping money into the economy. keeping interest rates low. helping lower the jobless rate. he took himself out of consideration. yellen is currently vice chairman the fed. she has completely supported the fed's stimulus bond buying. while that endears his or

her to democrats it worries republicans who worry pumping all that pumping money weakens the dollar and risks. the white house is optimistic about yellen's confirmation prospect. >> we're confident that dr. yellen is enormously qualified and that the senate will fulfill its responsibility in examining her qualifications. her experience. and will act accordingly. and that that will proceed and hopefully proceed, you know, expeditiously. >> was we heard from ms. yell enthe fed is charged with keeping the -- think that's why the u.s. bounced back from recession where the central bank is only charged with dealing with recession. high low employment or high unemployment right now is

it happened early this morning about 60 miles north -- i should say north harrisburg. paramedics rushing people to nearby hospitals. at least 10 people are now reported dead in this massive fire at a garment factory in bangladesh. a different factory in that same country collapsed killing more than 1100 people. much more from the fox news deck as shepard smith reporting continues after this.

the bodies of four american soldiers arrived at air force base in delaware today. the partial government shutdown blocked the death benefits that would have typically paid for their families to be there we have photos of those who died. restore military death benefits and the defense secretary chuck hagel just announced that the pentagon found a solution to the problem. with details on that. let's get to jennifer griffin who is live for us at the pentagon.

went out to meet the four coffins as part of the dignified transfer today at dover air force base. he said they come up with a solution a private charity, the fisher house which takes care of wounded warriors and their families is going to pay the death benefits, $100,000 per family member killed in action. they get those benefits in the first 36 hours usually. they did not get it because of the shutdown. the fisher house is going to pick up the slack for what the defense department with its budget, the largest budget in all of the federal government could not do which is pay these families and ease some of their pain at this very difficult time. they also are going to pay for those families who visited dover to meet their loved ones as they were returned to dover air force base today. the fisher house stepping in doing what the federal government didn't do.

>> shepard: so the families made it to the ceremony today? >> yes. we're told that all four families had representation there at dover air force base. they were able to make it because of private donations. they were flown in, they were there, but we have also learned and this is interesting, that there are 26 families in this position. it's not just these four who arrived at dover today there have been 26 u.s. service members killed since october 1st. of them were killed state side. their families also have not received initial days that they need to pay bills and take care of funeral arrangements. >> shepard: jennifer, you said this didn't have to happen. how did this happen? >> it's a good question and there is a lot of finger pointing taking place between capitol hill, the white house and the pentagon. i remember sitting in the pentagon press briefing three days before the shut down and the comptroller for the pentagon robert hale stood there and he warned the press and others that they were not going to be able to pay death

benefits if there was a shutdown. congress says they never heard that. the white house apparently wasn't listening. we have talked to people on the hill who say that on conference calls, in fact, the pentagon did warn them that this wasn't going to' harassment remember on the eve of the shutdown the congress passed something called the pay our military act. it's the one bill that the president signed in order to make sure service members got paid even if there was a shutdown. somehow that was written in a very -- in a not so -- it was not a very good bill or law, and it did not mention these benefits. and so lawyers here at the pentagon said our hands are tied. we can't pay these benefits because of the law says we -- it doesn't say we can. so on capitol hill, just a few moments ago we understand that house republicans passed actually it became a by farther san unanimous bill passing to pay these death benefits, the $100,000 to the families. they just passed that but the senate does not plan to act on it the president's

spokesman jay carney said today that the president is angry and ordered that this be resolved by the end of today. and now we hear from defense secretary chuck hagel that the solution they have cobbled together is that fisher house private charities going to pay these families. >> shepard: good news. jennifer griffin thanks so much, there is breaking news now on fox news channel. the nypd detective. for that man the arraignment just ended in connection with with this biker beat down that just happened on manhattan's west side highway. the charges, riot, criminal mischief. did he not enter a plea today but bail did get set. they set bail at $100,000 cash or $150,000 secure bond. no video or stills in the courtroom because is he an undercover police officer. is he reportedly on video though pounding on suv as bikers surrounded that vehicle. our fox station wnyw fox five reports while off duty
