president obama and congressional leaders just postponed their meeting at the white house, scheduled to happen at this very minute. they're trying to make a deal to avoid a possible u.s. debt default and end a two-week government shut down, and it appears they're getting closer. a live look at the white house now. fox news learn lawmakers came up with what they're calling the framework for a potential agreement. earlier today, harry reid said he is, quote, very optimistic about a deal this week. the feds have said the deadline for congress to raise the debt limit is three days away. we'll have continuing coverage minutes from now. >> more breaking. fox news confirmed a libyan terror suspect who used to be on the fbi's most lanted list is now here in the united states and this map has come their new york city. abu anas al-liby. that's the name he uses in the united states. he has faced a federal indictment here in new york city

for more than a decade. the pentagon reports u.s. special operations forces captured him during a raid in libya, not saturday but a week ago saturday. officials say they expect al liby to stand trial over whether he helped plan the bombings of u.s. embassies in 1998, and there's a lot of evidences that suggests he did. the u.s. attorney's office in new york will not comment but does tell it there's no information at this time. we know the accusation is he helped scout out and take pictures of the bombing for osama bin laden for it happened. we have the details from capitol hill. >> reporter: what we can confirm right now is federal sources tell us that abu anas al-liby did leave the uss san antonio where he was held for the last 11 days since his capture on october 5 in he was on the ship being interrogated be a high

level team, joint cia, fbi, and military interrogation team. they were going to keep him there as long as they needed to get information out of him that would stop any current operations. it's clear that after a week they weren't making much progress, and now we understand he has been read his miranda rights and is on route to the united states. it's not clear where they're taking him, but if history is any judge, the last time there was high-value target like this captured off the coast of somalia kept on a u.s. navy ship for 40 days was four years ago, and they brought him to new york, where abu anas al-liby was indicted decade ago -- indicted a deck aid ago. it will be interesting whether anyone will be claiming the reward of $5 million.

>> two sources 2010ed by the "associated press" says he is here in new york to face the charges. you mentioned sounded like they were getting very far with the interrogation on the ship. do we know if they got anything? >> it's very interesting. we have spoken to sources with knowledge of the investigation, who say that in fact al-liby was not cooperating last week, was not providing much information. remember, this is a man -- a terrorist, an accused terrorist, who wrote the book on how to resist interrogation. there was something called the manchester manual, back in the 90s, found in his london apartment, and it was for al qaeda operatives how to resist interrogation by western interrogators. so he knows what his rights are. he knows he will be read his miranda rights and now within a week they realized they weren't getting very far and read him his rights and now he will be tried for the 1998 bombings in a

u.s. federal court, presumably in new york. >> all right. thank you. continuing coverage of breaking news. the white house announced the meeting between congressional leaders and president obama is on hold that was scheduled to begin at 3:00 eastern. and the reason they postponed it is to give the united states senate time to work on a deal to avoid default and end the two-week partial government shutdown. the deadline for congress to raise the debt limit is three days away. treasury department officials are warning if lawmaker do not reach an agreement by thursday, the government will default on its debt for what is the first time ever with an asterisk, and i say that because after the war of 1812 it happened for a brief time, and back in 1979 because of a technical glitch it happened again very briefly because congress delayed raising the debt ceiling. this would potentially cause irreverse able damage to the

country. the partial government shut down is in day 14 and "associated press" says officials expect the federal court system to run out of money if the deadlock continues past thursday. there is word from bankers this would cause enormous problems. but ed henry is at the white house. from everything i heard today, ed, sounds like both sides they they're getting closer. >> reporter: they are. this is a time where a meeting being delayed is a good thing. normally we would say, uh-oh, there's a glitch, problem, the markets might react negatively. actually the markets are calm. in the positive territory, because they do appear to be inching closer. the reason for the delay is there were signals sent from the senate to the white house that these meetings behind closed doors between the democratic leader, harry reid, and republican leader, mccain connell, are making progress

that there is no point to getting enemy a car and taking them to the white house. so they're going to give them few more hours, see if they can have something on paper to bring to the president, perhaps later this afternoon or early evening. let me give you be broad outline. the question right now is how long to extend the debt ceiling. various sources telling us it could be into the spring, the summer. the key there is the longer it -- the extension of the debt ceiling, the morrow you are you see house republicans get upset. that it want to get more consessions out of the president. and then in terms of re-opening the government, do you re-open the government until december 31st or january 31st? the significance there if you only open it until december 31st, that creates another deadline beforemer sequester cuts kick in, and democrats thinking they have more leverage are saying, look, maybe we should put away some of those sequester cuts. too tough on domestic spending.

the republicans think they have been too tough on the pentagon. so if you have republicans you may get more republican votes if the deadlines december 31st. they may be able to have a debate at the end of the year about sequester but that would p put us in the sailboat again. >> this is a deal among senators. does this space a lot -- face a lot of opposition in the house? >> it could, the old philadelphia the details. not -- the old devil in the details. but the questions, any changes to the health care law? will this agreement have some sort of a window of three months or six months that, while the government is re-opened, while the debt ceiling and the whole default question is put aside, does the president negotiate, as he said in his news conference last week of what he believes to be reasonable changes. one of the table, for example, would be maybe delaying that medical device tax for two

years. so that's going to be the key for getting house republicans on board. >> ed henry live. thanks. now we have just gotten word today a six-year-old boy has drowned in a swimming pool aboard a cruise ship. a representative for carnival cruise lines said it happened yesterday on the last leg of a four-day trip through the caribbean. cops say passengers noticed the child underwater, pulled him from the pool but could not revive him. the ship arrived at the port of miami this morning. a representative read a statement that says, carnival extends its heartfelt sympathy to the family. the company's care team is providing assistance and support. of course, this is but the late nest a series of recent problems involving carnival cruise line. steve harrigan works the cruise industry and is live on the banks of best cane -- best cane bay. >> it's awful.

for the chiefs. now to an incredible story of a 72-year-old hunter recovering after spending 19 days alone in a northern california wilderness. he says he survive eating lizards and squirrels, not to mention a snake. it happened in the mendocino national forest, which i have on my back, and this is the terrain here. it's difficult area, and we don't know exactly how far he moved along during all of it, and frankly neither does he. it is three hours north of san francisco. it's rough terrain there. the only national forest in california without a major paved road at the entrance. very ditch to get into. the man's hunting partner reported him missing last month. the two split up for a few hours and that's when the guy says he fell and hit his head. he -- when he eventually woke up he claims he had no idea where he was or what was going on, and during the next two days he says he saw helicopter and tried to

send a smoke signal but nobody saw him. for more than two weeks he battled the cold weather conditions, including rain and snow, until another hunter finally found him. trace gallagher is live with more on this. man, trace, 19 days? >> reporter: and you mentioned that gene penafor battleled with the rain but the fog kept him from reconnecting the with the hunting partner and caused him to fall down the ravine and knocked himself unconscious. when he finally came to he realized he had to eat and stay warm. so he built a fire and kept the fire going every single day and night. he also cooked on it. and then he, of course, used it to stay warm and signal other hunters in the area. he had seven bullets so he started hunting and trapping small animals. you already know about squirrels, the snakes and the frogs. but listen to what else he ate.

now to the high school student who is in trouble just for showing up at a party where police arrested a dozen students for underage drinking. the thing is, this student didn't have a drop. she is a 17-year-old honor student who says she was there because a friend called her, come pick me up because i have had too much to drink. a cop at the scene vouch for the teen, said she didn't drink, was there to pick up someone who did drink. school officials claim she still violated a zero tolerance policy just by being there. they took away her captain position on the volleyball team, suspended her for five volleyball games. jonathan hunt has the rest of the story. seems clear if a friend is drunk, you haven't had a drop, maybe save a life. >> reporter: hard to see what she did wrong. she finished her shift as a waitress and got a text from her friend saying i'm at this party,

a little too much to drink. can you come and drive me home? erin said i felt like going to get her was the right thing to do, saving her from getting in the car when she was intoxicated and hurt herself or gifting in the car with someone else who was drinking. but as she arrived to pick up the friend, the cops also arrived so the got caught up in the bust and the school said you were there at a party where drinks were being served and that's it. if i were the family i would be taking legal action. >> that's what they're doing. i got a statement from a lawyer for the cox family. that statement says in part, we should be glad that young people like erin cox are willing to help friends who might not otherwise get home safely. but punishing her the school district sends a contrary and very dangerous message that young people are better off

a quick update on the top story. they're up on capitol hill. there was going to be a meeting an hour ago. but the senate is getting closer to the deal to avoid hitting the debt celling. one senator said he believes this needs 65 votes in the senate to take the pressure off the house and allow for the house to say, we got to do this. whether they'll get the 65 votes or not remains to be seen. no followup meeting scheduled for today. tomorrow, maybe. we'll see. >> on this day in the year 2003, a chicago cubs fan named steve bartman reached for a foul ball at wrigley field and caught the blame for the cubbi' epic
