disgrace. no excuse for it. the two men responsible are the commander and chief president obama and secretary hagel. the president has the power by executive order to pay for anything he wants, despite the government shutdown. hagel allowed it it to happen. he should resign immediately. the situation is so outrageous that ken fisher who heads up the fisher house charity that helps military families says that his organization will pay the families'' expenses until the government wises up. military benefits of the families of those killed in action are about $100,000. we know of 26 service families that have so far been denied. we have the names of six military people who are being dishonored by their own government. lt. jennifer morano. sergeant patrick hawkins. sergeant joseph peters. private first class cody patterson, lance corporal jirm collins and private angel lopez.

these brave americans sacrificed for this country. and they get this? they get this? the whole debacle once again points out that president obama's leadership capacity is in steep decline. we saw it in the syrian situation. we are seeing it again in the government shutdown. a new associated press poll says that the president's job approval rating has now slipped to 37% lowest point in his tenure. while the majority polled continue to blame the republicans the gap is closing. poll most liberal in the country. backed president obama all the way. must have pained them to release this poll. and the headline they put out buried the lead. the headline says poll, g.o.p. gets the blame in shutdown. so you can see how fair the a.p. really is the entire obama care government shutdown thing is a catastrophe. there is no question obama care is not ready to be rolled out. all the evidence says that

if the president would simply admit it and delay the individual mandate for aer yoorks the impasse would be solved. but mr. obama is too stubborn to do that and americans are starting to catch on. in the meantime, major damage is being done to the country and to the families of our service people killed in action. there is no excuse as i said. there is no excuse. hagel must go. he has lost all credibility among the military. and the president should order those payments immediately. and that's the memo. now for the top story tonight. reaction. joining us from washington. lt. colonel ralph peters and caved david hunt fox news analyst. who is most responsible for this in your opinion. >> it starts with the commander and chief we are at war, bill. we have been at war for 11 years. by the way, my family lost -- we lost my brother in 1968, we went through this kind of tragedy. so you get notified that your family member has been killed. the next phone call you get is oh by the way we are not going to pay for the

funeral. i'm ashamed of our government right now the commander and chief through the chain of command like hagel are absolutely responsible. we money in the department of defense. this should have never got it this spot and now we have families suffering have to put up with this crap in the middle of trying to bury their loved ones. it's unheard of and never happened by the way. >> bill: never happened as far as i know of. maybe the civil war. never in modern times has this kind of callus behavior been put forth. now, today, jay carney and we're going to talk to ed henry right after you guys, said, you know, the president didn't really know about, this now that he knows about it, colonel peters, he is going to correct and we are going to reimburse the fisher house for their experience expenses. the government is going to make it all right. what do you think about that? >> well, i think it's a disgraceful scandal. i agree that hagel certainly should go because, if he didn't know about it, it means he is not in control of his department. if he did know about it and did nothing, then, my god,.

>> bill: he has got to go. he had to know. hagel had to know. i'm not sure president obama knew or not, because he is under such, you know, intense pressure from all sides. it's possible he didn't know. but, hagel surely knew. and it's hagel's duty to tell the commander and chief hey, we can't have this. >> may i just point out, bill, that while the pentagon has -- and the administration has refused to pay this death benefit to the bereaved families of our fallen soldiers and marines, secretary of defense never closed his executive dining room in which military members are basically chefs and servants and it's a nice place. i have eaten there. sock couldeye salmon cooked to order. why can't we keep the executive dining room open and pay the family benefits. >> bill: the point you are

making is a larger point. we are still fighting in afghanistan and that hasn't stopped all the military operations are underway. the pentagon is operating even though the government is shutdown because the money is still there, okay? they have money this is just an unbelievable psychiatry up, colonel hunt. it's an unbelievable screw up but it goes to leadership it goes to how out of control the federal government is right now. am i wrong? no. it absolutely goes to leadership. starting with the commander and chief the president of the united states through hagel right down to the chiefs and bill, there is no outrage. >> there is outrage among the folks. are you kidding me? no outrage department of defense. you have seen no one talk about this you this be riding. don't you think every single veteran in this country is going oh, look.

they are hiding. we don't know where hagel is. is he hiding somewhere in the dining room, probably colonel peters. probably under the table. all right? but every american, every -- you know, as far as left as you can get, nobody can justify this colonel peters. bill i think you and i disagree on something. you think this is just incompetence. my scenario some political come sar pentagon or the white house thought this was one more way to embarrass republicans to show how bad the shutdown is and the shutdown is bad and i think it back fired on them. obama is in shock. the white house is in shock because they are taking the hit on this as they should but it is indicative of the disdain with which this administration regards the men and women in uniform and regards them as janitors. they have to clean up the international messes. oh but you don't invite them to dinner at the penthouse. >> i will give you the last word, colonel hunt? >> i'm ashamed for our

solving the shutdown. republican leaders will speak with the president shortly. joining us now from the white house ed henry who covers the president for us. i'm a little confused by president obama's leadership here. my theory is it goes back to the syria situation where he looked weak and he knows it. and now he has caught himself up in the shut down over obama care. he doesn't want to look weak again. so we're not getting any compromises. am i off base here, ed? >> well, part of the reason, you are on base and off base. i think in fairness to him one reason why he doesn't want to compromise with republicans he thinks if they just threaten default, that outside economists who are not affiliated with white house say could bring down the economy. it's a mistake for any president, either party to get into a tit-for-tat on that kind of thing and look like you are being hostage. on the other hand where you you are on base is what has not been sustainable to the president is his talking point again and again is i'm not going to negotiate under the threat of default. he has a democrat for the first time joe manchin from

west virginia conservative in the senate who came out in the last 24 hours and said you have to negotiate even if it's over a potential default. that's why we are in washington to negotiate with the other side he is only one lone democrat there may be others under pressure who may come out as well. that's not sustainable for the president who say i'm not going to negotiate. >> bill: leadership issue. on every front you are seeing the leadership in chaos. the rollout is chaos and everybody knows it. that's not working well. there isn't any compromise discussion going on now that we know of although i do agree with you that it will happen. you have got the unbelievable catastrophe of the military families which is so embarrassing to the commander and chief. couldn't get more embarrassed. today, jay carney struggling on this. i mean, it was like jay. >> couldn't answer a simple question he which is what i and others were asking him. when was the president informed on this? he didn't know. embarrassed a few days ago. and the commander and chief didn't know. they are struggling through

this in some ways. in other hand in fairness, point out and hearsay on many times. john boehner is in a box as well he got so fixated on the healthcare law. not just about that, it's about debt and spending. i think they are also trying to shift to more fertile ground for them. they realize they are not getting anything out of trying to change the healthcare law right now they have got to come up with something else. >> bill: there is also something in play here. there is the executive order. i wish one of you guys had asked that question today. all he has to do is sign an executive order to pay these military families. that takes 10 seconds. you don't need to borrow money from the fisher house and reimburse them later. >> asked about executive action and they were fuzzy on that because they say the lawyers are looking at it. >> bill: the lawyers? look, i'm not a lawyer. he has the power to do it. all right? i can tell him anybody who knows anything about history knows he can do it. so, this is all b.s. now, talking about b.s., what was that press

the health insurance arena. joining us from washington kate obenshain a republican and kirsten powers a democrat. fox news analyst. what about the leadership now. it's not microin on shutdown or microin on obama care. it's leadership which i think the president is losing control of and you say? >> well, i think that this is probably not going to be known in history as the era of great leadership. anywhere and i think the president has his deficits in that area. but if he would going to look at the last week or so, definitely the republicans are coming off much more badly in my estimation. i don't think that there is much that obama ha could be doing they keep insisting they want to negotiate but all their negotiations involve basically obama capitulating to their crazy demands. so, i think. >> crazy? >> bill: do you really think asking for which is really what this is coming down now, asking for a waiver for individuals on

obama care. every one of them voted against it in 2009-2010. we know that but the fact and the truth is that this massive program is now out of control you can't get through, nobody knows how it is going to effect them. people are seeing their premium go up when they didn't expect it. so let a year ago because that's the same waiver the president granted companies. that's not a crazy position. now, kate. there is no doubt that the republican party wants to sabotage this program and this is the president's legacy so i'm saying don't sabotage the whole program. just go for this microchange and then we can sibert. you say? >> i respectfully disagree with your aanalysis that he they're trying to sabotage it it's very hard to keep a straight face, folks when all the democrats can say is how crazy republicans are being because they are listening to the american people who didn't like the

bill in the first place. they don't like it now. this is part of the american process, kirsten. where when they don't like it, those who are advocating on behalf the american people have every right to try to change things. >> anyone supports. >> bill: let her finish kirsten. let her finish. go ahead, kate. >> obviously in the right of republicans to very reasonably say there should be a delay. no, we are not going to be able to get rich, sean duffy courageously said in that interview with andrea mitchell. it's clear we are not going to get rid of obama care. why can't individuals be treated the same way that businesses are being treated. the same way that big labor. the same way that obama cronies are being treated and be be allowed a year delay if they want it. that's reasonable? that's not crazy. >> bill: i think lose this argument among the american people even some on your side like manchin and more than a few congress people. democratic congress people you know what? let's do this and then in a year now we can see.

look, the bottom line is, kirsten, if it's a good law if most americans benefit from it, then they will want it and then it will all kick in. >> it doesn't work without the individual mandate, bill. >> bill: for a year it works. there is enough funding for it? >> and the other -- i mean i'm going to explain to you by the individual mandate versus the businesses mandate which you keep comparing them to each other like one gets it and why the other doesn't is that businessman date is very complicated and the businesses were having a hard time understanding how they were supposed to implement all of this. the individual mandate is not remotely complicated it's very simple. you are an individual. >> bill: look at your insurance premiums. >> in terms of complications, there is no complication. >> bill: i have got to stop it. nobody knows what they are going to be paying. co-pays, deductibles, insurance premiums. >> they will know before it's time to buy the insurance. >> bill: blind sided. >> not until january, bill. >> the problem is, kirsten

>> bill: washington beat segment tonight. let's get to ace corpdz james rosen and carl cameron. what's the latest on the political struggle cammeron in congress? is there any change? i mean, they are going to have to compromise sometime. what are you you hearing? >> new talk of another short-term extension on the debt limit. the idea is it would give them more time to continue negotiating the thing that they for years have not been able to resolve. apart from that sort of alice in wonderland though what down is up and what is small is big. republicans who have wanted for years small government are now fighting to reopen it and democrats who say they love and celebrate government and want to expand it with the affordable care act are fighting basically to keep it closed. the house republicans keep passing bills to open up part of the partially closed government and democrats keep on killing him in the senate and saying they are refusing to negotiate. that's a risky part about it. >> that's my question is what about the american people here? because, if you continue to punish the folks by keeping

the government shut, the folks are going to get angry at you. >> correct. >> bill: i don't think the republicans ever get their message out very well. for two reasons the media hates them. two there isn't a charismatic leader in the republican party right now. somebody who commands attention, can really get the word out. >> they are doing two things, bill. one is the rhetoric. one is that they are saying that they don't want to shut down the government republicans saying they want to reopen it polls suggest that the g.o.p. is taking a bigger hit on this than democrats. what they are doing is more than just the rhetoric are. actually been action to it past several days piecemeal reopen the government. that demonstrates they are trying to do something. democrats are getting hit in the polls for not negotiating. we see some worry beginning to show and house and senate democrats. >> bill: approval rating for the president? i think he is going to get a little worried. >> voters see it as unreasonable. not just on behalf of the is that true as well as on senate and house democrats. >> bill: is he taking the hit. because is he in charge. again, it goes back to

leadership, and the american people after syria now and shutdown and then the military debacle, and i want to go over to rosen for. this rosen, you are a state department guy, knock but obviously the military, very, very involved with the state department. and this comes out yesterday, were you surprised, rosen, that this was so botched by the department of defense? >> well, it is surprising that the administration and the house republicans and the democrats in congress all worked very effectively together as we were steaming towards a shutdown to keep the the military troops funded. but somehow would have left out of that the pay for families, especially in such dire circumstances. so it is surprising. i can tell you i spent the day on the phone working the phones with democrats who are in and out of government who are well plugged in and also who are on the house side and the senate side in the leadership and i can tell you what their calculation going forward is. you will hear both sides say. this they think time is on their side.

as we approach the 17th of october, which is the expiration for our debt ceiling, the democrats think that the pressure on speaker boehner is going to intensify chiefly because of his allies on wall street and at the chamber of commerce as they start to seat markets get rattled by the prospects of a default. that's their strategy going forward. >> bill: it's such a bad strategy. i have such a massive headache. because it's the folks, you know. it's the folks. >> what they're talking about doing now on the republican side is to try to wrap the government shutdown into increasing the debt limit and add in this idea with the help of paul ryan, the house budget committee chairman making it a grand bargain. something that has failed miserably for the last several years but the idea is wrap the government shutdown up, open it again. raise the debt limit for eard pooh of time and begin to deal with entitlement reform. it's very very difficult. the president says he is going to invite all these members down to the white house the next couple of days.
