end to affirmative action. tonight, we'll talk with a man in the middle of that battle. >> from the world headquarters of fox news, it's "the kelly file" with megyn kelly. >> good evening, everyone. i'm megyn kelly. tonight the senate's top two leaders say they are making substantial progress towards a deal to hike our debt ceiling and get the government working again. that news comes just one day after angry americans made their voices heard on the streets of the u.s. capital. the cameras showing veterans and supporters of our troops outraged that the government closed off memorials to the very people that gave blood, sweat and tears in defense of our country. >> it's not okay to inflict maximum pain on the american people. it's deplorable to inflict any pain on our veterans. >> our veterans, these memorials, are theirs. they should not be blocked. >> disgusted. >> i'm a vietnam veteran. what he's doing to this country,

i can't stand it. nobody is speaking up. that's what we're here for today. >> 90-year-old men who fought for our country denied access to a memorial that the american people built. open air memorial. no excuse. >> thoroughly disgusted. this is for our veterans and the united states government has no right. >> usa! usa! usa! usa! >> that protest then spread to the white house where folks dumped the barricades they had removed from outside of those memorials. our exclusive video catching confrontation as the crowd is met by police officers, some of whom push them back. watch. >> usa! usa! usa!

usa! >> and now this demonstration is under attack as some question the motives of these americans suggesting the tea party was behind it all. my next guest was there start to finish. dennis is a documentary filmmaker and creator of they come to america.com. amazing to watch coverage of this event which unquestionably had some tea party members there and politicians and vets there and regular americans upset about barricades being put in front of these memorials. you may not know that if you watched channels other than fox because they want you to believe that it's about the fringe. you were there. tell us what you saw. >> the other channels upset me. they upset me because they are feeding into that this behavior that the white house has created. i watched men and women come together at that memorial.

it was beautiful. there were men there with no legs, with no arms crying like you just saw. how dare anybody -- how dare anybody use them as a political pawn for a way of trying to boost up their own ratings. if it weren't for these men and women, there would be no television. i'm appalled by it. i'm appalled by it. here's the biggest thing we have. we have a blemish because the government shutdown is going to go away sooner or later, megyn, but the blemish on that memorial will stay with us forever. we will never be able to look at that memorial the same way again. and that is wrong. >> and yet if you watch coverage of this on our competitors today, these are the images. let me show you the images that are wallpapering the other channels. and these are images from the event. they are legitimate to show when

covering it. signs calling for impeachment of president obama. signs suggesting that this man with a confederate flag. so far as i can tell this is the only man with a confederate flag and this sound bite from the founder of freedom watch which has been on a loop. listen. >> we are now ruled quote/unquote by a president who bows down to allah. i call upon all of you to wage a second american nonviolent revolution, to use civil disobedience and to demand that this president leave town and get out, to put the koran down and get up off his knees and to figuratively come up with his hands out. >> i ask you whether larry and the people holding those signs and that confederate flag are representative of what you saw

this weekend? >> what i saw this weekend was a collection of thousands upon thousands of veterans that if their president, barack obama, was to fall down on the ground whether they agree with his policies or disagree, they would protect his life. those were the people at that memorial. it is a shame that we find ourselves in a place and time where america is going to learn all of its lessons the hard way. megyn, i was there from start to finish. i was hoping to come on your show tonight to tell you that this was a spark. that spark we've been waiting for. because we had it with the 2 million bikers to d.c. i covered that as well. that was a thing of beauty. it didn't get its time aired. i always watched the truckers. they failed on day one but they came back and rallied on day two but nobody is talking about

that. these vets, they came from all over the country. we should be celebrating the fact that these guys are coming from all over the country and instead we're using it to get ratings. it's cnn and msnbc want ratings, cover the fact that the truckers came down the road outside that memorial and that vets were going up and throwing $20 bills in the window and saying thank you. here's gas money. i saw grown men cry including myself. we had 90-year-old men in a bus for an hour and a half, all of the media had gone home already. i was there. they were left in the street. the cops wouldn't let them go up 500 feet and drop them off in front of the memorial. these men are so old they didn't realize that there was anything going wrong. they thought this was the norm. it breaks your heart and then they talk about these tea party

whackos. there are no tea party whackos there. let me tell you. intere there were a couple people there for obama screaming profanities at sarah palin. i really wish -- i have nothing against sarah palin or cruz or anybody. i'm for america. i wish they didn't come. i wish there were no politicians there. we didn't need that. >> that's what the vet group said. >> we didn't need it. it's not the man who organized it. the man who organized it, they are throwing him under the bus. i met this man. not once did he talk to me about anything with tea party or politics or nothing. in fact, here's something that's not covered. those veterans were standing out in the rain. it was supposed to start at 9:00. i went up to larry, i said what's going on? why aren't we starting this? we had to wait for sarah palin. i said give me that microphone. these men are waiting. i went and opened the ceremonies. larry didn't say, no, i have to follow policy. he handed it over. everybody was there --

>> talking about a different larry? >> yeah. larry is the organizer. then when i watched these 90-year-old men get wheelchaired down a wet street, i saw the barricades going to the white house and i ran to that white house. i was there before any other camera and there after the cameras left. i did not see one veteran act in a way that was unbecoming. >> but what was their message? it's been so drown out by so many outlets. what was the message they were bringing? >> this is what they did when they carried those barricades, they were carrying america. when they took those barricades and threw them in front of the white house, they were throwing the frustration of every american who has lost it because this is the way d.c. operates. until this country comes back together, we don't have a chance and the only way this country is coming back together is through the american people.

any consideration of race in public college admissions. a law detractors say would make jim crowe proud. michigan attorney general joins us tonight. his office is defending the law. that's not from me, mr. attorney general. that's from detractors that say it bans the consideration of race in the admissions process at the michigan college level. what say you? >> listen, first, thank you for the opportunity to be here. congratulations on week two of your show. i'm very confident, megyn, that we and the united states supreme court will uphold michigan's constitution. what we're saying in michigan is that we're requiring equal treatment because it's fundamentally wrong to treat people differently based on the color of your skin, race, gender, and the only thing we're discriminating against is

discrippkricrimination itself. >> they say michigan is 80% white. 90% of black voters cast ballots against this law. since michigan is 85% white, there's a gap in political power in that state and therefore you can't just have the voters pass a law saying no more consideration of race in the admissions process. >> you know, that's just nonsense. what we are doing in michigan is embracing chief justice roberts' famous quote when he said the best way to stop racial discrimination is to stop discriminating on the basis of race. what we're doing in michigan is we're requiring equal treatment and we have 15 universities and we want to do one approach saying it's wrong to treat people differently on the bases is of the color of your skin and the discussion that we're talking about here is we need to have an education revolution in america. we need to have diversity on college campuses but we need to do it constitutionally and not

by any means necessary. >> they point to the numbers as proponents of affirmative action always do and they say that, look, back before they had this law, proposition 2, the university of michigan campus had 6.5% black students in '05. since the law, only 4.7% are black so they say once they passed this law banning affirmative action black students suffered. >> you know, i'm a big fan of diversity. we need it on college campuses and across the country and we need to do a better job in michigan and across the land. florida, for example, is doing a great job with more minority admissions and so is california and texas and we ought to have the same passion and commitment in academic recruitment as we do in athletic recruitment. we ought to make sure that we're looking for that talented person who has the ability to compete in america. we do that athletically. we need to have that same passion and commitment for

education. we need to have an education revolution and the real core here is to deal with precollegiate schooling because for too long minorities in urban areas are shortchanged. >> you improve the economic process before these applicants become applicants and therefore improve their resumes when they try to get into schools. i want to ask you this -- >> we need to go into grade schools and meddiddle schools because public schools are quitting on those kids. >> that's going to take a long time. in the meantime, you have black applicants who are suffering. i understand the argument on the other side is you have white applicants who aren't getting in and they should but for the color of their skin. here's what i want to ask you. if you win this case because you lost at the lower court -- >> i think we're going to win. >> if you win. viewers should know ninth circuit court of appeals, left leaning court of appeals in california, they actually found a similar law okay saying it's okay. a split in the circuits.

lower circuit in michigan said your law is bad. now this is going to go up to the u.s. supreme court. if you win and the supreme court reverses the lower court, this affects not only michigan but how many states? >> i'm very confident that we will win and the michigan constitution will be upheld. i think the other key thing is states are laboratories of democracy. we see different ways to have diversity. i'm optimistic we can have diversity across our country by constitutional means. >> how many states to my question? are we talking potentially 50 states if they all pass a law like the one michigan has? >> we see about nine states across the country, 28% of the population is having legislation or constitutional amendments that require equal treatment. we have a great opportunity to achieve diversity in america. we need to do it by constitutional means and not by any means necessary. >> it's going to be an

most private information. they come after reports surfaced about a woman in kansas whose job it is to help people enroll in obama care. turns out that woman also has an outstanding arrest warrant. that is raising questions about how these so-called navigators are screened and who is responsible if something goes wrong with your information. joining me co-host of "the five" kimberly guilfoyle joins me now. these navigators get their hands on private information as you try to enroll. >> it's a big problem. it should be a position of trust and position of credibility and one in which the individual has had a very serious background check to ensure that they haven't had issues in the past with the law with issues of crime, theft, anything like that where you can say they have questionable credibility. >> when you apply to work in a nursing home, they do a background check on you to make sure you're a person of honesty and integrity.

they're not doing the background checks on the people who are taking people's private application material to enroll in obama care. something that the government is mandating they do? >> this is the most personal, private information. it's really rife with potential for identity theft to have all of your information. social security, credit information, all that. medical history. imagine the most personal bits of information that maybe even your family members don't have or know about you. this individual of questionable character and credibility will have that. do you feel comfortable with that kind of decision and with an administration and government that put together this failure of obama care and has this kind of individual entrusting your information and your identity with them. >> fox news has not independently confirmed this but it's a report in the daily collar that this woman faced a 2007 civil charge from a local check cashing business for writing a bad check. it was more than $1,700 behind

on her state tax bill. if that was true, if she was convicted of charges for writing a bad check, i can't tell whether this is just a charge that was dropped or a charge she was convicted for, that would be something that would be admissible against you in a court of law. very problematic and telling. >> a crime of moral turpitude. the jury would hear all about it and say you can discount her testimony because this is someone you shouldn't believe because they have a loose relationship with the truth. they have criminal issues. they should not be trusted. that's why -- >> you are being told if you don't have health insurance, you'll have to pay a big fine. you're not getting your refund this year. we'll take your obama care fee, your tax out of your refund. you have to deal with these navigateo naviga navigators. >> where are protections provided to americans under penalty of a fine if they don't

we showed you our exclusive video top of the hour as vets and others descends on war memorials this weekend in washington closed by the federal government even marching to the gates of the white house. by late today the whole thing became the subject of an attack by some media outlets suggesting that some caught on tape controversy was really what the event was all about. >> you have to be embarrassed looking at that video. you don't think that was members of your party? aren't you a republican? those were tea party people --

with the confederate flag suggesting that these people have a problem with the black family in the white house. karen, want to start with you. why? why is that where they go to dismiss the enormity of this event by pointing to bad examples of behavior? >> the media seems to like to play this game of let's find the most controversial poster. instead of actually talking about what we should be focused on which is a real lack of leadership in the white house. the white house is who is playing games instead of governing. that's what the story should be about. >> mark, what do you make of it? >> megyn, your a professional journalist. i'm not. there's a balance you have to strike when you look at these events and protests and things like this. you want them as representative as possible but find the most news worthy things. the fact there's a confederate flag hanging outside of a protest that has american veterans is pretty grotesque and

pretty news worthy as is one of the organizers calling barack obama a church going christian a muslim calling for revolution. that may not be a representative example of what was happening there over the weekend but it certainly is news worthy. that's why media outlets are covering it. >> do they jump to cover that? there's a question that if you watch the coverage of this event on some of our competitors, you would think that's -- look at these vets in the wheelchair with american flags. this isn't what the beat roll was on the other channels. it is about larry and what he said about the koran which is news worthy but not indicative of what the event was about. i wonder if that speaks to an agenda to marginalize the protests that these vets were trying to bring. >> yes, it does. unfortunately we're not seeing fair coverage. i would agree that it's fair to cover the entire rally, we should be talking about it more fairly in terms of what the vets were really trying to do. i mean, this white house is

playing games. remember the sequester when they shut down the white house tours? they are trying to make this as painful as possible. that's the real story here. >> you know, mark, it speaks to me because you can always find examples of bad behavior and the suggestion that, okay, that one man standing up and saying that or that guy with the confederate flag that that is somehow indicative of the tea party. their detractors have been saying this about them since the beginning as these racists. these are well known people that have taken it from the left. progressives. clarence thomas dismissed saying she hopes he dies early like many black men. than you have marco rubio dismissed as a coconut by a commentator on another network and elaine chao suggesting jobs are going to china and then

there is stacy dash who is dismissed as an oreo and dumb bee by people online that didn't like her endorsement of mitt romney. does that speak anymore for the left anymore than they speak for the tea party or the right? >> i'll say that name calling is the basis -- it's not what the left does and it doesn't speak for the left. we're working in a political media environment where if every time one of your colleagues at fox called somebody on the left a bad name, you know, your friend sean hannity and friend bill o'reilly throw bad names and call names to my friends on the left all the time. it's offensive to some people. it's outrageous to some people. but that's a different point. what i'm asking about is the essence of this news event being ignored for a reason? because instead they like to seize on some controversy and try to turn this event into something it was not. >> i'll answer that.

is it a news event or an event that is orchestrated by a special interest group with a political agenda that had very low turnout and while i believe -- >> the guys in the wheelchair -- >> appeared outside of the white house in wheelchairs felt their opposition to the government and frustration toward the government, people who are following this know that the only reason the shutdown exist is because john boehner won't bring the continuing resolution to the floor vote. >> these guys here don't care about that. they care about getting into see the memorial built in their honor. don't tell me these guys. don't tell me this guy here and others showed up with a crazy agenda left wing or right wing, didn't they want to get to their memorials? >> these are world war ii veterans we're talking about. these are heroes. we should do things to help them and let them go see the memorial. the white house is just trying to make this as painful as possible and it's ridiculous. >> it wasn't the only example of

extremist commentary in response to this event. as we saw a columnist for "the washington post" kathleen parker who describes herself as right of center. she's not left of center according to her. about ted cru calls him ted bin laden. she says he's ted bin laden. the guy who hands out suicide vests and then goes to lunch. i mean, let me get you to weigh in on this first, karen, as somebody who describes herself as conservative and had a show on another network for a time. ted bin laden about a u.s. senator? >> kathleen parker is going too far on this. ted cruz has done a good job of bringing a story that's been overshadowed by the shutdown which is health care and what a debacle it is. we've had it on the books for over three years and the website doesn't even work. we spent hundreds of millions of dollars on it. the health care debacle is another huge story that we're just missing right now. >> ted cruz and sarah palin also

what our soldiers are now being taught. i couldn't just let this one pass." >> when we went to the pentagon to confront the leaders on this, we thought we had made some headway. and so i think it's pretty shocking to all of us to have this now happen in some sort of army training and we are actively pro actively on behalf of america's military trying to do something about this. >> they believe the military and law enforcement lists them as hate groups because the self-appointed hate group watchdog, the southern poverty law center lists them as hate groups. they say that it does not equate them with neo-nazis or the ku klux klan but does believe their anti-gay stance is hate. we contacted the pentagon. they said contact the army. the army so far has not

kelly's court is back in session. food stamp recipients rushing registers in louisiana after a computer glitch let's them shop like there is no limit. this is cell phone video from spring hill where shoppers emptied shelves and loaded up carts take advantage of the two-hour outage. one woman only had 49 cents on her card but collected $700 in groceries. so who is going to flip this bill? is it the american taxpayer? joining me now fox news legal analyst and a former prosecutor. who foots that bill? >> it's going to be consumers or xerox. xerox was the one who is manning all of these cards.

they're the one that had the contract with the u.s. government to make sure that that information was available to retailers. they had an outage. their backup generators blew up and they had a two-hour window and all consumers went in. it has nothing to do with walmart. >> you have to hand it to walmart employees. they notice that the cards were not showing limits. they call corporate. food stamp cards are not showing limits. what should we do? tell viewers what corporate said? >> corporate said ring them up any way. we don't want these poor people to starve because you're going to starve if you can't buy food for two hours. i guess they eat flat screens tv because that's what people were buying in that two-hour window. it's nuts. what food stamp card has enough on it that you can buy a flat screen tv? >> but if you look at those cards, most are eggs, milk, meat, that's what they were.

>> $700 worth of -- we've all gone grocery shopping. $700 adds up quickly in the supermarket. listen to the headlines. if these shoppers were told you can't buy anything on the cards, tomorrow, walmart would read -- press would read walmart refus s s to sell food to poor people. >> as it was walmart made the decision to let them go through. here's the question i have. now that it stands some people bought these goods. who has to pay? >> better not be me or you or mercedes. i think entity that is responsible is walmart. all they had to do was cut people off. that's all they had to do. >> corporate should have said no. don't honor the cards. >> you're going to blame the victim? >> walmart is the victim? they put money in their coffers because of this glitch.

>> listen. on friday i had judge judy on the show. the reason she's my idol is because she's big on personal responsibility. does anybody think there may have been something called theft going on by shoppers who knew they didn't have $1,000 worth of credit on the food stamp card? should they are charged? >> they should be prosecuted. walmart has that policy. if you steal -- this is not a shopping spree. this is a stealing spree by consumers. they knew they didn't have balances. they should be brought up. when you're brought up on criminal charges and we all know this, there's restitution. they get to pay back the walmart for what they stole. >> some of this video shows abandoned carts. they were abandoned once limits came back on cards and overhead voice said we've got your limits. we found your limits. the limits are back on the cards and people were, like, i'm out of here. i can't get this cart full of goods. everybody knows that. >> we can't prosecute them.
